The Bill advances several distinct programmatic concepts that alter information flows, procedural gateways, confidentiality regimes and reporting obligations.

Information sharing by the Aboriginal and Torres Strait Islander Children and Young People Commissioner (new s 34)

• The Commissioner may disclose information obtained in carrying out functions if the Commissioner is reasonably satisfied it is relevant to the recipient’s functions and, for personal information, the individual has given consent (s 34(1)(a)-(b)).
• A limited non‑consensual exception permits disclosure of personal information without consent where the Commissioner believes on reasonable grounds the disclosure is necessary for a coordinated approach to a matter affecting an Aboriginal or Torres Strait Islander child or young person, or to enable effective advocacy (s 34(2)(a)-(b)).
• Designated recipients are confined to a named set of information‑sharing entities: members of the Human Rights Commission, the Custodial Inspector, and the ACT National Preventive Mechanism (NPM) (s 34, definitions).
• The recipient is treated as bound by the secrecy requirements that applied to the Commissioner in relation to the information and is regarded as a person engaged in administration of the provision containing the secrecy requirement (s 34(3)).
• The section is expressed to apply despite any other territory law (s 34(4)).

Procedural leave requirements for ACAT (new ss 53BAA, 53IAA, 53SAA, 53ZBAA)

• Where the Human Rights Commission has closed a complaint under the reason in s 78(2)(c) and issued a referral statement (s 82 variants), a complainant or the Commission’s referral triggers the possibility of an ACAT hearing only with ACAT leave (each new section requires ACAT leave) (see s 53BAA(1)-(2) and parallel provisions in ss 53IAA, 53SAA, 53ZBAA).

Confidentiality and protection in inquiries (substituted s 17 and related changes)

• ‘Entrusted persons’ (members, staff of a board, lawyers assisting a board) who obtain or generate protected information may commit a criminal offence if they disclose, use or make a record of that protected information, subject to specified defences and exceptions (new s 17(1), (4)-(5), definitions in (6)).
• Penalty: maximum 50 penalty units, imprisonment for 1 year, or both (s 17(1)).
• Strict liability applies to whether a person is or has been an entrusted person (s 17(2)); the fault element for obtaining or generating the information is recklessness (s 17(3)). The note clarifies an evidential burden in relation to the matters mentioned in s (4).
• Inquiries boards are required to provide entities with at least 28 days to respond to proposed adverse comments, and the report will include copies or summaries of any submission the entity makes (substituted ss 26A(2)(b)-(c), (3) and new (6)).

Reporting timeframes and gift disclosures (amending s 216B(2))

• Financial representatives must file gift returns within 7 days of the total amount from a person reaching $1,000 and within 7 days of any additional gift (s 216B(2) as substituted). The example given in the Bill shows reporting on first gift by day 8, and on second gift by day 8 of following month.

Publication and recordkeeping for inquiry reports

• A board of inquiry report is treated as a public document for the Civil Law (Wrongs) Act 2002 s 138 only where the Chief Minister makes it public (s 38(3) as substituted).
• Boards (including staff and lawyers assisting) are agencies for the Territory Records Act 2002, carrying obligations under that Act (s 38A).

Vexatious litigant declarations

• The court may declare a person a vexatious litigant where it is satisfied the person has frequently instituted vexatious proceedings, and may make the declaration on its own initiative or on application by the Attorney‑General or an aggrieved person (s 67A(2)-(2A)).

Technical and administrative changes

• Cross‑reference corrections and a change to an Oaths Act Part heading are included (Unit Titles s 23(3) note amendment; Oaths Act Part 3 heading change).

Collectively, the Bill shifts decision rights and control points: it gives the Commissioner explicit conditional powers to release personal information to specific oversight bodies; it shifts gatekeeping authority to ACAT by requiring leave in serial complaint types where the Commission has closed a matter; it centralises publication control over inquiry reports with the Chief Minister; and it criminalises certain disclosures by persons working for inquiries with defined penalties and limited defences. Each mechanism changes incentives for information handling, procedural strategies, and record management inside public bodies and for private parties interacting with them.

The Bill touches a defined set of public office‑holders, statutory bodies, and private parties who interact with those bodies.

