Future Made in Australia (Guarantee of Origin Charges) Act 2024

The Act’s operative concepts are primarily defined by cross-reference to the Future Made in Australia (Guarantee of Origin) Act 2024. The short list in this Act shows the legislative architecture is split: the primary scheme and definitions sit in the Guarantee of Origin Act, while this Act establishes charges for participation in that scheme.

Definitions and cross-references:

• The Act does not define the substantive types , such as “production profile”, “delivery profile”, “consumption profile”, “registered profile”, “registered renewable electricity facility”, “accredited power station”, “aggregated system” and similar , within its own text. Instead, each of those expressions “has the same meaning as in the Future Made in Australia (Guarantee of Origin) Act 2024” (s 8). Practically, that means the scope of who or what is captured by the charges is determined by the definitions and registration rules in the Guarantee of Origin Act, not by this charging Act.
• “Charge” in this Act functions as a statutory liability attached to registration status for a financial year; the Act does not use language of licence fees, taxes, levies or duties beyond the constitutional limits in ss 6-7. Each charge is imposed by specific subsections (ss 9-15) tied to registration status “at any time during the financial year” (for financial years ending on or after commencement).

Regulatory delegation and permitted forms of charge:

• The Act contemplates multiple regulatory forms for setting amounts. The regulations may prescribe a flat specified amount, a method for calculating the charge, different amounts or methods for different circumstances, and even a nil amount (s 16(1)). The Act expressly preserves the capability to differentiate treatment between classes or circumstances.
• Section 16(1) cites subsection 33(3A) of the Acts Interpretation Act 1901 (without limiting it), signalling that normal interpretative rules for regulatory prescription of monetary amounts apply.

Limits and constitutional guardrails:

• The Act includes express limitations directed at constitutional problems. Section 6 provides the Act does not impose a tax on property of a State, adopting the meaning of “property of any kind belonging to a State” as in s 114 of the Constitution (s 6(2)). Section 7 provides that the Act imposes charges only to the extent the charge is neither a duty of customs nor a duty of excise within the meaning of s 55 of the Constitution. These clauses model a statutory attempt to confine the measures within constitutional boundaries.

Timing and application:

• Liability arises if the registration exists “at any time during the financial year” (ss 9(1), 10(1), 11(1), 12(1), 13(1), 14(1), 15(1)). The Act’s focus on “financial year” as the unit of liability, combined with “at any time during,” creates a bright-line temporal trigger for charge exposure; the Act does not set prorating rules in itself.

Delegation of discretion:

• The Governor‑General makes the regulations; the Minister must be satisfied that the regulations’ effect will recover no more than the Commonwealth’s likely administrative costs (s 16(2)). The regulations may also create exemptions (s 17) and must be made under the general regulations power (s 18). Practically, the amount of discretion , including who benefits from exemptions, how amounts are calculated, whether charges will be nil in some circumstances , rests primarily with the executive through the regulation-making process, constrained by the Minister’s pre-condition on cost recovery and the constitutional limits set out in ss 6-7.

Scope of reach:

• The Act extends to external Territories (s 4) and to acts, omissions and matters outside Australia (s 5). The combination of these extensions with the definition cross-references to the Guarantee of Origin Act will influence which overseas or Territory-connected actors are captured, but the Act itself leaves the operational reach to those definitions and to regulations.

In short, the Act’s main concepts are: registration-linked charge liabilities for defined profiles and facility types as defined in the Guarantee of Origin Act; regulatory prescription of amount or calculation method (including nil); Ministerial pre-condition linking regulation-making to recovery of likely Commonwealth administrative costs; and a series of constitutional and jurisdictional limits and extensions. The substantive perimeter of those concepts depends on the definitions and registration mechanics in the Guarantee of Origin Act.

Direct payers

• Registered profile holders: Any entity or person whose production profile, delivery profile or consumption profile is a “registered profile” under the Guarantee of Origin Act will be subject to a statutory charge for a given financial year if the profile is registered at any time during that financial year (ss 9(1), 10(1), 11(1)). The Act imposes the liability on the profile itself, which in legal and practical terms will attach to whoever is the registrant under the registration regime established in the Guarantee of Origin Act.
• Registered renewable electricity facilities: Entities that own or operate facilities classified as a “registered renewable electricity facility” under the Guarantee of Origin Act will be subject to charges where the facility is any of: an accredited power station (s 12(1)), an electricity generation system other than an accredited power station (s 13(1)), an energy storage system (s 14(1)), or an aggregated system (s 15(1)), provided the facility is registered at any time during the financial year.

