Food Regulations 2017

The Regulations codify a handful of concepts that determine who decides, who pays, what must be displayed to consumers, and which operations are within or outside the reach of Parts 5, 7 and 8 of the Act.

• Prescription of enforcement agencies (reg 4). The Regulations nominate the Department, all municipal and district councils under the Local Government Act 1999 and any relevant regulatory subsidiaries as enforcement agencies for the Act (reg 4(1)). They then allocate responsibility: for businesses outside council areas the Department is prescribed as appropriate (reg 4(2)(a)); for businesses within council areas the local authority is generally the appropriate agency unless the Minister determines otherwise (reg 4(2)(b)(i)-(ii)). Where businesses operate across multiple council areas, enforcement responsibility can be shared, with each relevant local government authority being an appropriate enforcement agency (reg 4(3)(c)). The regulation defines "food transport business" and locational rules for such businesses (reg 4(4)) and sets how "council area" is to be read where a relevant regulatory subsidiary exists (reg 4(6)).

• Head of an enforcement agency (reg 5). The Regulations prescribe who is the "head": the chief executive of the Department for that agency, council CEOs (unless the council is a constituent of a regulatory subsidiary), and the person designated as principal officer for a regulatory subsidiary (reg 5).

• Adoption and modification of the Food Standards Code (reg 8). The Code is incorporated "as in force from time to time" (dynamic incorporation) subject to three specified modifications that affect (a) an exemption for unpasteurised goat’s milk vis‑à‑vis Standard 4.2.4 clause 15 (reg 8(2)(a)); (b) an exclusion from Chapter 3.1 for activities regulated by the Primary Produce (Food Safety Schemes) Act 2004 or exempt by reg 15 of these Regulations (reg 8(2)(b)); and (c) a narrowing of the application of Standard 3.2.1 to food businesses determined to be priority by the appropriate enforcement agency consistent with the priority classification system under s 79(2) of the Act, or where another Standard explicitly requires compliance (reg 8(2)(c)).

• Multiple‑site nutritional disclosure (reg 12). A prescriptive menu and labelling regime applies to “standardised food” sold by multiple‑site food businesses above specified thresholds. The Regulations define the content and format: average energy content in kilojoules calculated per item (not per 100 g) in accordance with Standard 1.2.8, rounded up to the nearest 10 kJ, displayed conspicuously on menus and tags, in the same font size as the price or item identifier, together with a statement that average adult daily energy intake is 8 700 kJ (reg 12(1)(b)-(e), (c)). The regime is limited by exclusions (reg 12(1)(f)) (for example, loaves/plain rolls, trial items, supermarkets/convenience stores, and certain not‑for‑profit services), and a transitional 12‑month compliance window applies where a business surpasses the location thresholds (reg 12(2)). The rule is also structured so that voluntary provision of nutritional information triggers full compliance (reg 12(4)-(5)).

• Fees, debt recovery and penalties. Enforcement agencies may charge inspection fees prescribed by notice and recover them as a debt (reg 13). Two regulatory offences with specified maximum penalties and expiation fees are in the Regulations: failing to comply with the voluntary‑turned‑mandatory disclosure obligation under reg 12(4) is an offence (max $2 500; expiation $125) (reg 12(5)), and selling meat of animals not referred to in the Food Standards Code is an offence (max $2 500; expiation $210), with carve‑outs for game meat and crocodile meat and an export exemption (reg 14(1)-(3)).

• Exemptions for primary production and on‑farm/boat activities (reg 7 and reg 15). The Primary Produce (Food Safety Schemes) Act 2004 is prescribed for the purposes of defining primary food production under the Act (reg 7). Independently, Parts 5, 7 and 8 of the Act do not apply to activities on farm land or on a boat that constitute a food business (reg 15(1)), but exceptions exist when the activity involves packing/treating of food in circumstances within s 7(2)(b) of the Act or handling of food sold directly to the public (reg 15(2)).

These concepts create the framework through which the Act is operationalised: allocation of enforcement, incorporation of national food standards subject to local qualifications, a defined nutritional disclosure regime, cost recovery for inspections, limited criminal sanctions, and targeted exclusions for primary production and small‑scale or particular business models.

The Regulations affect a wide set of actors inside and outside government by specifying roles, responsibilities, and obligations.

• Government bodies and officials. The Department (the Public Service unit assisting the Minister) is prescribed as an enforcement agency (reg 4(1)(a)) and as the appropriate enforcement agency for businesses outside council areas (reg 4(2)(a)). Municipal and district councils and any relevant regulatory subsidiaries are also prescribed as enforcement agencies (reg 4(1)(b)-(c)). Heads of enforcement agencies are prescribed (chief executive of the Department, council CEOs, principal officers of regulatory subsidiaries) (reg 5). The Minister retains discretions: to determine the Department as the appropriate enforcement agency in lieu of the local council (reg 4(2)(b)(ii)) and to prescribe forms at the Minister’s discretion under reg 10.