Aboriginal and Torres Strait Islander Children and Young People Commissioner, and information‑sharing recipients

• The Commissioner under the Aboriginal and Torres Strait Islander Children and Young People Commissioner Act 2022 gains a statutory power to disclose information to particular recipients where relevance and consent (or narrow exceptions) are satisfied (new s 34). This affects the Commissioner’s internal decision‑making and recordkeeping practices.
• The recipients identified as information sharing entities are (a) members of the Human Rights Commission, (b) the Custodial Inspector appointed under the Custodial Inspector Act 2017 s 9, and (c) the ACT National Preventive Mechanism (NPM) (new s 34, definitions). These bodies will receive information to which secrecy requirements now attach as if they had been engaged in the administration of the secrecy provision (s 34(3)).

Entrusted persons in inquiries

• Members of inquiry boards, board staff, and lawyers assisting a board are labelled ‘entrusted persons’ for the new protection offence in the Inquiries Act (new s 17(6)(a)-(c)). These individuals face a criminal offence for unauthorised disclosure, use or recording of ‘protected information’ (new s 17(1)) with a maximum penalty of 50 penalty units and/or up to 1 year imprisonment (new s 17(1)).
• Entrusted persons are subject to strict liability on the element of being an entrusted person (new s 17(2)). The obtaining/generating of information carries a recklessness fault element (new s 17(3)). The Bill also identifies authorised circumstances for disclosure (s 17(5)) that, if met, negate the offence.

Human Rights Commission and ACAT

• The Human Rights Commission’s existing complaint closure practice is affected: where the Commission closes a complaint for the specific reason in s 78(2)(c) and issues a referral statement, the complainant or a referral to ACAT can only have the matter heard by ACAT with ACAT leave (new ss 53BAA, 53IAA, 53SAA, 53ZBAA).
• Complainants seeking to escalate such matters will face an additional procedural hurdle to be decided by ACAT.

Financial representatives of entities (Electoral Act)

• The financial representative of an entity is required to monitor cumulative donations from a person, and to lodge returns within 7 days once the total reaches $1,000 and within 7 days for any subsequent gift from the same person (amending s 216B(2)). This directly affects the bookkeeping and compliance workload of the financial representative.

Boards of inquiry and the Chief Minister

• Boards must provide at least 28 days for entities to respond to proposed adverse comments (amended s 26A(3) and new (6)). Boards must also refrain from including submissions or any information that would disclose the fact that a notice was given if the proposed comment is not included (new s 26A(6)).
• Whether a board of inquiry report is a public document for the purposes of the Civil Law (Wrongs) Act 2002 s 138 depends on the Chief Minister making the report public (amended s 38(3)). This centralises a control point with the Chief Minister for publication status.

Custodial Inspector

• The Custodial Inspector is specifically added to the set of entities the Inspector may cooperate with, by naming the Aboriginal and Torres Strait Islander Children and Young People Commissioner in the cooperation list (s 6, new s 31(1)(g)).

Vexatious litigants

• Persons who frequently institute vexatious proceedings may be declared vexatious litigants by the Supreme Court; the court may act on its own initiative or on application by the Attorney‑General or an aggrieved person (amended s 67A(2)-(2A)).

General public and complainants

• Complainants whose complaints are closed under s 78(2)(c) and who receive referral statements will be affected by the new ACAT leave requirement and must apply for leave in order to have ACAT hear their matter (see new ss 53BAA(1)-(2) and parallels).

Entities submitting to inquiries

• Entities that receive notices of proposed adverse comment must prepare submissions within at least 28 days, and their submissions will be included in reports where the comment is included; if the board omits the proposed comment, the report must not include the submission or any indication a notice was given (new s 26A(6)).

This list is derived directly from the Bill text. The affected actors are narrowly specified in most provisions; the Bill creates differential obligations and decision points between named agents (Commissioner, ACAT, Chief Minister, financial representatives, boards, entrusted persons) and private individuals or entities interacting with them.

The Bill creates new statutory powers, duties, and procedural rights across multiple Acts. The key duties and rights are as follows, with citations to the Bill.

Information sharing by the Aboriginal and Torres Strait Islander Commissioner (new s 34)

• Duty/power to disclose: The Commissioner may disclose information to an information sharing entity where the Commissioner is reasonably satisfied the information is relevant to that entity’s functions (s 34(1)(a)).
• Consent obligation: If the information is personal information about an individual, the Commissioner must obtain the individual’s consent before disclosing (s 34(1)(b)), except where the limited non‑consensual grounds are met.
• Non‑consensual exception: The Commissioner may disclose personal information without consent if the Commissioner reasonably believes disclosure is necessary to ensure a coordinated approach to a matter affecting an Aboriginal or Torres Strait Islander child or young person, or for effective advocacy (s 34(2)(a)-(b)).
• Secrecy obligation flows to recipient: If an information sharing entity uses information disclosed under this section, a secrecy requirement is taken to apply to the entity in relation to that information; the entity is taken to be a person engaged in administration of the provision that contains the secrecy requirement (s 34(3)). The section operates despite any other territory law (s 34(4)).

