What it does
Mechanically, the instrument is a local environmental plan (LEP) titled Georges River Local Environmental Plan 2021 that, on commencement, replaces the prior local environmental plans applying to the area and sets the zoning, land-use permissions, development standards and a number of site‑specific and local controls for land within the Georges River local government area (cl 1.1; cl 1.3; cl 1.8). The Plan takes effect on publication on the NSW legislation website (cl 1.1AA) and relies on a set of maps (Land Application Map, Land Zoning Map, Lot Size Map, Height of Buildings Map, Floor Space Ratio Map and others) to identify where zones, controls and site‑specific provisions apply (cl 1.3; cl 1.7).
Substantively the Plan sets out:
- the zoning framework and objectives for each zone, and the Land Use Table specifying what is permitted without consent, permitted with consent and prohibited in each zone (Part 2, cl 2.1-2.3 and the Land Use Table);
- the principal development standards such as minimum lot sizes for subdivision and particular residential types, height limits and floor space ratios, and rules for calculating site area and floor space (Part 4, cl 4.1, 4.1A, 4.1B, 4.3-4.5, 4.6);
- local provisions and mandatory processes for environmental and heritage matters, flood and coastal hazard planning, stormwater, riparian land, acid sulfate soils and public bushland (Part 5 and Part 6, cl 5.10, 5.19, 5.21-5.23; cl 6.1-6.6, 6.12);
- procedural and practical directions for exempt and complying development, including the stated exclusions for environmentally sensitive areas (Part 3, cl 3.1-3.3 and Schedule 2-3 references);
- site‑specific additional permitted uses and local exceptions collected in Schedule 1 (Schedule 1) and a comprehensive local heritage inventory and heritage conservation areas recorded in Schedule 5 (Schedule 5).
