Environment Protection and Biodiversity Conservation Act 1999 - Proclamation - Uluru (Ayers Rock-Mount Olga) National Park (24/05/1977)

The proclamation deploys a limited set of legal and cartographic concepts to effect its purpose. Those concepts, as they appear on the face of the instrument, are:

• Proclamation under an enabling Act: The instrument identifies the power exercised as sub-section (2) of section 7 of the National Parks and Wildlife Conservation Act 1975. The proclamation-form is the vehicle by which that statutory power is exercised, subject to the procedural precondition recorded in sub-section (11) of the same section that the Governor-General shall not make the proclamation except after the Federal Executive Council has considered a Director's report.

• Declaration of park status: The core operative provision is that the area specified in the Schedule is "declared to be a park" and is assigned the name "Uluru (Ayers Rock-Mount Olga) National Park". The declaration converts the identified land area, as defined in the Schedule, into the legal category of "park" under the enabling legislative framework.

• Vertical extent: The proclamation expressly includes "the subsoil beneath the land within that area extending to a depth of 1000 metres below the surface". This is an express grant of the park declaration to a three-dimensional extent: surface plus subsoil down to 1000 metres.

• Schedule as description: The Schedule uses geodetic and survey language to describe the park perimeter, relying on parallels of latitude, meridians of longitude, bearings, distances and reference points. The Schedule also employs "more or less" language for total area measurement and designates specified exceptions (a) to (g) where smaller parcels are excluded.

• Procedural prerequisites and executive actors: The recitals state that the Federal Executive Council considered a report by the Director of National Parks and Wildlife, and the Acts Interpretation Act 1901 (section 16A) is invoked to treat the Administrator as the person for the time being administering the Government in place of the Governor-General, acting with the advice of the Federal Executive Council.

• Exclusions and specificity: The Schedule does not merely provide a single polygon. It lists seven separately described excluded parcels, with areas and detailed bearings and distances. These exceptions narrow the declared park footprint from the larger area initially described.

• Authentication: The proclamation bears formal authentication through signature, ministerial command and the Great Seal. This establishes it as a formal executive instrument on the face of the document.

These main concepts determine the instrumental mechanics and legal geometry of the declaration. The instrument is essentially declaratory and configurational; it does not itself include detailed regulatory regimes, rights or penalties. It therefore relies on the enabling Act and other laws for operational rules that will govern behaviour inside the declared park area.

The proclamation identifies the parcel of land and subsoil declared to be a park; consequently it directly affects any person or legal entity with interests, proprietary, possessory, or regulatory,in that specified land or the subsoil down to 1000 metres. The instrument on its face does not name any particular private parties, holders of title, leaseholders, licence-holders, or native title claimants; it instead operates by altering the legal status of the land described in the Schedule. Anyone whose rights in the area are derived from the legal status of the land, future administrators, statutory managers under the enabling Act, resource title applicants, and land administrators, will be affected insofar as the wider statutory scheme applies to declared parks.

Who decides: the proclamation record shows who made the declaration and the procedural actors required by the enabling law. The Administrator of the Government of the Commonwealth of Australia issued the instrument acting with the advice of the Federal Executive Council, as permitted by section 16A of the Acts Interpretation Act 1901. The Federal Executive Council is recorded as having considered a report by the Director of National Parks and Wildlife, which the recitals indicate is a statutory prerequisite under sub-section (11) of s 7 of the National Parks and Wildlife Conservation Act 1975. The Minister of State for Environment, Housing and Community Development signed by command. Those actors are the decision-makers recorded on the face of the instrument.

Who pays: the proclamation itself is silent about funding, compensation, or the allocation of financial responsibilities arising from the change of legal status. The instrument does not contain any schedule allocating costs, nor does it state whether any compensation, acquisition payments, or administrative outlays are payable to owners or third parties. Any costs arising from the change in status are therefore not described on the face of this instrument and must be located in the enabling Act or in subsequent administrative decisions.

Behavioural consequences and affected parties: the proclamation changes the legal description of the land and subsoil. That fact will matter to statutory managers and to parties who would otherwise seek to exercise rights in the land or subsoil, because the area is now described as a national park under the enabling Act. The Schedule’s detailed exclusions are relevant to parties whose interests fall inside those excepted parcels, because those excluded parcels remain outside the declared park footprint. The instrument’s silence about regulatory detail means that the immediate, concrete effect is classification and naming rather than the imposition of specific operational constraints in the text itself.