Cooperation duty for the Custodial Inspector (new s 31(1)(g))

• The Custodial Inspector must have the capacity to cooperate with the Commissioner named in the Aboriginal and Torres Strait Islander Children and Young People Commissioner Act 2022, section 10 (s 6, inserting new s 31(1)(g)).

Gift disclosure timing for entities (amended s 216B(2))

• Duty on the financial representative of an entity to give the commissioner a return containing the information in s 216A(2):
  • Not later than 7 days after the total amount received from a person reaches $1,000 (s 216B(2)(a) as substituted).
  • Not later than 7 days after the entity receives any additional gift from that person (s 216B(2)(b) as substituted).
• The example in the Bill illustrates a requirement to report each qualifying threshold and each subsequent gift (Bill example).

ACAT leave requirement for certain complaints (new ss 53BAA, 53IAA, 53SAA, 53ZBAA)

• Where the Commission has closed a complaint under the reason stated in s 78(2)(c) and provided a relevant referral statement (s 82 and variants), a complainant who either is referred to ACAT or applies to ACAT can have the complaint heard by ACAT only with the leave of ACAT (each new section states “The complaint may be heard by the ACAT only with the leave of the ACAT.”).
• This creates a procedural right in ACAT (discretionary) to determine whether the matter proceeds.

Protection and offence for inquiry personnel (new s 17)

• It is an offence for an entrusted person to disclose, use, or make a record of protected information obtained or generated in their capacity as an entrusted person (new s 17(1)).
• Maximum penalty: 50 penalty units, imprisonment for 1 year, or both (new s 17(1)).
• Strict liability applies to the fact of being an entrusted person (new s 17(2)); recklessness is the fault element for obtaining/generating the information (new s 17(3)).
• Defences/authorised disclosures: An entrusted person may disclose/use/make a record of protected information in exercising or assisting another to exercise a function under the Inquiries Act, if the information is already public, or in circumstances prescribed by regulation (new s 17(5)).

Procedural protections around proposed adverse comments (amended s 26A)

• Boards must inform entities of proposed adverse comments, state the period for submissions (at least 28 days) and notify that if the report includes the comment the report will include a copy or summary of any submission (amended s 26A(2)(b)-(c), (3)).
• If a proposed comment is not included in the report, the report must not include the related submission or any information that would disclose that a notice was given (new s 26A(6)).

Publication control and recordkeeping obligations (amended s 38(3), new s 38A)

• A board of inquiry report is a public document for Civil Law (Wrongs) Act 2002 s 138 only if it is made public by the Chief Minister (s 38(3) as substituted).
• For the Territory Records Act 2002, a board of inquiry is treated as including its staff and lawyers assisting, boards are agencies and therefore must comply with records management and protection obligations under that Act (s 38A).

Vexatious litigant declaration power (amended s 67A)

• The Supreme Court may declare a person a vexatious litigant if satisfied the person has frequently instituted vexatious proceedings and may do so on its own initiative or on application by the Attorney‑General or an aggrieved person (amended s 67A(2)-(2A)).

These duties and rights establish who may decide to act (Commissioner, Chief Minister, ACAT, Supreme Court), when a third party must hold information confidentially, and timelines for procedural steps. They also create criminal exposure for persons assisting inquiries and new administrative reporting timings.

The Bill introduces discrete enforcement provisions and clarifies the criminal law application to conduct under the Inquiries Act, in addition to procedural enforcement points in other provisions.

