Food Standards (Proposal P1050 – Pregnancy warning labels on alcoholic beverages) Variation

The central concept is the prescribed alcoholic beverage, defined as a beverage with more than 1.15% alcohol by volume that is either for retail sale or sold as suitable for retail sale without further processing, packaging or labelling. Importantly, it excludes a beverage that is sold for retail sale and packaged in the presence of the purchaser - meaning that a drink mixed or poured at a bar, or a bottle filled at a cellar door where the customer watches, is not caught. The 1.15% ABV threshold means that low‑alcohol beers and wines below that level are excluded, but standard beer (typically 4‑5%), wine (around 8‑15%) and spirits (over 20%) are all captured. The definition also covers beverages sold as “suitable for retail sale” without further processing, which would catch bulk containers sold to retailers who simply put them on shelves without repacking.

The pregnancy warning label is defined as either the pregnancy warning pictogram or the pregnancy warning mark. The pregnancy warning pictogram is the image of a pregnant woman silhouetted in black, holding a wine glass, with a red circle and strikethrough over it - the classic “no alcohol in pregnancy” symbol. The pregnancy warning mark adds two text elements inside a black border: the signal words “Pregnancy Warning” in red bold capital letters, and the statement “Alcohol can cause lifelong harm to your baby” in black sentence case. The mark is the more detailed option; the pictogram is the simpler one for small containers.

An individual unit is defined as a container that is an innermost package and contains a beverage with more than 1.15% ABV. This is the smallest sealed package, such as a beer can, a wine bottle, or a glass spirit bottle. The term is needed to separate inner and outer packaging responsibilities.

Size of type is defined as the measurement from the base to the top of a letter or numeral - a standard typographic metric, not a cap‑height measurement. This ensures that the signal words and statement are printed at a legible physical size.

Standard drink is defined as 10 grams of ethanol at 20°C - a reference definition inserted into the main definitions section for consistency with other parts of the Code, but not directly used in the pregnancy warning provisions.

The variation also introduces a table-based structure in sections 2.7.1‑9, 2.7.1‑10 and 2.7.1‑11 that maps container volumes to label types and minimum sizes for pictogram diameter, signal word type size and statement type size. For containers with more than one layer of packaging, the outer package has its own size table: if the outer package is a single unit of not more than 200 ml (e.g., a small can shrink‑wrapped), the pictogram alone suffices, but for all others the mark is required with a larger pictogram diameter (11 mm) and larger type sizes than those for individual units. The scheme is tiered and precise, leaving no discretion for alternative formats or voluntary additions.

The primary affected parties are manufacturers and importers of alcoholic beverages sold at retail in Australia (and New Zealand, if the Code applies there). They must redesign labels on all covered products - tens of thousands of stock‑keeping units across beers, wines, spirits, pre‑mixed drinks, cider and ready‑to‑drink products. The compliance burden falls on labelling and packaging supply chains: artwork must be redesigned, printing plates altered, and inventory rotated. For small breweries, wineries and distilleries, the cost of label redesign per SKU can be significant, especially if they use short print runs. The transition period of 36 months provides time but does not reduce the per‑unit cost.

Retailers such as supermarkets, bottle shops, liquor stores and online alcohol retailers must ensure that products on their shelves bear the required label. However, the duty to display runs with the product label, not the retailer, so the primary responsibility is on the packager or importer. Retailers must be cautious about accepting new stock that is incorrectly labelled, and may need to conduct spot checks during the transition period. Hospitality venues that sell alcohol for on‑premises consumption (pubs, bars, restaurants) are generally not affected because the definition of prescribed alcoholic beverage excludes beverages packaged in the presence of the purchaser - a bottle of wine opened at the table is not caught. However, if a venue sells a sealed bottle for off‑premises consumption (e.g., a restaurant that sells a bottle of wine to take away), that bottle is for retail sale and must carry the label. The venue would need to ensure that any take‑away alcohol is properly labelled - or alternatively, they could open the bottle and sell it as a “package in the presence of the purchaser” to avoid the requirement, though that would change the product condition.

