What it does
This regulation (Fisheries Management (Aquaculture) Regulation 2024) prescribes the regulatory mechanics for aquaculture permits and leases under the Fisheries Management Act 1994. It commences on 1 September 2024, replacing the 2017 regulation (s 2). Key mechanical changes and features set out in the text are as follows.
First, the regulation defines classes of aquaculture permits and leases and sets detailed conditions tied to each class. Permit classes are listed in section 5(1) (classes A, B, C, D, E, F and H), with definitions for fish hatcheries and marine vegetation hatcheries included. Lease classes are set out in section 37(1) (class 1 to class 4) with depth and activity thresholds used to allocate class membership.
Second, the regulation prescribes procedural requirements for applications, fees and notices. Applications must be in the approved form and accompanied by specified fees, with explicit calculation and adjustment rules for fees using a fee unit mechanism (Schedule 3, Part 1, s 1 and Schedule 3, Part 2). Specific application and processing fees are listed in Schedule 3, Part 2 (items 1, 10, 11, 13, 15, 19, 22, 23, etc).
Third, the regulation imposes operational conditions on permit holders. These include pre-movement notices and record-keeping for transfers of aquaculture species and catching and cultivation material among defined aquaculture production areas (s 11 and s 12), the requirement to keep aquaculture shipment log books in an approved form (s 13), and requirements for commercial farm development plans that must include biosecurity risk management plans (s 21).
Fourth, the regulation creates financial security regimes linked to Class A and B permits. A security condition requires permit holders to guarantee compliance obligations via either a default financial arrangement or elective financial arrangements such as bank guarantees or cash deposits (Part 3, ss 22-26). The default arrangement sets out annual payments, trust accounts and enforcement authorities, while elective arrangements permit forfeiture where recoverable costs are not paid (ss 26-31, 33-35). The regulation establishes and governs several trust accounts, including an Aquaculture Research Trust Account (ss 17-19) and two trust accounts for lease securities and annual default payments (ss 33-34).
