What it does
These regulations establish a mandatory registration and real‑time reporting scheme for retail petrol stations in South Australia. Part 2 creates an electronic aggregation system, prescribes the registration and information that fuel retailers must supply to the system, requires retailers to report the "normal fuel price" and the unavailability of fuels, and sets time limits for those reports (regs 5-7). The Commissioner is required to establish and maintain the electronic aggregation system and to publish information about accessing and using it (reg 6(1)-(2)). The Commissioner also has express power to grant, vary or revoke exemptions from the operation of Part 2, either to a specified retailer by written notice or to a class of retailers by notice in the Gazette (reg 4(2)-(3)).
Mechanically, the regulations do four things:
- Define key terms used in the scheme, including "fuel", "normal fuel price", "fuel retailer" and "petrol station" (reg 3).
- Require registration of each petrol station with the Commissioner or a person approved by the Commissioner and prescribe the specific details to be entered into the aggregation system as part of registration (reg 5(1)-(2)).
- Require fuel retailers to enter current normal fuel prices and to report when a fuel is unavailable, and to update price data within defined timeframes linked to pump display changes (reg 7(1)-(2)).
- Create the aggregation system as the centralised electronic repository and public dissemination point for the information and require the Commissioner to publish access and usage information for it (reg 6(1)-(2)).
The registration and ongoing reporting obligations attach to the "fuel retailer for a petrol station" (reg 5(1); reg 3 definition). Existing petrol stations were required to register within 30 days of the commencement of the regulations; new stations must register before they first supply fuel for retail sale (reg 5(1)(a)-(b)). The deadline for updating a price in the aggregation system is "as close in time as possible" to the change and, in any event, no more than 30 minutes after the change takes effect, where a change is made to the pump display (reg 7(2)). The Commissioner may exempt individual retailers or classes of retailers (reg 4(2)-(3)).
