FOOD REGULATIONS 2014

Risk classification: The Regulations introduce a formal risk-classification tool called the Northern Territory Food Business Risk Classification (r 3A). The Agency applies that tool to classify food businesses by food safety risk (r 3B). The tool must be available for inspection at the Agency office and published online (r 3A(3)). The classification schema is the trigger for fee levels in Schedules 1, 1A and 1B.

Fees by risk and premises: Fees are prescribed per premises where the business operates. Schedule 1 sets registration fees (Priority 1 to Priority 4, denominated in revenue units: P1 180, P2 90, P3 45, P4 0). Schedule 1A sets renewal fees (P1 145, P2 70, P3 35, P4 0). Schedule 1B sets fees for variation of registration conditions (P1 90, P2 45, P3 22, P4 0). The Regulations anchor fee incidence to the risk classification allocated by the Agency (r 4, r 4A, r 4B).

Food safety auditors and approval: The Chief Health Officer (CHO) may approve persons as food safety auditors subject to competence, skills and knowledge (r 4C). Authorised officers can be approved under a separate route (r 4D). Approvals may be conditional and run until an expiry date not exceeding three years, suspension, or cancellation (r 4E). The CHO may vary, suspend or cancel approvals on enumerated grounds, including wilful or negligent contraventions, failure to notify interests, incompetence, or a direct or indirect interest that could affect performance (r 4F(2)(a)-(e)). Procedural fairness is mandated prior to suspension or cancellation: notice and opportunity to make submissions, and consideration of submissions (r 4F(3)-(4)). Auditors may request suspension or cancellation of their own approval, in which case the CHO must comply and the procedural constraints of r 4F do not apply (r 4G).

Auditor functions, conflicts and identity: Auditors must carry out audits of food safety programs required by the Food Standards Code, perform post-audit follow up where appropriate, assess compliance with Food Safety Standards, and report in accordance with r 4M (r 4J). Auditors must notify the CHO of direct or indirect interests in food businesses as soon as practicable; they must not audit a business in which they have such an interest (r 4K(1)-(2)). Explicitly, payment for services does not constitute a direct or indirect interest under r 4K(3). The CHO issues identity cards specifying conditions and expiry, and auditors must return cards on cessation (r 4H).

Audit frequency and reporting: The CHO determines audit frequency for required food safety programs and must give proprietors written notice of frequency and the date by which programs must be implemented (r 4L). Auditors must report results in an approved form within 21 days of completion, and reports must account for remedial action taken prior to reporting (r 4M(1)-(3)). For imminent and serious food-safety risks or matters that will cause significant unsuitability of food, auditors must immediately report to the CHO and complete a report no later than 24 hours after becoming aware (r 4M(4)-(5)). A copy of any such report must be given to the proprietor (r 4M(6)).

Infringement notices: Part 3 defines an infringement notice offence as any offence listed in Schedule 2 and prescribes the prescribed amount as the monetary value of the penalty units listed in Schedule 2 (r 5). Authorised officers can issue notices where they reasonably believe an offence has been committed (r 6). Notices must contain specific particulars and advice about expiation, election to have the matter heard in court under s 21 of the Fines and Penalties (Recovery) Act 2001, and potential enforcement consequences (r 7). Part 3 preserves the right to prosecute and does not require the issue of an infringement notice in order to proceed (r 10).

Interplay with other instruments: The Fines and Penalties (Recovery) Act 2001 is invoked for enforcement and election processes (r 7(1)(f), r 7(2)(b)). Schedule 2 lists sections of the Food Act 2004 (for example, s 15, s 16, s 17, s 18, s 19, s 20, s 46, s 52, s 53, s 70, s 71(1) etc) with penalty-unit quantities for individuals and bodies corporate; the Regulations convert those quantities into a prescribed amount as the monetary equivalent of the penalty units (r 5(2), Schedule 2).

