Juries Regulations 2008

The regulations build on four conceptual pillars derived from the Act: the jury pool, the jury panel, civil jury payments, and the infringement notice regime.

Jury pool. The concept of a jury pool (Part 2A, inserted in 2011) replaced the older system of direct empanelment. The pool is a cohort of summoned citizens from which jurors are allocated to multiple courts via a pool precept (Form 2). The pool precept is issued by a judge or a person appointed by a judge (section 32G(1)) and specifies the number of jurors required, the date and time, and the place of attendance. The pool supervisor (likely a court officer) then conducts a ballot under section 32H(1) to select the required number. The timing requirement in regulation 3D ensures that the ballot happens early enough to give those selected time to attend. A juror who fails to obey the summons must be reported to the sheriff “as soon as practicable” (regulation 3C). The summons itself (Form 1) is to the Jury Assembly Room at a specified date and time, and the juror must attend “from day to day until you shall be discharged.” That open-ended obligation is a significant imposition on personal scheduling.

Fees and allowances. The regulations distinguish between a flat “fee for doing jury service” (regulation 4(1)) and a separate “lost income” payment (regulation 4(2)). The flat fee is a token amount. The lost income payment is optional, capped at $1,000 per day without hardship showing, and requires a formal application within three months of the last day of service (extendable to one year in exceptional circumstances). The application must be in a form approved by the summoning officer and accompanied by required information. This creates an administrative hurdle for jurors who may be unfamiliar with the process. Travel expenses are reimbursed either at actual public transport cost or at 45 cents per kilometre for road travel where public transport is unavailable.

Employer reimbursement. The regulations create a mechanism for prescribed employers (government departments, state instrumentalities, and state trading concerns - regulation 6) to apply to receive the juror’s fee rather than the juror. The employer must apply by statutory declaration (regulation 8(2)), providing the juror’s details, the hourly rate, and the hours of lost service. The officer then pays the employer. This provision recognises that government employers often continue paying wages during jury service; the fee then offsets that cost. For private-sector employers, the juror retains the fee (unless the employer has a contractual arrangement). The separate regulation 7 requires non-government employees to disclose employer details within 14 days, but that information is not used for direct employer reimbursement under regulation 8 - only prescribed-class employers can apply. The purpose appears to be informational or for potential future policy use.

Infringement notices. Part 4 creates an alternative enforcement pathway for two specific offences. The “modified penalty” of $800 is lower than the court maximum. The scheme is governed by the Criminal Procedure Act 2004 Part 2. The Sheriff designates authorised officers who can issue notice Form 3. The notice warns the alleged offender of the consequences under the Fines, Penalties and Infringement Notices Enforcement Act 1994, including driver’s licence suspension, vehicle immobilisation, and garnishee orders. The scheme allows the person to dispute the allegation by not paying and writing to Jury Services; the matter then goes to court where the maximum penalty is $5,000. Form 4 is for withdrawal of the infringement notice if the approving officer decides not to proceed.

The regulations affect a broad class of persons and organisations, each with distinct compliance obligations.

Jurors. Every person summoned under the Act who lives or works in Western Australia and meets the statutory qualifications is directly affected. The regulations dictate how much they will be paid (a few dollars per day unless they apply for lost income), how they claim travel expenses (receipts for public transport or 45 cents per km if no public transport), and what information they must provide about their employer (within 14 days after service, under penalty of $1,000). They also face the prospect of an infringement notice with an $800 modified penalty if they fail to attend. The low flat fees create a disincentive for time-poor professionals and high-income earners, who may face a net loss even with the lost-income application given the $1,000 daily cap and the three-month application window. For self-employed persons, the fee is unlikely to compensate for lost business.

Employers of jurors. Two categories emerge. First, employers in the prescribed class (government departments, state instrumentalities, state trading concerns - regulation 6) can apply under regulation 8 to receive the juror’s fee. They must provide a statutory declaration with ABN, earnings paid, juror name, occupation, hourly rate, and hours lost. This imposes an administrative cost on those employers, but it allows them to recover some of the wage cost during the juror’s absence. Second, private-sector employers are not eligible for this reimbursement. Their employees keep the small fee (unless the employer applies directly to the juror via contract). Private employers bear the full cost of the employee’s absence without any state subsidy, which is a hidden cost of the jury system.

