Plain English Summary
3/10 complexity
This instrument prescribes four government-funded transition programs under the Export Control Act 2020 to support parties affected by phasing out live sheep exports by sea. It targets sheep producers, shearers, livestock transport businesses and related transport businesses, sets commencement (the day after registration — 13 August 2025) and repeal (30 June 2029) dates, and records each program’s purpose and beneficiary classes.
This instrument mechanically prescribes four transition assistance programs under section 424E of the Export Control Act 2020. Section 424E is the enabling provision that empowers the Minister to make grants or arrange payments for transition assistance related to the phasing out of live sheep exports by sea. The instrument does not itself appropriate money, create statutory entitlements, or impose any regulatory prohibition on exporting live sheep: those prohibitions or phase out mechanisms exist elsewhere in the Act or in separate regulations. What the instrument does is define the categories of program that can receive funding and the description and purpose of each program. It also specifies the legislative power of the Commonwealth Parliament underpinning these programs, namely paragraph 51(i) of the Constitution (trade and commerce with other countries and among the States). This specification of power is not ornamental: it signals that the instrument may rely on the trade and commerce power to support spending that could otherwise face a head of power challenge under section 81 or 96 of the Constitution. The instrument has a fixed sunset: the whole instrument is repealed at the end of 30 June 2029. The practical effect is that any funding commitments under these programs must be made and substantially completed before that date. The instrument creates no ongoing duties or compliance obligations independently of any grant agreement that might later be entered into. It is a spending enabling instrument, not a regulatory restriction. The four programs address different nodes of the sheep supply chain: research and development extension, the shearing industry, farm business transition, and livestock transport industry transition. Each program description and purpose is set out in a table at section 5.

This instrument is the Export Control (Transition Assistance—Phase Out of Live Sheep Exports by Sea Programs) Instrument 2025.
2 Commencement
2 Commencement
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.
The central concept is "transition assistance" as enabled by section 424E of the Export Control Act 2020. The instrument does not define that term but prescribes specific programs that constitute the assistance. The instrument creates two defined categories of business for transport related programs. A "livestock transport business" means a business that on or after the commencement of the instrument is engaged in transporting live sheep for export by sea and was so engaged for any period between 1 July 2022 and 30 June 2025. A "livestock transport related business" means a business that is engaged in transporting goods related to or for use in the export of live sheep by sea and was so engaged in that same lookback period. The distinction matters because item 4 of the table in section 5 covers both categories but the co funding requirement and eligible activities apply differently. The four program concepts are: (1) Support for Research and Development Extension Program, which funds organisations to demonstrate and encourage adoption of best practice farming systems and disseminate options for other market opportunities; (2) Shearing Industry Transition Program, which funds an industry organisation to help shearing contractor businesses offer a broader range of seasonal and regional work; (3) Farm Business Transition Program, which funds sheep producers to access advice, apply R&D innovations, and invest in on farm infrastructure and alternative farming systems; (4) Livestock Transport Industry Transition Program, which funds transport businesses to access advice and training and invest on a co funded basis in asset modification or acquisition for other transport activities. A critical threshold concept is that recipients must be "are, are likely to be, or will be negatively affected by the phasing out of the export of live sheep by sea". This is a forward looking and discretionary test that will depend on the applicant's circumstances and the assessor's judgment. The instrument does not define the "phasing out of the export of live sheep by sea" but treats it as an established policy trajectory.
Who it affects
The instrument directly affects four categories of economic participants. First, sheep producers who are negatively affected or likely to be negatively affected by the phase out. This includes producers whose business model depends on the live export channel as a price setting mechanism or as an alternative to domestic processing. The instrument does not limit eligibility by geographic location, but the practical effect falls most heavily on Western Australian producers because the vast majority of live sheep exports by sea depart from Western Australian ports and the domestic processing capacity in that state is limited. Second, shearing contractor businesses and individual shearers whose employment patterns are tied to the seasonal demands of the live export supply chain. The Shearing Industry Transition Program funds an industry organisation rather than individual shearers directly, meaning shearers must rely on the organisation's program design to access benefits. Third, livestock transport businesses and livestock transport related businesses. These are narrowly defined: they must have been engaged in the relevant transport activity between 1 July 2022 and 30 June 2025 and continue to be so engaged after commencement. This lookback excludes businesses that entered the live sheep transport market after 30 June 2025 (if any remained permitted). Fourth, organisations involved in research and development extension that can demonstrate how their work informs options for negatively affected supply chain participants. The instrument does not mention export brokers, feedlot operators, livestock agents, or port handling businesses, though these may also be affected and may fall within the broader "sheep supply chain participants" language of the R&D program description. The instrument also affects Commonwealth administrators who must design grant guidelines, assess applications, and manage the co funding and acquittal processes. The sunset at 30 June 2029 creates a hard deadline that affects the time horizon for business planning: any transition investment must be committed and completed within roughly four years.