Practical identification: the Schedule supplies the coordinates, bearings and distances needed to identify the area in cadastral or mapping systems. That technical content directly affects surveyors, land registry officials, and administrators who will implement the declaration in records and maps.

The proclamation itself confers a status and records procedural compliance; it does not enumerate operational duties, rights, or entitlements in the text. Nevertheless the instrument establishes several legal touchpoints that create duties and vest authority, at least procedurally.

Procedural duties recorded on the face of the instrument: the recitals make explicit that a Governor-General proclamation under sub-section (2) of s 7 of the National Parks and Wildlife Conservation Act 1975 must be preceded by consideration by the Federal Executive Council of a report by the Director of National Parks and Wildlife pursuant to sub-section (11) of that section. The proclamation records that the Federal Executive Council has considered the Director’s report. That recorded sequence identifies a statutory procedural duty for the executive in making the declaration: obtain or obtain consideration of the Director’s report and refer the matter to the Federal Executive Council prior to proclamation.

Authority and executive action: the instrument purports to effect the declaration through the Administrator acting with the advice of the Federal Executive Council in light of section 16A of the Acts Interpretation Act 1901. The document therefore identifies who lawfully made the declaration and the authority underpinning the act. The Administrator, the Federal Executive Council and the Director of National Parks and Wildlife appear as relevant actors tied to duties and decision-making functions in the recitals.

Rights and obligations of land or subsoil holders: the proclamation does not directly state which rights to the land or subsoil are extinguished, preserved, or modified. It declares the area to be a park and includes the subsoil down to 1000 metres, which on its face suggests the park status covers both surface and subsurface. However the instrument does not specify whether pre-existing private rights, licences, leases, easements, or other interests are extinguished, suspended, or to be compensated. Those questions are not resolved by this proclamation text and would require reference to the enabling legislation and any associated regulations for concrete duties on, or rights of, third parties.

Administrative duties following the declaration: because the proclamation assigns a name and declares the area a park, administrative duties will arise to give effect to the declaration: updating public records, mapping, signage and registering the name in whatever registers are used to reflect national parks. The proclamation itself does not specify those steps; it merely creates the substantive factual and legal baseline that triggers them.

Narrow exceptions and specificity: the Schedule’s exceptions (a) to (g) define small parcels excluded from the declared park. Those excluded parcels create discrete duties for administrators and surveyors to ensure that the declared park boundary does not inadvertently include the excepted land. For any party with an interest in those excepted parcels, the Schedule provides the detailed descriptive material needed to identify whether their parcel was excluded or included, which is the first step in determining applicable duties and rights.

Limitations of the instrument: the proclamation does not set out enforcement powers, management obligations or public access regimes. As such, it primarily creates the legal circumstance in which the enabling Act’s management and regulatory provisions will apply, but the proclamation itself does not articulate those rights and duties.

This proclamation contains no express penalty provisions, enforcement mechanisms, or detailed sanctions. It is a declaratory instrument that describes the land and grants park status and a name in accordance with the recitals. There are no sections in this text that impose criminal, civil, administrative or regulatory penalties, nor does it specify an enforcement agency or procedure for contraventions.

Two implications flow directly from that absence on the face of the document. First, any penal or enforcement provisions applicable to activities within the declared park must be sourced in the enabling statute, the National Parks and Wildlife Conservation Act 1975, or in subordinate instruments made under that Act. The proclamation records the statutory power used to create the park, but it does not itself define how the park will be policed, which acts will be prohibited or permitted, what fines or other legal remedies will apply, or how enforcement will be carried out. Second, the absence of penalty clauses in this instrument means any practical legal consequences for third-party behaviour must be inferred from, and enforced under, the wider legislative and regulatory framework that governs parks under the enabling Act.

The instrument does record procedural compliance required by the enabling Act, namely the Federal Executive Council’s consideration of a Director’s report prior to the proclamation as recorded in the recitals citing sub-section (11) of s 7. That recorded compliance is administrative rather than penal, but it is a prerequisite that, if not met in form, could be relevant to any legal challenge to the validity of the proclamation. The proclamation asserts that the procedural requirement was satisfied; the instrument does not itself provide an internal mechanism for review or revocation.