Proprietors of food businesses: The Regulations directly affect proprietors required to register under the Food Act 2004. Proprietors will be told their audit frequency and the date by which required food safety programs must be implemented (r 4L). Proprietors are liable for registration fees per premises, renewal fees, and variation fees as set out in Schedules 1, 1A and 1B; the fee a proprietor pays depends on the risk classification allocated to their business by the Agency (r 4, r 4A, r 4B; Schedules 1-1B). Proprietors are the recipients of audit notices and copies of certain audit reports (r 4L, r 4M(6)). They are the primary addressees of compliance obligations under the Food Standards Code whose implementation the CHO monitors through audits.

Food safety auditors: Individuals approved under r 4C and authorised officers approved under r 4D are directly affected. They must meet competence standards, submit to an approval regime (application, disclosure and potential conditions), carry an identity card and comply with reporting and conflict-of-interest rules (r 4C-4K, r 4H, r 4M). Approvals have defined maximum terms and are amenable to suspension or cancellation on specific grounds (r 4E-4F). Auditors who identify imminent risks face an immediate reporting obligation (r 4M(4)-(5)).

Chief Health Officer and Agency staff: The CHO has delegated powers to approve auditors, set audit frequency, vary approvals, issue notices, and withdraw infringement notices within a narrow time window (r 4C-4F, r 4L, r 9). The Agency is required to maintain and publish the risk-classification tool (r 3A(3), r 3B). The Regulations centralise decision-making authority with the CHO and the Agency for classification, auditing policy, and auditor approvals.

Authorised officers: Those with authorisations under the Food Act are affected as they may be approved as auditors (r 4D). They also are the class of officers empowered to issue infringement notices where the authorised officer reasonably believes an offence has occurred (r 6).

Bodies corporate and individuals: Schedule 2 distinguishes between individuals and corporate bodies when specifying penalty units for infringement-notice offences. Corporations face higher penalty-unit quantities for many listed offences (Schedule 2).

Legal and enforcement agencies: The Fines and Penalties (Recovery) Act 2001 enforcement agencies are specified recipients for payment of prescribed amounts under infringement notices (r 7(1)(f)). Courts become relevant to those who elect trial rather than expiation, and to those seeking judicial review of CHO decisions: both applicants and auditors can apply to the Local Court for merit review of CHO decisions within five business days (r 4C(7)-(9), r 4F(5)-(8)).

Consumers and competitors: Indirectly affected groups include consumers who rely on the CHO to set audit frequency and ensure effective auditing of food safety programs, and competitors whose cost structures may be influenced if the fees, audits or classifications differentially affect businesses.

Those seeking to challenge CHO decisions: The Regulations provide narrow, time-limited merit review rights in the Local Court against CHO decisions on auditor approvals and variations (r 4C(7)-(9), r 4F(5)-(8)). The five-business-day limit is a specific procedural constraint that affects potential litigants.

Duties of the CHO and Agency

• To publish and make available the Northern Territory Food Business Risk Classification tool and apply it to classify food businesses (r 3A(1)-(3), r 3B).
• To determine the audit frequency for food safety programs required by the Food Standards Code and give written notice to proprietors of audit frequency and the date by which programs must be implemented (r 4L).
• To approve or refuse auditors, impose conditions, issue identity cards, vary or revoke approvals, and issue withdrawal notices for infringement notices within 28 days and before payment (r 4C-4F, r 4H, r 9).

Duties of auditors

• Apply for approval in the approved form and provide further information if requested (r 4C(2)-(3)).
• Carry out audits of food safety programs and necessary post-audit actions, assess compliance with the Food Safety Standards, and report in writing to the CHO within 21 days in the approved form (r 4J, r 4M(1)-(3)).
• Immediately report to the CHO any contravention that is an imminent and serious risk or that will cause significant unsuitability of food intended for sale, completing that report within 24 hours (r 4M(4)-(5)).
• Notify the CHO of any direct or indirect interest in a food business as soon as practicable, and not carry out audits of businesses in which they have such an interest (r 4K(1)-(2)). Payment for audit services is not a direct or indirect interest for these purposes (r 4K(3)).
• Return the identity card to the CHO when ceasing to be an auditor (r 4H(3)).

