47 Protected documents and other things in proceedings, processes or actions other than criminal proceedings (1) This section applies to— (a) any legal proceeding other than a criminal proceeding; S. 47(1)(b) amended by No. 31/2024 s. 113(Sch. 1 item 16.12). (b) any proceeding, other than a criminal proceeding, of any tribunal, authority or person having power to require the production of documents or the answering of questions, other than Integrity Oversight Victoria; (c) any disciplinary process or action. S. 47(2) amended by No. 30/2016 s. 16. (2) In any proceeding, process or action to which this section applies, a protected person is not compellable to produce, or permit inspection of, any document or other thing that the protected person has created or that has come into his or her possession or control in the performance of the duties and functions or the exercise of the powers of the person or the IBAC under this Act or any other Act, if the IBAC certifies in writing that in the IBAC's opinion the document or thing is a protected document or other thing.
