125 Onus and burden of proof where access refused If the matter the subject of a proceeding is a decision by the respondent to refuse access to government information, the respondent must prove on the balance of probabilities: (a) that the information is exempt under Part 4; or (b) that the complainant is not entitled to access under this Act.