Key duties and rights
The instrument creates no duties in the conventional regulatory sense. It does not prohibit conduct, require licensing, or mandate compliance with standards. Instead it creates rights of eligibility: businesses and organisations that meet the criteria in the program descriptions and definitions have the right to apply for funding under the prescribed programs. The instrument itself does not specify grant amounts, application forms, merit criteria, or assessment processes. Those will be set out in separate grant guidelines or funding arrangements administered by the Department of Agriculture, Fisheries and Forestry or its delegate. The instrument does create a specific right for livestock transport businesses and livestock transport related businesses to access co funded asset modification or acquisition under item 4 of the table. The phrase "on a co funded basis" indicates that the Commonwealth will not bear the full cost: the business must contribute its own funds. The instrument does not specify the co funding ratio, leaving that to program design. The instrument also creates a right for sheep producers under item 3 to invest in on farm infrastructure and alternative farming systems and practices using program funding. This is potentially valuable for producers who wish to shift to wool production, meat processing, or other agricultural activities. The instrument does not create a right to payment from the Commonwealth in the absence of an approved application and a signed grant agreement. The rights are contingent on administrative discretion, budget allocation, and compliance with any conditions imposed under the funding arrangement. The specified legislative power in section 6 confirms that the Commonwealth relies on its trade and commerce power to sustain these programs, which may be relevant to any future challenge to the constitutional validity of spending decisions made under this instrument.
Penalties and enforcement
The instrument itself contains no penalty provisions. It does not create offences, civil penalties, infringement notices, or enforceable undertakings. Enforcement, if it arises, will flow from the grant agreements entered into under these programs. Standard Commonwealth grant agreements typically include provisions for repayment of unspent funds, clawback for misused funds, termination for breach, and referral for investigation under the Criminal Code Act 1995 (Cth) if fraud or false statements are involved. The instrument does not impose any reporting obligations directly. Any compliance burden arises from the terms of the grant agreement rather than from this legislative instrument. The instrument's sunset on 30 June 2029 means that any compliance enforcement action must be completed before that date or the instrument ceases to be the authorising mechanism for the programs. However, grant agreements typically survive the repeal of the authorising instrument by their own terms. The instrument gives the administering department discretion in program design, and that discretion includes decisions about audit frequency, verification of claims, and assessment of whether a business or person is "negatively affected" by the phase out. There is no right of merits review established in the instrument itself, though judicial review under the Administrative Decisions (Judicial Review) Act 1977 (Cth) may be available for decisions made under the programs if the grant guidelines are legislative or the decisions are deemed to be made under an enactment. The absence of penalty provisions in the instrument should not be read as an absence of legal risk for recipients who make false claims or misuse funds. The general law of contract and the Commonwealth's fraud and financial benefits offences apply.
How it interacts with other laws
This instrument is made under section 424E of the Export Control Act 2020 and operates as a legislative instrument for the purposes of the Legislation Act 2003. It is subordinate to the parent Act. If any provision of the parent Act imposes conditions on the making of grants under section 424E, those conditions apply and are not overridden by this instrument. The instrument also interacts with the broader Export Control framework: the phase out of live sheep exports is governed by other provisions of the Act or regulations made under it, including any prohibitions, licensing requirements, or transitional arrangements that reduce or eliminate the number of sheep that may be exported by sea. This instrument does not affect the operation of those provisions. It provides assistance in response to them. The instrument specifically specifies legislative power under paragraph 51(i) of the Constitution. This is unusual in a program prescribing instrument and suggests that the drafter anticipated potential constitutional challenge. The reliance on the trade and commerce power rather than the spending power under section 81 or the grants power under section 96 may have implications for how the programs are structured: spending under section 81 is limited to purposes of the Commonwealth, whereas section 96 allows conditional grants to states without the same purpose limitation. If the programs involve direct payments to private businesses rather than to states, the specification of section 51(i) may be necessary to ensure constitutional validity. The instrument does not reference state laws or state transition assistance programs. Where state programs exist (for example, Western Australian government support for affected producers), the interaction between Commonwealth and state funding is not addressed. Recipients may need to consider whether Commonwealth grant income is assessable for tax purposes under the Income Tax Assessment Act 1997 (Cth) and whether GST applies. The instrument is silent on taxation treatment.
Amendment history
This instrument, registered on 13 August 2025, appears in its original form with no amendments recorded in the source text. The commencement table confirms that the whole instrument commenced the day after registration, which is 13 August 2025. The note to the table states that it relates only to provisions as originally made and will not be amended to deal with later amendments. This means any future amendment would require a separate amending instrument. The instrument has a fixed sunset of 30 June 2029. Given the limited four year life and the fact that it prescribes programs rather than creating ongoing regulatory settings, amendments are unlikely unless the policy settings change significantly. Possible amendments could include adding new programs, modifying program descriptions or purposes, extending the lookback period, or altering the sunset date. The source text does not indicate any amendment history because none exists. The instrument is too recent to have been amended. The Legislative Instruments Act 2003 (now the Legislation Act 2003) requires the Federal Register of Legislation to maintain a version history, and any amendment would appear in a compiled version. Practitioners cannot rely on this instrument being static, but the source text as provided reflects the instrument as originally made. The instrument is a legislative instrument, not a regulation or a rule, so amendments would be made by a further instrument under section 424E of the Export Control Act 2020. The parent Act may itself be amended, which could affect the scope of section 424E and therefore this instrument, but no such amendment is present in the source.