Criminalisation under the Inquiries Act (new s 17)

• The principal new penalty is in the substituted s 17 (Protection of information). An entrusted person (member, staff of a board, or lawyer assisting) commits an offence if the person, having obtained or generated protected information in their capacity as an entrusted person, discloses, uses, or makes a record of that information (new s 17(1)). Maximum penalty is 50 penalty units, imprisonment for 1 year, or both.
• The Bill makes strict liability apply to the status element of being an entrusted person (new s 17(2)), which means an accused cannot rely on lack of knowledge of their entrusted status as a fault defence for that element.
• The fault element for obtaining or generating the information is recklessness (new s 17(3)). The Bill’s note references Criminal Code s 58 as imposing an evidential burden in relation to matters mentioned in s (4), meaning the defendant bears an evidential burden to show an exception under s 17(4) applies (Bill note).
• Defences/authorised disclosures are set out: disclosure/use/making a record is permitted if made in exercising or assisting another to exercise a function under the Act, if the information is already public, or in a circumstance prescribed by regulation (new s 17(5)). These operate as statutory exceptions that prevent criminal liability when met.

Application of the Criminal Code to the Inquiries Act (s 16)

• Section 4 note is amended to replace the previous specific reference to “an offence against this Act, s 365” with “all offences against this Act” (s 16), indicating that the Criminal Code and related procedural machinery apply to offences under the Inquiries Act generally.

Enforcement through ACAT leave (new ss 53BAA, 53IAA, 53SAA, 53ZBAA)

• The new ACAT provisions do not create penalties but create a procedural gate: ACAT’s discretion to grant leave is an enforcement mechanism that limits automatic access to ACAT for certain complaints closed by the Commission. The ACAT determines whether a complaint can be heard, practical effect is control over caseload and a filter on complaints escalated after Commission closure.

Electoral Act reporting (amended s 216B(2))

• The Electoral Act amendment imposes a mandatory reporting timetable (returns within 7 days after total amount from a person reaches $1,000 and within 7 days of any additional gift). The Bill text does not specify a penalty in s 216B(2) itself; enforcement consequences for non‑compliance remain governed by the Electoral Act framework and are not changed in the text of this Bill. Practically, the financial representative’s obligation is time‑sensitive and subject to whatever enforcement mechanisms exist under the Electoral Act.

Publication status and liability under Civil Law (Wrongs) Act 2002 (amended s 38(3))

• The Bill narrows when a board of inquiry report benefits from the publication defence under Civil Law (Wrongs) Act 2002 s 138: only reports made public by the Chief Minister are public documents for the purpose of that defence (s 38(3) as substituted). This ties the availability of a publication defence to an executive decision by the Chief Minister.

Vexatious litigant declarations (amended s 67A)

• The Supreme Court’s ability to declare vexatious litigants is a judicial enforcement tool; the Bill expands the court’s capacity to act on its own motion and identifies applicants who may seek a declaration (Attorney‑General or an aggrieved person) (s 67A(2A)).

Other enforcement implications and recordkeeping

• Boards of inquiry are agencies for the Territory Records Act 2002 (new s 38A). That Act imposes obligations on agencies relating to records management and protection; non‑compliance has regulatory consequences under the Territory Records regime (new s 38A; the note in the Bill references divs 2.3 and 2.4 of the Territory Records Act 2002). The Bill itself does not amend the enforcement apparatus of the Territory Records Act but stimulates its application to boards and associated staff/lawyers.

Overall enforcement is concentrated in: (1) criminal sanctions for unauthorised handling of protected inquiry information by entrusted persons; (2) procedural gatekeeping by ACAT for certain complaints; (3) time‑critical reporting duties on financial representatives under the Electoral Act; and (4) executive control over whether inquiry reports are treated as public documents with associated publication defences. The Bill sets out the offences and processes, but for several areas it relies on existing enforcement frameworks in the referenced Acts.

The Bill explicitly cross‑references and changes the operation of several other Territory statutes. These interactions reallocate responsibilities, change applicability of protections, and tie decision rights across Acts.

Overrides and cross‑Act effect: Aboriginal Commissioner information sharing (new s 34)

• The new s 34 states it applies despite any other territory law (s 34(4)). That is an express cross‑Act override: the Commissioner’s power to disclose under the conditions in s 34 takes precedence over conflicting Territory laws. The subsection also creates a mechanism whereby secrecy requirements that applied to the Commissioner are taken to apply to the receiving information sharing entity, and the entity is taken to be engaged in administration of the provision containing the secrecy requirement (s 34(3)). This interacts with secrecy or confidentiality regimes in other Acts by creating a pathway that both permits disclosure and imposes the secrecy regime upon recipients.

