sch.3-sec.2 Application to vehicle complying with inconsistent ADR requirement

A provision of this Schedule does not apply to a vehicle if the provision is inconsistent with a requirement of a second or third edition ADR that the vehicle complies with, regardless of whether or not the vehicle is required to comply with the requirement. However, subsection (1) does not apply if the vehicle is not of the same class or type as a vehicle to which the requirement of the second or third edition ADR applies. Also, to avoid doubt, this section does not apply to a requirement of a second or third edition ADR if, and to the extent, a provision of this Schedule expressly provides that the requirement does not apply to a stated vehicle, a vehicle of a stated type or in stated circumstances.