Duties of proprietors

• Implement any required food safety programs by the date specified in the CHO’s notice (r 4L(b)(ii)).
• Facilitate auditors and respond to audit reports and post-audit follow up, noting auditors will provide copies of imminent-risk reports (r 4J, r 4M(6)).
• Pay prescribed registration, renewal or variation fees according to the risk classification and number of premises (r 4, r 4A, r 4B; Schedules 1-1B).

Duties of authorised officers

• Where they reasonably believe an infringement-notice offence has been committed, an authorised officer may issue an infringement notice containing specified particulars and statutory advice, including the prescribed amount, enforcement agency, and election rights under the Fines and Penalties (Recovery) Act 2001 (r 6-7).

Rights and procedural protections

• Applicants for auditor approval and auditors subject to variation, suspension or cancellation of approval have a right to be given written notice of the CHO’s decision and reasons, an opportunity to make submissions, and a right of merits review by the Local Court within five business days after receipt of notice (r 4C(5)-(9), r 4F(3)-(8)). The Court must give written reasons and can confirm, vary, revoke or substitute decisions (r 4C(9), r 4F(7)-(8)).
• Persons issued with infringement notices have the right to expiate the offence by paying the prescribed amount within 28 days, or to elect to have the matter heard in court under s 21 of the Fines and Penalties (Recovery) Act 2001 by making the prescribed statement of election included with the notice (r 7(2)(a)-(b)).
• The CHO may withdraw an infringement notice within 28 days of issue and before payment (r 9).

Enforcement and escalation

• Part 3 preserves the option to prosecute offences despite the existence of an infringement-notice scheme. The Regulations do not require an infringement notice be issued prior to prosecution; nor do they prevent multiple infringement notices for the same offence, and if multiple notices are issued a person may expiate by paying under any of them (r 10).

Administrative details and timeframes

• Auditor approvals may expire up to a maximum of three years (r 4E(1)(a)).
• Auditors must submit standard audit reports within 21 days (r 4M(2)(b)).
• Immediate reporting obligations for significant or imminent risk must be completed within 24 hours and a copy provided to the proprietor (r 4M(4)-(6)).
• Appeals against CHO decisions related to auditor approvals or disciplinary action must be commenced in five business days (r 4C(8), r 4F(6)).

Infringement-notice mechanics and amounts

• Part 3 designates infringement-notice offences as those offences listed in Schedule 2. The prescribed amount for each listed offence is the monetary equivalent of the number of penalty units assigned in Schedule 2 (r 5(1)-(2)). Schedule 2 lists Food Act 2004 provisions and a pair of penalty-unit amounts for each listed offence, distinguishing individuals and bodies corporate (for example, s 15(1) and (2): individual 5 penalty units, body corporate 25 penalty units; s 16(1) and (2): individual 4 penalty units, body corporate 20 penalty units; see Schedule 2 for full list).

• The Regulations do not set the dollar value of a penalty unit. The prescribed amount is expressed as the monetary value of the number of penalty units listed. Practitioners must therefore confirm the current dollar value of a penalty unit under the relevant statutes or financial regulations to calculate the exact monetary expiation amount.

Issuance and contents of infringement notices

• An authorised officer may issue an infringement notice if they reasonably believe an infringement-notice offence has occurred (r 6). The notice must include the person’s name and address (if known), date the notice is given, the date/time/place of the alleged offence, a description of the offence, the prescribed amount and the enforcement agency to which payment is payable (r 7(1)(a)-(f)). The notice must also inform the recipient of the right to expiate by paying within 28 days, the right to elect court proceedings under the Fines and Penalties (Recovery) Act 2001, and possible enforcement actions that may follow non-payment, including suspension of driving licence, seizure of property, wage deductions, registration of a statutory charge on land, community work orders and ultimately imprisonment for breach of such an order (r 7(2)(a)-(c)).

