39A Application for review may be sent to Commissioner (1) Instead of reviewing a decision, a public sector organisation may send an application mentioned in section 39(1) to the Commissioner to be dealt with under section 103(4). (2) If the public sector organisation is required under section 103(2)(b) to conduct a further review of the decision, subsection (1) does not apply and the decision must be reviewed under section 39.
