sec.37 Proceedings generally

Proceedings for an offence against this Act are to be taken in a summary way under the Justices Act 1886 within 12 months after the offence is committed or within 6 months after the commission of the offence comes to the knowledge of the registrar, whichever period is later to expire, upon the complaint of the registrar or a person authorised for the purpose by the registrar. Without derogating from the provisions of section 139 of the Justices Act 1886 , a complaint for an offence against this Act may be heard at a place within the district appointed for the purposes of Magistrates Courts under the Justices Act 1886 in which the defendant resides. In proceedings referred to in this section the authority of the complainant to make the complaint is to be presumed unless the contrary is proved.