Who pays and who decides

• Payment obligation is statutory: the Act imposes charges on the registered profile or registered renewable electricity facility. The Act does not set collection mechanics, but the registered entity as recorded under the Guarantee of Origin Act will be the locus of liability. Identification of the liable party depends on the registration rules in the principal Act, which this charging Act cross‑references (s 8).
• The amount to be paid is set by regulation, not by the primary Act (ss 9(2)-15(2), 16(1)). The Governor‑General makes regulations (s 18) and the Minister must be satisfied that regulations will recover no more than the Commonwealth’s likely administrative costs before they are made (s 16(2)). Thus, executive actors (the Minister and the Governor‑General acting on advice) decide amounts and exemption design through subordinate legislation.

Stakeholders indirectly affected

• Entities considering registration: Because the charge applies for any financial year in which registration exists “at any time,” parties considering registering profiles or facilities will face potential incremental cost of participation. The timing of registration relative to the financial year will affect exposure because the statutory trigger is time-based (ss 9(1), 10(1), 11(1), 12(1)-15(1)).
• State and Territory governments: The Act binds the Crown in right of each State and of the territories (s 3), but explicitly does not bind the Crown in right of the Commonwealth (s 3). Section 6 states that the Act does not impose a tax on property of a State. These provisions mean state and territory agencies that are registrants could be within the charge base, but the Act contains an express protection for State property from a tax.
• Overseas actors and external Territories: The Act extends to external Territories (s 4) and has extra‑territorial application to acts and omissions outside Australia (s 5). Therefore, registrants incorporated or operating outside Australia may be captured if they are registrants under the Guarantee of Origin Act and if the definitions in that primary Act reach them.

Who does not pay (explicit)

• The Crown in right of the Commonwealth: the Act does not bind Commonwealth Crown (s 3). That means Commonwealth government entities will not be bound by the Act as written. The text does not create an explicit payment obligation for Commonwealth entities.

Uncertainty holders

• Parties registered under the Guarantee of Origin Act but operating for portions of the financial year will face uncertainty as to whether the design of the regulations will prorate charges or impose full-year charges where registration exists “at any time during” the year (compare s 16(1) enabling methods, with the default trigger in ss 9(1)-15(1)). The Act leaves that design choice to the regulations.

In short, the statutory payers are registrants under the Guarantee of Origin Act: profile holders and registered renewable electricity facilities. Executive actors decide amounts and exemptions via regulation, subject to the Ministerial pre‑condition in s 16(2). Several groups , state/territory entities, external Territory actors, and overseas registrants , have particular treatment or potential exposure under the Act’s jurisdictional clauses.

Duties created by the Act

• Payment duty: The primary statutory duty is on registered profiles (production, delivery, consumption) and on registered renewable electricity facilities in the listed classes to be liable for a charge where the registration exists at any time during a financial year ending on or after commencement (ss 9(1)-11(1), 12(1)-15(1)). The duty is period-based (a financial year) and triggered by registration status.
• Duty to accept subordinate instruments: There is an indirect administrative duty created by the Act for affected parties to monitor, and comply with, the regulations that will prescribe amounts and methods, and that may provide exemptions (ss 16-18). Compliance duties in practice will flow from those regulations.

Rights and protections in the Act

• Limits to charges: The Act creates a right of sorts for payers in that the Minister must be satisfied that regulations will recover no more than the Commonwealth’s likely administrative costs relating to administration of the Guarantee of Origin Act before regulations are made (s 16(2)). This is a statutory constraint on regulation-making designed to tie the purpose of charges to cost recovery.
• Exemptions power: The regulations may create exemptions (s 17). While this is an executive discretion (to be exercised via regulations rather than the Act itself), it affords the possibility of statutory relief to particular classes of registrants, depending on how the regulations are drafted and what exemptions are made.

Rights not created or explicitly reserved

• No explicit refund, dispute resolution or review mechanism in the Act: The Act contains no provision that sets out processes for disputing an asserted charge, seeking refunds, or administrative review of charge assessments. It is silent on enforcement, collection, and appeal mechanisms; those likely belong in the regulations or in other general-purpose collection statutes.
• No explicit right against Commonwealth entities: The Act does not bind the Crown in right of the Commonwealth (s 3). That is a limitation on the Act’s reach, not a right conferred to third parties.