Interaction with the Human Rights Commission Act 2005 and ACAT jurisdiction

• The new ACAT leave provisions are grafted into the Human Rights Commission Act 2005, building on existing referral and closure mechanics in ss 78 and 82 (as referenced in each new section). The practical effect is a procedural choke point: where the Commission closes a complaint under s 78(2)(c) and issues a referral, the ACAT may only hear the complaint with leave (new ss 53BAA, 53IAA, 53SAA, 53ZBAA). This interacts with the Commission’s existing powers to close and refer, and with ACAT’s own practice and jurisdictional thresholds.

Inquiries Act and the Criminal Code

• By substituting s 4’s note and making “all offences against this Act” subject to the Criminal Code (s 16), the Bill binds the Inquiries Act offences into the broader Criminal Code machinery. The substituted s 17 creates a specific criminal offence with penalties; the Bill’s note references the Criminal Code evidential‑burden principle (Criminal Code s 58) in relation to s 17(4). Therefore, operation of the Criminal Code evidential and legal burden rules will apply in prosecutions under the Inquiries Act.

Civil Law (Wrongs) Act 2002 s 138 publication defence

• The Bill narrows when a board of inquiry report is a “public document” for the purposes of s 138 of the Civil Law (Wrongs) Act 2002 (substituted s 38(3)). The substituted text requires that the report be made public by the Chief Minister for the defence to apply. This links an executive decision (Chief Minister publishing) to the availability of a civil law defence against defamation or related claims in the Civil Law (Wrongs) Act.

Territory Records Act 2002

• New s 38A explicitly treats a board of inquiry, including staff and lawyers assisting, as an agency for the Territory Records Act 2002, triggering records‑management obligations and protections in that Act (s 38A and its note referencing divs 2.3 and 2.4). Records handling and preservation duties under the Territory Records Act thus extend to boards and their personnel.

Electoral Act 1992

• The timing amendment to s 216B(2) integrates with the disclosure regime set out in the Electoral Act, requiring shorter reporting windows and cumulative monitoring of gifts. The Bill inserts the 7‑day requirements but leaves other enforcement measures in the Electoral Act intact.

Supreme Court Act 1933

• The vexatious litigant amendments adjust the Court’s internal threshold and its standing to act. Those changes interact with the Court’s own procedures, and with any existing statutory controls on litigant behaviour, but the Bill itself does not alter procedural sanctions beyond declaration power.

Unit Titles (Management) Act 2011 and Oaths and Affirmations Act 1984

• Changes are technical: a cross‑reference amendment in the Unit Titles Act (s 26) and a Part heading change in the Oaths Act (s 24), aligning statutory language but not altering substantive operation.

Taken together, the Bill threads new operational dependencies between Acts: authorising certain cross‑agency disclosures while binding recipients to secrecy; centralising publication power with the Chief Minister to determine whether inquiry reports benefit from a statutory publication defence; and tying offences under the Inquiries Act into the Criminal Code framework. Where the Bill leaves enforcement or detailed procedure to the existing frameworks in other statutes, those frameworks will determine final operational outcomes.

The Bill document contains limited amendment history information and notes. The text itself is presented as the Justice and Community Safety Legislation Amendment Bill 2026 (J2025‑1587). Relevant amendment history items included in the Bill text:

• Presentation speech reference: The Bill lists a presentation speech made in the Legislative Assembly on 7 May 2026 (Endnote 1).
• Notification: The Bill indicates notification under the Legislation Act occurred in 2026 (Endnote 2), and the Act is to commence on the 7th day after its notification day (s 2). No specific notification date is supplied within the Bill text beyond the endnote placeholder.
• The Bill’s s 3 lists the legislation it amends: Aboriginal and Torres Strait Islander Children and Young People Commissioner Act 2022; Custodial Inspector Act 2017; Electoral Act 1992; Human Rights Commission Act 2005; Inquiries Act 1991; Oaths and Affirmations Act 1984; Supreme Court Act 1933; and Unit Titles (Management) Act 2011.
• Repeal: The Bill expressly repeals the Crimes (Child Sex Offenders) Amendment Act 2025 (A2025‑4) (s 4). The Bill text does not elaborate the effect of that repeal beyond the single line that the earlier Act “is repealed” (s 4).
• The Bill text includes endnotes referencing where to find the latest republication of amended laws: www.legislation.act.gov.au (Endnote 3).
• The Bill effecting changes to specific sections is recorded in paragraph form under each Part heading, showing the existing section being substituted or the new section text inserted. For example, Part 2 replaces s 34 of the Aboriginal and Torres Strait Islander Children and Young People Commissioner Act 2022 with new text (s 5); Part 6 substitutes s 17 of the Inquiries Act 1991 (s 18).
• The Bill includes a number of consequential notes and examples to illustrate operation (for example, the Electoral example demonstrating successive returns, and the note in substituted s 17 referencing the Criminal Code’s evidential burden principle).