Payment and withdrawal rules

• Electronic payments are not effective until the amount is credited to the enforcement agency’s bank account; cheques are not effective unless cleared on first presentation (r 8). This affects the timing of expiation and the point at which the CHO may no longer withdraw a notice (r 9 requires withdrawal within 28 days and before payment). The CHO may withdraw an infringement notice by written notice given to the person, provided this occurs within 28 days after the notice was given and before payment (r 9(1)-(2)).

Interaction with prosecutions and multiple notices

• Part 3 expressly preserves the State’s ability to commence or continue criminal proceedings for the same underlying conduct for which an infringement notice has been issued, unless the offence is expiated (r 10(1)). The Part does not require an infringement notice to be issued before prosecution and does not prevent multiple infringement notices for the same offence being issued to the same person; if multiple notices are issued, expiation may be effected by paying the prescribed amount in accordance with any of them (r 10(2)-(3)).

Disciplinary measures for auditors

• The CHO may suspend or cancel an auditor’s approval for reasons including negligent or wilful contravention of the Act or these Regulations, breach of conditions, incompetence, or failure to disclose a direct or indirect interest (r 4F(2)(a)-(e)). The CHO must provide notice of intention and an opportunity to make submissions prior to such action, except where the auditor requests suspension or cancellation (r 4F(3)-(4), r 4G). Auditors have a five-business-day window to seek merits review in the Local Court (r 4F(5)-(8)).

Procedural enforcement consequences

• The infringement-notice drafting requires the inclusion of the enforcement agency specified under the Fines and Penalties (Recovery) Act 2001. The Regulations therefore tie the practical enforcement route for non-payment to that Act, enabling actions such as seizure of property, wage deductions and registration of statutory charges as remedies for unpaid expiation amounts (r 7(2)(c)).

Food Act 2004

• The Regulations function as subordinate instruments under the Food Act 2004, implementing the Act’s registration, renewal and enforcement machinery and elaborating audit powers and obligations. Schedule 2 directly references specific provisions of the Food Act 2004 by identifying which sections are infringement-notice offences and by prescribing penalty units for each (Schedule 2). The Regulations thus operationalise parts of the Food Act by setting fees, auditors’ regime and infringement-notice details.

Food Standards Code and Food Safety Standards

• Auditing duties are explicitly linked to the Food Standards Code: auditors must carry out audits of food safety programs prepared in relation to food businesses under the Food Standards Code and assess compliance with the Food Safety Standards (r 4J). The CHO’s audit frequency determination pertains to programs required by the Food Standards Code (r 4L). The Regulation therefore implements the national technical standards by prescribing how compliance with those standards will be audited and monitored locally.

Fines and Penalties (Recovery) Act 2001

• The infringement-notice procedure in Part 3 is integrated with the Fines and Penalties (Recovery) Act 2001. An infringement notice must specify the enforcement agency as defined in the 2001 Act to which payment is payable (r 7(1)(f)). The notice must inform recipients of their right to elect for the matter to be dealt with by a court under s 21 of the 2001 Act (r 7(2)(b)). The Regulations also list the potential enforcement actions that the 2001 Act enables (r 7(2)(c)(i)-(v)). Practitioners must therefore coordinate strategy and remedies across both instruments.

Local Court jurisdiction and administrative law remedies

• The Regulations create a narrow merits-review route to the Local Court for aggrieved applicants and auditors. Applicants may apply to the Local Court to review merits of a CHO decision about approval of an auditor (r 4C(7)-(9)); auditors may seek review of variation, suspension or cancellation of approval (r 4F(5)-(8)). The Regulations require the Court to confirm, vary, revoke or substitute the CHO decision and to provide reasons. These provisions engage administrative-law principles and provide a short window for review.

Penalty-unit regime and financial legislation

• The prescribed amounts for infringement notices are defined as monetary equivalents of penalty units listed in Schedule 2 (r 5(2)). The value of a penalty unit is governed outside these Regulations, typically in a financial or general penalties statute. Therefore, to compute actual dollar expiation amounts, one must consult the current statutory value of a penalty unit.

