Greenhouse and Energy Minimum Standards (Computer Monitors) Determination 2014

The Determination builds on a small set of interlocking concepts: covered product classes, normative standards, testing and labelling rules, model families, and transitional/registration effects. Each concept is operationalised by express text and by reference to Australian/New Zealand and international standards.

Covered product classes. The Determination sets out three product classes by objective metrics. Class 1 and Class 2 are monitors with diagonal screens less than 76 cm and distinguished by pixel resolution less than or equal to 1.1 megapixels (Class 1) or greater than 1.1 megapixels (Class 2). Class 3 covers diagonal sizes equal to or greater than 76 cm and up to 152 cm (s5(1) table). The scope is limited to monitors designed for 230-240 V mains connection; the definition is the Determination’s primary gatekeeper for coverage (s5(1)).

Exclusions. A detailed list of product types is expressly excluded from coverage (s5(2) table). Notable exclusions are: electronic displays used exclusively for digital signage or picture frames; advertising displays; high performance electronic displays meeting specified resolution, viewing angle, colour gamut and size thresholds; specialised professional displays (including EN 55103-classified professional products and IEC 60601 medical products); combined products where networking circuitry cannot be physically separated (examples include devices with integrated networking functionality and integrated PCs or tablets); public displays (criteria include screen size ≥81 cm or marketed for multi-user/public viewing); very large displays over 152 cm diagonal; and products marketed or classified as televisions (including those with integrated TV tuners or sold primarily as TVs) (s5(2) table, Column 2 and 3).

Normative standards. The Determination adopts specific standards as the technical reference. AS/NZS 5815.2:2013 supplies the MEPS and labelling framework; AS/NZS 5815.1:2012 supplies measurement methods. AS/NZS 4665.1:2005 (including specified amendments) is the reference for Mark III external power supplies used in testing when the monitor is not supplied with an external supply (s3 defined terms; s6(1)-(3); s7(2)-(3)). The Determination fixes the versions of the referenced standards to those that existed on the date of commencement (s3 notes; s4(2)).

Testing and labelling mechanics. Tests must be performed in accordance with AS/NZS 5815.1:2012 sections 2 and 3 (s6(2); s7(2)). Energy performance must meet the criteria in AS/NZS 5815.2:2013 section 2 (s6(1)). Labelling must comply with AS/NZS 5815.2:2013 sections 3 and 4, albeit with two express carve-outs that remove a permitted electronic label alternative and the specific wording that a label may be displayed electronically on the screen (s7(1)(a)-(b)). The instrument thereby imposes a narrowed labelling regime relative to the full standard text.

Families of models. Two or more models can be treated as a single family for registration when they share marketing category, energy performance characteristics and relevant physical characteristics, and are included on a single test report prepared prior to an application under s41 of the Act. Families are capped at ten models (s9(1)-(2)).

Administrative character. The Determination designates the products as category A products under the Act (s10) and states that existing registrations under the 2013 Determination are unaffected and are taken to be registered under this Determination (s11). It also clarifies that where a term is defined in a referenced standard it takes that meaning for purposes of this Determination, unless defined in the Act, Regulations, or this Determination (s4(1)).

Copyright and access. The Determination explicitly points users to Standards Australia for purchase of the referenced standards and includes copyright notes that limit free reproduction of Standards Australia material (opening COPYRIGHT section and s3 notes). The Determination itself is Commonwealth copyright material available under a Creative Commons licence subject to attribution and non‑commercial conditions.

The Determination affects market participants who manufacture, import, supply, test, label and sell the covered classes of computer monitors in Australia, plus testing laboratories, registrars and regulators engaged under the GEMS framework. The instrument refers repeatedly to testing and registration steps that fall primarily on suppliers and model registrants.

Suppliers and registrants. The primary practical obligation will sit with entities that supply computer monitors into the Australian market. The Determination covers commercially available computer monitors encased in a single housing that primarily display visual information from a computer, and that are designed to be connected to 230-240 V mains. That describes typical desktop monitors retailed to consumers and businesses, so manufacturers, importers, and distributors of those monitors are the core affected parties (see s3 definition of "computer monitor" and s5(1)). Entities applying for model registration under the Act will also be affected because s9(1)(d) requires inclusion on a single test report prepared prior to making an application for registration under section 41 of the Act.

