Housing Regulations 1980

This instrument organises around a small set of stable legal concepts and processes. Key concepts that the Regulations define and deploy, with immediate operational consequences, are:

• Authority and Common Seal (r 5). The Authority’s common seal must bear the Authority’s name within two concentric circles and may only be affixed in the presence of the chief executive officer or two other officers appointed by the Authority. The seal’s custody is to remain with the person appointed by the Authority (r 5(2)-(4)). This concentrates control of formal document execution within named officeholders.
• Aboriginal corporate entity and Aboriginal land (r 6A). The Regulations define “Aboriginal corporate entity” by reference to three statutory categories: corporations under the Commonwealth Corporations (Aboriginal and Torres Strait Islander) Act 2006, incorporated associations under the Associations Incorporation Act 2015 with membership wholly or principally of Aboriginal descent, and corporations under the Commonwealth Corporations Act 2001 with membership likewise principally composed of persons of Aboriginal descent (r 6A). “Aboriginal land” is defined as freehold land owned by an Aboriginal corporate entity over which that entity or another Aboriginal corporate entity has power to grant a lease (r 6A).
• State‑Commonwealth agreement as a Housing Agreement (rr 6A, 6B). The Regulations identify the National Partnership Agreement on Remote Indigenous Housing (entered 27 February 2009, as amended) and its Implementation Plan as the “State‑Commonwealth agreement” and declare it to be a Housing Agreement within the meaning of s 48 of the Act (r 6B). The declared purpose of Part 3 is to enable the Authority to administer and perform any act required under that agreement on behalf of the State (r 6C).
• Housing management agreement and applied provisions (rr 6D, 6E). The Authority is expressly authorised to enter into housing management agreements with Aboriginal corporate entities in respect of Aboriginal land to “control and manage” letting and leasing of housing on that land (r 6D(1)-(2)). The Regulations apply the provisions of Part VIIA Division 2 of the Act, except section 62B, to such agreements (r 6E(1)), and provide that terms defined in r 6A have the same meaning in the applied provisions (r 6E(2)), while references to “Aboriginal entity” in the applied provisions are read as references to an Aboriginal corporate entity (r 6E(3)).
• Ministerial approval exclusion (r 6F). The Regulations state that prior approval or consent of the Minister for Indigenous Affairs is not required for entry into a housing management agreement or a residential tenancy agreement in respect of a nominated lot or nominated house, or to carry out anything required or permitted under such agreements (r 6F(2)). This removes a statutory gatekeeping step for these dealings under the Regulations.
• Financial assistance on‑lending and long term bond rate (r 6). The Regulations set an object to enable the Authority, as a State lending authority, to on‑lend in accordance with clause 25 of the referenced Commonwealth‑State agreement (r 6(2)). They prescribe a floor of 6% p.a. and a ceiling of 1% below the long term bond rate for initial on‑lend interest (r 6(3)(a)(i)-(ii)), a staged annual 0.5% p.a. increase until the ceiling is reached and dynamic linkage thereafter to the long term bond rate (r 6(3)(b)), and they define how to calculate the long term bond rate (r 6(4)).
• Fees and charges (Parts 5; regs 8-11). The Regulations set a detailed conveyancing fee schedule (r 8 Table), architectural fees payable as percentages of estimated construction cost with thresholds and categories for new designs, repetitive designs, and additions/repairs (r 9), modest plan and inspection fees (r 9(2)), and the $50 p.a. owner management fees in strata and community titles contexts where the Authority provides services (regs 10-11).

Each concept creates a specific decision node: whether the Authority exercises its discretionary “may” powers (for housing management agreements and provision of management services), the pricing decisions implied by fee schedules, the calculation and application of lending interest rates, and the procedural controls around execution of documents using the common seal. The Regulations also link to external documents, such as the National Partnership Agreement and Implementation Plan, and to other statutes (Strata Titles Act 1985, Community Titles Act 2018, Residential Tenancies Act 1987, Land Administration Act 1997), so the concepts operate in a cross‑instrument regulatory network (see regs 6A, 6B, 6G, 10(1), 11(1)).

