It works alongside the *Fisheries Management Act 1994*.\n\n**Who needs a permit?**\nAnyone running a commercial aquaculture operation generally needs a permit. The Regulation creates different **classes of permits** (A through H) based on what you farm, where you farm it (public water vs private land), and how you farm it (extensive, meaning no feeding, vs intensive, meaning you provide food). Small hobbyists breeding ornamental fish in tanks under 10,000 litres are exempt.\n\n**Using public waters (Leases)**\nIf you want to farm in public rivers, estuaries, or marine areas, you need an **aquaculture lease** (Classes 1–4) in addition to a permit. The government can offer these leases by auction, public tender, or ballot. Lessees must clearly mark their boundaries, keep the area tidy, and maintain navigation channels.\n\n**Financial security and cleanup guarantees**\nHolders of Class A and Class B permits must provide a **financial guarantee** (a bank guarantee, cash deposit, or annual payments into a trust account). This ensures that if the farmer abandons the site or fails to clean it up, the government has funds to do the work instead of using taxpayer money. The money is held in special trust accounts until the permit ends and obligations are met.\n\n**Tracking fish to stop disease**\nTo prevent disease outbreaks, permit holders must notify the Department and keep detailed log books (**aquaculture shipment log books**) before moving live fish, oysters, or farming equipment between different water areas (e.g., from one river to another) or from interstate. There are exceptions for market-ready products.\n\n**Fees and research contributions**\nFarmers must pay application fees, annual administration contributions, and research contributions. These fees are calculated using **fee units** (a set dollar amount that increases automatically with inflation each year). Research contributions go into a dedicated trust fund managed by an advisory committee.\n\n**Labeling for safety**\nAnyone selling shellfish (like oysters or mussels) must label the container with the species and the exact location where they were grown. This allows authorities to trace any contaminated products quickly.\n\n**Why this matters**\nThe Regulation balances commercial fishing interests with environmental protection and public rights. It ensures that public waterways are not left damaged or littered with abandoned farming equipment, tracks stock movements to prevent biosecurity disasters, and ensures fair access to public resources through transparent lease allocation processes."},"summary":{"complexity_score":4,"scope_assessment":{"changed":false,"description":"Based on the available metadata, there is no indication that the scope of this regulation has changed from its original intent.