• Local government and regional subsidiaries. Councils and any regional subsidiaries established by two or more councils under the Local Government Act 1999 are central enforcement actors (reg 4). Where a relevant regulatory subsidiary exists, the subsidiary can be the relevant local government authority and the combined area of its constituent councils becomes the "council area" for enforcement purposes (reg 4(5)-(6)). Council chief executives are prescribed heads for enforcement purposes unless the council is a constituent of a regulatory subsidiary (reg 5(b)-(c)).

• Food businesses. The Regulations affect multiple types of food businesses:

  • Multiple‑site food businesses. Those meeting thresholds (20 or more locations in South Australia, or 50 or more in Australia with at least 5 in SA) must display kilojoule information and the average intake statement for standardised food (reg 12(1)(f)(iii) and note). Numerous display, calculation and rounding requirements apply (reg 12(1)(b)-(d) and (e)). Supermarkets and convenience stores are explicitly excluded from the operation of s 112(1) (reg 12(1)(f)(iv)). Drive‑through businesses have a specific allowance for separate adjacent boards visible at or before ordering points (reg 12(1)(d)(iii)(A) and reg 12(1)(e)(i)(A)).

  • Food transport businesses. These have specific locational rules for enforcement (reg 4(4)(a)) and are subject to inspection fees if inspections occur (reg 13).

  • On‑farm and on‑boat businesses. The Regulations exclude many on‑farm or on‑boat food‑business activities from Parts 5, 7 and 8 of the Act but carve out packing/treating and retail handling (reg 15).

  • Small businesses. The Regulations define small business for counting staff as businesses with not more than 20 people engaged in handling food, counting full‑time equivalent staff where appropriate (reg 3).

  • Producers subject to the Primary Produce (Food Safety Schemes) Act 2004. That Act is prescribed as the definition of primary food production for the Act, affecting how Chapter 3.1 of the Code applies (reg 7 and reg 8(2)(b)).

  • Sellers of meat. Any person selling for human consumption meat of an animal not referred to in the Code is prohibited from doing so, with explicit exemptions for game meat and crocodile meat and an export exception (reg 14).

• Consumers. Consumers are affected indirectly through mandated nutrition labelling for qualifying multiple‑site businesses (reg 12). The Regulations prescribe presentation and legibility standards intended to affect the visibility and comparability of energy information (reg 12(1)(d)-(e)).

• Businesses offering trial items and limited rollouts. The Regulations exclude items sold for not more than 60 consecutive days at up to 5 locations from the multiple‑site disclosure obligation (reg 12(1)(f)(ii)), which directly affects product rollouts and marketing planning.

• Not‑for‑profit and catering entities. There are carve‑outs: multiple‑site businesses that are not‑for‑profit bodies delivering meals to homes, primary catering providers and businesses that sell food for consumption only on the premises are excluded from s 112(1) (reg 12(1)(f)(v)-(vi)).

• Exporters. The meat prohibition in reg 14(1) does not apply to food intended for export (reg 14(3)), so export-oriented sellers are carved out.

In short, the Regulations allocate administrative authority between the State Department and local governments, impose operational duties on certain classes of businesses (notably multiple‑site food businesses, meat sellers, on‑farm/boat producers), and create cost‑recovery mechanisms for enforcement. They also embed the national Code dynamically while modifying parts that intersect with South Australian policy choices.

The Regulations create a series of duties for businesses and corresponding administrative rights for enforcement agencies. Below are the principal duties, the legal bases, and the operational rights that enforcement agencies receive.

Duties imposed on businesses

• Notification duty (reg 11). For the purposes of s 86(3) of the Act, the prescribed period for notification after the date of transfer or change is 14 days (reg 11). Businesses transferring or changing operations must notify the appropriate enforcement agency within that timeframe.

• Multiple‑site disclosure obligations (reg 12). Businesses that meet the statutory thresholds for a multiple‑site food business (see reg 12(1)(f)(iii) and the note) must display the average energy content (kJ) for each item of standardised food and must display the average adult daily energy intake statement of 8 700 kJ (reg 12(1)(b)-(e)). The calculation must be done in accordance with Standard 1.2.8 of the Code but adjusted to be per whole item, not per 100 g (reg 12(1)(c)). Display and formatting rules (numerals then "kJ", rounded up to nearest 10 kJ, same font size as price or item identifier, conspicuous and legible placement on menus, tags or labels, etc.) are mandatory (reg 12(1)(d)-(e)). If a business is excluded but supplies nutritional information voluntarily, it must comply fully as if s 112(1) applied (reg 12(4)-(5)).

• Meat sale prohibition (reg 14). A person must not sell for human consumption meat of an animal that is not referred to in the Code (reg 14(1)). The prohibition excludes game meat as defined in the Code and crocodile meat, and it does not apply to food destined for export (reg 14(2)-(3)). "Meat" is defined to include the flesh of an animal (reg 14(4)).