Consumers are the intended beneficiaries of the warning, but the cost of label compliance will flow through to retail prices. The requirement to display the label “as a whole and without modification” prohibits any alteration, including the addition of qualifying statements, disclaimers or alternative fonts. This limits the ability of alcohol producers to use creative packaging to downplay the warning. For consumers with low vision or who are colour‑blind, the colour specifications (red circle, black figures, white background) may be sub‑optimal, but that is not addressed in the instrument.

Compliance professionals including food technologists, regulatory affairs officers, labelling consultants and auditors must understand the specific size thresholds. The tables use three volume bands, and for multi‑pack products (e.g., a 6‑pack of beer cans within a carton) the label must appear on both the carton (outer package) and each can (individual unit), unless the carton is transparent. That double requirement increases material and printing costs for multi‑packs.

The central duty is found in section 2.7.1‑8: a prescribed alcoholic beverage must display a pregnancy warning label. If the beverage has one layer of packaging, the label must be on that package. If it has more than one layer, the label must be on the outer package and on the individual unit (or each individual unit if there are multiple). However, there are two express exceptions: (a) the outer package does not need a label if the label on the individual unit is clearly discernible and not obscured by the outer package - for example, a clear plastic bag over a labelled bottle; and (b) the bladder within a box (e.g., a wine cask bladder) does not need a label. This second exception is narrow - it applies only to the flexible inner bag, not to the box itself. The box is the outer package and must bear the label, unless the bladder label is discernible (which it typically would not be, given the bladder is opaque or inside a cardboard box).

Sections 2.7.1‑9, 2.7.1‑10 and 2.7.1‑11 set out which label format must be used based on volume and whether the package is the only layer, the outer package, or an individual unit. The duties are prescriptive: a producer cannot choose to use the full warning mark on a 150 ml bottle if the volume is under 200 ml - the pictogram alone is required. Conversely, on a 375 ml bottle (e.g., a stubbie of beer), the full warning mark must be used. The tables are mandatory; there is no equivalent option.

The label must comply with the form requirements of section 2.7.1‑12: white background, red circle and strikethrough, black silhouette, red bold capitals for signal words, black sentence case for the statement, black border, and a clear space of at least 3 mm around the border of the mark. The label must be displayed as a whole and without modification. That means no cropping, resizing (other than the specified minimum sizes), recolouring, adding borders within the label, or overlaying other graphics. It also means the pictogram and text cannot be separated - the mark is a single composite image. The requirement to display “as a whole” suggests that even minor alterations such as changing the kerning or the ratio between elements would be non‑compliant.

During the transition period (clause 4(2) and (3)), a producer has the right to continue selling product that complies with the old Code, or to adopt the new label early. After the transition period, only product packaged and labelled before the transition period ended may be sold under the old rules. That grandfathering applies only to stock that was already packaged and labelled - it does not permit new production runs to use old labels. Therefore, the practical right is to use up old labels through to the end of the transition period, but thereafter all new labelling must comply.

The instrument does not create a private right of action for consumers; enforcement is through the food regulatory system. Rights are essentially limited to the temporal flexibility afforded by the transition period and the grandfather clause.

The variation itself does not specify monetary penalties or criminal sanctions. Penalties for non‑compliance with the Food Standards Code arise from the Food Standards Australia New Zealand Act 1991 (FSANZ Act) and from state and territory food legislation that adopts the Code. Under the FSANZ Act, it is an offence to sell food that does not comply with a standard (section 44), with penalties of up to 2,000 penalty units for an individual or 10,000 penalty units for a body corporate (as at 2020, one penalty unit was $222, so maximum fines around $444,000 for individuals and $2.22 million for corporations). Additionally, states and territories have their own food acts (e.g., Food Act 2006 (Qld), Food Act 2003 (NSW)) that impose penalties for non‑compliant labelling, often with daily penalties for continuing offences.

Enforcement is primarily the responsibility of state and territory food regulatory agencies, such as the NSW Food Authority, Queensland Health, and the Department of Health in each jurisdiction. They can issue improvement notices, prohibition orders, and initiate prosecution. Imported products are also subject to the Code; the Australian Border Force and the Department of Agriculture, Fisheries and Forestry can detain and destroy non‑compliant imported goods.

