23Deferring access

23 Deferring access (1) The public sector organisation may decide to defer providing access to the information for a period not exceeding 60 days if the (a) is required by a law in force in the Territory to be published but is yet to be published; or (b) has been prepared for presentation to the Legislative Assembly, or as a submission to a particular person or body, and has yet to be presented or submitted. under section 20 the period for which access is likely to be deferred. (3) If by the end of the period mentioned in subsection (2): (a) the information has not been published, presented or submitted as mentioned in subsection (1)(a) or (b); and (b) the public sector organisation has not provided access to the the organisation is taken to have refused access to the information.