The Regulations allocate duties, costs and decision rights among a fairly narrow set of actors. Primary affected parties identified in the text are:

• The Authority (defined by reference to the Act). The Regulations directly constrain and empower the Authority: they set formalities for its common seal (r 5), authorise it to enter housing management agreements with Aboriginal corporate entities (r 6D), authorise it to administer the State‑Commonwealth agreement (r 6C), and permit it to provide management services to strata and community corporations and to charge $50 per lot owner annually where it does so (regs 10-11). The Authority also exercises discretion under the on‑lending regime to set an appropriate interest rate within defined bounds, having regard to the income of the home purchaser and family (r 6(3)(a)).
• Aboriginal corporate entities. These are the recipients of an express invitation to negotiate housing management agreements (r 6D(1)). Their legal status is defined narrowly (r 6A), and the Agreements may operate over Aboriginal freehold land where the entity or another Aboriginal corporate entity has power to grant a lease (r 6A). The exclusion of ministerial approval (r 6F) directly affects the institutional path such entities must follow to permit the Authority to manage letting and leasing on their land.
• Home purchasers, borrowers and mortgage parties. The on‑lending provisions (r 6) apply to home purchasers where moneys lent to the Authority pursuant to clause 24 of the referenced agreement are used to grant financial assistance to a home purchaser (r 6(3)). The contract of sale, mortgage or other instrument must specify an interest rate not less than 6% and not greater than 1% below the long term bond rate, subject to the staged increase provisions (r 6(3)(a)-(b)). The Regulations therefore affect borrowing costs and loan documentation for those purchasers.
• Owners of lots in strata titles schemes and community titles schemes. If the Authority provides management services to the strata company or community corporation in connection with statutory functions under the Strata Titles Act 1985 or Community Titles Act 2018, owners of lots can be required to pay an annual management fee of $50 to the Authority (regs 10(2)-(3) and 11(2)-(3)). These owners have a statutory obligation to pay where the Authority requires it.
• Legal and conveyancing representatives, developers and purchasers dealing with instruments prepared by the Authority. The conveyancing fee schedule (r 8 Table) lists itemised fees for mortgages ($196), discharge of mortgage ($78), transfers ($245), deeds of co‑ownership ($235), settlement statements ($213) and other specific items. These fees apply to clients who obtain documents prepared by the Authority.
• Architects and building owners who use the Authority’s design or inspection services. Regulation 9 prescribes percentage fees based on estimated cost of construction (for example, 8% for new individual houses under “new design”), and charges for plan examination ($40) and building inspections ($20 per inspection).
• Ministers and other statute administrators. The Regulations remove a formal gatekeeping role for the Minister for Indigenous Affairs in the specific areas covered by r 6F, affecting ministerial oversight or intervention paths in housing management and tenancy arrangements on Aboriginal land.

Secondary or indirect stakeholders include private strata/community managers who might be displaced if the Authority provides management services in a scheme, and lenders or investors assessing the credit quality and interest rate regime for loans originated under the specified Commonwealth‑State arrangement. The Regulations’ defined interconnections with the Residential Tenancies Act 1987, Strata Titles Act 1985 and Community Titles Act 2018 means practitioners working across these statutory regimes must reconcile obligations and payments when the Authority is a contracting or servicing party (see regs 6A definition of “residential tenancy agreement”, 10(1), 11(1)).

The Regulations allocate a short list of duties and rights. Concrete, enforceable duties and rights are:

• Duty on the Authority to observe common seal formalities (r 5). The Common Seal must bear the Authority’s name within two concentric circles (r 5(2)). It must not be affixed except in the presence of the chief executive officer or two other appointed officers, and the seal must remain in the custody of the appointed person (r 5(3)-(4)). These are procedural duties on the Authority to preserve formal execution integrity.
• Right and discretion to enter housing management agreements (r 6D). The Authority “may” enter into housing management agreements with an Aboriginal corporate entity (r 6D(1)). The Agreement’s express purpose is enabling the Authority to control and manage letting and leasing of housing on Aboriginal land (r 6D(2)). The use of “may” establishes an institutional right without creating a mandatory duty to enter such agreements (r 6D(3) clarifies the Authority is not required to enter into such an agreement).
• Applied statutory rights and duties from Part VIIA Division 2 of the Act (r 6E). The Regulations import most provisions of Part VIIA Division 2 of the Act into housing management agreements, except section 62B (r 6E(1)). Terms defined in r 6A operate in those provisions (r 6E(2)-(3)). The net effect is that the rights and duties created by Part VIIA Division 2 of the Act now apply to the relationships governed by housing management agreements, but the instrument itself leaves the content of those applied provisions to the Act.
• Exclusion of prior Ministerial consent for specified actions (r 6F). The Regulations remove the requirement for prior approval of the Minister for Indigenous Affairs for entry into a housing management agreement or a residential tenancy agreement in respect of a nominated lot or nominated house or for doing anything required or permitted under such agreements (r 6F(2)). That is a negative duty on ministers and a positive right for parties to contract without needing that prior consent.
• Duty to apply the Land Administration Act 1997 where relevant (r 6G). The Regulations preserve the Land Administration Act’s operation over Aboriginal land; the Part does not affect that application (r 6G).
• Financial duties in on‑lending contracts (r 6). Where moneys lent to the Authority under clause 24 of the referenced agreement are used to grant financial assistance, the contract of sale, mortgage or other instrument must specify rates within a bounded range and apply the staged increase mechanism (r 6(3)). The Authority must consider the income of the home purchaser and family when setting the initial rate within the bounds (r 6(3)(a)). The Regulations state that they operate notwithstanding sections 33 or 42 of the Act (r 6(3) opening words), indicating these rules prevail over those particular Act provisions for these transactions.
• Fee‑paying duties on recipients of Authority services (regs 8-11). A person receiving conveyancing documents prepared by the Authority must pay the specified fee in the Table (r 8). Owners who receive strata or community management services from the Authority must pay the $50 annual management fee where the Authority requires it (regs 10(2)-(3), 11(2)-(3)). Owners must pay these fees to the Authority when required.
• Fee liability for architectural services (r 9). Where an owner utilises the Authority’s architectural services, the owner must pay a percentage of the estimated cost of construction as prescribed by the Table in regulation 9(1). Owners who use non-design Authority services during construction must pay examination and inspection fees of $40 and $20 per inspection respectively (r 9(2)).

Rights include the Authority’s discretion to accept or decline to enter housing management agreements and to set the initial on‑lend rate within the statutory bounds, and owners’ rights to rely on the Authority to perform management services when contracted. Duties are mostly administrative (seal custody, fee collection, compliance with rate mechanics) and contractual (loan documents to specify rates in line with r 6).

The Regulations themselves contain no express criminal penalties, fines or administrative penalty provisions within the text reproduced. Their enforcement and penalties therefore operate by reference to:

• The Act and the applied provisions. Several pieces of enforcement machinery will be located in the Housing Act 1980 and the applied Part VIIA Division 2 provisions of the Act (applied by r 6E(1)). The Regulations expressly import those applied provisions except for s 62B; enforcement measures that apply to disputes, breaches or enforcement actions related to housing management agreements will be those found in the applied provisions of the Act. The Regulations do not reproduce those enforcement provisions.
• Statutory obligation to pay fees. Regulations 8-11 prescribe fees and state that owners must pay them (for example, regs 10(3), 11(3)). While the Regulations require payment, they do not specify default penalties or recovery mechanisms; these mechanisms will be those in the Act, or in general law and statutory debt recovery procedures. Practitioners should consult the Act and relevant recovery statutes to determine enforcement paths for unpaid fees.
• Contractual enforcement. For on‑lending and mortgage arrangements governed by regulation 6, enforcement of the interest rate mechanics and mortgage terms will proceed according to the terms of the contract of sale, mortgage or other instrument and the Act’s mortgage enforcement regime. The Regulations require these instruments to specify interest rates and escalation mechanics (r 6(3)), so contractual remedies and mortgage enforcement paths would apply where a borrower defaults, subject to the Act’s provisions.
• Cross‑statute enforcement. The Regulations insist that the Land Administration Act 1997 remains applicable to Aboriginal land (r 6G). Enforcement powers and penalties in that Act will therefore continue to operate where relevant. Likewise, residential tenancy matters remain governed by the Residential Tenancies Act 1987 and strata/community matters by their respective statutes (regs 6A, 10(1), 11(1)).
• Administrative oversight and internal controls. Regulation 5 creates an internal control rule for the performance of official acts using the Authority’s Common Seal: the seal must only be used in the presence of the chief executive officer or two other appointed officers (r 5(3)). A breach of this procedure may attract disciplinary or administrative consequences within the Authority, but the Regulations do not set out civil sanctions.

Because the Regulations frequently refer to other statutes and apply other statutory provisions, enforcement and penalties are primarily sourced from those parent statutes rather than from the Regulations themselves. The instrument’s silence on fines or specific penalties means practitioners must map potential breaches (non‑payment of fees, misuse of powers under housing management agreements, failure to comply with mortgage terms) onto enforcement regimes in the Act, the Residential Tenancies Act 1987, the Strata Titles Act 1985, the Community Titles Act 2018, and the Land Administration Act 1997, as applicable.