The instrument does not treat non‑compliance as a strict liability offence - the prosecution would need to prove that the product was sold or exposed for sale without the required label. But there is no defence of ignorance; the person who packages or imports the product bears the duty. The size and colour specifications are objective, so if a label fails the measurements, it is non‑compliant regardless of intent. The 36‑month transition period is a de facto amnesty, but once it expires, any new stock without a compliant label is at risk.

There is no provision for corrective advertising, recalls or civil penalties in this variation - those may be ordered under broader food safety legislation if the non‑compliance is considered to present a risk to public health. Given the warning is about harm during pregnancy, a failure to label could be framed as a health risk, though the instrument itself does not link to any specific recall power.

This variation is an amendment to the Australia New Zealand Food Standards Code, which is given legal effect by the FSANZ Act. It is part of a larger regulatory framework. Specifically, it inserts definitions into Standard 1.1.2 and references into Standard 1.2.1 (notes about information requirements). Standard 2.7.1 already contained requirements for alcohol labelling, including the standard drink statement and the alcohol content declaration. Division 4 now adds a separate, additional obligation on top of those existing requirements. A product must now carry both the pregnancy warning label and the existing standard drink information, alcohol content, name and address of the packer, etc.

The variation interacts with Australia’s consumer law (the Australian Consumer Law, Schedule 2 to the Competition and Consumer Act 2010). The pregnancy warning label is a mandatory disclosure; if a producer were to add text that contradicts or undermines it (e.g., “Drink responsibly” near the warning), that could still be a misrepresentation if it suggests that moderate drinking is safe during pregnancy. However, the requirement to display the label “as a whole and without modification” would likely prohibit any alteration of the label itself, but it does not prohibit other text on the package. There is a potential tension: the brand owner may want to add a disclaimer such as “If you are pregnant or planning a pregnancy, consult your doctor.” That is not prohibited by this variation, but it must not obscure or modify the mandated label.

The variation also interacts with intellectual property law. The pregnancy warning mark and pictogram are prescribed images. A producer cannot make their own version - they must reproduce the exact images as defined. The images are presumably copyright in the Crown or FSANZ. The instrument does not grant a licence to use the images; it simply mandates their display, which effectively compels reproduction. There is no commercial right to use the image for other purposes.

The variation interacts with trade measurement laws (e.g., National Measurement Act 1960) only to the extent that containers must also comply with volume marking requirements. The size tables are based on container volume, so a producer must ensure that the declared volume matches the actual volume to apply the correct label tier.

For multi‑state and multi‑country compliance, the variation is part of the joint Australia New Zealand Code. New Zealand has its own adoption mechanism, but the variation itself applies under Australian law. Anyone importing into Australia must comply. New Zealand producers exporting to Australia must also comply.

Finally, the variation does not override state‑specific laws on alcohol labelling, such as those concerning health warnings or responsible service of alcohol. If a state requires an additional warning (e.g., the NSW Liquor Act requires a warning about drinking during pregnancy for certain premises), the federal Code standard would be a minimum, but the pregnancy warning label itself is now uniform across Australia, which may reduce some state variation.

This instrument is the original variation made under Proposal P1050. It was made by the Board of FSANZ on 27 July 2020, gazetted on 31 July 2020 (FSC No. 135), and commenced on that date. There is no subsequent amendment to this variation in the source provided. The variation is self‑contained; it does not amend earlier amendments to the Code on this topic, because this was the first pregnancy warning label requirement for alcoholic beverages in the Code. (Previous voluntary schemes existed in some states, but this is the first mandatory national requirement.)

The variation includes a transition period of 36 months from gazettal, meaning that during this period both the old and new labelling are permissible for sale. After 31 July 2023, only products packaged and labelled before that date can use the old labels. The source text does not indicate any transitional provisions beyond the 36‑month window and the grandfathering for pre‑packaged stock. A product that was packaged and labelled before the end of the transition period may be sold indefinitely thereafter - presumably the producer relies on the date of packaging to establish that it was done during the transition period.

