sec.108 Existing inspectors

Subsection (2) applies to a person who— before the commencement, was appointed under a primary Act as an inspector; and still held the appointment immediately before the commencement. The relevant primary Acts are the Introduction Agents Act 2001 , the Manufactured Homes (Residential Parks) Act 2003 and the Security Providers Act 1993 , but not the Tourism Services Act 2003 which adopted inspectors appointed under the Fair Trading Act 1989 . On the commencement, the person is taken to hold office under this Act as an inspector for the primary Act on the conditions stated in the person’s instrument of appointment under the primary Act. Subsection (4) applies to a person who— before the commencement, was appointed under the repealed Property Agents and Motor Dealers Act 2000 as an inspector; and still held the appointment immediately before the commencement. On the commencement, the person is taken to hold office under this Act as an inspector for each 2014 primary Act on the conditions stated in the person’s instrument of appointment under the repealed Property Agents and Motor Dealers Act 2000. s 108 amd 2014 No. 30 s 63 sch 1 (sec.108-ssec.1) Subsection (2) applies to a person who— before the commencement, was appointed under a primary Act as an inspector; and still held the appointment immediately before the commencement.