Retailers. Retailers face obligations insofar as labelling and communication requirements apply to products on sale: the Determination adopts sections 3 and 4 of AS/NZS 5815.2:2013 for labelling, but excludes the electronic label alternative permitted by clause 4.2 and the phrase permitting labels to be displayed electronically on the monitor (s7(1)). That practical exclusion means retailers and showroom demonstrators cannot rely on the electronic label workaround in the referenced standard without regulator approval; they should expect physical label requirements unless regulator guidance indicates otherwise.

Testing laboratories and conformity assessment bodies. The Determination prescribes testing methods in AS/NZS 5815.1:2012 (s6(2); s7(2)) and requires specific handling of external power supplies during tests (s6(3); s7(3)). Accredited test laboratories will therefore be central to compliance, as families of models can be grouped only where models are included on a single test report (s9(1)(d)). Laboratories will be required to use the versions of referenced standards frozen as at commencement (s4(2)).

Suppliers of external power supplies. Where monitors are supplied without an external power supply, the Determination requires tests be conducted with an external power supply having a Mark III energy performance mark in accordance with AS/NZS 4665.1:2005 (s6(3)(b); s7(3)(b)). Suppliers of external PSUs or those providing PSUs for testing will need to ensure the correct Mark III unit is available.

Excluded suppliers and niche markets. A range of suppliers are not affected because their products fall into the listed exclusions in s5(2): firms making digital signage, advertising displays, high‑performance professional displays meeting the specified objective thresholds, specialised medical or professional displays, combined products with inseparable networking functionality, large public displays, very large displays (>152 cm) or products marketed as televisions will not be subject to the Determination’s MEPS and labelling requirements. That carve‑out channels regulatory attention to consumer/desktop monitor markets rather than professional or multi‑function devices.

Regulators and administrators. The Determination interacts with the Act’s registration and enforcement machinery and therefore directly affects regulators and administrators implementing the GEMS regime. The instrument references regulator approval in the excluded labelling text from AS/NZS 5815.2:2013 (s7(1)(a) note), signalling an ongoing role for regulator discretion with respect to label formats.

Consumers and purchasers. Consumers are affected indirectly via the Determination’s impact on product availability, labelling, and possibly price. The Determination prescribes energy performance and labelling, which affects information available at point of sale (s6(1); s7(1)). Consumers purchasing excluded product categories, such as televisions or specialised medical displays, are unaffected by this Determination.

Finally, standards bodies and copyright holders are tangentially affected because the Determination requires use of specified versions of copyrighted standards which are available for purchase from Standards Australia (s3 notes; opening COPYRIGHT section).

This section sets out the principal obligations that the Determination imposes and the key rights it recognises or preserves. All operative duties and rights in the Determination are expressed by reference to definitions, test and labelling requirements, registration mechanics, and the treatment of families of models.

Duties to meet GEMS levels. Suppliers of covered computer monitors must ensure that products meet the energy use requirements specified in section 2 of AS/NZS 5815.2:2013. The Determination adopts those requirements as its GEMS level standard (s6(1)). Conformance entails applying the measurement methods in AS/NZS 5815.1:2012 (s6(2)), and where an external power supply can be disconnected, testing with the supplied external power supply or a Mark III external power supply if none is supplied (s6(3)(a)-(b)).

Testing duties. The Determination requires tests to be conducted in accordance with sections 2 and 3 of AS/NZS 5815.1:2012 (s6(2); s7(2)). For labelling, the same testing requirements apply (s7(2)). A supplier or registrant that intends to rely on a family of models for registration must have the models included on a single test report prepared before applying for registration under section 41 of the Act (s9(1)(d)). Hence, there is a duty to commission and retain compliant test reports produced under the specified standard versions.

Labelling and communication duties. Labelling requirements are those in sections 3 and 4 of AS/NZS 5815.2:2013; however, the Determination excludes (a) the option in clause 4.2 of the standard allowing an electronic label as an alternative to a physical label and (b) the words in clause 4.3(b) that permit “Displayed electronically on the computer monitor screen” (s7(1)(a)-(b)). The effect is that the Determination imposes the standard’s labelling requirements but narrows permissible formats unless regulator approval applies to the excluded electronic alternatives. Entities that supply covered monitors must therefore ensure the physical label and communication requirements of the standard are met in line with the Determination.