There is no mention of any review or sunset clause. The variation appears to be a permanent amendment to the Code, subject to any future variation proposed by FSANZ.

Based solely on the source text, there is no reference to any litigation concerning this variation. The variation is a delegated legislative instrument made by a standards body, and as such it is subject to judicial review under the Administrative Decisions (Judicial Review) Act 1977 or under the FSANZ Act itself. However, the source does not indicate that any legal challenge has occurred. It is plausible that trade associations or individual producers considered legal action on grounds such as the breadth of the definition, the cost implications, or the extraterritorial application to imports, but no such litigation is recorded in the instrument.

In the broader context of mandatory warning labels, there has been litigation in other jurisdictions (e.g., the US tobacco warning label cases on First Amendment grounds; the EU wine packaging challenges on ground of proportionality; similar challenges in Canada regarding graphic health warnings). Australia’s plain packaging for tobacco withstood WTO and constitutional challenges. A similar challenge to alcohol pregnancy warning labels would need to argue that the mandatory display of the exact wording and image (the mark) is an unjustified burden on free speech or commercial expression, or that it goes beyond the legislative power of the Commonwealth under the Constitution. The source does not engage with such arguments, and there is no published judgment on this specific variation. The instrument is assumed to be valid unless and until overturned.

For a litigator, the likely points of future challenge would be: whether the definition of “prescribed alcoholic beverage” is sufficiently certain (the “sold as suitable for retail sale” limb might be ambiguous for bulk containers), whether the size requirements are proportionate given the limited space on very small containers (e.g., 50 ml spirit miniatures), and whether the prohibition on modification prevents the use of a QR code or other information alongside the label. None of these are addressed in the source.

Several specific traps arise from the precise wording of the variation. The first is the distinction between outer package and individual unit labelling for multi‑packs. If a product has an outer cardboard carton containing four 250 ml cans, the outer package must bear the pregnancy warning mark with an 11 mm pictogram and large type (section 2.7.1‑10(3): “All other prescribed alcoholic beverages” - because the carton is more than 200 ml). Each individual can (250 ml) must bear the pregnancy warning mark with a 6 mm pictogram (section 2.7.1‑11(3) second row). That means the mark must appear twice: once on the outer and once on each inner unit. The exception in subsection 2.7.1‑8(3) says the outer package need not have a label if the inner label is clearly discernible and not obscured - but for a cardboard box that is opaque, that exception does not apply. Thus, a producer cannot simply label the inner cans and leave the outer blank; the outer must have its own label unless it is transparent.

The second trap is the bladder within a box exemption (subsection 2.7.1‑8(4)). This applies only to the bladder, not the box. A wine cask’s inner plastic bladder does not need a label, but the cardboard box that holds it is the outer package and must display the label. Some producers might think the exemption extends to the entire packaging system, but it is limited.

Third, the requirement that the label be displayed as a whole and without modification means that the pictogram and text must appear exactly as prescribed. If a producer uses the full mark but tries to include it within a larger graphic or with a different background colour (e.g., a gold label with the mark printed on it), the white background requirement (section 2.7.1‑12(2)) would be violated. The background of the pregnancy warning label must be white - that means the area immediately behind the pictogram, signal words and statement must be white, not the whole package. But if the label is printed as a patch on a coloured bottle, the patch must be white. That imposes a separate die‑cut or patch, increasing printing cost.

Fourth, the size of type definition uses base‑to‑top of a letter or numeral. That means ascender height, not cap height for capital letters. For the signal words which are in capital letters, the size of type is measured from the base of the letter to the top of the capital (which is typically the cap height). For the statement in sentence case, the size of type is measured on lowercase letters (from base to top of ascenders like ‘l’ or ‘h’). The minimum sizes (2.1 mm, 1.6 mm, 2.8 mm, 2.7 mm) are small, but must be strictly met. A slight reduction in print scaling could create non‑compliance.

Fifth, the clear space requirement (section 2.7.1‑12(8)) of at least 3 mm around the border of the mark means that no other text or graphic can intrude into that zone. If the warning label is placed near a barcode, the barcode must be at least 3 mm away. On small labels, that reduces usable space.