Procedural preconditions and constraints on executive action

• Ministerial pre-condition: The Minister’s satisfaction that regulations will effect recovery of no more than likely Commonwealth administrative costs is a statutory precondition for the Governor‑General to make regulations under this Part (s 16(2)). In practice, the Minister must form that opinion or be satisfied in some way before regulations that set amounts, methods or exemptions are promulgated. The Act does not prescribe the evidentiary standard or process for forming that satisfaction.
• Constitutional constraints: Sections 6 and 7 operate as substantive limits on what can be imposed by regulation under this Act. The Act “does not impose a tax on property of any kind belonging to a State” (s 6(1)) and limits charges to those that are not duties of customs or excise within the meaning of section 55 of the Constitution (s 7). These are not affirmative rights to challenge but they are express statutory protections that may be relevant to judicial review or constitutional challenge.

Delegation and discretion

• Regulatory discretion: The Act gives broad discretion to the regulations to set methods and amounts (including nil), to create exemptions, and to prescribe matters “necessary or convenient” to carry out this Act (s 18). Those delegations create practical duties for registrants to comply with subordinate instruments and for the executive to justify regulatory choices within the statutory constraints such as s 16(2).

Records and timing duties implied by the Act

• Financial year trigger: Because liability is assessed by reference to the financial year and registration at any time within that year (ss 9(1)-15(1)), there is a duty for registrants to maintain records of registration status and the dates of registration/des-registration to determine exposure for a particular financial year. The Act does not spell out record-keeping requirements, but the design makes temporal documentation operationally relevant.

In sum, the Act creates a statutory duty to pay charges linked to registration status, assigns regulatory actors the role of setting amounts and exemptions, imposes a Ministerial pre-condition tying regulations to administrative cost recovery, and leaves procedures for assessment, collection and dispute to regulation or other law because the Act itself is silent on those operational details.

Statutory silence on penalties and collection

• The Act contains no express enforcement, penalty, sanction, interest, debt-recovery method, assessment power or compliance regime in its text. The operative provisions impose charges (ss 9-15) and reserve to the Governor‑General the power to make regulations (s 18) and to the regulations the power to prescribe amounts and exemptions (ss 16-17). Nowhere in the Act are enforcement provisions specified.

Implication: enforcement will depend on regulations or other laws

• Because the Act authorises the Governor‑General to make regulations “prescribing matters required or permitted by this Act” or “necessary or convenient” to give effect to it (s 18), the legislative expectation is that the regulations will contain the operational and enforcement mechanics that the Act does not supply: how charges are assessed, how and when they are payable, interest and penalties for non‑payment, remedies and dispute routes, and collection mechanisms. The Act itself does not create criminal offences or civil penalties.

No express authorisation for private cost recovery in the Act

• The Act does not itself set out a mechanism for the Commonwealth to sue for unpaid charges or to register a statutory charge against property. In the absence of express collection mechanisms in the primary text, collection would need to rely on regulations made under s 18 or on existing Commonwealth debt recovery mechanisms under general government law. If the regulations are silent on precise enforcement tools, ordinary Commonwealth debt recovery procedures would likely be available, but that is not established by this Act’s text.

Constitutional and jurisdictional constraints on enforcement

• The Act includes constitutional guardrails that may affect enforcement strategies. Section 6 prevents the Act “impos[ing] a tax on property of any kind belonging to a State,” and section 7 limits charges to those that are not duties of customs or excise within the meaning of s 55 of the Constitution. These provisions may be invoked in any legal contest over enforcement if a complainant argues the charge operates as an invalid tax on State property or as a prohibited duty of excise or customs.

Administrative discretion and potential for regulations to impose sanctions

• The regulations could prescribe penalties, interest and enforcement processes, including civil sanctions, administrative penalties or processes for review and appeal. The Act’s regulation-making power is broad (s 18) and s 16(1) explicitly contemplates that the regulations may specify “methods” for calculating charges, which could include accounting procedures for arrears or pro‑rata calculations. The Ministerial pre-condition in s 16(2) constrains the content of regulations to the cost‑recovery purpose but does not expressly limit the kinds of enforcement tools the regulations may include.