Family of models rules. Registrants may group models into a family where the models meet four criteria: same marketed category/class; same energy performance characteristics; identical physical characteristics relevant to compliance with sections 6 and 7; and all included on a single test report prepared prior to registration application under s41 of the Act (s9(1)(a)-(d)). A family may have at most 10 models (s9(2)). The duty here is procedural and evidentiary: ensure accurate classification and maintain the single test report and other documentation to support the family assertion.

Rights preserved. The Determination explicitly preserves existing registrations made under the 2013 Determination: models registered under the 2013 Determination are taken to be registered under this Determination (s11). That provision is a transitional right for registrants, avoiding immediate re‑registration requirements.

Administrative and interpretative rights. The Determination gives effect to definitions in referenced standards where terms are not defined in the Act, the Regulations, or the Determination itself (s4(1)). This is both a rule of interpretation and a practical right for executors of the Determination to apply standardised technical meanings.

Copyright and access considerations. The Determination includes copyright notes that restrict free reproduction of Standards Australia materials, and points users to Standards Australia and SAI Global for permissions and copies (opening COPYRIGHT text and s3 notes). Those notes operate as rights and obligations around access to normative materials: parties must obtain the standards through the usual purchase channels or permissions if they intend to reproduce standard content.

Absence of penalty provisions in the Determination. The instrument itself does not set penalties. Enforcement, penalties, and other compliance mechanisms operate under the Act. The Determination therefore creates substantive and procedural obligations but relies on the Act for enforcement modalities (see the Act references in the instrument; the Determination makes no penalty provisions itself).

The Determination contains no express penalty clauses or enforcement provisions. It establishes substantive requirements (energy performance levels, testing methods, labelling requirements, model family rules and category designation), and it relies on the Greenhouse and Energy Minimum Standards Act 2012 for the enforcement framework. The text of the Determination refers repeatedly to the Act (for example, the header identifies the instrument as made under s23 of the Act and several notes refer to definitions and registration provisions in the Act) but does not itself articulate infringement consequences (s1 preamble; s3 notes; s9(1)(d); s11).

Regulatory enforcement thus flows from the Act’s general GEMS enforcement machinery rather than from this Determination. The Determination designates products as category A (s10), which is an administrative categorisation under the Act and may have implications for registration and enforcement procedures set out in the Act and its Regulations. The Determination also refers to registration under section 41 of the Act as the procedural step in the family-of-models rule (s9(1)(d)), indicating that registration is a necessary administrative act and that compliance verification can be tied to registration records. The Determination does not, however, specify which administrative actions or civil or criminal penalties may follow non‑compliance , those are matters addressed in the Act and related regulations, not in this instrument.

Regulatory discretion and approval. The labelling carve‑outs reference regulator approval in the excluded clause of the standard (s7(1)(a) note). Specifically, the Determination excludes the electronic label alternative that in the standard is subject to approval by “the relevant regulator.” This signals that a regulator retains discretionary approval authority over label formats, but the Determination itself does not set the approval criteria or procedures.

Practical enforcement levers. In practice, enforcement under the Act typically involves compliance notices, infringement penalties, injunctions, removal from the market, and financial penalties administered by the regulator, but those mechanisms are not specified here. The Determination’s role is to define the technical and labelling obligations that, if breached, would engage the Act’s enforcement powers. The Determination expressly preserves registrations from the prior 2013 Determination (s11), which reduces immediate enforcement friction on previously registered models.

Evidentiary and administrative enforcement inputs. The Determination requires test reports prepared under particular standards and specifies that models included on a single test report may be treated as a family (s9(1)(d)). The single test report is thus an evidentiary artefact that regulators can request or audit; failure to produce compliant test documentation will be a straightforward ground to find non‑compliance under the regime established by the Act.

In summary, the Determination sets out what is required; it references the Act for how failures to comply are addressed. The Determination itself leaves penalties, enforcement procedures, and regulator powers to the Act and associated regulatory instruments.

The Determination is an instrument made under the Greenhouse and Energy Minimum Standards Act 2012 and explicitly ties its interpretative and administrative contours to that Act and to other regulatory texts and standards. Key interactions are with the Act, with the Regulations to the Act (as referenced in s4(1)), with the Legislative Instruments Act 2003 (via interpretive notes), and with the normative standards incorporated by reference.