The Regulations deliberately cross‑reference and import provisions from several external instruments and Acts. Explicit interactions recorded in the text are:

• Housing Act 1980. The Regulations are subordinate to and operate under the Act. The defined term “Act” in r 4 clarifies that all internal references attach to that statute. Regulation 6E applies Part VIIA Division 2 of the Act to housing management agreements, except section 62B (r 6E(1)-(3)). Regulation 6(3) operates “notwithstanding section 33 or 42 of the Act”, signalling a specific override for the on‑lending interest mechanics to the extent of any inconsistency (r 6(3) opening words).
• National Partnership Agreement on Remote Indigenous Housing and Implementation Plan. The Regulations define the “State‑Commonwealth agreement” as the National Partnership Agreement on Remote Indigenous Housing (entered 27 February 2009, as amended) together with its Implementation Plan (r 6B(1)), and declare it a Housing Agreement as defined in s 48 of the Act (r 6B(2)). Regulation 6C states the Part’s purpose is to enable the Authority to administer that agreement for and on behalf of the State (r 6C( a)) and to authorise the Authority to do acts required by the agreement on behalf of the State (r 6C(b)). Therefore obligations and actions under that National Partnership Agreement are authorised to be performed by the Authority under the Act through this Regulations’ mechanism.
• Residential Tenancies Act 1987. The Regulations adopt the term “residential tenancy agreement” by reference to s 3 of the Residential Tenancies Act 1987 (r 6A). When housing management agreements produce nominated lots or nominated houses, the tenancy arrangements interact with the Residential Tenancies Act 1987 as the standard reference for tenancy definitions and likely procedures. The Regulations do not displace the Residential Tenancies Act; they reference it for definitional coherence.
• Land Administration Act 1997. Regulation 6G states that the Part does not affect the application of the Land Administration Act 1997 in relation to Aboriginal land. Therefore, decisions and processes under the Land Administration Act continue to apply to Aboriginal land even where the Authority enters housing management agreements (r 6G).
• Strata Titles Act 1985 and Community Titles Act 2018. Regulations 10(1) and 11(1) expressly adopt definitions from those statutes for “owner”, “strata company”, “strata titles scheme”, “community corporation”, “community titles scheme” and “owner of a lot”. The Authority’s ability to charge $50 annual management fees to owners arises only where the Authority provides management services “in connection with the strata company’s (or community corporation’s) functions under” those Acts (regs 10(2), 11(2)). Thus the Authority’s management role is supplementary to statutory functions under those Acts.
• Corporations laws and associations legislation. Regulation 6A’s definition of “Aboriginal corporate entity” imports three corporate forms from different statutes: Corporations (Aboriginal and Torres Strait Islander) Act 2006 (Commonwealth), Associations Incorporation Act 2015 (WA), and Corporations Act 2001 (Commonwealth). This definition means entities operating under differing incorporation regimes may qualify as Aboriginal corporate entities for the purpose of entering housing management agreements.
• Compilation and amendment instruments. The Compilation Table and Reprints listing at the end of the text show a history of amendments and reprints, indicating that these Regulations operate in a legislative environment where subordinate legislation has been updated through specific Statutory Instruments and Amendment Regulations (Compilation Table).

Operationally, the Regulations sit as a bridging instrument that allows the Authority to act under broader Commonwealth‑State program funding arrangements, while ensuring accompanying obligations are coordinated with relevant Western Australian statutory regimes. Practitioners must therefore coordinate compliance across the Act, the applied provisions of Part VIIA Division 2, the Residential Tenancies Act 1987, the Land Administration Act 1997, and the strata and community titles statutes when the Authority is a party to management or tenancy arrangements.

