sec.40 Other authorities
A person is an appropriate person for the issue of an authority, other than an authority mentioned in sections 36A to 39 , if the chief inspector is reasonably satisfied the person or, if the person is a corporation, an executive officer of the corporation— is an adult; and is physically able to handle explosives under the authority; and has satisfactory knowledge of— the requirements under the Act applicable to holders of the authority; and the hazards associated with the explosives to which the authority would apply; and is, in all the circumstances, an appropriate person for the issue of the authority. For subsection (1) (c) , the chief inspector may require the person to take a written, oral or practical examination. s 40 amd 2019 Act No. 7 s 104 (sec.40-ssec.1) A person is an appropriate person for the issue of an authority, other than an authority mentioned in sections 36A to 39 , if the chief inspector is reasonably satisfied the person or, if the person is a corporation, an executive officer of the corporation— is an adult; and is physically able to handle explosives under the authority; and has satisfactory knowledge of— the requirements under the Act applicable to holders of the authority; and the hazards associated with the explosives to which the authority would apply; and is, in all the circumstances, an appropriate person for the issue of the authority. (sec.40-ssec.2) For subsection (1) (c) , the chief inspector may require the person to take a written, oral or practical examination.
- (a) is an adult; and
- (b) is physically able to handle explosives under the authority; and
- (c) has satisfactory knowledge of— (i) the requirements under the Act applicable to holders of the authority; and (ii) the hazards associated with the explosives to which the authority would apply; and
- (i) the requirements under the Act applicable to holders of the authority; and
- (ii) the hazards associated with the explosives to which the authority would apply; and
- (d) is, in all the circumstances, an appropriate person for the issue of the authority.