Interaction with the Greenhouse and Energy Minimum Standards Act 2012. The Determination is made under s23 of the Act (instrument preamble). Multiple notes in the Determination instruct that expressions and administrative concepts used in the Determination have the same meaning as in the Act (s3 Note: pursuant to paragraph 13(1)(b) of the Legislative Instruments Act 2003, expressions used in this determination have the same meaning as in the Act). The Determination refers to registration under section 41 of the Act when setting out the family of models rule (s9(1)(d)). The designation of covered products as category A products (s10) is a designation within the Act’s classification scheme. Enforcement and penalty structures are not included in the Determination and must therefore be sought in the Act and its Regulations.

Interaction with the Regulations. The Determination instructs that if a term is not defined in the Act, the Regulations to the Act, or the Determination, but that term is defined in a referenced standard, the term should be read as having the meaning given in the standard (s4(1)). That clause positions the Regulations as the second level of definition after the Act and the Determination itself.

Interaction with the Legislative Instruments Act 2003. The Determination cites paragraph 13(1)(b) of the Legislative Instruments Act 2003 in a Note to s3, stating that expressions used in the Determination have the same meaning as in the Act (s3 Note). This indicates an awareness of the interpretative rules that govern instrument drafting and ties the Determination’s meanings back to statutory definitions specified in the Act.

Interaction with external standards and their legal status. The Determination incorporates technical standards by reference and fixes their operative versions as the versions that existed on the date the Determination came into force (s3 notes; s4(2)). The incorporated standards include AS/NZS 5815.1:2012, AS/NZS 5815.2:2013, AS/NZS 4665.1:2005 (with specified amendments), EN 55103‑1:2009 and IEC 60601‑1:2005 (with specified amendments) (s3). The Determination explicitly says that where a term or phrase is defined in a standard specifically mentioned in s3, that definition applies for the Determination’s purposes unless defined in the Act, Regulations or the Determination (s4(1)). This allocates definitional authority to standards where statutory or instrumentary definitions are silent.

Copyright law and access to standards. The Determination acknowledges copyright constraints in the included standards and directs users to Standards Australia for purchase and to SAI Global for reproduction enquiries (opening COPYRIGHT section and s3 notes). That means compliance obligations implicate intellectual property regimes: to obtain the authoritative technical methods suppliers will likely need to purchase the standards or otherwise obtain licences for reproduction.

Relationship to other GEMS instruments. The Determination revokes and replaces the 2013 Determination (s2(2)), but explicitly maintains existing registrations: models registered under the 2013 Determination are taken to be registered under this Determination (s11). That manages the transition between instruments and avoids duplication of registration requirements for already registered models. It also situates the instrument within the broader family of GEMS determinations that collectively specify MEPS for different product classes.

Administrative law and regulator approvals. The Determination excludes certain phrases from the labelling standard that condition electronic labelling on regulator approval (s7(1)(a) note). The exclusion preserves the concept of regulator approval in the standard, but places the Determination’s default position against the automatic acceptance of electronic labels. The regulator’s approval powers and procedural obligations will be set out under the Act and regulations rather than in this Determination.

In short, the Determination is an instrument that operationalises product standards under the architecture of the GEMS Act, interacts with regulations for definitions, incorporates contemporary versions of technical standards, and is constrained by copyright obligations around those standards.

The Determination contains several discrete amendment and transitional references. It is itself a replacement instrument and embeds within it references to specific versions of standards and to the previous Determination. Those features form the visible amendment history in the text.

Revocation and replacement. The instrument expressly revokes and replaces the Greenhouse and Energy Minimum Standards (Computer Monitors) Determination 2013 (F2013L00733) (s2(2)). The revocation means that the 2014 Determination supersedes the 2013 instrument as the operative GEMS Determination for covered computer monitors.

Commencement. The Determination comes into force on the day after it is registered (s2(1)). That is the standard commencement mechanism for legislative instruments and sets the operative date for the versions of standards frozen by the Determination.