The Sheriff of Western Australia. The Sheriff is the key administrator under these regulations. The Sheriff receives reports of failures to obey summonses (regulation 3C), appoints authorised and approved officers for infringement notices (regulation 9(3)), issues certificates or identity cards to those officers (regulation 9(4)), and is the party to whom infringement notice payments are directed (Form 3). The Sheriff’s Office also handles the employer reimbursement applications. The expanded role under the 2011 amendments (jury pools and infringement notices) increased the Sheriff’s administrative burden and discretion.

Summoning officers. Individual summoning officers (often court staff) determine lost income applications. They have discretion to accept or reject applications, to extend the application deadline in exceptional circumstances, and to determine whether hardship justifies a payment above $1,000. That discretion is not heavily constrained by the regulations, which means outcomes may vary across different officers. The officer must approve the form of application and the information required (regulation 4(4)(a) and (b)), giving them significant power over what evidence a juror must produce.

Parties in civil trials. The party that requested a jury must pay into court $1,195 per day for a 12-person jury or $230 per day for a 6-person jury, plus $230 per day for the pool (regulation 3). These amounts are substantial and will influence decisions about whether to elect a jury. For a five-day trial, the cost would be $5,975 for a 12-person jury plus $1,150 for the pool, totaling $7,125 - a non-trivial cost that operates as a tax on the right to jury trial in civil matters.

Courts and the judiciary. Judges or persons appointed by judges issue pool precepts (Form 2). The regulations do not specify who may be appointed; that is left to the Act. Courts must manage the timing of jury selection to comply with regulation 3D. The infringement notice scheme relieves courts of some minor prosecutions, but the overall system imposes scheduling demands.

Enforcement agencies. The Fines, Penalties and Infringement Notices Enforcement Act 1994 regime is triggered when infringement notice penalties are not paid. That Act’s powers (driver’s licence suspension, property seizure) are referenced in Form 3. The regulations do not alter that Act but integrate with it.

Duty to obey a summons or direction. The foundational duty is to obey a summons served under the Act. Failure without reasonable excuse is an offence under section 55(1). Regulation 3C requires the pool supervisor to report any failure to the sheriff. The infringement notice pathway (Schedule 2) applies an $800 modified penalty. The duty also extends to obeying a direction given under section 32H(4) (direction to attend a particular court after selection). These duties are absolute except for the “reasonable excuse” defence. The regulations do not define what constitutes a reasonable excuse; that is left to judicial interpretation.

Right to fees and allowances. A juror has a right to the prescribed fee (regulation 4(1)): $10 for a half-day, $15 per day for the first three days, $20 per day thereafter. However, this right is qualified by the possibility that the fee may be paid to the employer instead under regulation 8 (for prescribed-class employers). The juror also has a right to apply for a higher fee based on lost income, but this is not automatic - it requires a proactive application within three months, with information as required by the summoning officer, and the cap is $1,000 per day unless hardship is shown. The right to travel expense reimbursement is similarly proactive: the juror must pay the fare and then claim reimbursement, or provide evidence that public transport was unavailable to claim the per-kilometre allowance. There is no provision for advance payment of travel costs, which may deter low-income jurors from attending.

Duty to provide employer information. A juror who is employed by a non-prescribed-class employer (i.e., most private sector employers) must give the summoning officer written advice of the employer’s name and business address within 14 days after completing jury service (regulation 7). This is a strict obligation: no reasonable excuse is mentioned; the penalty is a $1,000 fine. The regulation does not specify why this information is needed. It might be for statistical purposes, or to enable future employer reimbursement if the law changes. But the obligation is real and carries a penalty. The 14-day window is tight; a juror who forgets or loses the contact details could be penalised.

Right of prescribed employer to reimbursement. An employer in the prescribed class (government departments, state instrumentalities, state trading concerns) has a right to apply for the juror’s fee under regulation 8(1). The summoning officer “is to pay” - mandatory language - once the application is made with a statutory declaration and the required information. The employer must provide the ABN, earnings paid, juror name, juror occupation, hourly rate, and number of hours lost. This is a straightforward reimbursement mechanism. But note: the amount paid is the fee that would have gone to the juror, which is very small (e.g., $15 per day). For a government department, the administrative cost of preparing a statutory declaration and submitting the application likely exceeds the fee recovered. So the right may be more theoretical than exercised.