Practical consequence for registrants

• Registrants should expect that compliance ultimately depends on the detail of regulations. Until regulations are made, the Act creates liability in principle without specifying how it will be enforced. That timing creates operational risk: entities could be uncertain about their practical exposure, payment schedules and the consequences of non‑payment until the regulations are published.

In summary, the Act creates charges but does not itself specify penalties or enforcement mechanisms. Enforcement details are left to regulations and to the existing broader legal framework for Commonwealth liabilities; registrants should expect to look to subordinate instruments for specifics on deadlines, payment procedures, penalties, interest and dispute processes.

Primary cross-reference to the Guarantee of Origin Act

• The Act is explicitly designed to operate as a charging instrument for the Future Made in Australia (Guarantee of Origin) Act 2024. Multiple core terms are defined by reference to that primary Act (s 8). The practical scope and coverage of the charges therefore depends directly on the substantive definitions, registration criteria, and administrative arrangements set out in that other Act. The charging Act cannot be fully understood in isolation from the principal scheme it complements.

Connection to Acts Interpretation Act 1901

• Section 16(1) of this Act is expressed to be “without limiting subsection 33(3A) of the Acts Interpretation Act 1901,” signalling that interpretative provisions relating to regulations and amounts for charging have primacy or operate alongside the standard interpretation rules for subordinate instruments. This cross-reference may affect how courts interpret regulatory methods for calculating charges where those methods are prescribed by regulation.

Constitutional limits in the Constitution

• The Act expressly references constitutional constraints. Section 6 adopts the s 114 concept by stating the Act does not impose a tax on property of a State, and section 7 states the Act imposes charges only insofar as they are neither duties of customs nor duties of excise within s 55 of the Constitution. Those cross-links frame the Act to be read alongside constitutional prohibition and defence provisions; they are statutory acknowledgements of legal limits that are judicially enforceable.

Administrative and revenue law interfaces

• The Act requires the Governor‑General to make regulations prescribing amounts and related matters (s 18). Those regulations will likely interact with other Commonwealth revenue and debt-collection statutes and administrative rules. While the Act itself is silent on collection mechanisms, once regulations prescribe amounts and payment mechanisms, actors will need to align with Commonwealth financial management frameworks and possibly the Treasury’s usual approaches to charging and cost recovery.

Crown liability and intergovernmental law

• Section 3 binds the Crown in right of the States and Territories but not the Crown in right of the Commonwealth. That provision interacts with broader doctrines of Crown immunity and intergovernmental relations. Because the Act does not bind the Commonwealth Crown, a Commonwealth agency that is a registrant may assert it is not bound by this charge regime. Related interactions with intergovernmental contracts or memoranda of understanding would depend on details in the Guarantee of Origin Act or in implementing regulations.

Extra‑territoriality and external Territories

• The Act extends to external Territories (s 4) and to acts and omissions outside Australia (s 5). Therefore, the Act’s reach interacts with private international law, extraterritorial regulatory doctrines and possible conflicts of laws where registrants, facilities or activities are located abroad or in external Territories. The operational effect will depend on the extent to which the Guarantee of Origin Act’s registration regime reaches those entities.

Regulatory hierarchy and administrative law

• The discretion to make regulations (s 18) and the Ministerial pre-condition (s 16(2)) will interact with administrative law principles, including the merits and judicial review of administrative decisions made under delegated powers. If regulations create decisions that adversely affect registrants (for example, exemptions refused, calculation methods applied), those administrative acts would be subject to judicial review principles applied to executive action and subordinate legislation.

Absence of explicit enforcement mechanisms and interaction with other statutes

• Because the Act does not detail enforcement mechanisms, interactions with other laws are inevitable: collection may proceed under the Public Governance, Performance and Accountability Act, under Commonwealth debt recovery procedures, or under specific regulations made pursuant to this Act. The Act’s silence means stakeholders must look to the instrument set created by the executive (the regulations) and other general Commonwealth statutes to understand enforcement and recovery.

Overall, the Act is constructed to be read and operated in close coordination with the Future Made in Australia (Guarantee of Origin) Act 2024, with constitutional constraints and standard Commonwealth administrative and revenue law frameworks shaping implementation, enforcement and interpretation.

As enacted

• The text presented is the Act as assented to on 10 December 2024 (front matter). The Act’s commencement provisions (s 2) include a table and a note that “This table relates only to the provisions of this Act as originally enacted. It will not be amended to deal with any later amendments of this Act.” That language is standard and indicates that the table records original commencement arrangements and is not updated in the statutory text when later amendments occur.

