#### 112 Illegal advantage with respect to authorised CMS 112 Illegal advantage with respect to authorised CMS > > (1) A person must not, during the design, manufacture, assembly, installation, maintenance or repair of an authorised CMS, dishonestly make provision to gain an advantage (whether or not for another person) in the operation of the CMS. > > > (2) A person who, as a result of gross negligence during the design, manufacture, assembly, installation, maintenance or repair of an authorised CMS, makes provision to gain an advantage (whether or not for another person) in the operation of the CMS is guilty of an offence. > > > (3) A person must not do anything to an authorised CMS in order to conceal anything that is an offence under subclause (1) or (2). > > > (4) A person must not authorise or permit another person to act in a way that is an offence under another provision of this clause. > > Maximum penalty—50 penalty units.
