What it does
These regulations set a formula and a governance framework for allocating money from the Community Support Fund established under the Gaming Control Act 1993. They specify a mandated allocation of 25% of the community support levy payable under section 151 of the Act to the Departmental division identified as Sport and Recreation (or, if that division ceases, to another division the Minister selects whose primary purpose is support of community sport and recreation clubs) (regulation 4(1)). The Department is the operational distributor of that 25 per cent share (regulation 4(1)). The regulations also create a discrete, Minister‑controlled approval process for discretionary distributions from the Fund to State Service Agencies for a defined range of purposes related to gambling harm prevention, direct support services, research, community capacity building and community sport and recreation (regulations 5 and 6). Any discretionary distribution under that process must meet one or more specified criteria (regulation 7) and requires that the Commission advise the Department that, in the Commission’s opinion, the proposed distribution would be consistent with the regulations (regulation 6(2)(c)).
The Minister may attach terms and conditions to any approval, and those terms may include requirements that the Department impose conditions on distributions requiring that all or part of the money be provided to particular organisations (regulation 6(4)-(6)). The Minister may issue written guidelines to State Service Agencies about administration and management of distributed money; compliance with those guidelines is a condition of any distribution (regulation 8(1)-(2)). The Minister must cause a review of the efficacy of Fund distributions every five years and publish the findings; review costs may be paid from the Fund only with Minister approval (regulation 9). The regulations commenced 1 July 2023 (regulation 2), were notified in the Gazette on 5 April 2023, are administered in the Department of Treasury and Finance, and are set to expire on 1 July 2029 (regulation 10 and final notices).