• On‑farm/boat exemptions with exceptions (reg 15). While Parts 5, 7 and 8 of the Act do not apply to on‑farm and on‑boat activities that constitute a food business (reg 15(1)), activities are not exempt if they involve packing/treating of food within the ambit of s 7(2)(b) of the Act or handling of food to be sold directly to the public (reg 15(2)(a)-(b)).

Administrative rights and discretions

• Enforcement agency designation and discretionary centralisation (reg 4). The Department and councils are prescribed enforcement agencies. The Minister may determine that the Department is the appropriate enforcement agency for a particular food business even when the business would ordinarily fall under a local council (reg 4(2)(b)(ii)). For businesses operating across multiple council areas, multiple local government authorities can each be an appropriate enforcement agency (reg 4(3)(c)).

• Inspection fees and recovery (reg 13). Enforcement agencies may impose inspection fees "of an amount prescribed by notice" for inspections reasonably required in connection with the Act, and they may recover those fees as a debt from the occupier, owner or operator (reg 13(a)-(b)). The fee amount is not fixed in the Regulations; it is left to a notice.

• Ministerial discretion on prescribed form (reg 10). For s 81(2) of the Act, the prescribed form may be determined according to the Minister’s discretion (reg 10), giving administrative flexibility over paperwork requirements.

• Adoption of the Code and dynamic updating (reg 8(1)). The Code is adopted as it is in force from time to time, meaning updates to the national Code will apply in South Australia subject to the local modifications recorded in reg 8(2).

Enforcement and sanctioning powers

• Regulatory offences with money penalties and expiation fees. Failure to comply with reg 12(4) (voluntary nutritional information that triggers the mandatory regime) is an offence with a maximum penalty of $2 500 and an expiation fee of $125 (reg 12(5)). Selling meat contrary to reg 14(1) is an offence with a maximum penalty of $2 500 and an expiation fee of $210 (reg 14(1)). The Regulations do not set out the full enforcement mechanisms (for example, prosecution processes) but they give enforcement agencies fee and debt‑recovery powers (reg 13) and leave some administrative details to Ministerial determination (reg 10).

Rights retained by businesses and others

• Exporters. The meat prohibition does not apply to food that is to be exported, so exporters retain the right to sell meat for export even if the same meat would be prohibited for domestic sale (reg 14(3)).

• Exempted businesses. Businesses that fall within the statutory exclusions for multiple‑site nutritional disclosure (reg 12(1)(f)) are not required to comply with s 112(1), though they are encouraged to provide the information (reg 12(3)).

• Small businesses. The small business definition in reg 3 sets a threshold that will affect the applicability of some obligations and administrative expectations. The Regulations count staff by full‑time equivalence for this purpose (reg 3).

Collectively, the Regulations assign discrete duties to business classes, create specific display and labelling obligations for multiple‑site operators, allow enforcement agencies to impose and recover inspection costs, and reserve several decisions to the Minister or enforcement agencies, creating both prescriptive obligations and discretionary administrative levers.

The Regulations set out monetary penalties and administrative enforcement powers, and they create a structure where both local authorities and the Department can exercise enforcement activity, including cost recovery for inspections.

Penalties specified in the Regulations

• Nutritional disclosure failure (voluntary information) (reg 12(5)). If a business outside the operation of s 112(1) (because of a specific exclusion) voluntarily provides nutritional information that might reasonably be mistaken for nutritional information, the business must calculate and make the information available as if s 112(1) applied (reg 12(4)). Failure to comply with this obligation is an offence, carrying a maximum penalty of $2 500 and an expiation fee of $125 (reg 12(5)).

• Prohibition on unauthorised meat sales (reg 14(1)). Selling for human consumption the meat of an animal not referred to in the Food Standards Code is an offence. The maximum penalty is $2 500; the expiation fee is $210 (reg 14(1)). The prohibition does not apply to game meat (as defined in the Code) or crocodile meat (reg 14(2)), nor does it apply where the food is to be exported (reg 14(3)).

Enforcement agency powers and administrative mechanisms

• Designation of enforcement agencies and heads (regs 4-5). The Regulations prescribe the Department, councils and relevant regulatory subsidiaries as enforcement agencies (reg 4(1)). They prescribe the chief executive of the Department, council CEOs (except where councils are constituents of a regulatory subsidiary), and designated principal officers of regulatory subsidiaries as heads of enforcement agencies (reg 5). These prescriptions operationalise the Act’s enforcement architecture and identify the persons who will exercise enforcement powers under the Act where those powers are delegated to a "head".

• Allocation of appropriate enforcement agency (reg 4(2)-(3)). The Regulations allocate primary responsibility to local government for food businesses conducted in a council area and to the Department for businesses outside council areas. They also allow the Minister to designate the Department as appropriate in individual cases (reg 4(2)(b)(ii)). For food businesses operating in more than one council area, each relevant local government authority is prescribed as an appropriate enforcement agency for that portion of activity (reg 4(3)(c)).