Litigation history
The source text names no cases and contains no reference to litigation. This is consistent with an instrument that commenced on 13 August 2025 and has been in force for a very short period. The instrument is part of a highly contested policy area: the phase out of live sheep exports has been the subject of political debate, parliamentary scrutiny, and legal challenge. The specification of legislative power under section 51(i) of the Constitution in section 6 of this instrument suggests that the drafter was conscious of potential constitutional challenge. A challenge might argue that the programs do not fall within the trade and commerce power because they relate to domestic transition rather than to international trade. Alternatively, a challenge might argue that the spending is not for the purposes of the Commonwealth if the phase out itself is challenged as beyond Commonwealth power. No such challenge has yet produced a reported judgment affecting this specific instrument. Any litigation that does arise would likely focus on: (a) whether the specification of legislative power is sufficient to support the programs; (b) whether decisions made under the programs are justiciable; or (c) whether grant decisions can be challenged under the Administrative Decisions (Judicial Review) Act 1977 (Cth). The instrument itself does not provide for merits review, so any challenge would need to proceed by way of judicial review on administrative law grounds. The constitutional specification in section 6 may also be relevant to any challenge to the validity of the parent Act's phase out provisions: if the phase out is held invalid, this instrument's programs would lose their statutory foundation because they are defined by reference to "the phasing out of the export of live sheep by sea". No such holding exists in the source text.
Gotchas
The instrument contains several features that could trap unwary businesses or practitioners. First, the sunset of 30 June 2029 is absolute: the whole instrument is repealed on that date without savings provisions shown in the source. Any grant agreements that extend beyond that date would need to be separately authorised or the instrument would cease to be the enabling provision for further payments. Second, the lookback period for transport businesses is narrow: they must have been engaged in the relevant transport activity between 1 July 2022 and 30 June 2025. A business that was involved before 1 July 2022 but not during that specific three year window is excluded. A business that enters the live sheep transport market after 30 June 2025 is also excluded, even if it is negatively affected by the phase out. Third, the co funding requirement for transport businesses under item 4 is stated but the ratio is unspecified. Businesses may assume they will receive full funding and then discover a significant co contribution is required. Fourth, the Shearing Industry Transition Program funds "an industry organisation" rather than individual shearers or shearing contractors directly. The individual or business has no direct right to funding; they must rely on the organisation's program design and distribution decisions. Fifth, the phrase "are, are likely to be, or will be negatively affected" appears in each program description but is not defined. This gives wide discretion to the administering department and may lead to inconsistent treatment of applicants. Sixth, the instrument does not define "sheep producer" or "shearing contractor business". These terms will need to be interpreted by administrators and may be narrower than the ordinary business understanding. Seventh, the Farm Business Transition Program requires investment in on farm infrastructure and alternative farming systems but does not specify what qualifies. A producer who invests in something the department later deems ineligible risks losing funding. Eighth, the instrument does not provide for review of adverse decisions. A business denied funding has no statutory avenue of internal review or merits review under this instrument, though judicial review may be available. Ninth, the instrument specifies legislative power under section 51(i) of the Constitution but does not specify any corresponding limitation. If a program is challenged as outside power, the outcome is uncertain.
How to comply
Since this instrument creates no prohibitions or duties, "compliance" means positioning a business or organisation to successfully access the prescribed programs. The first step is to determine whether the business falls within one of the eligible categories: sheep producer, shearing contractor business or individual shearer, livestock transport business, livestock transport related business, or an organisation involved in research and development extension. For transport businesses, documentary evidence of engagement in the relevant transport activity between 1 July 2022 and 30 June 2025 should be gathered. This may include contracts, bills of lading, port records, or financial statements showing income from live sheep transport. Without this evidence, the business cannot satisfy the definition in section 4. For sheep producers, evidence of being "negatively affected" by the phase out should be assembled. This may include evidence of reduced sale prices, reduced saleyard throughput, increased transport costs to alternative markets, or loss of access to specific export markets. The instrument does not specify a test for "negatively affected" so producers should build a robust factual case. For shearing contractors, the instrument does not allow direct application to the Commonwealth. The business should contact the designated industry organisation once it is announced and ensure its employees and contractors are registered or identified for program purposes. For all applicants, attention should be paid to the sunset date: applications must be submitted and approved, and for transport businesses the co funded asset modification or acquisition must be completed, before 30 June 2029. Early engagement with the administering department is advisable because program guidelines and application rounds are not specified in the instrument. Businesses should also consider the tax treatment of any grant payments received: grant income may be assessable under ordinary income concepts or may be subject to specific provisions in the tax legislation. GST implications should also be assessed, particularly for co funded asset acquisitions. Legal advice should be sought before entering into any grant agreement to understand clawback provisions, reporting obligations, and the consequences of early termination. The instrument itself does not provide a compliance checklist; the obligations will arise from the grant agreement, not from the legislative instrument.
Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.