Because the proclamation extends the park status to the subsoil down to 1000 metres, any enforcement regime that applies to mineral exploration, extraction, drilling, or other subsurface activities will need to be looked up in the enabling Act or in separate resource law. This proclamation does not allocate authority over subsurface enforcement, nor does it identify which statutory regimes govern subsurface rights. Enforcement and penalty questions therefore fall outside the text of this proclamation and must be located in the enabling legislation and related instruments.

The proclamation itself invokes and relies upon other legislative instruments on its face, and its operation is functionally connected to those laws. The text makes three explicit references that determine legal interaction points.

First, the enabling power is identified as sub-section (2) of section 7 of the National Parks and Wildlife Conservation Act 1975. The proclamation is therefore an exercise of authority conferred by that Act, and its practical legal effects must be understood in conjunction with the wider provisions of that Act. The proclamation does not reproduce the enabling Act's substantive management provisions, but by declaring the area to be a park under that Act it imports the need to apply any relevant regulatory and management framework the Act provides. Any duties, prohibitions, licensing regimes, or penalty regimes that apply to parks under that Act will be the instruments through which the declaration has operational effect.

Second, the recitals quote sub-section (11) of s 7 of the enabling Act, which constrains the Governor-General's power to make a proclamation to circumstances after the Federal Executive Council has considered a report by the Director of National Parks and Wildlife. The proclamation records that the Federal Executive Council took that procedural step. The interaction here is procedural: the enabling Act imposes a precondition for valid exercise of power, and the proclamation asserts that precondition was satisfied. That interaction affects the legal provenance and possible challenges to the instrument, because compliance with statutory procedural steps can be material to validity.

Third, the proclamation invokes section 16A of the Acts Interpretation Act 1901 to treat a reference to the Governor-General as including the person administering the Government of the Commonwealth (in this case the Administrator, Sir Arthur Roden Cutler), and to require that references to the Governor-General be read as the Administrator acting with advice of the Federal Executive Council. This interaction explains why the Administrator can make the proclamation and be treated as the Governor-General for the purposes of making it. The Acts Interpretation Act function thus supplies interpretative support for a substitutionary executive actor.

Other statutory interactions are not specified in the proclamation text. The instrument does not refer to land title, Crown land provisions, compulsory acquisition or compensation, mineral titles, native title, environmental impact assessment regimes, planning laws, or local government powers. Where those subject-matter laws intersect with national parks, such intersections will be governed by their own text and by how the enabling Act reconciles them. The proclamation does not itself resolve conflicts or state precedence between the park declaration and other regimes. It therefore operates as a focal point: to understand complete legal effects, one must combine the proclamation's declaration and schedule with the substantive provisions of the National Parks and Wildlife Conservation Act 1975 and any other laws that govern land, subsurface rights, and administrative obligations in the Northern Territory.

Finally, the Schedule’s reliance on geodetic descriptions and explicit excepted parcels means that cadastral and land-registration statutes and systems will be implicated. The proclamation supplies the descriptive material that those systems will need to implement the change in status in mapping and registers, but the proclamation does not itself amend land titles or list the procedural steps for updating registers.

The proclamation as supplied contains its date of issue, signatories and the text of the declaration and Schedule. It bears the date "24 May 1977", and it is signed by the Administrator of the Government of the Commonwealth of Australia, Sir Arthur Roden Cutler, acting with advice of the Federal Executive Council. The instrument is authenticated with the Great Seal and it carries the ministerial command "By His Excellency's Command, KEVIN NEWMAN Minister of State for Environment, Housing and Community Development."

Inside the four corners of this document there is no indication of any amendments to the proclamation. The text does not show repeal language, subsequent modifications, corrections, schedules of consequential amendments to registers or other instruments, or dates of later variation. There is no marginal note, stamp or appended note indicating the proclamation has been superseded or amended. The Schedule stands as the descriptive baseline for the declared park in this instrument.