Right to dispute an infringement notice. A person who receives an infringement notice (Form 3) may choose not to pay and instead have the matter heard in court. The notice states that the maximum court penalty is $5,000, which is a significant risk. The person must write to Jury Services before the due date to indicate they wish the matter to go to court. The regulations do not prescribe any additional disputes mechanism; it is the standard Criminal Procedure Act 2004 Part 2 pathway.

Right to apply for extension of time for lost-income claim. Under regulation 4(5), the summoning officer may extend the three-month application period by up to one year if satisfied that exceptional circumstances exist. The regulation does not define “exceptional circumstances.” This creates discretion and potential inconsistency. A juror who misses the deadline may still apply if they can persuade the officer.

The regulations create a two-tier enforcement system for jury service offences, plus a separate penalty for failing to provide employer information.

Infringement notice regime. The primary enforcement tool for two specific offences is the infringement notice. Schedule 2 prescribes two offences: failure to obey a summons (section 55(1)) and failure to obey a direction under section 32H(4). The modified penalty is $800 for each. This is a fixed penalty; no reduction for early payment is provided. The notice is in Form 3, which includes payment options, dispute information, and warnings about consequences of non-payment under the Fines, Penalties and Infringement Notices Enforcement Act 1994. The Sheriff appoints authorised officers to issue these notices. The officer must hold a certificate, badge, or identity card (regulation 9(4)). The scheme is efficient: it avoids court proceedings for minor non-compliance, but it also gives the state a powerful administrative tool. The notice warns of licence suspension, vehicle immobilisation, garnishee orders, and property seizure. There is no means assessment before those enforcement actions are taken under the 1994 Act; the person must challenge the notice first.

Court prosecution. If the person disputes the infringement notice or does not pay, the matter can proceed to court. The maximum penalty for the section 55(1) or (2) offence is $5,000 - considerably higher than the $800 modified penalty. This creates a classic “tax or fine” choice: pay $800 now or risk $5,000 plus court costs later. The regulations do not specify that paying the modified penalty constitutes an admission of guilt; the Criminal Procedure Act 2004 governs that effect.

Penalty for failing to provide employer information. Regulation 7 imposes a fine of $1,000 for a juror who fails to provide the name and business address of their employer within 14 days after completing jury service. This is not subject to the infringement notice scheme; it would be prosecuted under the standard criminal process. The maximum penalty is set at $1,000 in the regulation itself (not by reference to the Act). This is a strict liability offence on the face of it; no reasonable excuse is mentioned. The burden on the juror is to remember to supply information that may not have been requested at the time of service. The summoning officer does not appear to have discretion to extend the 14-day period.

Enforcement of civil jury payments. Regulation 3 does not impose a penalty for non-payment; it simply states the amounts and times. Failure to pay the prescribed amount by 10 a.m. on each trial day presumably means the jury trial cannot proceed, or the party may be in contempt. That is handled by the court, not the regulations.

Reporting failures. Regulation 3C requires the jury pool supervisor to report to the sheriff “as soon as practicable” any person who fails to obey a summons. This is a procedural obligation on the supervisor, not a penalty on the juror, but it ensures that non-compliance is escalated.

Enforcement agents. The Sheriff of Western Australia is the central enforcement figure: appointing officers, receiving reports, and presumably coordinating infringement notice issuance. The Sheriff is also the entity to which payments are made (Form 3). The regulations do not confer enforcement powers on other police or court officers; it is a self-contained administrative system.

The regulations do not operate in a vacuum. They interact with several other Western Australian statutes and instruments.

Juries Act 1957 (the parent Act). The regulations are entirely subordinate to the Act. They prescribe things that the Act explicitly leaves to regulation: forms for summonses and precepts (section 32D and 32G), amounts for civil jury payments (section 44(1) and (3)), fees and allowances (section 58B(2)-(5)), and offences for which infringement notices may be issued (Schedule 2 of the regulations refers to section 55 offences). The regulations cannot expand, limit, or override the Act. For example, the Act sets the maximum penalty for section 55 at $5,000; the regulation’s $800 modified penalty is a lower administrative amount. The Act defines who is qualified to serve; the regulations do not address that. The Act provides for excusals and deferrals; the regulations are silent. Practitioners must read the regulations alongside the Act.