Commencement specifics recorded in the original table

• Section 2(1) provides that each provision of the Act commences at the later of the start of the day after Royal Assent and “at the same time as the Future Made in Australia (Guarantee of Origin) Act 2024 commences.” The table includes an entry saying “However, the provisions do not commence at all if the event mentioned in paragraph (b) does not occur.” The published table also includes a date (3 November 2025) in column 3 with the parenthetical note “(paragraph (b) applies).” Section 2(2) clarifies that any information in column 3 is not part of the Act; it may be inserted or edited in published versions. The legal effect is that commencement depends on the other Act commencing; the table records an intended or conditional commencement date but the statutory trigger remains the later of Royal Assent + 1 day and the start of the Guarantee Act.

No recorded amendments in the provided text

• The supplied text contains no statutory amendments after enactment. The Act’s content is limited to the initial enactment text. The Act’s note about the commencement table not being amended implies future versions of the Act may be annotated in published copies but the underlying text will be formally amended by subsequent amending Acts, which are not present in the supplied material.

Potential amendment pathways (textual mechanics)

• The Act expressly leaves key details to regulations (ss 16-18). Typically, if Parliament or the executive wishes to alter the scope, amounts or exemptions further, it can do so either by:
  • amending this Act (Parliamentary process, creating new liabilities or rights in primary legislation), or
  • making or amending subordinate regulations under the power in s 18 (Governor‑General in Council), constrained by the precondition in s 16(2).
• The Act’s built-in delegations mean that many operative changes to amounts and exemptions will likely occur via regulations rather than primary legislation, subject to the Minister’s satisfaction requirement.

Practical note for users tracking amendments

• Because the Act cross-references the Guarantee of Origin Act for many definitions and for the scheme’s operation, amendments to the primary Act will change the practical effect of the charging Act without any textual change in this charging statute (for example, by expanding or narrowing the set of “registered profiles” or “registered renewable electricity facilities”). Users should therefore monitor legislative and regulatory changes to both Acts.

In summary, the provided text shows an initial Act assented to 10 December 2024 with conditional commencement tied to the separate Guarantee of Origin Act. There are no subsequent amendments recorded in the supplied material. The Act’s design contemplates that many operational and financial details will be implemented by subordinate regulations, which can be updated within the statutory constraints.

No cases or decisions are recorded in the Act

• The Act as provided contains no references to cases, judicial interpretations or litigation. There is no litigation history embedded in the text.

Potential areas that might give rise to litigation (textual sources)

• Constitutional limits: The Act expressly anticipates constitutional constraints by providing that it does not impose a tax on property of a State (s 6) and that it imposes charges only insofar as they are neither a duty of customs nor a duty of excise within the meaning of s 55 of the Constitution (s 7). Disputes could therefore arise in future litigation about whether particular charges, as prescribed by regulation, operate in substance as forbidden duties of excise or as an impermissible tax on State property. Any such litigation would be procedural and substantive, and the statutory provisions themselves flag these legal boundaries.
• Delegation and administrative law: Litigation could challenge the validity of regulations under the Act on grounds of improper delegation, failure to satisfy s 16(2) (the Minister’s pre-condition that regulations recover no more than the Commonwealth’s likely administrative costs), or incompatibility with the enabling power. Because s 16(2) makes the Minister’s satisfaction a precondition to regulations being made, an affected party might seek judicial review of a regulation on the basis that the required precondition was not genuinely or lawfully satisfied.
• Interpretation disputes: Given that the Act cross-references definitions (s 8), disputes over whether particular activity or facility types fall within the definitions in the Guarantee of Origin Act could lead to litigation. Questions about whether a profile or facility was “registered at any time during the financial year” may generate factual and legal contests over the date of registration, registrant identity and the point at which a charge becomes payable.

No recorded precedents or authorities cited in the Act

• The Act includes no section-by-section legislative history beyond the second reading speech dates, and it does not cite judicial authorities. The absence of litigation history in the document means any useful precedents or interpretative guidance will only emerge after regulations are made and disputes arise.

Practical consequence for interested parties

• Until regulations are issued and the Guarantee of Origin Act’s definitional and administrative architecture is operational, there will be no adjudicated disputes specific to the charging regime. Stakeholders should monitor the order and content of subordinate instruments because the early regulations are likely to be the first stimuli for litigation if parties consider the charges overreaching or the preconditions in s 16(2) unsatisfied.