Because this document is a standalone proclamation, any amendment, repeal, or variation would need to be effected by a subsequent legal instrument, whether by further proclamation or by legislative amendment of the enabling Act, or by an executive instrument authorised under that Act. No such subsequent instrument is contained within this text. The absence of any amendment clause or later-date annotation in this document means that, on its face, this is the original declaration as made on the date shown.

For practitioners or researchers, this absence is functionally material. It means that to determine whether the declaration remains in force, or whether the boundaries, name, vertical extent, or exceptions have been amended, one must search for later proclamations, amending instruments, or statutory changes in the enabling legislation. The proclamation itself supplies the initial entry point and the authoritative text of the original declaration, but it does not record any subsequent legal history.

The document’s provenance details, date, signatory, ministerial command and Great Seal, are sufficient on their face to support its authenticity as of the date of issue. Any later legal history, including amendment or revocation, cannot be inferred from the document itself and therefore must be sought in external secondary instruments or legislative records.

The proclamation text does not contain or reference any litigation, judicial decisions, or references to legal proceedings. There are no case citations, no references to judicial review, and no indication that the proclamation was subject to, or the subject of, court proceedings within the text supplied. Consequently this document contains no litigation history inside its own language.

From a source-grounded vantage point, the absence of litigation material in the proclamation has two practical implications. First, the instrument itself gives no record of legal challenges to its validity, nor does it record settlements, orders, or undertakings made in litigation. Second, because the proclamation records that a procedural prerequisite was observed, the Federal Executive Council's consideration of the Director’s report as required by sub-section (11) of section 7,any potential judicial challenge claiming procedural invalidity would need to be pursued against the background of the factual assertion recorded in the instrument that the requisite consideration occurred. The proclamation asserts compliance with the enabling Act's procedural step; the text does not address the content or adequacy of the Director’s report or the substance of the Federal Executive Council's consideration.

For those seeking litigation history related to this declaration, the proclamation does not provide any leads beyond the names, date and the fledged description of the declared land and excepted parcels. Any judicial material, whether about the validity of the proclamation, disputes over boundaries, challenges to administrative process, or claims relating to rights in the excluded or included parcels, would need to be found in court records, law reports or administrative tribunal files outside this document. The proclamation itself neither records nor summarises such proceedings.

Researchers should therefore treat this text as a primary declaratory instrument with no litigation narrative embedded. To establish whether litigation followed, one must perform a search of judicial and tribunal databases, relying on the name and date in this proclamation as search terms. The instrument does not purport to be a litigation record or to incorporate judicial commentary.

The proclamation contains several technical and legal particulars that demand attention when using the instrument to identify rights, responsibilities and administrative steps. These particulars do not introduce policy judgments; they are mechanics and potential traps for practitioners and administrators.

1. Subsoil to 1000 metres included: The declaration explicitly extends to "the subsoil beneath the land within that area extending to a depth of 1000 metres below the surface". That express vertical extent is unusual in some instruments and means that any subsurface rights within that 1000 metre band may be implicated by the park declaration. The proclamation itself does not specify whether or how existing mineral rights, exploration licences, or other subsurface interests are affected. Practitioners must not assume subsurface rights remain unaffected: the instrument does not say so.

2. Precision of the Schedule and "more or less" language: The Schedule gives a total area of "132,550 hectares more or less". The words "more or less" and the reliance on bearings and distances mean that small discrepancies may arise between the Schedule description and modern surveyed boundaries. Surveyors and land registry officers must reconcile the Schedule language with current geodetic standards.

3. Excepted parcels (a)-(g): The Schedule contains seven specific exclusions by area and metes-and-bounds. Those excepted parcels are specified with precise bearings and distances tied to a base intersection (latitude 25 degrees 20 minutes 13.47 seconds south with the meridian of longitude 131 degrees 2 minutes 46.87 seconds east). Small errors in interpreting the base reference point or in converting bearings to modern coordinate systems could lead to incorrect application of the exceptions.

4. Reliance on the Petermann Aboriginal Reserve as a boundary reference: The Schedule references "the eastern boundary of the Petermann Aboriginal Reserve". The proclamation assumes the existence and recognisability of that reserve boundary. Practitioners must ensure the referenced reserve boundary is correctly identified in cadastral records for accurate mapping.