• Inspection fees and recovery as a debt (reg 13). An enforcement agency may impose an inspection fee for any inspection reasonably required in connection with the Act, with the fee amount to be prescribed by notice (reg 13(a)). The agency may recover the fee as a debt from the occupier of the premises or the owner/operator of the food transport vehicle (reg 13(b)). The Regulations therefore provide a direct cost‑recovery mechanism for enforcement activity, but the fee quantum and the process for prescribing it are left to subordinate notice.

• Ministerial discretion over prescribed forms (reg 10). The prescribed form for the purposes of s 81(2) of the Act may be determined according to the Minister’s discretion, allowing the executive to specify compliance paperwork and attendant evidence requirements (reg 10).

Operational details affecting enforcement

• Priority classification and Standard 3.2.1 (reg 8(2)(c)). Standard 3.2.1 now applies only to food businesses determined by the appropriate enforcement agency to have a priority classification consistent with a priority classification system determined by the relevant authority under s 79(2) of the Act, or where another Standard explicitly requires compliance (reg 8(2)(c)). This links prosecutorial or enforcement focus to classification decisions under the Act and gives enforcement agencies discretion to concentrate resources on priority business classes.

• Transitional allowances (reg 12(2)). Where a business becomes subject to the multiple‑site disclosure rules because it increases its number of locations, it has a 12‑month window in which non‑compliance is not an offence. This transitional rule moderates immediate enforcement for businesses growing into the threshold.

Enforcement processes implied by the Regulations

• The Regulations set monetary penalties and expiation fees but do not in themselves specify the full procedural enforcement pathway (for example, how prosecutions are commenced under the Act or how expiation notices are served). Those processes will be those provided in the Act and any other relevant enforcement statutes or local government procedures. What the Regulations do is create a statutory basis for specified offences and provide mechanisms (inspection fees/debt recovery) that enable enforcement agencies to fund inspections.

Uncertainties and operational considerations

• Fee quantum and notice regime not fixed in the Regulations (reg 13). Enforcement agencies may impose a fee "of an amount prescribed by notice", but the Regulations do not state the mechanism or timelines for that notice. This creates a potential uncertainty for businesses about likely inspection costs until a specific notice is published.

• Ministerial delegations and centralisation potential (reg 4(2)(b)(ii) and reg 10). The Minister’s power to designate the Department as the appropriate enforcement agency for a business and to determine forms gives the executive administrative flexibility but also concentrates discretionary choices that can affect how and by whom enforcement is exercised.

In short, the Regulations equip enforcement agencies with a combination of definitive offence provisions and administrative tools (inspection fees, debt recovery, discretionary classification) while leaving some key parameters, inspection fee amounts and prescribed forms,to subordinate instruments or Ministerial determination.

The Regulations explicitly link to and depend upon several other South Australian and Commonwealth statutes. Understanding those interactions is essential to operationalisation.

• Food Act 2001 (the Act). The Regulations are subordinate legislation made under the Act and repeatedly reference sections of the Act to set prescribed particulars. Examples: the prescription of enforcement agencies and heads implements the definition of enforcement agency and head under the Act (regs 4-5); the prescribed form for s 81(2) of the Act is delegated to the Minister under reg 10; the prescribed period for s 86(3) (notification of transfer/change) is fixed at 14 days (reg 11). The Regulations therefore function as an implementation layer for the Act.

• Local Government Act 1999. The Regulations rely on the Local Government Act 1999 for their structure of local enforcement. They prescribe all municipal and district councils under the Local Government Act 1999 as enforcement agencies (reg 4(1)(b)), and they contemplate regional subsidiaries established by two or more councils under that Act (reg 4(1)(c)). The Regulations define how council areas are to be read where a relevant regulatory subsidiary exists (reg 4(6)), and they prescribe the chief executive officer of a municipal or district council as the head of the enforcement agency unless the council is a constituent of a relevant regulatory subsidiary (reg 5(b)).

• Food Standards Australia New Zealand Act 1991 and the Food Standards Code. The Regulations adopt the Australia New Zealand Food Standards Code as defined in the Food Standards Australia New Zealand Act 1991 (the Code), explicitly incorporating the Code "as in force from time to time" (reg 8(1)). That dynamic incorporation means amendments at the national level will automatically apply in South Australia except where the Regulations modify particular Code provisions (reg 8(2(a)-(c))). The Regulations therefore create a two‑way dependency: national standards inform South Australian obligations, but the Regulations also limit how those standards apply within the State (for example, via the goat’s milk exemption and the priority classification limitation on Standard 3.2.1).

