62E Closure of Account

(1) Section 19(4) of the Financial Management Act 1994 does not apply to the Great Ocean Road Coast and Parks Account.

(2) the Great Ocean Road Coast and Parks Account may only be closed by an amendment to this Act.

Division 5—Transfer of staff from Parks Victoria

62EA Transfer of staff from Parks Victoria

(1) Parks Victoria may transfer an employee of Parks Victoria to duties in the Authority, subject to the approval in writing of—

(a) the Authority; and

(b) the Minister; and

(2) A transfer under subsection (1)—

(a) must be on terms and conditions of employment that are no less favourable overall; and

(b) may be permanent or for a fixed term; and

(3) The service of a transferred employee with the Authority is taken to be continuous with the service of the employee as an employee of Parks Victoria immediately before the transfer.

(4) A transferred employee has an entitlement to benefits in connection with their employment by the Authority that is the same as the entitlement to benefits the employee accrued in connection with their employment by Parks Victoria.

(5) Nothing in this section prevents—

(a) any of the terms and conditions of employment of a transferred employee from being altered by or under any law, award or agreement with effect on or after the day on which their employment is transferred; or

(b) a transferred employee from resigning or being dismissed on or after the day on which their employment is transferred in accordance with the terms and conditions of their employment with the Authority.

(6) In this section—

transferred employee means an employee transferred under subsection (1) from Parks Victoria to duties in the Authority.
