49 Indemnities and undertakings
> > (1) The Commission may recommend to the Attorney General that a person be granted (under section 32 of the [Criminal Procedure Act 1986](/view/html/inforce/current/act-1986-209)) an indemnity from prosecution.
>
> > (2) The Commission may recommend to the Attorney General that a person be given (under section 33 of the [Criminal Procedure Act 1986](/view/html/inforce/current/act-1986-209)) an undertaking that—
> >
> > > (a) an answer, statement or disclosure in proceedings before the Commission, or
> >
> > > (b) the fact of a disclosure or production of a document in proceedings before the Commission,
> >
> > will not be used in evidence against the person.
>
> > (3) Section 33 of the [Criminal Procedure Act 1986](/view/html/inforce/current/act-1986-209) applies in relation to proceedings before the Commission in the same way as it applies in relation to proceedings for an offence.

> > (4) A reference in this section to proceedings before the Commission includes a reference to a compulsory examination or public inquiry conducted by the Commission or any other investigative activity involving the Commission or an officer of the Commission.