In short, there is no litigation history recorded in the provided material. The Act itself signals possible constitutional and administrative law litigation pathways by incorporating statutory safeguards and delegations that could be tested once regulations are in force.

Charge timing and the “any time during the financial year” trigger

• Each charge is imposed “for a financial year ending on or after the commencement of this section, if the profile/facility is a registered [profile/renewable electricity facility] at any time during the financial year” (ss 9(1)-15(1)). The “at any time” trigger creates a bright-line exposure: a registration for one day in a financial year could, absent regulations providing otherwise, create charge exposure for that entire financial year. The Act itself contains no prorating rule; whether charges are prorated, apportioned or otherwise adjusted is left to regulation (s 16(1)(b) permits methods of calculation). Registrants should not assume pro rata treatment until regulations specify it.

Regulatory discretion over amounts, including nil amounts and different methods

• Section 16(1) allows the regulations to prescribe a fixed amount, a method for calculating the amount, different amounts for different circumstances, and even nil amounts. The broad regulatory scope means substantial variation could be implemented without primary legislation. That creates regulatory risk for stakeholders because the executive can alter cost exposures by changing regulations, subject to s 16(2).

Ministerial satisfaction as a pre-condition , evidence and contestability

• The Minister must be satisfied that the effect of the regulations will be to recover no more than the Commonwealth’s likely costs in connection with administration of the Guarantee Act (s 16(2)). The Act does not prescribe how that satisfaction is to be documented, what evidence is needed, or whether the satisfaction is reviewable. That leaves open procedural questions about whether and how affected parties can challenge the sufficiency of the Minister’s satisfaction or the factual basis on which regulations were adopted.

No enforcement or penalty mechanics in the Act

• The Act imposes charges but is silent about collection, interest on overdue charges, penalties for non-payment, or administrative assessment processes. Until regulations provide detail, registrants will be uncertain about payment timetables, enforcement consequences, dispute resolution mechanisms and the identity of the administrative decision-maker for assessments.

Dependence on the Guarantee of Origin Act for core scope

• Many core terms are defined by reference to the Guarantee of Origin Act (s 8). The charging Act’s coverage therefore cannot be fully understood without that other Act. If the Guarantee Act defines “registered profile” or “registered renewable electricity facility” narrowly or broadly, the charge base may be significantly different. Stakeholders should not treat the charging Act in isolation.

Crown treatment nuances

• The Act binds State and Territory Crowns but not the Commonwealth Crown (s 3). That means Commonwealth-controlled entities may not be subject to these charges. The Act also provides that it does not impose a tax on State property (s 6), a protection that could become relevant in intergovernmental disputes.

Extra-territorial reach and compliance complexity

• The Act has extra-territorial application (s 5) and extends to external Territories (s 4). If the definitions in the Guarantee Act reach overseas facilities or profiles, entities operating outside Australia could find themselves within the charge regime. This raises compliance complexity and potential conflicts of law.

Constitutional limits could be litigated

• Sections 6 and 7 are explicit statutory acknowledgements of constitutional limits on taxing States and imposing duties of excise/customs. If regulations are designed in ways that arguably contravene those limits (for example, by effectively operating as an excise on production), litigation could ensue. The Act’s inclusion of these provisions does not preclude a legal challenge.

Lack of transitional rules

• The Act does not include transitional provisions about registrations crossing a commencement boundary, other than the financial year trigger in ss 9-15 and the conditional commencement in s 2. The absence of transitional arrangements could create ambiguity for registrations that straddle the commencement date of the Guarantee Act and these charging provisions.

Who decides exemptions and how broad they will be

• Exemptions are to be provided by regulation (s 17). The breadth and availability of exemptions will therefore depend on executive policy choices and how the regulations are drafted. Entities should not assume exemptions will be available unless they are enacted in regulation.

In sum, the principal “gotchas” are the temporal trigger that may create full-year exposure for short registrations, broad regulatory discretion over amounts and methods (including nil), the Ministerial pre‑condition that lacks prescribed procedures, the Act’s silence on enforcement mechanisms, and the dependence for scope on the definitions in the Guarantee of Origin Act. Those features create implementation, compliance and litigation risks that registrants must manage by closely tracking subordinate legislation.

