Originally focused on administrative matters (Common Seal), home loan interest rates, and conveyancing fees, the 2011 insertion of Part 3 (Aboriginal housing) added a substantial new purpose: implementing the National Partnership Agreement on Remote Indigenous Housing. This transformed the regulations from simple administrative/fee-setting rules into an instrument for managing Commonwealth-State Indigenous housing agreements and complex land management arrangements involving Aboriginal corporate entities. The 2019-2021 additions of strata and community title management fees (Regulations 10-11) further expanded scope into property management services."},"complexity_factors":["Multiple fee schedules with tiered calculations (architectural fees vary by project type and dollar value thresholds)","Cross-references to at least 6 other Acts (Housing Act 1980, Corporations (Aboriginal and Torres Strait Islander) Act 2006, Associations Incorporation Act 2015, Corporations Act 2001, Aboriginal Affairs Planning Authority Act 1972, Land Administration Act 1997, Strata Titles Act 1985, Community Titles Act 2018, Residential Tenancies Act 1987)","Defined terms section lists 17 specific definitions, some nested (e.g., 'applied provisions' refers to other provisions as modified)","Complex interest rate calculation mechanism in Regulation 6 involving long-term bond rates and annual incremental increases","Application provisions that modify how other Act provisions apply (Regulation 6E applies Part VIIA Division 2 of the Act with specific modifications)","Historical layering: Regulations date from 1980 but have been substantially amended, with Part 3 (Aboriginal housing) inserted in 2011 creating a modern overlay on older provisions"],"plain_english_summary":"**What this legislation does:**\n\nThese regulations set out the administrative rules for how Western Australia's Housing Authority operates under the *Housing Act 1980*. They cover four main areas:\n\n**1. Aboriginal housing management (Part 3)**\n- Allows the Housing Authority to enter into agreements with Aboriginal corporations to manage rental housing on Aboriginal-owned land\n- Implements the National Partnership Agreement on Remote Indigenous Housing (a deal between the Commonwealth and State governments)\n- Lets the Authority handle leasing and tenancy matters on behalf of Aboriginal land owners\n- Clarifies that the Minister for Indigenous Affairs doesn't need to approve these arrangements\n\n**2. Home loan interest rates (Part 4)**\n- Sets rules for interest rates on loans to home buyers under a 1978 Commonwealth-State housing agreement\n- Interest rates must be between 6% and 1% below the long-term government bond rate\n- Rates increase gradually by 0.5% per year until reaching the maximum allowed\n\n**3. Fees for services (Part 5)**\n- Lists fees for legal document preparation (mortgages, transfers, caveats, etc.) — ranging from $40 to $245\n- Sets architectural fees as percentages of construction costs (6-8% depending on project type and size)\n- Charges $50 annual fees for strata and community title management services\n\n**4. Administrative procedures (Part 2)**\n- Specifies how the Housing Authority's official seal (Common Seal) must look and be used\n\n**Who it affects:**\n- Aboriginal corporations and communities in remote areas seeking housing management support\n- Home buyers receiving government-backed loans\n- People buying or selling property involving Housing Authority documentation\n- Property developers and architects using Authority services\n- Owners in strata and community title schemes managed by the Authority\n\n**Why it matters:**\nThese regulations enable the State to deliver on its commitments under national Indigenous housing agreements, ensure affordable home lending continues under legacy programs, and establish transparent fees for property-related services.