• Primary Produce (Food Safety Schemes) Act 2004. The Regulations prescribe that Act for the purposes of defining primary food production under s 7(1) of the Act (reg 7). They also use the Primary Produce Act as a basis for excluding certain activities from Chapter 3.1 of the Code (reg 8(2)(b)(2)), effectively carving out activities regulated under the Primary Produce Act from the scope of certain Code obligations when read alongside the Act.

• Correctional Services Act 1982. The Regulations prescribe correctional institutions within the meaning of the Correctional Services Act 1982 as public institutions for the purposes of the Act (reg 6(b)), which likely affects how public institutions are regulated and inspected under the Act.

• Interplay with the Act’s priority classification system (s 79(2) of the Act). Reg 8(2)(c) modifies Standard 3.2.1 by tying its application to whether an enforcement agency determines a food business has a priority classification consistent with a priority classification system determined by the relevant authority under s 79(2) of the Act. Thus, enforcement agency classification decisions under the Act determine whether Standard 3.2.1 applies in practice.

• Export and trade law contexts. Reg 14(3) expressly exempts exported food from the meat‑sale prohibition in reg 14(1). That interacts with export regulation, quarantine and trade obligations, but the Regulations themselves only state the export exemption.

• Debt recovery and local government enforcement regimes. Reg 13 allows inspection fees to be recovered as a debt from an occupier or owner/operator. The enforcement of such debts will interact with wider debt recovery and local government revenue recovery mechanisms, even though the Regulations do not specify the exact recovery process.

• Definitions and exclusions affecting advertising and online material. Reg 12(6)(c) defines a "menu" to include lists made available to the public on the Internet, in leaflets and by other means, but excludes advertising not designed to be used in connection with placing an order. Reg 12(6)(d) states that advertising that includes contact details to place orders will be taken to be designed to be used for ordering in the absence of proof to the contrary. Those rules create an interface between advertising law, e‑commerce practices and the nutritional disclosure regime in reg 12.

Overall, the Regulations sit at a junction between state administrative law (allocation of local vs State enforcement), national food standards, primary production regulation, and local government regulatory practice. They dynamically import national standards while retaining State-specific qualifications and administrative discretions, and they create interdependencies that require operators and regulators to consult not only the Regulations but also the Act, the Food Standards Code, the Primary Produce Act and local government frameworks.

The Regulations include a legislative history section that records their initial commencement and subsequent variations. The key entries in the legislative history provided in the text are as follows.

• Principal regulations and commencement. The Food Regulations 2017 were made as principal regulations in 2017 (No. 193), gazetted 27 June 2017, with commencement (r 2) on 1 July 2017 (Legislative history: 2017 No. 193, Gazette 27.6.2017 p2628; r 2 commencement 1.7.2017).

• Subsequent variations and commencement dates. Several variations are listed:

  • 2017 No. 263, Gazette 29.8.2017 p3816, with commencement 29.8.2017 (r 2).
  • 2018 No. 75, Gazette 21.6.2018 p2177, with commencement 1.7.2018 (r 2).
  • 2019 No. 71, Gazette 13.6.2019 p1861, with commencement 1.7.2019 (r 2).
  • 2020 No. 162, Gazette 4.6.2020 p3014, with commencement 1.7.2020 (r 2).

• Specific provisions varied. The legislative history identifies particular regulations that were varied, deleted or substituted across those instruments. Notable adjustments recorded:

  • Part 1, r 2 was omitted under the Legislation Revision and Publication Act 2002, effective 29.8.2017.
  • Part 4, r 9 was deleted by 75/2018 r 4, effective 1.7.2018.
  • r 13 (inspection fee) was substituted by 75/2018 r 5, effective 1.7.2018, and further varied by 162/2020 r 4, effective 1.7.2020.
  • r 14(2) was varied by 263/2017 r 4, effective 29.8.2017.
  • Schedule 1 (Sch 1) underwent omissions and insertions across 29.8.2017, 1.7.2018, 1.7.2019 and deleted by 162/2020 r 5 (see legislative history entries).

• Revocation of previous regulations. The Food Regulations 2017 revoked the Food Regulations 2002, indicating a comprehensive replacement of the earlier subordinate regime.

• Historical consolidated versions. The legislative history lists the historical versions of these Regulations as at 29.8.2017, 1.7.2018 and 1.7.2019. The textual record indicates that later variances (for instance, the 2020 variations) further altered provisions such as reg 13.

What the legislative history concretely shows is that the Regulations have been actively amended since their initial commencement, with specific attention to the inspection fee provision (r 13), the meat provision (r 14(2)), and the content and structure of Part 4/Schedule 1. The history also shows the use of the Legislation Revision and Publication Act 2002 to omit certain provisions (for example r 2) as part of statutory housekeeping.

Limitations of the legislative history in the provided text

• The history lists the instruments and commencement dates but does not provide the text of the amendments themselves in this extract beyond the earlier included provisions. Where the legislative history notes that a provision was "substituted" or "varied", the revision may have inserted different language; readers should consult the consolidated text and the specific amending instruments (Gazette notices) cited to examine the exact prior and posterior language.

