What it does
The Gas Legislation (Miscellaneous Amendments) Act 2001 is a short amending statute that makes two types of changes to the Gas Act 2000 and the Gas Pipelines Act 2000. First, it introduces a substantive new constraint on the Governor’s power to reclassify a supply pipeline as a transmission pipeline under section 3 of the Gas Pipelines Act 2000. Second, it performs a mechanical terminology substitution, replacing the word “validated” with “certified” and “validation” with “certification” throughout both principal Acts. The source text indicates that the overwhelming majority of the amendments effected by Part 2 (sections 3 to 27, amending the Gas Act 2000) and most of Part 3 (sections 28 to 34, amending the Gas Pipelines Act 2000) have already been incorporated into the authorised versions of those Acts. The substantive new provision is contained in section 30, which inserts new subsections (4) and (5) into section 3 of the Gas Pipelines Act 2000. That section is uncommenced; section 2(1) states that section 30 commences on a day to be proclaimed, while the remaining provisions commence on Royal Assent. The new subsection (4) provides that where a Governor’s order under subsection (3) would have the effect of treating a supply pipeline as a transmission pipeline, and there is in force an exclusive franchise under section 30 of the Gas Act 2000 in respect of the area in which the supply pipeline is situated, the Governor is not to make the order unless the person to whom the exclusive franchise has been granted consents to the order. Subsection (5) limits that consent requirement to the duration of the exclusive franchise. The two schedules at the end effect the terminology changes: Schedule 1 substitutes “certified” for “validated” in both Acts; Schedule 2 substitutes “certification” for “validation” in both Acts. The Act therefore operates as a narrow adjustment to regulatory classification powers and a clean-up of language, rather than a fundamental restructuring of gas industry regulation. It leaves the core licensing, access, and safety regimes of the principal Acts untouched.