Finally, the transition period ends 36 months after the date of commencement. The date of commencement is the date of gazettal (31 July 2020), so the transition ends 31 July 2023. After that, any product on the shelf that was packaged after that date must comply. However, existing stock packaged before 31 July 2023 can be sold indefinitely. There is no sunset on that grandfathering, meaning that old‑label stock could still appear on shelves years later. A producer needs to track packaging dates carefully.

Compliance requires a systematic label assessment for each alcoholic beverage product. The first step is to determine whether the beverage is a prescribed alcoholic beverage as defined. This means checking that the alcohol by volume exceeds 1.15%, that it is for retail sale (or sold as suitable for retail sale without further processing), and that it is not packaged in the presence of the purchaser. Products sold only to the hospitality trade without retail packaging (e.g., kegs, bulk containers) are not captured. But if the keg is also sold at retail (e.g., a home‑brew keg with a tap), the requirement may apply - note the “suitable for retail sale” limb could catch kegs if they are presented to consumers without further processing. Producers should review their distribution channels.

For each covered product, the next step is to identify the number of packaging layers. A single glass bottle with a label is one layer. A can in a cardboard carton is two layers. The rules apply per layer. For single‑layer products, follow section 2.7.1‑9. For outer packages, follow section 2.7.1‑10. For individual units (the innermost container), follow section 2.7.1‑11. Note that if the product is an individual unit inside a transparent outer, the outer can be left unlabelled if the inner label is clearly discernible - but “clearly discernible” likely means the label can be read without undue effort, considering the print size and any tint on the outer.

For each layer, measure the container volume (the stated volume on the package or the actual volume, which must be consistent). Use the tables to select the correct label type and minimum dimensions. For containers under 200 ml, only the pictogram is required, but it must be at least 8 mm diameter. For containers between 200 ml and 800 ml, the full mark is required, with a pictogram at least 6 mm, signal words at least 2.1 mm, statement at least 1.6 mm. For containers over 800 ml, the mark is required with larger sizes (9 mm, 2.8 mm, 2.7 mm). Be careful: the outer package table (section 2.7.1‑10) uses a different mapping - for an outer package no more than 200 ml containing only one individual unit, the pictogram alone suffices; all other outer packages must use the mark with 11 mm pictogram. So a 12‑pack in a carton (200 ml cans) would have an outer package volume of 2.4 litres - the mark on the outer must be 11 mm pictogram. The individual cans (200 ml each) require only the pictogram (8 mm). That asymmetry is a potential source of error.

Obtain the exact artwork from FSANZ or follow the description in sections 2.7.1‑2 and 2.7.1‑12. The pictogram is provided as an image in the variation - presumably the official version must be used. The mark is also depicted. Ensure the colours are correct: white background, red circle and strikethrough (the specific shade of red is not defined, but must be red; use a standard red such as Pantone 186 or similar). Black for silhouette, signal word colour red, statement colour black. Signal words in bold sans-serif capitals; statement in sentence case sans-serif. Border of the mark must be black. The entire label must have a clear space of at least 3 mm outside the border; do not print any other text, graphics, barcodes, or cut marks within that zone.

Print the label at the required physical sizes. The pictogram diameter is the critical measurement. It may be necessary to test‑print and measure with a precision caliper to ensure compliance, as printer variation can cause shrinkage or expansion. The type sizes for signal words and statements should be set in the design at exactly the minimum or larger; note that “size of type” is measured base‑to‑top, so if using a font where the capital letters are shorter than the full cap height, adjust accordingly.

Finally, maintain records of compliance: a spreadsheet mapping each SKU to its packaging layers, volumes and label specifications. Keep samples of printed labels dated before the transition period end to prove grandfathering if challenged. For imported products, ensure the foreign supplier receives the artwork and confirms compliance with Australian code. Consider engaging a third‑party auditor to check samples before mass production.

If a product is already in the supply chain with non‑compliant labels during the transition period, no action is needed until the end of the transition, but start planning label redesign well before the 36‑month deadline to avoid shortages of compliant stock.