• The legislative history does not record subordinate notices (for example, any notices prescribing the amount of inspection fees under reg 13) and does not list any disallowances, reviews or subsequent retractions.

Practitioners and compliance officers should therefore consult the consolidated Regulations on the official legislation website for the most up‑to‑date enacted text and consult the specific Gazette instruments cited in the legislative history for the exact amendment language and context.

The text of the Food Regulations 2017 supplied does not include any case references or a reported litigation history. The Regulations themselves are subordinate legislative instruments and do not record judicial decisions. Consequently:

• There are no cases named or summarised in the Regulations as provided. The Regulations do not cite or identify any court decisions interpreting their provisions.

• Because the Regulations adopt the Australia New Zealand Food Standards Code (reg 8(1)) and interact with the Food Act 2001 and other statutes, litigation relevant to interpretation is more likely to occur in the context of the Act, the Code, or particular enforcement actions. The instrument itself contains no litigation record.

Practical implications for users who need case law

• If you require judicially interpreted authority on how any of these Regulations apply, examples might include disputes about whether a food item is "standardised food" for reg 12, whether a particular display meets the "conspicuous and legible" standard, or whether an enforcement agency has lawfully imposed an inspection fee, searches should be conducted in the usual legal databases (e.g., AustLII, commercial databases) for cases citing the Food Act 2001 and the Food Regulations 2017, or decisions of local government or administrative tribunals that mention these Regulations.

• Because the Regulations dynamically import the Food Standards Code, case law interpreting Code provisions could be relevant, though the Regulations modify particular Code provisions for South Australia (reg 8(2)). Care must therefore be taken to note whether national Code interpretations remain applicable in South Australia given the local modifications.

• Administrative decisions and local government enforcement actions may be the most common source of disputes under these Regulations (for example, debt recovery proceedings under reg 13 or prosecution under regs 12 and 14). For practical purposes, one should also review local government enforcement policies, any published notices prescribing inspection fees, and Ministerial determinations about forms or agency designation.

In short, the supplied Regulations contain no litigation history. To identify judicial or tribunal interpretation, a separate search of case law and administrative decisions is required.

The Regulations contain numerous detail points and drafting choices that can catch operators, enforcement bodies and advisors unaware. The following are concrete pitfalls drawn directly from the text.

• Dynamic adoption of the Food Standards Code. Reg 8(1) adopts the Code "as in force from time to time". That means changes at the national level automatically become South Australian requirements unless the Regulations expressly modify them (reg 8(2)). Practitioners must track FSANZ amendments continuously because the Regulations do not freeze the Code at a specific version.

• Local exceptions to national standards (goat’s milk and priority classification). The Regulations carve out unpasteurised goat’s milk from certain pasteurisation clauses in the Code (reg 8(2)(a)), and they narrow Standard 3.2.1 to businesses designated as priorities (reg 8(2)(c)). Advice and compliance checks must allow for these State‑level deviations from the Code.

• Multiple definitions that alter jurisdiction. The definition of "food transport business" and the locational rules in reg 4(4) determine which authority enforces the business in practice. A food transport business without a depot is taken to be conducted at the principal base of vehicles or, if none, at each place where a vehicle is usually parked (reg 4(4)(a)(i)-(ii)). For operators with distributed fleets or occasional parking arrangements, the choice of enforcement agency can shift among multiple councils or the Department depending on where vehicles are "usually parked", which is a fact‑sensitive inquiry.

• Ministerial and enforcement agency discretion. The Minister may determine that the Department is the appropriate enforcement agency even where a local council would otherwise be prescribed (reg 4(2)(b)(ii)). The Minister also determines prescribed forms under reg 10. These discretions can centralise enforcement and impose administrative choices that materially affect businesses.

• Inspection fee uncertainty. Reg 13 authorises agencies to impose inspection fees of amounts "prescribed by notice", but the Regulations do not state the fee amounts or the notice mechanism. Businesses face uncertainty until specific fee notices are published. Enforcement agencies have the power to recover inspection fees as a debt (reg 13(b)), creating immediate financial exposure.

• Multiple‑site disclosure thresholds and practical counting. Reg 12(1)(f)(iii) excludes multiple‑site businesses carried on at less than 20 separate locations in South Australia and at less than 50 in Australia. The Note clarifies that s 112(1) only applies where a multiple‑site food business is carried on at 20+ SA locations or 50+ Australia locations (with at least 5 in SA). Businesses operating near those thresholds need careful counting and documentation to avoid inadvertent enrolment in the disclosure regime.

• Voluntary nutritional information triggers full compliance. If a business excluded from reg 12(1) voluntarily provides nutritional information (or information likely to be mistaken for it) on a menu or display, the Regulations require that the information be calculated and made available as if s 112(1) applied (reg 12(4)). A business that casually posts calorie or energy claims could unintentionally trigger full statutory compliance obligations and an offence on failure to comply (reg 12(5)) with a $2 500 maximum penalty.