Criminal Procedure Act 2004 (Part 2). The infringement notice regime is specifically created under Part 2 of the Criminal Procedure Act. Regulations 9 and 10, and Schedules 2 and 3, give effect to that Part. The Criminal Procedure Act defines terms like “authorised officer,” “approved officer,” “modified penalty,” and sets the procedural rules for issuing notices, withdrawing them, and proceeding to court. The Juries Regulations do not replicate those procedures; they merely designate offences and penalties and authorise the Sheriff to appoint officers. The Criminal Procedure Act also governs the effect of payment: it does not constitute an admission of guilt but finalises the matter.

Fines, Penalties and Infringement Notices Enforcement Act 1994. Form 3 in Schedule 3 explicitly references this Act. If a person fails to pay the $800 modified penalty by the due date, enforcement action under that Act may be taken. That Act allows the Fines Enforcement Registry to suspend driver’s licences, suspend vehicle licences, cancel licences, immobilise vehicles, remove number plates, publish details on a website, issue garnishee orders against earnings or bank accounts, and seize and sell property. These are severe consequences for a relatively minor failure. The regulations do not provide any means-based discretion before those actions; the 1994 Act may have its own hardship provisions, but they are not mentioned here.

Acts Amendment (Justice) Act 2008. The commencement of the regulations (other than Part 1) was tied to the commencement of Part 14 of this amending Act (regulation 2(b)). That Act presumably made changes to the Juries Act 1957 that required these regulations. Understanding the parent Act’s amendment history helps to contextualise the regulations’ provisions.

Interpretation Act 1984. As with all WA statutory rules, the Interpretation Act governs matters like commencement, repeal, and defined terms. Regulation 2 and the compilation table reflect that Act’s rules.

The Criminal Code and other offence provisions. The offences under section 55 of the Juries Act are criminal offences, not civil penalties. The standard criminal law principles apply (burden of proof beyond reasonable doubt, defences, etc.). The infringement notice scheme is an alternative to prosecution, not a separate civil penalty regime.

Other state jury regulations from other jurisdictions. The regulations are WA-specific. However, comparative practitioners may note the low fee amounts relative to other Australian states (e.g., NSW has higher flat rates). The regulations do not reference interstate legislation.

The regulations were originally gazetted on 26 September 2008 and commenced in two stages: Part 1 on the date of publication (26 September 2008), and the remainder on 30 September 2008 (tied to the commencement of Part 14 of the Acts Amendment (Justice) Act 2008).

2011 amendments (two sets). The first set, gazetted 30 June 2011, made significant changes: they inserted the entire Part 2A on jury pools (regulations 3A-3D) and Schedules 1 and 2 forms. They also amended regulation 4 (fees) and regulation 6 (class of employer) and regulation 8 (reimbursement of employer). The commencement was staged: regulations 1-3 (citation and preliminary) on 30 June 2011; regulations 4, 8, and 9 (fees, reimbursement, and infringement notice provisions) on 1 July 2011; and regulations 5-7 on 28 October 2011.

The second set, gazetted 27 October 2011, inserted Part 4 (infringement notices) including regulations 9 and 10 and Schedules 2 and 3 (prescribed offences, modified penalties, and forms). Most provisions commenced 28 October 2011. This created the infringement notice scheme for failing to obey summons or direction.

2013 amendment. Gazetted 20 August 2013, this made minor amendments to Schedule 3 forms (Form 3 and Form 4). It commenced 21 August 2013.

2020 amendment (SL 2020/27). Gazetted 31 March 2020, commencement 1 April 2020. This amended regulation 4 (fees) and Schedule 3 (forms), likely updating the lost-income application process and the infringement notice forms.

2020 amendment (SL 2020/162, Part 4). This was part of a broader package dealing with infringement notices across multiple regulations. It amended Schedule 3 forms (Form 3). It commenced 29 September 2020.

2023 amendment (SL 2023/33). Gazetted 21 April 2023, commencement 22 April 2023. This made the most recent changes: it amended regulation 3 (civil jury amounts, increasing them to $1,195 and $230), regulation 5 (travel allowance increased to 45 cents per kilometre), and Schedule 1 Form 1 (summons form) and Schedule 3 forms (Form 3 and Form 4). This is the current version. The civil jury amounts were substantially increased (previously they were lower), which will affect cost-benefit calculations for parties.

Reprint 1 was issued as at 16 March 2012, incorporating the 2011 amendments. The current compilation (as shown in the source) incorporates all amendments up to SL 2023/33.

