In this Part, the Gas Pipelines Act 2000 is referred to as the Principal Act.

The amendments effected by this section have been incorporated into the authorised version of the Gas Pipelines Act 2000 .

30. Section 3 amended (Interpretation)
Section 3 of the Principal Act is amended by inserting after subsection (3) the following subsections:
(4) Where –
(a) an order under subsection (3) would have the effect that a supply pipeline is to be treated as a transmission pipeline for the purposes of this Act; and
(b) there is in force an exclusive franchise under section 30 of the Gas Act 2000 in respect of the area in which the supply pipeline is situated –
the Governor is not to make the order unless the person to whom the exclusive franchise has been granted consents to the order.
(5) The consent of a person to whom an exclusive franchise has been granted under section 30 of the Gas Act 2000 is only required under subsection (4) during the period of that exclusive franchise.
