What it does
This Act creates a licensing and regulatory framework for private health service establishments in Tasmania: private hospitals, day-procedure centres and residential care services. It defines the classes of establishment and sets out who must hold a licence and when premises may be exempt (see s 3 definitions and s 5). It prescribes the lifecycle of a licence from application (s 9), approval in principle or refusal (s 10), duration and issue (ss 11-13), amendment and transfer (ss 19, 22), through to cancellation (ss 29-30). The Secretary of the Department administers the scheme (s 3, s 58) and is given a range of decision-making powers and discretions, including exemption powers (s 5(6)-(7)), conditions on approvals in principle (s 10(2)), and the power to require repairs and improvements (s 21).
Mechanically, the Act imposes operational duties on licensees: maintaining a director of nursing for hospitals and day-procedure centres (s 39), ensuring a registered nurse is on duty at all times unless exempt (s 41), keeping a register of patients in an approved form (s 42), making a copy of the Act and regulations available at the establishment (s 43), maintaining insurance approved by the Secretary (s 16(2)), and paying an annual licence fee by 31 December each year (s 18). The Act also enforces compliance through inspection powers (ss 46-47), infringement notices (s 55A), summary offences and specified penalties (multiple provisions), and the ability to cancel licences where statutory grounds are met (ss 29-30).
The Act states its objects as ensuring quality and safety of services at private health establishments and that those services meet Tasmanians’ needs consistent with Australian clinical practice guidelines (s 4). It creates an advisory body, the Health Service Establishments Advisory Committee, to advise the Secretary (ss 6-8, s 7 sets its functions). Regulations may prescribe licensing standards and may adopt external standards or codes by reference (s 56(2)-(4)). The Act also requires compliance, in relation to residential care, with relevant Commonwealth aged care legislation and standards where applicable (s 31).
