What it does
The Child Support (Registration and Collection) Act 1988 makes provision for the collection of certain periodic maintenance payments and for other purposes. Its principal objects, stated in section 3, are to ensure that children receive from their parents the financial support that the parents are liable to provide, that periodic amounts payable by parents towards the maintenance of their children are paid on a regular and timely basis, and that Australia is in a position to give effect to international agreements relating to maintenance. The Act establishes a framework for registering maintenance liabilities, collecting payments from payers and disbursing them to payees. Section 105 applies the Family Law Act 1975 (other than Division 4 of Part V of that Act), the standard Rules of Court, the Federal Circuit and Family Court of Australia (Division 1) Rules, the related Federal Circuit and Family Court of Australia (Division 2) Rules and any Rules made under section 123A of the Family Law Act 1975 to proceedings under this Act (other than proceedings under subparagraph 113(c)(i)), subject to this Act and with such modifications as are prescribed by the applicable Rules of Court, as if the proceedings were proceedings under the Family Law Act 1975. Section 124 provides that the Act applies, with such modifications as are prescribed, in relation to orders (including interim orders) made under a law of a foreign country that are registered in a court under the Family Law Act 1975 or the law of a Territory, and similarly applies to maintenance agreements made under a law of a foreign country that are registered in or approved by a court. Section 5 extends the Act, in so far as it relates to the maintenance of exnuptial children, to New South Wales, Victoria, Queensland, South Australia and Tasmania, and to Western Australia if the Parliament of Western Australia refers the matter of the maintenance of exnuptial children or matters that include that matter to the Parliament of the Commonwealth or if Western Australia adopts this Act in so far as it relates to the maintenance of exnuptial children. Part VIII of the Act provides for court review of certain decisions. The Act operates alongside the Child Support (Assessment) Act 1989 by focusing on registration and collection of liabilities that may arise from administrative assessments or court orders.
