109 Consent of Homes Victoria required to transfer interest in land
S. 109(1) amended by No. 40/2022 s. 39(8).
(1) A registered agency or former registered agency must not transfer, sell, lease, mortgage, charge or otherwise deal with land in which Homes Victoria has an interest under this Division unless Homes Victoria consents in writing to that transfer, sale, lease, mortgage, charge or other dealing.
(2) This section does not apply to—
S. 109(2)(a) amended by No. 45/2018 s. 375(2).
(a) a residential rental agreement under the **Residential Tenancies Act 1997**; or
(b) a dealing of a class declared by the Minister to be exempt.
(3) A declaration under this section must be published in the Government Gazette.
(4) A consent under subsection (1) must not be unreasonably withheld.