Immediate actions (before regulations are made)

• Map registrant status: Parties who own or operate profiles or renewable electricity facilities that may be registrable under the Guarantee of Origin Act should identify whether they are likely to be “registered profiles” or “registered renewable electricity facilities” once the Guarantee Act comes into force (s 8). Because liability under this Act depends on registration “at any time during the financial year” (ss 9(1)-15(1)), knowing the dates and mechanics of registration is the first compliance step.
• Monitor commencement of primary Act: The charging Act’s commencement is conditional on the Guarantee of Origin Act commencing (s 2(1)). Entities should track the commencement of the Guarantee Act because the charging regime does not commence unless and until that other Act does. The published table suggests an intended date, but the legal trigger is the Guarantee Act’s commencement.

Prepare for timing exposure and record-keeping

• Maintain clear records of registration dates: Because liability attaches if registration exists “at any time during the financial year,” registrants should document registration start and end dates, notifications, and any administrative correspondence to support arguments about temporal exposure and to determine whether regulations (when made) apply to particular periods.
• Budget for possible full-year liability: Until the regulations set methods or proration, assume the statutory text could create full-year exposure for a partial-year registration. Financial planning should therefore account for the upper-bound exposure until the regulations clarify methods of calculation (s 16(1)).

Track regulation-making and the Minister’s pre-condition

• Watch for regulations and explanatory instruments: The Act leaves amounts, methods and exemptions to regulation (ss 16-18). Subscribe to government notices, Federal Register of Legislation updates, and ministerial publications to obtain draft regulations, explanatory statements and any cost-recovery assessments prepared to satisfy s 16(2).
• Scrutinise the Minister’s published satisfaction: Although s 16(2) does not prescribe an evidentiary standard, affected parties should obtain the factual and financial basis for the Minister’s satisfaction that regulations will recover no more than the Commonwealth’s likely costs. That reasoning may be relevant for later legal contest and for policy engagement.

Engage in the regulatory process

• Participate in consultations: Because the amount and methods will be set by regulation and exemptions will be available by regulation (s 17), stakeholders should engage at the draft regulation stage, submit comments, and seek clarifying provisions on proration, payment timing, record-keeping obligations, enforcement mechanisms and dispute resolution.
• Seek exemptions where appropriate: If a sectoral or other exemption is required to avoid perverse outcomes, pursue that through executive channels and in regulation submissions under s 17.

Prepare administrative systems

• Accounting and billing systems: Design accounting and billing systems to accept a regulatory determination of charges that may be fixed-dollar or formula-based (s 16(1)). Ensure systems can handle retroactive application if regulations include transitional rules or backdated methods.
• Compliance processes and internal controls: Develop internal controls for monitoring registration status, payment deadlines (once regulations set them), and for escalating disputes or appeals.

Legal risk management

• Assess constitutional risk exposure: For State entities and for arrangements involving State property, review the scope of s 6 and how regulations might interact with State property. For production-linked charges, consider the possibility of claims that a charge operates as an excise, referencing s 7. Obtain legal advice tailored to the specific facts if there is a plausible risk of constitutional invalidity.
• Plan for dispute and enforcement scenarios: Because the Act is silent on enforcement, prepare to seek clarity in regulations about interest, penalties and dispute mechanisms. If these are absent or inadequate, be ready to explore administrative review or judicial review options in the context of administrative law.

Operational coordination with counterparties

• Contract clauses: For businesses entering into contracts that will be affected by registration (for example, power purchase agreements or supply arrangements), include terms allocating responsibility for charges, specifying pass-through rights, and setting notification obligations about registration status and regulatory changes.
• Insurance and price modelling: Consider whether to include the risk of charges and regulatory change in price models and insurance arrangements.

Practical steps once regulations are made

• Read regulations immediately upon gazettal: Once amounts, methods and exemptions are prescribed, determine precise exposure for each financial year, payment schedules, dispute remedies and enforcement provisions.
• Implement payment and reporting flows: Put in place processes to make payments on time, to report required information (if regulations prescribe reporting obligations), and to retain evidence of payment and registration dates.

In short, compliance requires mapping registration exposure, monitoring commencement and subordinate instruments, participating in regulation drafting, implementing accounting and contractual protections, and planning for potential disputes given the Act’s silence on enforcement mechanisms. The statutory references to registration timing and to the regulation-making architecture (ss 9-18) should anchor a compliance programme that is responsive to the regulations when they are made.
