83Extension of time to comply

83 Extension of time to comply (1) A public sector organisation on whom a compliance notice has been served may apply to the Commissioner for an extension of the period within which to comply with the notice. (2) The Commissioner must not consider an application for an extension unless the application is made before the period sought to be extended expires. (3) The Commissioner may grant an extension if: (a) satisfied that it is not reasonably possible for the public sector organisation to take the action specified in the notice within the period specified in the notice; and (b) the organisation gives the Commissioner an undertaking to take that action within the extended period. Information Act 2002 55 (4) If the Commissioner grants an extension, the compliance notice is taken to have been amended accordingly.