The Regulations include an explicit compilation table that records the instrument’s amendment chronology and commencement dates. The regime of amendments shows iterative updates to fees, new parts and definitions, and the addition of Aboriginal housing provisions. Key items from the Compilation Table and notes are:

• Original commencement and citation. The Housing Regulations 1980 were published 24 December 1980 and commenced 1 January 1981 (r 1, r 2; Compilation Table).
• Early amendments. Amendment Regulations appear in 1984, 1986 and 1993 (Compilation Table). Regulation 9 (architectural fees) contains an amendment note dating to 19 April 1984 (r 9 amended: Gazette 19 Apr 1984 p. 1114).
• 1990s and 2000s amendments. The conveyancing fees table was inserted and amended across the 1990s (inserted 1 June 1993; multiple amendments noted at rr 8). A reprint occurred at 24 Aug 2001. Significant amendments were effected by the Housing Amendment Regulations 2006 (Gazette 30 Jun 2006 p. 2360‑1) with a reprint or commencement on 1 July 2006.
• Introduction of Part 3 and Aboriginal housing provisions. The Part headed “Aboriginal housing” and regulations 6A-6G were inserted by the Housing Amendment Regulations 2011 (Gazette 27 May 2011 p. 1924-7). The headings note “Heading inserted: Gazette 27 May 2011 p. 1925.”
• Subsequent updates to fees and other operatives. Conveyancing fees have been updated repeatedly: entries in the amendment list show changes in 1995, 1996, 1998, 2006, 2009, 2012, 2015, 2016, 2017, 2018, 2022, 2023, 2024 and 2025 (Compilation Table lists SL 2022/151 r.4; SL 2023/73 r.4; SL 2024/90 r.4; SL 2025/100 r.4).
• New provisions for strata and community titles management. Regulation 10 (strata management fees) was inserted on 31 December 2019 (Gazette 31 Dec 2019 p. 4647‑8) and amended via SL 2021/73 r.4. Regulation 11 (community titles management fees) was inserted by SL 2021/73 r.5.
• Recent reprints and continuing updates. The Compilation Table records a second reprint as at 3 Aug 2012, and successive amendment regulations leading up to Statutory Law instruments in 2024 and 2025 (SL 2024/90 and SL 2025/100).

The amendment history highlights two trends: (1) fee schedules and operational particulars (for example, conveyancing fees and adding strata/community management fees) are frequently updated by amendment regulations; and (2) Part 3’s insertion in 2011 created a new, distinct statutory framework for Aboriginal housing engagement and administration by the Authority. Practitioners should therefore check the most current statutory instrument (the Compilation Table cites SL 2025/100 r.4 as the latest fee amendment) to ensure reliance on current fees and operational rules.

The Regulations as presented contain no internal references to case law, judicial decisions or litigation outcomes. The text does not cite or summarise any judicial proceedings, and the Compilation Table does not list any related reported litigation. Therefore, within the instrument itself, there is no recorded litigation history.

Where disputes might arise based on the Regulations, potential sources of litigation are visible from the text, though no cases are named in the instrument:

• Housing management agreements and the applied provisions. Since regulation 6E applies Part VIIA Division 2 of the Act (except s 62B) to housing management agreements, disputes over the interpretation or operation of those applied provisions would be litigated under the Act’s framework. The Regulations do not reproduce that dispute‑resolution machinery; any jurisprudence would arise under the Housing Act and the specific applied provisions.
• Contractual and mortgage enforcement under regulation 6. The regulation prescribes mandated interest rate mechanics for on‑lent funds (r 6(3)). Disputes over the correct application of the staged 0.5% increases, calculation of the “long term bond rate” (r 6(4)), or the Authority’s exercise of discretion “having regard to the income of the home purchaser and his family” in setting initial rates (r 6(3)(a)) are potential litigation drivers. The Regulations do not include adjudicative rules for such disputes.
• Payment of fees and fee liability. Regulations 8-11 place payment obligations on persons receiving conveyancing documents, owners of lots in strata or community schemes where the Authority provides services, and owners who use Authority architectural services. Enforcement over unpaid fees would proceed through statutory or contractual collection mechanisms and potentially litigation, but none is referenced.
• Ministerial approval exclusion. Regulation 6F removes the need for prior approval of the Minister for Indigenous Affairs for certain agreements and actions. If a party contended that ministerial consent was required under other statutory regimes or that r 6F was inapplicable, litigation might arise to determine the boundary between the Regulations and other statutory requirements (for example the Land Administration Act), but the Regulations themselves preserve the applicability of the Land Administration Act (r 6G).

Practitioners seeking precedent on how regulators, courts or tribunals have interpreted analogous provisions must look to decisions under the Housing Act 1980, Part VIIA, the Residential Tenancies Act 1987, the strata and community titles Acts, and the Land Administration Act. Because the Regulations act largely by cross‑reference and by establishing specific fee and process rules, most adjudicated controversies would be decided under those parent Acts or general principles of contract and administrative law. The absence of litigation references in the instrument means counsel should undertake jurisdictional searches in the Housing Act and associated case law databases for any relevant decisions interpreting applied provisions or disputes involving the Authority’s exercise of powers under these Regulations.