• Menu and advertising scope. "Menu" extends beyond the physical menu and includes internet lists, leaflets and posters (reg 12(6)(c)). However, advertising that is not designed to place orders is excluded, but the presence of contact details intended to take orders will be taken to mean the advertising is designed to be used for ordering unless proven otherwise (reg 12(6)(d)). This makes online marketing and click‑to‑order interfaces areas of legal risk if nutritional info is omitted or inconsistent.

• Display formatting is prescriptive. Nutritional information must be in numerals followed by "kJ", rounded up to the nearest 10 kJ, displayed conspicuously and in the same font and at least the same font size as the price or item identifier (reg 12(1)(d)(i)-(vi) and reg 12(1)(e)(iii)). Mis‑sized fonts, inconsistent labelling, or non‑conspicuous placement can create offences.

• Combinations and size variants treated as separate items. If a food item has different size servings or is sold as part of a combination, each size and each combination is a separate "item of standardised food" for the purposes of calculation and display (reg 12(6)(a)-(b)). Operators must therefore prepare kJ information for every size and combo variant, which materially increases compliance costs for businesses offering customisable items.

• Exclusions and the small business definition. The small business definition is staff‑based and uses full‑time equivalents (reg 3). Businesses that are seasonal or use casual labour may unintentionally exceed the small business threshold. The multiple‑site disclosure exclusion for businesses with less than 20 SA locations and less than 50 Australia locations (reg 12(1)(f)(iii)) can be crossed by small incremental expansions, but reg 12(2) gives a 12‑month grace period in that event.

• Meat prohibition nuances. Reg 14(1) bans sale for human consumption of meat that is not referred to in the Code; however the ban excludes game meat (as defined in the Code) and crocodile meat (reg 14(2)). The Regulation also exempts food destined for export (reg 14(3)). Sellers dealing in exotic or non‑standard meats must confirm Code inclusion or rely on an exemption; failure risks a $2 500 penalty and $210 expiation.

• On‑farm/boat exemptions are narrow. Reg 15 exempts many on‑farm and on‑boat activities from Parts 5, 7 and 8 of the Act but not where the activity involves packing/treating in circumstances covered by s 7(2)(b) of the Act or handling food sold directly to the public (reg 15(2)). Producers need to identify whether their activity constitutes packing/treating or direct retail handling to determine the applicable obligations.

• Priority classification gating for Standard 3.2.1. The reach of Standard 3.2.1 depends on enforcement agency classification decisions under s 79(2) of the Act (reg 8(2)(c)). Businesses should confirm their priority status with the relevant enforcement agency because applicability is not automatic.

These "gotchas" are concrete, textual traps and operational complexities embedded in the Regulations. They combine dynamic incorporation of national law, fine‑grained display and labelling rules, administrative discretion and financial exposure for businesses.

This section sets out practical compliance steps tied directly to the Regulations. Treat these as a checklist to be adapted to particular business models and fact patterns. Each step cites the relevant Regulation(s).

1. Determine your enforcement agency and head (reg 4-5)

   • Ascertain whether your business is conducted in a council area or outside one. If outside, the Department is the appropriate enforcement agency (reg 4(2)(a)). If inside a council area, the local council is the appropriate enforcement agency unless the Minister has determined otherwise (reg 4(2)(b)(i)-(ii)).
   • If you operate in more than one council area, identify the relevant local government authorities for each area where food is handled or sold (reg 4(3)(c) and reg 4(4) for food transport businesses).
   • Confirm who the head of the enforcement agency is for liaison and notification: the Department’s chief executive, the council CEO, or the principal officer of a regulatory subsidiary (reg 5).

2. Meet notification obligations (reg 11)

   • If you transfer or change a food business, notify the appropriate enforcement agency within 14 days of the transfer or change (reg 11). Maintain evidence of notification (date‑stamped emails, acknowledgements, or certified post receipts).

3. Assess whether you are a multiple‑site food business subject to reg 12

   • Calculate the number of separate locations in South Australia and Australia. The disclosure regime applies if the multiple‑site food business is carried on at 20 or more SA locations, or at 50 or more locations in Australia (with at least 5 in SA) (reg 12(1)(f)(iii) and Note).
   • If you approach these thresholds, prepare a documented counting method to demonstrate compliance or exclusion.

