107 Homes Victoria to have interest in certain registered agency land S. 107(1) amended by No. 40/2022 s. 39(2). (1) Homes Victoria is deemed to have an interest in all land of a registered agency that is declared by notice published in the Government Gazette to be land to which this section applies. S. 107(2) amended by No. 40/2022 s. 39(3)(a). (2) Homes Victoria may publish a notice under subsection (1) in relation to land of a rental housing agency that is a registered agency if— S. 107(2)(a) amended by No. 40/2022 s. 39(3)(b). (a) Homes Victoria and the rental housing agency have agreed in writing (before or after the agency is registered under this Part) that this section should apply to the land because the land has been purchased or developed with funds provided by Homes Victoria; or S. 107(2)(b) amended by No. 40/2022 s. 39(3)(b). (b) the land was transferred to the rental housing agency by Homes Victoria (before or after the agency was registered under this Part). S. 108 (Heading) amended by No. 40/2022 s. 39(4).