No prior versions of this Bill, nor prior amendment trajectories for the named Acts beyond what is contained in the Bill, are set out in the document. The Bill is presented as an instrument of amendments; it does not append a formal legislative history beyond the presentation speech and notification endnotes. Practitioners relying on the current statutory position after the Bill commences should consult the republications at the Territory legislation website for consolidated texts, as the Bill itself notes (Endnote 3).

The Bill text does not record any litigation history. It is a presented Bill (J2025‑1587) and includes only legislative drafting, commencement timing, and endnotes about presentation and notification. No judicial decisions, appeals, or statutory interpretation cases are included in the Bill or its endnotes.

That absence in the Bill text implies there is no litigation history embedded in the source document to cite. However, the statutory changes it proposes create legal interfaces where disputes and litigation are possible once the provisions commence. The Bill itself highlights areas where judicial or tribunal decision‑making will play a role:

• ACAT’s discretion to grant leave under the new ss 53BAA, 53IAA, 53SAA and 53ZBAA places ACAT as the arbiter of whether a complaint closed by the Commission on the reason in s 78(2)(c) proceeds to hearing. Litigation or judicial review may follow from an ACAT leave decision on procedural or jurisdictional grounds, although such possibilities are not recorded in the Bill text.
• The substituted s 17 in the Inquiries Act creates a criminal offence with strict liability for certain elements (new s 17(2)) and recklessness for others (new s 17(3)). Enforcement of that offence may give rise to criminal prosecutions and consequent challenges on issues such as the meaning and scope of “protected information”, whether a person qualifies as an “entrusted person”, and the operation of the statutory defences in s 17(5). The Bill’s note references the Criminal Code’s evidential burden principle, which is a procedural point that will shape criminal prosecutions under the new provision.
• The narrowed application of the Civil Law (Wrongs) Act 2002 s 138 defence via substituted s 38(3) makes the availability of a publication defence contingent on an executive act by the Chief Minister. Disputes could arise over whether a document does or does not enjoy the s 138 defence depending on whether the Chief Minister has been deemed to make the report public.
• The information sharing model in new s 34 gives the Aboriginal and Torres Strait Islander Commissioner power to disclose personal information without consent in particular circumstances. Litigation could arise on the scope of the non‑consensual exception, how the “reasonably satisfied” and “reasonable grounds” standards are applied, and whether the provision’s operation “despite any other territory law” interacts with other statutory privacy or secrecy schemes.

This Bill, as presented, does not include reported litigation because it is the source instrument rather than a history of cases. Practitioners should anticipate that the new criminal, administrative and procedural provisions, especially those with tightly framed operational tests (for example, “reasonably satisfied”, “reasonable grounds”, “recklessness”, and leave thresholds),may generate litigation about statutory interpretation and the proper exercise of discretion once put into practice.

The Bill introduces several practical traps and consequential effects that administrators and private parties should note. Each “gotcha” is grounded in the Bill text.

7‑day electoral gift reporting is cumulative and repetitive (amended s 216B(2))

• The financial representative must track cumulative amounts from each donor and lodge a return within 7 days after the total reaches $1,000 (s 216B(2)(a)). The representative must also lodge another return within 7 days after any additional gift (s 216B(2)(b)). The Bill’s example shows that a $1,000 gift followed by $100 requires two returns within 7 days of each receipt.
• Gotcha: bookkeeping must capture cumulative totals per donor and trigger immediate reporting events; failure to do so risks breaching the Electoral Act reporting obligations. The Bill does not alter the content of returns; it alters the timing and frequency.

Confidentiality obligations transfer to recipients under the Commissioner’s information sharing (new s 34(3)-(4))

• When the Aboriginal and Torres Strait Islander Commissioner discloses information to an information sharing entity, the recipient is taken to be subject to the secrecy requirement in relation to that information and to be “engaged in the administration” of the secrecy provision (s 34(3)).
• Gotcha: recipients must treat the disclosed information as subject to whatever secrecy requirement applied to the Commissioner at the time of disclosure. The subsection also operates despite any other territory law (s 34(4)), which could have surprising effects where recipients believe other statutes authorise wider use or disclosure.