Commonwealth and other Territory instruments

• The Regulations cross-reference the Food Standards Code, which is a national instrument. Auditing and compliance obligations in these Regulations are therefore an interface between Territory administrative enforcement and national food-safety standards. The Regulations also refer to identity and enforcement processes that may intersect with other Territory administrative procedures.

Amendments and legislative history

• The endnotes record that the Food Amendment Regulations 2019 introduced key sections and reorganised parts of the Regulations. Those amendments reshaped the auditing and risk-classification infrastructure. For example, pt 1A (regs 3A-3B), pt 2A (regs 4C-4M), and Schedules 1A-1B were inserted by the 2019 amendment (Endnotes).

Commencement and initial enactment

• The Food Regulations 2014 were notified on 24 December 2014 and commenced 1 January 2015 (r 2 and Endnotes). Those Regulations are made under the Food Act 2004 and have been reprinted "as in force at 1 August 2020" in the material provided.

Food Amendment Regulations 2019

• The Endnotes identify the Food Amendment Regulations 2019 (SL No. 18, 2019) as a key amending instrument. It was notified on 31 July 2019. The Endnotes show a staggered commencement: r 6 of that instrument commenced 1 August 2020 (r 2(2)), and the remainder commenced 1 August 2019 (r 2(1)). The 2019 amendment added Part 1A (regs 3A-3B), substituted Part 2 heading, inserted regs 4A-4B, created Part 2A with Division 1 and Division 2 (regs 4C-4M), substituted r 8, amended r 9, substituted Schedule 1 and inserted Schedules 1A-1B (Endnotes, "General amendments").

Specific insertions and substitutions

• The Endnotes list the legislative surgical changes effected by No. 18, 2019: r 3 amended, part 1A heading inserted, regs 3A-3B inserted, Part 2 heading substituted, regs 4A-4B inserted, Part 2A heading inserted with Div 1 & 2 and regs 4C-4M inserted, r 8 substituted, r 9 amended, sch 1 substituted and sch 1A-1B inserted. The Endnotes reflect systematic reworking of the auditing and fee regimes in 2019.

Other formal amendments

• The Interpretation Legislation Amendment Act 2018 made formal amendments of a non-substantive nature to rr 1 and 7 and Schedule 2 of these Regulations (Endnotes). The Endnotes identify those as general amendments of a formal nature that do not affect substantive operation but alter drafting or citation mechanics.

Practical effect of amendments

• The 2019 amendments impose a more prescriptive regime for auditor approvals, reporting and CHO oversight, create a formal risk-classification tool as the basis for fee setting and require public availability of that tool, and recast fee schedules into priority categories with explicit revenue-unit amounts. Practitioners should note that the amendments created the auditing regime (regs 4C-4M) and the classification-fee link (r 3A-3B; Schedules 1-1B).

What the amendments do not change (within the text provided)

• The Regulations as provided do not set the monetary rounding of penalty units, nor do they define "Agency" within the text supplied. They also do not itself set the detailed content of the Northern Territory Food Business Risk Classification; rather the Regulations require its use and publication (r 3A(1)-(3)).

Advice for drafting queries and legislative tracing

• Because the Endnotes list inserted and substituted provisions with their amending instrument (No. 18, 2019) and commencement dates, practitioners consulting earlier versions must pay attention to which provisions came into force in August 2019 and which came later in August 2020 (Endnotes: Food Amendment Regulations 2019). Confirmation against the consolidated legal database or the Northern Territory reprint with amendment history is recommended to confirm the status of transitional provisions and to identify any further amendments post-dating the 1 August 2020 reprint.

No cases are referenced in the Regulations themselves and the provided material contains no transcript of judicial decisions that interpret these specific Regulations. The instrument creates procedural routes that could generate litigation in two predictable areas, both of which are established clearly in the text.