Several points in the Regulations create traps for the unwary or non‑compliant steps that practitioners and participants should note:

• “May” does not mean “must” for housing management agreements (r 6D). The Authority is authorised to enter housing management agreements but is not obligated to do so. Parties expecting the Authority to accept every proposal should confirm contractual commitments rather than presuming a statutory duty.
• Minor but binding exclusions and exceptions. Regulation 6E applies Part VIIA Division 2 of the Act “except section 62B” (r 6E(1)). Users must not assume all Part VIIA Division 2 provisions apply; they must consult the Act for the complete content and verify the effect of excluding s 62B.
• Ministerial approval is not required for specified actions (r 6F(2)), but the Land Administration Act continues to apply (r 6G). While r 6F removes the need for the Minister for Indigenous Affairs’ prior consent for housing management and tenancy agreements, these transactions remain subject to the Land Administration Act 1997 where applicable. Practitioners should not read r 6F as a carte blanche to ignore land tenure, alienation or vesting requirements under the Land Administration Act.
• Complexity in the long term bond rate calculation (r 6(4)). The “long term bond rate for a year” is defined as “the coupon rate on the longest term security of the last Commonwealth public loan issued prior to 1 May that last occurred prior to that year” (r 6(4)). Implementing this requires identifying the “last Commonwealth public loan” and its coupon rate, potentially entailing timing and market identification issues. Lenders and loan documentation must be precise in their source and date when applying this definition to avoid disputes.
• Rate band and staged increase mechanics are pre‑specified (r 6(3)). Contracts must specify initial interest rates not less than 6% p.a. and not more than long term bond rate minus 1%, with automatic 0.5% per annum increases at specified times until the ceiling is reached and thereafter variation by reference to the long term bond rate. Loan documentation must incorporate these schedules accurately and provide clear drafting on the Governor of the rate adjustments.
• Fee amounts are updated frequently (r 8 Table and Compilation Table). The conveyancing fees table shows multiple amendment entries across the years, including recent statutory instruments up to SL 2025/100 r.4. Users relying on out‑of‑date fee schedules risk non‑payment or underpayment. Always check the most recent reprint or amendment.
• Definitions tie into multiple statutes (r 6A, regs 10(1), 11(1)). The Regulations import definitions from Commonwealth and Western Australian legislation. Determining whether an entity qualifies as an “Aboriginal corporate entity” requires cross‑reference to Commonwealth Corporations Act regimes and the state Associations Incorporation Act 2015. Likewise, “owner” in the strata/community context borrows from other Acts. Misclassifying an entity can affect entitlement to enter agreements or liability for fees.
• Narrow coverage of fees and services. The $50 annual management fee for owners only applies where the Authority provides management services “in connection with” functions under the Strata Titles Act or the Community Titles Act (regs 10(2), 11(2)). Parties cannot be charged the fee absent that service provision. Disputes may arise about whether the Authority’s activity constitutes the requisite “connection with” the statutory function.
• Common seal formalities are strict (r 5). Documents executed without compliance with r 5(3) may be invalid or challengeable; the Authority must maintain custody and record procedures for affixing the seal to avoid internal control failures.
• “Notwithstanding” language may override Act provisions (r 6(3)). Regulation 6 operates “Notwithstanding section 33 or 42 of the Act”, so practitioners must be alert where other parts of the Act might otherwise apply differently. Confirm the scope of the override.
• Relationship to the State‑Commonwealth agreement is derivative (r 6B, 6C). The Regulations rely on the National Partnership Agreement and Implementation Plan; any material changes or cessation of those external instruments will affect the Authority’s delegated powers and obligations under these Regulations.

These are concrete, text‑based pitfalls. Many require cross‑statute diligence, precise drafting in loan and management agreements, and updated reference to fee tables to avoid administrative or contractual problems.

Below are practical steps and checkpoints for the principal actors to operationally comply with the Regulations, with explicit references to the relevant provisions.