Standards versioning and incorporated amendments. The Determination is explicit about which versions of referenced standards apply. For AS/NZS 4665.1:2005 it states that AS/NZS 4665.1:2005 includes all amendments up to and including AS/NZS 4665.1:2005/Amdt 1:2009 made on 27 February 2009 (s3 definition of AS/NZS 4665.1:2005; Note 2). For AS/NZS 5815.2:2013 it states that the standard includes all amendments up to and including AS/NZS 5815.2:2013/Amdt 1:2014 made on 23 January 2014 (s3 definition of AS/NZS 5815.2:2013; Note 2). For IEC 60601‑1:2005 it includes amendments up to and including IEC 60601‑1:2005/Amdt 1:2012 made on 13 July 2012 (s3). AS/NZS 5815.1:2012 is specified as it existed on the Determination date (s3). The Determination ties the operative normative references to those precise snapshots, thereby locking in the technical requirements as at commencement.

Transitional registration treatment. Section 11 states that this Determination does not affect the registration of any model registered against the 2013 Determination and confirms that models already registered are taken to be registered against this Determination (s11). That transitional clause removes the need for immediate re‑registration of previously registered models and is an explicit transitional amendment provision.

Family of models cap. Section 9 introduces a specific limitation not only on the criteria for grouping models into a family but also on the maximum size of a family: a model cannot belong to a family if its inclusion would lead to more than 10 models in that family (s9(2)). That numerical cap is a discrete administrative rule introduced by the Determination.

Labelling carve‑outs. The Determination modifies the labelling regime by adopting sections 3 and 4 of AS/NZS 5815.2:2013 but excluding specific text that permits electronic labels and labels displayed electronically on-screen (s7(1)(a)-(b)). The exclusions amount to targeted amendments to how the standard’s labelling options apply in Australia under this Determination, effectively removing certain alternatives that the standard would otherwise allow.

No amendments recorded within the Determination itself. The instrument contains no schedule of subsequent amendments to itself. The Determination’s textual amendments are its revocation of the prior instrument, adoption and freezing of specific standard versions, the family of models cap, transitional registration clause, and the labelling exclusions. Any later changes would appear in subsequent legislative instruments or in amendments to the Act and Regulations, which are outside the text of this Determination.

Availability and copyright. The Determination’s opening section places limits on reproduction of Standards Australia material and directs users to the appropriate bodies for permissions (opening COPYRIGHT). That is not a legal amendment to the standards but a caution about intellectual property which affects how market participants obtain and rely on the referenced documents.

Overall, the Determination is an updated, version‑specific instrument replacing the 2013 Determination, with transitional preservation of prior registrations and express choices about the versions of standards that remain applicable.

The Determination itself contains no references to litigation or legal proceedings and cites no judicial decisions. The instrument is an administrative legislative instrument that implements technical requirements and contains no annexed case law. The text offers no schedule or appendix summarising litigation or judicial interpretation of its provisions (the instrument makes no mention of cases).

Because the Determination is an exercise of statutory power under section 23 of the Greenhouse and Energy Minimum Standards Act 2012 (instrument preamble), any legal challenges to regulatory decisions arising under the Determination would be brought under the applicable administrative and judicial review regimes set out in general law and the Act. The Determination, however, does not itself set out judicial review pathways, any prior litigation, or any administrative determinations that have been judicially tested. It does preserve existing registrations made under the 2013 Determination (s11), which reduces immediate scope for transition litigation over re‑registration for those already registered models.

Where a party disputes a regulator’s decision about compliance, registration, or labelling under the GEMS framework, the Act and the Regulations , not this Determination text , will identify the legal and administrative routes for review or appeal. The Determination references registration under section 41 of the Act for family‑of‑models purposes (s9(1)(d)), implying that disputes about registration eligibility are questions that would engage the Act’s procedural provisions.

The Determination’s references to standards and to the versions of standards fixed at commencement (s3 notes; s4(2)) may create boundary issues in disputes about whether a particular test method or measurement applies. Any litigation about technical interpretation would usually require expert evidence about the correct reading and application of the referenced standards as frozen in the Determination; but again, the Determination contains no litigated authority or examples.

Finally, the instrument’s exclusion of certain labelling alternatives in AS/NZS 5815.2:2013 (s7(1)(a)-(b)) leaves open the possibility of administrative disagreement where a supplier believes an electronic label approach should be allowed. The Determination’s language, however, excludes those specific options unless regulator approval is obtained under the standard’s prior wording, which the Determination has removed from automatic effect. Any dispute about regulator refusal to approve an electronic label would be addressed through the Act’s administrative review mechanisms; the Determination itself gives no guidance on litigation outcomes.

In short, there is no litigation history recorded in the Determination; any litigation or judicial interpretation will arise from application of the Act and would need to be examined in the Act’s legal corpus rather than in this instrument’s text.

