#### 58 Failure to fulfil responsibilities under the scheme Failure to fulfil reporting responsibility (1) A person commits an offence if: (a) the person is required to give a notice under a provision of Division 2 of Part 3 (reporting to the Secretary); and (b) the person fails to give the notice in accordance with the provision. Penalty: 60 penalty units. Failure to fulfil responsibility to disclose in communications activity (2) A person commits an offence if: (a) the person is required to make a disclosure in accordance with the rules under section 38 (disclosure in communications activity); and (b) the person fails to make the disclosure in accordance with the rules. Penalty: 60 penalty units. Failure to keep records (3) A person commits an offence if: (a) the person is required to keep records of a matter under section 40 (keeping records) for a period; and (b) the person fails to do so. Penalty: 60 penalty units.