Merits review in the Local Court

• The Regulations provide for merits review in the Local Court of CHO decisions on approval of auditors and CHO decisions varying, suspending or cancelling auditor approvals (r 4C(7)-(9), r 4F(5)-(8)). The Regulations require that the application be made within five business days after notice of the CHO’s decision was received by the applicant (r 4C(8), r 4F(6)). The Court’s powers are set out: confirm, vary, revoke or substitute a decision and the Court must state reasons in writing (r 4C(9), r 4F(7)-(8)).

Potential litigation themes

• Although not illustrated by cases in this text, litigation is most likely to arise in the following factual matrices:
  • Challenge to CHO refusal or conditioning of auditor approval on grounds of competence, including disputes about what constitutes sufficient skills and knowledge (r 4C(1), (4)-(6)).
  • Challenge to suspension or cancellation of approvals where the CHO relies on alleged negligence, contravention or undisclosed interests by the auditor (r 4F(2)(a)-(e)).
  • Disputes over whether an auditor’s conduct required immediate reporting given the threshold "imminent and serious risk" or "significant unsuitability" in r 4M(4)-(5).
  • Challenges to the adequacy of notice given by the CHO under r 4L when imposing audit frequency or the date by which a proprietor must implement food safety programs.

No reported judicial construction provided

• The Regulations do not include any list of judicial decisions construing their provisions. Absent reported decisions in this text, practitioners must rely on statutory text and may need to identify case law subsequently generated, particularly on definitions of "direct or indirect interest" (r 4K), the CHO’s reasonableness in setting audit frequency (r 4L), or on the Local Court’s approach to merits review under these specific enabling provisions.

Elective court proceedings from infringement notices

• The Regulations expressly preserve the right of a recipient to elect to have the matter dealt with by a court under s 21 of the Fines and Penalties (Recovery) Act 2001 (r 7(2)(b)). That route creates opportunities for contested prosecutions or civil litigation against the factual basis of an infringement notice. The Regulations do not themselves provide guidance on evidentiary standards in such court proceedings; those are governed by the 2001 Act and general criminal and civil procedure rules.

Records and public access to classification tool

• The requirement that the risk-classification tool be available for inspection and published on the Agency’s website (r 3A(3)) may generate administrative-law disputes about the content of the tool and how it was applied to a particular business. The Regulations provide the disclosure obligation but do not mandate a right to reasons for an assigned classification. Any dispute about the application of the tool could attract judicial review or merits review approaches depending on the decision-maker and the decision being challenged.

Practical note

• For practitioners preparing to litigate under or about these Regulations, the immediate procedural constraints are critical: five business days for merits review of CHO decisions about auditors, 28 days for expiation payments under infringement notices, and precise time windows for CHO withdrawal of notices. These timelines are embedded in the Regulations (r 4C(8), r 4F(6), r 7(2)(a), r 9(2)) and will drive early case management decisions.

Short windows for court review of CHO decisions

• If a person is dissatisfied with the CHO’s decision about auditor approval or with a variation, suspension or cancellation of approval, the Regulations permit a Local Court review, but only if the application is made within five business days after notice of the CHO’s decision was received (r 4C(8), r 4F(6)). That five-business-day window is short and can foreclose merits review if missed. Practitioners must act quickly to preserve review rights.

CHO discretion over audit frequency and implementation dates

• The CHO alone determines audit frequency for required food safety programs and notifies proprietors in writing (r 4L). There is no statutory limit in the Regulations on how frequent audits can be, nor a requirement for published criteria on frequency. Proprietors will receive a unilateral notice of frequency and implementation date; the Regulations do not specify an internal appeal against audit-frequency determinations, other than general administrative-law avenues.

Payment to auditors not treated as an interest

• Regulation 4K(3) states that payment to an auditor for performing auditor functions does not constitute a direct or indirect interest for the purposes of the conflict-of-interest rule. This means auditors can be paid by the audited business without creating a prescribed conflict. The consequence is a potential perception of conflict that is not a breach of the Regulations as drafted. Practitioners should note that while payment is not an "interest" under r 4K, other professional or ethical rules may still apply.