Narrow non‑consensual exception and evidential expectations (new s 34(2))

• The Commissioner may disclose personal information without consent only where reasonably satisfied that disclosure is necessary for coordinated approaches or effective advocacy (s 34(2)). “Reasonably satisfied” and “necessary” are legal thresholds. Gotcha: reliance on the non‑consensual exception requires records and a documented reasoning trail; absence of such evidence may expose the Commissioner or recipient to challenge.

Criminal exposure for inquiry participants, strict liability and recklessness (substituted s 17)

• Entrusted persons face an offence for disclosure/use/recording of protected information (s 17(1)) with a maximum penalty that includes imprisonment. Strict liability for being an entrusted person (s 17(2)) means an individual cannot avoid liability by asserting lack of awareness of their status. Recklessness is the fault element for obtaining/generating information (s 17(3)).
• Gotcha: lawyers assisting boards are explicitly included among entrusted persons (s 17(6)(c)), meaning legal advisers must be alert to the new offence. The Bill’s note references the Criminal Code evidential burden rule for s 17(4); therefore, defendants may carry an evidential burden regarding authorised disclosure defences.

28‑day minimum for response to proposed adverse comments and inclusion of submissions (amended s 26A)

• Boards must give at least 28 days (increased from 14) for entities to make submissions in relation to proposed adverse comments (amended s 26A(3)). The report will include a copy or summary of any submission if the comment is included (amended s 26A(2)(c)).
• Gotcha: entities making submissions should be aware their submissions will be published as part of the report if the comment is included. Conversely, new s 26A(6) prevents the report including a submission if the proposed comment is not included, but boards must ensure they do not inadvertently include material that discloses that a notice was given.

Publication defence is linked to Chief Minister’s action (amended s 38(3))

• A board of inquiry report is a public document for the defence in Civil Law (Wrongs) Act 2002 s 138 only if the Chief Minister makes the report public (s 38(3) substitution).
• Gotcha: publication by other means may not attract the s 138 defence unless the Chief Minister has acted. Entities relying on a publication defence should confirm whether the Chief Minister has made the report public before relying on s 138 protections.

ACAT leave requirement limits direct access where Commission closes a complaint (new ss 53BAA et seq.)

• Where the Commission closes a complaint under s 78(2)(c) and issues a referral statement, the complainant can only have the matter heard by ACAT with ACAT leave (new ss 53BAA, 53IAA, 53SAA, 53ZBAA).
• Gotcha: individuals who receive a referral statement from the Commission cannot assume an automatic right to have the complaint heard; they must apply for leave and satisfy ACAT’s leave test.

Broad “despite any other territory law” formulation (new s 34(4))

• The express override clause in new s 34(4) can have broader effects than may be immediately apparent. Gotcha: where other Territory statutes impose different disclosure or secrecy regimes, the Commissioner’s new power and its overlay of secrecy onto recipients could create conflicts or require careful cross‑statutory analysis before disclosure.

Boards and records obligations under Territory Records Act (new s 38A)

• Boards of inquiry are agencies under the Territory Records Act 2002 including staff and lawyers assisting (s 38A). Gotcha: records management obligations apply from the start; boards and assisting lawyers need to comply with retention and protection obligations, which can affect evidentiary disclosure, privileged materials, and legal workflows.

These are immediate operational pitfalls contained in the Bill text; practitioners should map processes to avoid inadvertent breaches, ensure documented decision‑making for discretionary exceptions, and update compliance and recordkeeping systems accordingly.

The Bill creates concrete procedural steps and recordkeeping duties. Below are practical, source‑anchored compliance actions aligned to the new provisions.

Aboriginal and Torres Strait Islander Commissioner , information sharing (new s 34)

• Record decisions: For each disclosure under new s 34, document the Commissioner’s reasoning demonstrating that the information is relevant to the recipient’s functions (s 34(1)(a)) and, where relying on a non‑consensual exception, the reasonable grounds justifying necessity for a coordinated approach or effective advocacy (s 34(2)). The statutory tests are expressed as “reasonably satisfied” and “believes on reasonable grounds”, so contemporaneous written evidence of the assessment is prudent.
• Consent capture: For personal information, obtain and retain evidence of the individual’s consent where consent is relied on (s 34(1)(b)). Use standard consent forms that record scope, recipients, and purpose.
• Apply secrecy treatment to recipients: When disclosing, notify the recipient that a secrecy requirement attaches and that the recipient is taken to be engaged in administration of the secrecy provision (s 34(3)). Ensure the recipient has processes to limit access consistent with the secrecy requirement.
• Cross‑statutory checks: Because s 34(4) operates “despite any other territory law”, ensure legal advice is taken on potential interactions with other statutes before making disclosures.