For the Authority

• Common Seal procedures: maintain a written register and custody chain for the Common Seal, ensure the CEO or two appointed officers are present at affixings, and store the seal with the appointed custodian (r 5(2)-(4)). Produce and follow internal authorisation forms showing the presence of the required officers.
• Housing management agreements: develop a template housing management agreement aligned with Part VIIA Division 2 of the Act, excluding s 62B as the Regulations do. Ensure terminology aligns with regulation 6A definitions (r 6E(1)-(3)). Record that entry is discretionary (r 6D(1), (3)).
• Liaison with Aboriginal corporate entities: verify corporate status under the cited statutes before negotiating (r 6A). Confirm Aboriginal land status and the entity’s power to grant leases per r 6A’s definition of Aboriginal land.
• Ministerial approvals: note that prior approval of the Minister for Indigenous Affairs is not required for these agreements or tenancy agreements (r 6F(2)), but maintain records demonstrating compliance with other statutory processes, particularly the Land Administration Act 1997 (r 6G).
• Lending operations: when on‑lending moneys from clause 24 funds, ensure contracts of sale, mortgages and instruments specify initial interest rates no less than 6% and no greater than 1% below the long term bond rate, include the 0.5% per annum staged increase schedule and the ongoing variation tied to the long term bond rate (r 6(3)(a)-(b)). Adopt a clear internal method for identifying the long term bond rate in accordance with r 6(4).
• Fee collection and disclosure: publish the Authority’s fee schedule and keep it current with statutory amendments (regulation 8 Table and compilation entries). Ensure conveyancing, architectural and inspection fees are charged as prescribed (regs 8-9) and collect the $50 annual management fee from owners in schemes where the Authority provides management services (regs 10(2)-(3), 11(2)-(3)).

For Aboriginal corporate entities

• Verify incorporation status and land ownership rights under r 6A before entering negotiations for a housing management agreement.
• Negotiate the scope of the Authority’s control and management responsibilities for letting and leasing clearly; remember the Authority is not obliged to enter an agreement (r 6D(1), (3)).
• Confirm interactions with the Land Administration Act 1997 in relation to land transactions (r 6G).

For home purchasers, borrowers and mortgagees

• Expect mortgage and sale documents to specify interest rates that comply with regulation 6(3). Confirm the initial rate, the staged 0.5% increases, and the reference to the long term bond rate (r 6(3)(a)-(b), 6(4)).
• Ensure the mortgage contract contains mechanism for calculating the long term bond rate and records the source and date of the Commonwealth public loan coupon rate used (r 6(4)).

For strata and community lot owners

• Confirm whether the Authority provides management services to the strata or community corporation. If it does and the Authority requires payment, owners must pay $50 per annum to the Authority (regs 10(2)-(3); 11(2)-(3)).
• Check scheme records and agreements to identify the presence, scope and timing of Authority services before paying.

For conveyancers, developers and architects

• Use the precise fee schedule in regulation 8 for documents prepared by the Authority and the percentage tables in regulation 9 for architectural fees. For architectural work, base fees on the estimated cost of construction categories and thresholds in r 9(1) and collect $40 for plan examination and $20 per inspection where Authority services are used (r 9(2)).
• Keep contemporaneous proof of which fee table/version was in force at the date of the transaction because the conveyancing fee table has been amended repeatedly (see Compilation Table).

Cross‑compliance checks

• Cross‑reference the Housing Act 1980, Part VIIA Division 2 as applied (r 6E), the Residential Tenancies Act 1987 for tenancy definitions and obligations (r 6A), the Land Administration Act 1997 for land tenure issues (r 6G), and the Strata Titles Act 1985 or Community Titles Act 2018 as applicable for scheme functions (regs 10(1), 11(1)).
• Maintain version control of statutory instruments and reprints (Compilation Table). Because fees and certain operational details are amended by later Statutory Instruments (SL 2024/90; SL 2025/100), confirm the correct instrument version before calculating charges or preparing documents.

Records, transparency and dispute readiness

• Keep clear records of all housing management agreements, the Authority’s decision not to enter an agreement, and the reasons; record the exercise of discretion when setting initial on‑lend rates and evidence of assessment of purchaser income for regulatory compliance (r 6(3)(a)).
• For any contested calculation of the long term bond rate, maintain contemporaneous source documentation showing which Commonwealth public loan and coupon rate was used, and the date of reference (r 6(4)).
• Provide owners with written notices of required payments (for fees) and retain proof of service and receipts.

Adhering to these steps will align operational practice with the Regulations’ procedural and financial mandates and reduce the risk of contractual or administrative disputes.