Immediate reporting threshold and 24-hour clock

• Auditors must immediately report to the CHO any contravention that is an imminent and serious risk to safety or that will cause significant unsuitability of food intended for sale; the Regulation requires the report to be completed as soon as possible and not later than 24 hours after the contravention comes to the auditor’s attention (r 4M(4)-(5)). Determining whether a contravention meets the "imminent and serious" or "significant unsuitability" threshold is a substantive judgment call that can expose auditors and proprietors to rapid enforcement responses.

Unclear definition of "Agency"

• The Regulations repeatedly refer to "the Agency" (for example, r 3A(3) and r 3B) but do not define the term in the excerpts provided. Practitioners must confirm the statutory definition or administrative practice that identifies which department or office "the Agency" denotes when complying with publication or inspection obligations.

Fees tied to Agency-assigned classification

• The fee a proprietor must pay is pegged to the risk classification allocated by the Agency (r 4, r 4A, r 4B; Schedules 1-1B). Businesses have a direct financial incentive to secure a lower risk classification. The Regulations do not set an internal review process for classification decisions in these provisions; challenging a classification may require administrative review or other procedures not specified here.

Infringement notices and multiple proceedings

• Part 3 does not prevent prosecution for the same conduct giving rise to an infringement notice unless the offence is expiated (r 10(1)). Also, more than one infringement notice for the same offence may be issued and a person may expiate under any of them (r 10(3)). This creates complexity for enforcement and defence strategy: payment may extinguish liability under the scheme, but simultaneous prosecutions remain possible unless the offence is expiated.

Timing of payment and CHO withdrawal rights

• Electronic payment is effective only when the amount is credited to the enforcement agency’s bank account and cheques are only effective when cleared on first presentation (r 8). The CHO may withdraw an infringement notice provided this is done within 28 days after issuance and before payment (r 9). These mechanics mean payment by e-payments or cheques can leave a short window in which a CHO withdrawal can change the legal position; careful confirmation of crediting and cheque clearance status is necessary.

Prescribed amounts expressed in penalty units

• Schedule 2 lists penalty units rather than dollar amounts; the prescribed monetary amount is defined as the monetary value of the listed number of penalty units (r 5(2)). Practitioners must look up the current monetary value of a penalty unit to calculate an expiation amount.

Identity card return obligation

• The Regulations require auditors who cease to be food safety auditors to return their identity cards "as soon as reasonably practicable" (r 4H(3)). Failure to return identity cards may attract administrative consequences, though the Regulations do not specify penalties here.

Potential for overlapping enforcement

• The Regulations preserve criminal prosecutions and civil enforcement under the Fines and Penalties (Recovery) Act 2001 alongside the infringement-notice regime (r 10). This can produce overlap and duplication of enforcement pathways, creating strategic choices for both regulators and regulated entities.

Checklist for proprietors and businesses

1. Confirm registration and classification: Ensure registration is current and verify the risk classification assigned by the Agency, since fees for registration, renewal and variation are set by classification and per premises (r 4, r 4A, r 4B; Schedules 1-1B). If unsure who the Agency is, seek clarification from the CHO’s office or the Department responsible for food safety.

2. Budget for fees by premises: For each premises, allocate funds for registration and renewal according to the schedule: registration (P1 180, P2 90, P3 45, P4 0), renewal (P1 145, P2 70, P3 35, P4 0) and for variations (P1 90, P2 45, P3 22, P4 0). Confirm the definition of "revenue unit" and any indexing that may alter monetary values at the time of payment.

3. Implement required food safety programs: Upon receiving written notice from the CHO of the audit frequency and the date by which food safety programs must be implemented, ensure your business has the programs in place by that date (r 4L). Maintain records of implementation to demonstrate compliance in audits.

4. Prepare for audits: Maintain your food safety program documentation and be ready for audit. Expect auditors to report within 21 days of an audit and to follow up on identified deficiencies (r 4M). If an auditor issues an immediate-risk report, respond promptly and document remedial actions; auditors are required to take account of remedial action in their reports (r 4M(2)(c)).

