An auditor may perform a function under section 39 in relation to a person only if the auditor produces to the Regulator, or other person in relation to whom the function is being performed, documentary proof of the decision of the responsible Ministers under section 39 . a letter outlining the decision endorsed by or on behalf of the responsible Ministers
