14A No access to health record relating to Children and
Young People Act complaint etc
A record keeper must not give access to a health record or part of a
health record under section 10 if—
(a) the record or part of a record relates to—
(i) a child concern report under the Children and Young
People Act 2008, section 353 as in force immediately
before the commencement of the Children and Young
People Amendment Act 2023, section 29; or
(ii) a voluntary report or a mandatory report under the Children
and Young People Act 2008, section 354 (2) or
section 356 (1) (e); or
(iii) a prenatal report under the Children and Young People
Act 2008, section 362; or
(iv) information that is care and protection report information
within the meaning of the Children and Young People
Act 2008, section 845 (2), definition of care and protection
report information, paragraph (b); or
(v) a report under the Children and Young People Act 1999,
section 158 or section 159; or
(vi) a notification under the Children’s Services Act 1986,
section 103; and
(b) either—
(i) the record or part of a record identifies the person who
made the report; or
(ii) the record keeper is satisfied that the record or part of the
record allows the identity of the person who made the
report to be worked out.