5. Administrator substituted for Governor-General: The recitals invoke section 16A of the Acts Interpretation Act 1901 to treat references to the Governor-General as including the person for the time being administering the Government of the Commonwealth. The proclamation is therefore issued by the Administrator acting with advice of the Federal Executive Council. When relying on this instrument, confirm that the substitution was lawfully made for the date in question.

6. No compensation or funding language: The proclamation does not mention compensation for owners, or any funding to implement the park’s administration. If rights are affected but compensation or transitional arrangements are required under other law, those are not dealt with here.

7. No operational rules or enforcement in the text: The proclamation does not list permitted or prohibited activities, management arrangements, or enforcement mechanisms. Anyone expecting to find the operational legal regime in this instrument must consult the enabling Act and regulations.

8. Historical drafting conventions: The instrument reflects drafting conventions of the 1970s: bearings given in degrees and minutes, latitudes and longitudes in degrees, minutes and seconds, use of "more or less" and metes-and-bounds descriptions. Modern geographic information systems may require conversion or reconciliation.

Each of these points is a potential practical trap when interpreting or giving effect to the proclamation. They are not conclusions about the policy merits of the declaration; they are concrete technical and legal issues arising from the text on its face.

Compliance questions under this proclamation split into two categories: procedural compliance by decision-makers at the time of making the proclamation, and practical compliance by land administrators, surveyors, and affected parties in registering and operating under the new park status. The proclamation itself records the procedural step that must be satisfied under the enabling Act and supplies the descriptive material necessary for practical implementation. The following checklist is source-grounded and limited to steps implied by the instrument.

For decision-makers seeking to replicate or validate the process used here:

• Ensure the Federal Executive Council has considered a report by the Director of National Parks and Wildlife, as required by sub-section (11) of section 7 of the National Parks and Wildlife Conservation Act 1975, before making a proclamation under sub-section (2) of s 7. The proclamation records that this consideration is a mandatory precondition to valid exercise of the power.
• Where the Governor-General is not available, rely on section 16A of the Acts Interpretation Act 1901 to treat the Administrator as the person administering the Government; ensure that the Administrator acts with the advice of the Federal Executive Council, as recorded in this instrument.

For administrators, surveyors and registrars implementing the declaration:

• Use the Schedule’s descriptive material to identify the declared area. The Schedule sets the boundary by reference to parallels and meridians, bearings and distances, a fixed intersection with the eastern boundary of the Petermann Aboriginal Reserve, and specific excepted parcels (a)-(g). Careful geodetic conversion is necessary for accurate mapping.
• Treat the listed excepted parcels (a) to (g) as outside the park. Each exception contains bearings, distances and area measurements that must be used to exclude those parcels from the declared park footprint when updating maps or title data.
• When updating registers, records and maps, note the declared name "Uluru (Ayers Rock-Mount Olga) National Park" and the date of proclamation 24 May 1977. Use the exact name as assigned by the proclamation for any official records to avoid naming inconsistencies.

For parties with interests in the land or subsoil:

• Identify whether your interest lies inside the area defined in the Schedule or within an excepted parcel. The Schedule supplies the descriptive detail needed to make that determination.
• Note that the proclamation includes the subsoil down to 1000 metres. If your interest involves subsurface rights or activities, take particular care to determine whether those rights are inside the declared park’s vertical extent.
• The proclamation does not address compensation, extinguishment of rights, or transitional arrangements. If your rights may be affected, consult the enabling Act and any relevant regulations or administrative instruments to determine the legal consequences and whether compensation or other protections exist.

For records and audit:

• Keep a copy of the proclamation with its signatures and Great Seal as the primary source document showing the declaration and the date it took effect. The instrument is self-authenticating on its face and will serve as the primary legal record for the park’s establishment.

For future actions:

• Any modification to the park boundary, name, vertical extent, or excluded parcels must be effected through the legal mechanisms provided by the enabling Act and appropriate executive or legislative instruments. The proclamation itself contains no amendment mechanism and therefore any changes require a subsequent valid instrument.

This compliance guidance is limited to the obligations and steps implied by the text of the proclamation. It does not address substantive regulatory obligations that may follow under the National Parks and Wildlife Conservation Act 1975 or other laws. Where compliance questions involve operational rules, penalties, or compensation, the enabling Act and any subordinate instruments must be consulted.