4. Prepare and display nutritional information correctly (reg 12(1)(b)-(e), (6))

   • Calculate average energy content for each item of standardised food in kilojoules using Standard 1.2.8 of the Food Standards Code, adjusted to compute energy for the whole item (rather than per 100 g) (reg 12(1)(c)).
   • If multiple sizes or combos exist, prepare kJ information for each size and each combination (reg 12(6)(a)-(b)).
   • Display the kJ as numerals followed by "kJ", rounding up to the nearest 10 kJ (reg 12(1)(d)(i)-(ii)).
   • Ensure the kJ information appears on menus that include the item, or on a tag/label if the item is displayed, in a conspicuous, legible manner and in the same font and at least the same size as the price or item identifier (reg 12(1)(d)(iii)(A)-(vi) and reg 12(1)(e)(iii)).
   • Display the average adult daily intake statement "8 700 kilojoules" on menus and in the area where items are displayed, in a conspicuous manner and in the largest font size used to identify an item (reg 12(1)(b)(ii) and reg 12(1)(e)(i)-(iii)).
   • For drive‑through facilities, the kJ and average intake statement may be on a separate adjacent board visible at or before the point of ordering (reg 12(1)(d)(iii)(A) and reg 12(1)(e)(i)(A)).

5. Avoid inadvertently triggering mandatory disclosure (reg 12(4)-(5))

   • If you are excluded under reg 12(1)(f), do not publish or display any information that could reasonably be mistaken for nutritional information unless you are prepared to comply fully with the calculation and display obligations. If you voluntarily provide such information, you must meet the full compliance standard or risk an offence (reg 12(4)-(5)).

6. Prepare for inspections and possible fees (reg 13)

   • Budget for potential inspection fees. The fee amounts are prescribed by notice (reg 13(a)); consult enforcement agency publications and local government websites for any published notices.
   • Keep records of premises, food transport vehicle ownership and operations because inspection fees can be recovered as a debt from occupiers and owners/operators (reg 13(b)).

7. Check meat product compliance (reg 14)

   • Confirm that meat sold for human consumption is of an animal referred to in the Food Standards Code (reg 14(1)). If selling game meat or crocodile meat, confirm whether the product is explicitly within Code definitions or otherwise exempted (reg 14(2)). If intending to export, confirm that reg 14(3) exempts exported food from the domestic prohibition.

8. Confirm primary production and on‑farm/boat status (regs 7 and 15)

   • If you operate on farm land or a boat, determine whether your activity is an on‑farm primary production operation covered by the Primary Produce (Food Safety Schemes) Act 2004 (prescribed in reg 7). If so, Parts 5, 7 and 8 of the Act do not apply to many activities (reg 15(1)), but they do apply where packing/treating occurs in circumstances covered by s 7(2)(b) of the Act or where food is handled for direct sale to the public (reg 15(2)). Seek a written position from the relevant enforcement agency if the status is unclear.

9. Track Code amendments and South Australian modifications (reg 8)

   • Because the Code is adopted dynamically (reg 8(1)), monitor FSANZ updates and state notices concerning any local modifications (reg 8(2)). Particular attention should be paid to changes to Standards 1.2.8, 3.1.1 and 3.2.1 and Standard 4.2.4 where goat’s milk exceptions are relevant.

10. Keep documentation and evidence for enforcement and audit

    • Maintain records of calculations for kJ values (including methodology under Standard 1.2.8), proof of menu displays, dates of updates, staff full‑time equivalent calculations, notifications to enforcement agencies, inspection receipts, and communications with local government or the Department. Such documentation will be critical if a dispute arises or a fine/expiation is contested.

11. Liaise early with the enforcement agency

    • Where classification or priority status affects applicability of a Standard (reg 8(2)(c)), consult the enforcement agency about your business’s priority classification under the Act (s 79(2)) to determine whether obligations such as Standard 3.2.1 apply.

12. Seek advice on ambiguous matters

    • For borderline or novel products (e.g., unusual meats, products that might be "standardised food" or novel chains of supply), obtain written advice from the enforcement agency or legal counsel because misclassification can carry monetary penalties (regs 12 and 14) and administrative costs.

13. Use the 12‑month transition where growth pushes you over thresholds (reg 12(2))

    • If you grow into the disclosure thresholds because you add locations, note that a 12‑month compliance window applies to avoid prosecution for immediate non‑compliance (reg 12(2)). Use this period to plan and implement menu and label changes.

14. Check advertising and online ordering channels (reg 12(6)(c)-(d))

    • Ensure that online menus, third‑party delivery platforms, click‑to‑order pages, and any advertising that includes ordering contact details are compliant with the menu and nutritional information rules (reg 12(6)(c)-(d)). If advertising includes order contact details, it will be assumed to be designed to facilitate orders, bringing it within the menu definition unless you can prove otherwise.

Compliance is therefore a mix of administrative identification (who is the enforcement agency), process and record‑keeping (notifications, staff counts, kJ calculations), and front‑of‑house implementation (menu labels, tags, and font sizing). Where there is doubt about a Regulation’s application to a particular product or business arrangement, secure a written position from the relevant enforcement agency or obtain legal advice, because some breaches carry fixed monetary penalties and expiation fees and others create immediate debt exposure through inspection fee recovery.