5. Manage interactions with auditors: Recognise auditors will disclose any imminent and serious risk to the CHO within 24 hours (r 4M(4)-(5)). If paying for private auditors, note that payment is not an "interest" for the purposes of r 4K, but maintain transparent contracting and professional independence safeguards.

6. Monitor infringement notices: If served with an infringement notice, check the prescribed amount in penalty units (Schedule 2) and compute the current monetary equivalent using the present penalty-unit value. You have 28 days to expiate by paying the prescribed amount, or you may elect court proceedings under s 21 of the Fines and Penalties (Recovery) Act 2001 by completing the included form (r 7(2)(a)-(b)). Confirm electronic payments are credited to the enforcement agency’s bank account and cheques clear on first presentation (r 8).

Checklist for auditors and prospective auditors

1. Apply for approval in the approved form: If not an authorised officer, apply to the CHO for approval as a food safety auditor, providing requested information and demonstrating competence, skills and knowledge (r 4C(1)-(3)). Authorised officers may request approval in writing and are not required to use the standard application route (r 4D(3)-(4)).

2. Expect conditions and time limits: Approval may be given with conditions and will remain in force until the specified expiry date (not exceeding three years), suspension or cancellation; plan renewals and record expiry dates to avoid lapse (r 4C(4)-(6), r 4E(1)-(2)).

3. Keep conflicts-of-interest disclosures current: Notify the CHO as soon as practicable of any direct or indirect interest in a food business; do not audit any business in which you have such an interest (r 4K(1)-(2)). Remember that payment for auditing services is not a disqualifying "interest" under r 4K(3) but professional independence standards should be maintained and documented.

4. Carry identity card and return on cessation: Keep your CHO-issued identity card while approved and return it to the CHO promptly after ceasing to be an auditor (r 4H(1)-(3)). The identity card must display conditions and expiry and be signed by the CHO and the auditor (r 4H(2)).

5. Timely reporting obligations: Complete audit reports in the approved form within 21 days after completion of the audit and include an assessment of whether the business complies with the Food Standards Code relating to food safety programs (r 4M(1)-(3)). For any imminent and serious risk, prepare a report as soon as possible and not later than 24 hours after becoming aware; provide a copy to the proprietor (r 4M(4)-(6)).

6. Post-audit follow-up: Where deficiencies are found, be prepared to carry out necessary post-audit actions, including further audits to confirm remediation (r 4J(1)-(2)).

Remedies and dispute options

• Challenging CHO decisions: If the CHO refuses approval or varies, suspends or cancels an approval, the affected person may seek merits review in the Local Court within five business days after the notice was received (r 4C(7)-(9), r 4F(5)-(8)). Prepare evidence and arguments quickly because the statutory timeframe is short.

• Infringement notices: Electing court proceedings instead of paying the prescribed amount preserves the opportunity to contest the facts in court under the Fines and Penalties (Recovery) Act 2001 (r 7(2)(b)). If choosing to expiate, ensure electronic payments are credited and cheques clear to make payment effective (r 8). Be aware that the CHO can withdraw an infringement notice within 28 days and before payment (r 9): if a withdrawal notice is received, do not pay.

Administrative and record-keeping best practice

• Keep contemporaneous records of audit-ready documentation, food-safety program implementation, communications with auditors, and CHO notices. Maintain evidence of remediation where auditors identify deficiencies, as r 4M requires auditors to account for remedial action in their reports.

• Ensure financial processes capture fee calculations and payments for registration, renewal and variation by premises and by risk classification. Confirm the meaning of "revenue unit" and current conversion to dollars at the time fees are payable.

• Track approval expiry and renewal deadlines for auditors to avoid lapses in authority.

Engage early with CHO/Agency

• Given the central role of the CHO and the Agency in classification, audit frequency setting and auditor approvals, early engagement with those offices to clarify procedures, expectations, and timelines will reduce compliance risk. If classification appears inconsistent with business operations, raise the issue promptly; formal remedies are limited and time-sensitive.