The Determination contains multiple practical traps for supply chains and compliance officers that arise from how it defines scope, references standards, and narrows labelling alternatives. Below are concrete items that merit attention.

Scope ambiguity due to market descriptions. Several exclusions are framed by marketing and intended use, not strictly by technical capability. For example, products “marketed as” televisions, or “marketed as intended to be viewed by more than one user at a time,” and products “not intended for sale to the general public” are excluded (s5(2) Column 2). That raises questions: who determines marketing intent, how is marketing evidence weighed, and how will borderline products be classified at import or at point of sale? These are enterprise‑facing classification risks that registrants must address with documentary evidence.

Combined products and inseparable networking functionality. The exclusion for combined products removes devices with built‑in or integrated networking functionality “the circuitry for which cannot be physically separated or switched independently from the electronic display component” (s5(2) item 5 Column 3). Devices with integrated Wi‑Fi, Bluetooth, or embedded compute capability that cannot be physically disconnected may therefore be excluded. Conversely, monitors with detachable compute modules may remain covered. The key is functional and physical separability; suppliers must document component separability and switching independence for borderline products.

High‑performance display thresholds are technical and cumulative. The high performance exclusion requires meeting all listed elements: IPS/VA technology, pixel resolution ≥2.3 megapixels, viewing angle ≥178 degrees at minimum contrast 1:10, colour gamut ≥72% of NTSC, and diagonal ≥61 cm (s5(2) item 3). Failure to satisfy any single element means the product stays in scope. Suppliers must therefore substantiate each threshold with test data; partial satisfaction will not trigger exclusion.

Testing external power supplies. When a monitor is not supplied with an external PSU, the Determination requires testing with an external PSU that has a Mark III energy performance mark per AS/NZS 4665.1:2005 (s6(3)(b); s7(3)(b)). Procuring a compliant Mark III supply for testing is a necessity. If testing is performed with an alternative PSU or using a different power configuration, the tests may be non‑compliant.

Labelling alternatives removed. The Determination excludes clause 4.2 and certain words in clause 4.3(b) of AS/NZS 5815.2:2013 that permit electronic labels as an alternative to a physical label and labels displayed electronically on the monitor (s7(1)(a)-(b)). Practically, this means the electronic label workaround is not available by default in Australia unless regulator approval is obtained under the previously permissive standard language. Retailers that assumed electronic on‑screen labels were acceptable will need to adopt physical labels or secure explicit regulatory approval.

Versions of standards are frozen. The Determination fixes the versions of referenced standards as they existed on the date the Determination came into force (s3 notes; s4(2)). Suppliers must ensure tests are run to those exact standard versions and not to later or earlier amendments. This can create friction where an international manufacturer’s conformity programme uses updated test procedures.

Family of models cap. A family cannot include more than ten models (s9(2)). Suppliers using family grouping to reduce testing costs must structure their model families to avoid exceeding this cap. Attempting to include an eleventh model in a family will invalidate the family claim for that model and may expose the supplier to re‑testing and re‑registration costs.

Registration timing and test report sequencing. A family of models requires inclusion on “a single test report which was prepared prior to the application for registration for the model being made under section 41 of the Act” (s9(1)(d)). The timing requirement is strict: prepare the test report before applying. Retrospective inclusion or use of test reports produced after the registration application will not satisfy the rule.

Copyright and cost of standards. The Determination requires application of standards that are typically not freely reproducible and must be purchased from Standards Australia (s3 notes; opening COPYRIGHT). Compliance teams should budget for standards procurement and legal clearance for any reproduction or communication of standard content.

Transitional registrations. The Determination preserves registrations under the previous 2013 Determination (s11). However, registrants cannot assume that preservation equates to exemption from compliance with the updated testing and labelling requirements: the preserved registration means the model is taken to be registered under this Determination but compliance with the substantive requirements remains mandatory.

Category A designation. The products are designated as category A products (s10). While the Determination does not itself describe the administrative consequences of that categorisation, registrants should verify any procedural impacts in the Act and Regulations.

In sum, the main gotchas are classification ambiguity, the need for exact‑version testing and specific external PSUs for testing, the removal of electronic label options, the family‑size cap, and costs/administrative steps around standards procurement and test reporting.

This section sets out a practical checklist and sequence for businesses to comply, grounded in the Determination’s text and the standards it requires.