Custodial Inspector cooperation (new s 31(1)(g))

• Establish memoranda of understanding or protocols between the Commissioner and the Custodial Inspector to operationalise cooperation, particularly for information handling and secrecy obligations as set out in new s 34.

Electoral Act gift reporting (amended s 216B(2))

• Implement donor‑level tracking: Financial representatives must track cumulative donations per donor to identify the trigger point when totals reach $1,000 and to generate a return within 7 days (s 216B(2)(a)).
• Create process for subsequent gifts: For any additional gift from the same donor, lodge an additional return within 7 days of receipt (s 216B(2)(b)).
• Maintain audit trail: Keep records of receipt dates, donor identity, cumulative totals, and filed returns to evidence compliance.

Human Rights Commission and ACAT leave requirements (new ss 53BAA, 53IAA, 53SAA, 53ZBAA)

• If a complainant receives a referral statement after the Commission’s closure under s 78(2)(c), counsel should prepare an ACAT leave application in accordance with ACAT practice directions. The Bill places the decision with ACAT; therefore provide material addressing jurisdictional and leave criteria likely pertinent to ACAT (the Bill does not set out ACAT’s leave test; comply with ACAT rules and directions).
• Maintain records of the Commission’s closure reasons and referral statements, as these are prerequisites under the new sections.

Inquiries Act , entrusted persons and protected information (new s 17)

• Identify entrusted persons: Boards should maintain clear lists of members, staff and lawyers assisting to demarcate who is an entrusted person (s 17(6)).
• Training and protocols: Provide mandatory training and written protocols for entrusted persons on what constitutes “protected information”, permitted disclosures under s 17(5), and penalties under s 17(1). Ensure lawyers assisting are included in training.
• Use statutory exceptions properly: Document instances where disclosure under s 17(5)(a) (in exercising or assisting exercise of a function), s 17(5)(b) (information already public), or s 17(5)(c) (regulation) is relied upon. The Bill’s note indicates the evidential burden for s 17(4) defences, so maintain records that will evidence the applicability of exceptions.

Boards , proposed adverse comments and report content (amended s 26A)

• Allow at least 28 days for submissions on proposed adverse comments (amended s 26A(3)). Clock compliance mechanisms to prevent shorter notices.
• Inform entities clearly that, if a proposed comment is included in the report, the report will include a copy or summary of any submission the entity makes (amended s 26A(2)(c)). Seek informed consent from entities about the disclosure of submissions as part of report publication.
• If the board decides not to include a proposed comment, do not include the submission or any information that would disclose that a notice was given (new s 26A(6)). Ensure redaction checks and report‑production workflows are in place.

Publication controls and records management (amended s 38(3), new s 38A)

• Coordinate with the Chief Minister’s office: Because s 38(3) ties the availability of a s 138 publication defence to the Chief Minister making the report public, boards should liaise with the Chief Minister’s office on publication decisions and timing.
• Implement Territory Records Act obligations: Treat the board and its staff/lawyers as an agency under the Territory Records Act 2002 (new s 38A). Apply records management, retention and security standards from inception.

Supreme Court vexatious litigant process (amended s 67A)

• Parties or counsel considering an application for a vexatious litigant declaration should be aware the Court may act sua sponte or accept applications from the Attorney‑General or an aggrieved person (s 67A(2A)). Evidence of frequency of proceedings and their vexatious nature should be compiled to support an application.

General administrative steps

• Update policies, manuals and information sheets to reflect the new timeframes, secrecy obligations, and procedural gateways.
• Ensure legal advice is sought when using statutory exceptions or when the Bill’s provisions intersect with other statutory duties or professional obligations (for example, legal professional privilege vs obligations under new s 17).
• Retain contemporaneous documentation for decisions involving subjective statutory standards in the Bill (for example, “reasonably satisfied”, “reasonable grounds”, and any ACAT leave application materials).

Following the commencement date (7 days after notification, s 2), organisations and individuals named or affected by these provisions should review and operationalise the above steps to reduce compliance risk and to document the lawful exercise of discretion under the new provisions.