The source text (the regulations as provided) contains no references to any court cases, litigation, or judicial interpretation of the regulations. As subordinate legislation, the regulations themselves are rarely the direct subject of litigation; disputes typically concern the parent Act. However, potential areas of litigation that could involve the regulations include:

• A challenge to the validity of an infringement notice issued under Schedule 2 on the basis that the form used did not comply with Schedule 3 (Form 3). The regulations specify that forms must be used, but minor departures might not invalidate the notice if the Criminal Procedure Act cures it.
• A dispute about whether a summoning officer properly exercised discretion under regulation 4(2) or 4(5) to deny a lost-income application, potentially giving rise to judicial review. The officer’s decision is administrative and may be reviewable for unreasonableness or procedural unfairness.
• A prosecution under section 55 of the Act for failing to obey a summons might involve a defence of “reasonable excuse.” The regulations do not define that term, but the court would interpret it. The infringement notice scheme does not require a subjective assessment of excuse; the modified penalty is payable regardless of excuse, but the person can dispute and argue excuse in court.
• A challenge to the constitutionality of the infringement notice scheme under Chapter III of the Commonwealth Constitution (if the person argued that the modified penalty imposes a punishment without judicial determination). However, the scheme allows for court review, so the argument would be weak.
• A question about whether the prescribed class of employer in regulation 6 improperly discriminates against private-sector employers. That would be a political rather than legal argument, as the Act itself likely authorises such distinctions.

Without specific case law cited in the source, one can only note that the regulations have not been the subject of reported challenges (or at least none are noted in the compilation). The low-value amounts in dispute (a few hundred dollars) likely deter litigation. The cost of judicial review would exceed any possible recoverable fee.

A number of traps in the regulations can ensnare unwary jurors, employers, and practitioners.

The lost-income application deadline is only three months, not six or twelve. Regulation 4(4)(c) requires the application to be made “within 3 months after the last day of the period of jury service.” This is a short window. Many jurors will not know about this option until weeks after service, and by the time they organise paperwork, it may be too late. The officer may extend by up to one year in exceptional circumstances, but that is discretionary. The burden is on the juror to apply promptly.

The $1,000 daily cap on lost income is hard to exceed. Even if a juror earns $2,000 per day, the default cap is $1,000. To exceed that, they must not only show that income exceeds $1,000 but also that non-payment would cause “undue hardship.” Undue hardship is not defined. The summoning officer has discretion, and the juror must provide information to satisfy the officer. This creates uncertainty and potential inequity for high-income earners who may face a severe financial penalty for serving.

Private-sector employers cannot claim reimbursement. Regulation 6 limits the prescribed class to government departments, state instrumentalities, and state trading concerns. A small business that continues to pay wages to a juror gets nothing from the state. The only financial benefit is the small daily fee that the juror receives, and the juror may choose to keep it rather than pass it on. The employer’s application right under regulation 8 is explicitly limited to prescribed-class employers. Private employers are left with the cost of the employee’s absence.

The employer information duty applies only to non-government employees. Regulation 7 applies to “a person doing jury service who is employed by an employer under a contract of service other than an employer in a class prescribed under regulation 6.” So government employees do not need to provide this information. That is curious - why only private-sector employees must comply? The penalty is $1,000. Any juror from the private sector who forgets to send the employer’s name and business address within 14 days after service faces a fine. The regulation does not specify what the summoning officer does with this information; it is not required for the reimbursement process because private employers cannot claim.

Travel allowance is only 45 cents per km, and only when public transport is unavailable. Many jurors will drive because public transport is inconvenient. If public transport exists (even if it would add two hours to the journey), they only get the public transport fare, not the per-km allowance. For a 30 km round trip, that might be $5 by bus versus $13.50 by car. The regulation does not consider the time cost of using public transport. The 45-cent rate is below the ATO’s cents-per-kilometre deduction rate (85 cents for 2024-25), so driving jurors are under-compensated for car costs.

Civil jury payments are due by 10 a.m. each day, with no grace. Regulation 3(1) says “the prescribed time is 10.00 a.m. on each day of the civil trial.” If the paying party is late, the court may refuse to proceed, causing delay and potential cost orders. The amounts are fixed per day; there is no discount for shorter days or for trials that settle mid-morning.

The infringement notice modified penalty of $800 is not trivial compared to the maximum $5,000. The notice gives a stark choice: pay $800 or risk court, licence suspension, and a potential $5,000 fine. For a person who genuinely had a reasonable excuse, the rational choice may still be to pay $800 to avoid the hassle and risk of court. The scheme thus may penalise people who were in the right but choose to avoid legal costs.

