What it does
This Act establishes a statutory scheme for two discrete but related housing grants in Tasmania: a Tasmanian HomeBuilder grant (Part 2) and a Commonwealth HomeBuilder grant (Part 3). It sets the amounts payable (s10; s15), defines the types of contracts and transactions that qualify (s5; s13; s18), prescribes applicant eligibility criteria (s12; s17), and sets application, payment and recovery processes (Pt 4; ss24, 45-47). Administration and decision-making power is vested in the Commissioner of State Revenue (s3, definition of Commissioner; s48), who decides eligibility, may impose conditions on payment and may require repayment where conditions or eligibility are not met (ss23, 26, 45). The Act also creates investigatory and enforcement powers for the Commissioner and authorised officers (Pt 5; ss36-39, 38), and attaches civil recovery mechanisms including a first charge on the applicant’s interest in the home (s46(3)) and the power to recover from third parties (s47).
Mechanically, the Tasmanian HomeBuilder grant is a fixed $20,000 payment (s10) payable where the Commissioner is satisfied that the applicant meets eligibility criteria (s11-13). The Commonwealth HomeBuilder grant amount is set by reference to the timing of the eligible transaction: $25,000 for contracts entered into before 1 January 2021, and $15,000 for contracts entered into on or after 1 January 2021 but before 1 April 2021 (s15(1)). The Commonwealth amount also becomes zero if the National Partnership on HomeBuilder ceases to be in force (s15(2)), linking state-level payment mechanics to an intergovernmental funding arrangement.
Applications must be made to the Commissioner in a form approved by the Commissioner, must include specified information and supporting verification, and must be lodged in the statutory window (s20). The Commissioner may pay grants before transaction completion where adequate protections are imposed (s23(2)), and may authorise payment in anticipation of residence obligations subject to repayment and notice requirements (s25). The Commissioner may impose conditions on grants (s26), may vary or reverse decisions within five years (s28(2)), and may require repayment and impose penalties where payments were made in error or based on false or misleading information (ss45-46). The Act provides a limited internal review and external appeal route: notice of objection to the Commissioner, internal reconsideration or delegation (ss30-31), and review by the Magistrates Court (Administrative Appeals Division) following objection (s32); judicial review is constrained by s33.