Step 1 , Scope analysis and classification. For each product model intended for supply in Australia, determine whether it is a “computer monitor” as defined (single housing, primary function displays visual information from a computer, designed for 230-240 V mains) (s3; s5(1)). Measure diagonal screen size and native resolution to determine Class 1, 2 or 3 membership (s5(1) table). Check the exclusions list in s5(2) carefully: if the product is marketed as a television, intended primarily for public or advertising display, is a combined product with inseparable networking circuitry, or otherwise meets one of the exclusion criteria, it is not covered and GEMS obligations in this Determination will not apply to it.

Step 2 , Obtain the exact standards. Purchase or otherwise acquire AS/NZS 5815.1:2012, AS/NZS 5815.2:2013 (including the 2014 amendment cited), and AS/NZS 4665.1:2005 with the amendments noted in the Determination (s3 notes). The Determination freezes the versions that apply (s4(2)), so tests and labelling must follow those exact texts. Budget for the cost and licensing constraints described in the Determination’s COPYRIGHT text.

Step 3 , Testing plan and external PSU handling. Engage an accredited test laboratory to conduct the tests specified in sections 2 and 3 of AS/NZS 5815.1:2012 (s6(2); s7(2)). If the monitor is supplied with an external PSU, testing must be carried out with that PSU. If it is not supplied with an external PSU, tests must be conducted with an external PSU that has a Mark III energy performance mark in accordance with AS/NZS 4665.1:2005 (s6(3)(a)-(b); s7(3)(a)-(b)). Verify that the test lab uses the correct standard versions and that the test report is prepared prior to any registration application under section 41 of the Act if you intend to claim family‑of‑models status (s9(1)(d)).

Step 4 , Verify energy performance. Ensure the model meets the energy use requirements in section 2 of AS/NZS 5815.2:2013 (s6(1)). Use the test laboratory’s measurements as evidentiary support. If a model fails the MEPS criteria, remedial product redesign or withdrawal from the Australian market will be necessary.

Step 5 , Labelling compliance. Prepare physical labels and communications in accordance with sections 3 and 4 of AS/NZS 5815.2:2013, noting that the Determination excludes the electronic label alternative and on‑screen wording that could otherwise have permitted an electronic label (s7(1)(a)-(b)). Do not rely on electronic on‑screen labels unless you obtain explicit regulator approval under the Act or related regulatory processes.

Step 6 , Family of models strategy. If you plan to group multiple models as a family, ensure they meet the four criteria set out in s9(1): same marketed category/class; identical energy performance characteristics; identical physical characteristics relevant to compliance; and inclusion on a single test report prepared before applying for registration under s41 of the Act (s9(1)(a)-(d)). Ensure the family contains no more than 10 models (s9(2)). Keep the single test report and supporting documentation with dates to evidence the prior preparation.

Step 7 , Registration. Apply for registration as required under the Act. The Determination references section 41 of the Act for registration sequencing in the family context (s9(1)(d)). If your model was already registered under the 2013 Determination, the Determination takes that registration to be a registration under this Determination (s11), but you should verify that your registration records are complete and that test reports and labelling documentation are available for audit.

Step 8 , Record keeping and documentation. Maintain test reports, labelling proofs, evidence of the external PSU used for testing, and all marketing materials that substantiate your product’s classification (important where exclusions are defined by marketing or intended use) (s5(2)). Keep standards purchase receipts or licence evidence to show you applied the correct standard versions (s3 notes; s4(2)).

Step 9 , Regulatory engagement. If you wish to use an electronic label or an alternative label format, note that the Determination has excluded the standard’s automatic allowance for electronic labels (s7(1)(a)-(b)). Contact the relevant regulator to seek approval, and obtain that approval in writing before relying on electronic labelling approaches. Also check the regulator’s guidance on testing laboratories and accepted test reports.

Step 10 , Market monitoring and updates. Although the Determination fixes standard versions at commencement (s4(2)), stay aware of subsequent legislative instruments and any Act or Regulation amendments that may change registration, enforcement, or administrative procedures. The Determination itself does not notify future amendment events; monitor the Federal Register of Legislative Instruments (the Determination’s note points to FRLI) and regulator communications for changes (end Note).

Practical compliance checklist summary:

• Confirm product scope (s3; s5(1)-(2)).