The penalty for failing to provide employer information is $1,000 - a fixed amount not subject to infringement notice. Regulation 7 mentions no alternative process. A juror who forgets could face a criminal prosecution and a fine of up to $1,000. There is no warning before the obligation; the juror must know regulation 7 exists.

Compliance under these regulations depends on whether you are a juror, an employer, or a party to a civil trial. Each has distinct steps.

Jurors: step-by-step. First, if you receive a summons (Form 1), attend at the Jury Assembly Room on the specified date and time. Check the time - it is usually a.m. Be prepared to attend from day to day until discharged. You cannot leave until formally discharged. If you have a reasonable excuse for not attending, contact the summoning officer before the date; do not simply stay away, as a failure will be reported to the sheriff and an infringement notice may issue. If you attend and serve, keep a record of your attendance days and times. Calculate your fee using the table in regulation 4(1). Expect $10 for a half-day, $15 per day for up to three days, $20 per day after that. To claim a higher amount for lost income, download or obtain the approved form from the summoning officer (or ask Juries Services). Complete it with details of your income loss (pay slips, a letter from your employer). Attach evidence. Submit it within three months of your last day of service. If you miss that deadline, write a letter explaining the exceptional circumstances and request an extension up to one year. Keep copies of everything. For travel, if you used public transport, keep the tickets or receipts (electronic or paper). If no public transport was available, measure the most direct route from your home to the court in kilometres, then claim 45 cents per km each way (so multiply kilometres by 0.45 and then by 2). You must claim after service, presumably by submitting a travel claim form to the summoning officer. The regulations do not prescribe a time limit for claiming travel expenses, but do it promptly. If you are a private-sector employee, within 14 days after your service ends, give the summoning officer written advice of your employer’s name and business address. Use a letter or email; keep a copy. This is mandatory; failure risks a $1,000 fine. If you receive an infringement notice for failing to attend, you have options: pay $800 by the due date (no admission of guilt), or write to Jury Services before the due date stating you wish to dispute the allegation. Be aware that disputing means court, with a potential $5,000 penalty if you lose. Seek legal advice before disputing if the facts are not clear.

Employers in the prescribed class (government departments, state instrumentalities, state trading concerns). If your employee serves as a juror and you continue to pay their wages, you may apply under regulation 8 to receive the fee that would otherwise go to the juror. Prepare a statutory declaration (signed before a justice of the peace or authorised witness) that includes: your Australian Business Number, the earnings you paid to the juror for any period of jury service, the juror’s name, the juror’s occupation, the hourly rate, and the number of hours of service lost. Send this to the summoning officer. The officer is required to pay you the juror’s fee. Be aware that the fee is very small - a few dollars per day - so the administrative effort may exceed the benefit. You might decide not to apply. There is no deadline for application in the regulation, but apply promptly to avoid administrative delays.

Private-sector employers. You cannot apply for reimbursement. Your employee will receive the small fee directly. You may contract with your employee to have them pay the fee to you, but the regulations do not require that. You may advise the juror that you will need the employer details for the regulation 7 information - but that is the juror’s obligation, not yours. You have no compliance steps under these regulations unless you choose to support the juror in their lost-income application by providing a letter confirming hours and rates.

Parties in a civil trial (legal practitioners representing plaintiffs or defendants). If you elect a jury, ensure your client pays into court the prescribed amounts by 10 a.m. on each trial day. For a 12-person jury: $1,195 per day. For a 6-person jury: $230 per day. Also $230 per day for the pool. If you fail to pay, the court may proceed without a jury or adjourn. The amounts are per day, so a trial lasting 10 days costs $11,950 for a 12-person jury. Consider whether the tactical advantage of a jury is worth the cost. The regulations do not provide for refunds if the trial settles mid-day; the amount for that day is still due presumably.

Sheriff and summoning officers (administrators). Ensure that summonses are in the correct form (Form 1). Issue pool precepts (Form 2) with correct details. Report failures to obey summonses under regulation 3C promptly. Process lost-income applications within the three-month window; be prepared to exercise discretion for extensions. For private-sector jurors, collect the employer information under regulation 7 and keep it on file; the regulations do not specify what to do with it. For infringement notices, ensure authorised officers have current identity cards. Use Form 3 for initial notices and Form 4 for withdrawals. Maintain records as required by the Criminal Procedure Act 2004.
