Electricity (Principles of Vegetation Clearance) Regulations 2021

The regulations turn a handful of technical and administrative concepts into binding legal parameters. These concepts appear repeatedly in both the body and the schedules and determine how obligations apply on public and private land, in bushfire risk areas, for different voltage classes and for particular vegetation types.

Clearance zone and buffer zone: The clearance zone is the primary safety envelope around an overhead powerline and is defined by the diagrams and numerical values in Schedule 1 (definition in reg 3 and Schedule 1). On private land and in bushfire risk areas, a buffer zone adjoins the clearance zone; occupiers are explicitly not required to clear vegetation beyond the buffer zone (reg 5(3)). Schedule 1 sets how those zones are drawn and the numerical values (V, H, B, S, P) that determine their extents (Schedule 1 cl 5).

Voltage and span dependence: The required clearance dimensions depend on the operating voltage of the line and the length of the span between supports. Schedule 1 contains tables for multiple voltage bands (240 V to 11 kV, 19 kV, 33/66 kV, 132-275 kV) and span brackets; the relevant table determines V, H, B, S and P used in the diagrams (Schedule 1 cl 5 and Tables 1-4). For high-voltage lines (132 kV and 275 kV) there is a "stepout" S and alternative S* values available subject to certain conditions (Schedule 1 cl 5(2)-(3) and Table 4). A "3.5m rule" sets a minimum vertical clearance in certain circumstances (Schedule 1 cl 5).

Low risk powerline: The regulations carve out a category of low risk powerline , an overhead powerline in a prescribed area, each span not exceeding 50 m and carrying low voltage conductors (reg 3 definition). Low risk powerlines can be managed under an alternative, somewhat relaxed principle focussed on preventing contact or arcing (reg 4(2)(b)), but only where the Technical Regulator has approved that approach (reg 4(4)). The prescribed area is itself defined by maps on a Technical Regulator website (reg 3(3)).

Private vs public powerline and private powerline voltage threshold: The distinction between public land and private land matters because buffer zones and who must clear differ. The regulations also define "private powerline" for section 4(1) of the Act by setting the prescribed voltage at 19 kV (reg 3(2)). That numerical threshold determines whether a line is a private powerline for occupier duties under reg 5.

Vegetation classification: Schedule 2 introduces three practical classes for planting and nurturing near public powerlines: approved vegetation (expected mature height 3 m or less), permitted vegetation (more than 3 m but not more than 6 m), and exempt vegetation (generally under 2 m and includes small crops and groundcovers). The lists of species and the boundaries are to be published on a Technical Regulator website, meaning the legal effect of Schedule 2 is coupled to an external delegated list (Schedule 2 cl 1 and cl 4 Table 1).

Technical Regulator roles and delegations: The Technical Regulator controls several discretionary instruments. The regulator publishes the bushfire risk area maps (reg 3), may approve entities to use relaxed principles for low risk powerlines (reg 4(4)), may require electricity entities to prepare clearance guidelines (reg 4(6)), may grant exemptions to occupiers and persons in relation to Schedule 2 provisions on application (reg 7), and may determine alternate clearance zone values for a specific line on application (Schedule 1 cl 6). Applications require forms and Minister-fixed fees (reg 7(2); Schedule 1 cl 6(3)). The regulator also resolves objections and may stay clearance works while an objection is determined (reg 10).

Contracting and local schemes: Electricity entities may contract with councils to agree vegetation clearance schemes for areas outside prescribed areas (reg 8). Those schemes must be in writing, may be enforced as contracts (reg 8(5)-(6)), and must not derogate from the prescribed principles (reg 8(4)). Electricity entities may also make agreements with occupiers of private land to carry out more frequent inspections or to have the occupier perform the work (reg 9). Such agreements are contractual and must be written and executed (reg 9(1)-(2)).

Procedural protections: The regulations build in notice and objection mechanisms. Electricity entities must notify councils at least 30 days before starting a clearance program (reg 11), and notices to owners/occupiers must state the right to object to the Technical Regulator (reg 10(8)). An objection lodged within 21 days can suspend the entity from carrying out the proposed clearance until the regulator determines the objection (reg 10(1)-(4)).

Penalty and qualification hooks: The instrument prescribes an offence for breach of a condition attached to a Technical Regulator exemption with a maximum penalty and expiation fee (reg 7(5)). It also prescribes a minimum qualification (a diploma in arboriculture from a registered training organisation) for persons exercising vegetation clearance powers on behalf of an electricity entity (reg 12).

Taken together, these concepts create a system that ties technical clearances to voltage/span tables, routes bespoke adjustments and disputes to the Technical Regulator, channels local variation through bilateral schemes or contracts with councils or occupiers, and links planting rules to a schedule and regulator-published species lists.

The regulations allocate duties and decision-making across four principal actors and several peripheral actors. The text identifies who pays, who decides, and who must act.

Electricity entities: Entities that have duties under section 55 of the Electricity Act 1996 to keep vegetation clear around public powerlines are at the centre of the regime. They must inspect overhead powerlines at intervals no longer than three years and clear vegetation to the standards set out in regulation 4 (reg 4(2)). Electricity entities may agree vegetation clearance schemes with councils for public land (reg 8), enter written agreements with occupiers of private land (reg 9), apply to the Technical Regulator for determinations about clearance-zone parameters for particular powerlines (Schedule 1 cl 6), and may be required by the Technical Regulator to prepare guidelines on clearance (reg 4(6)). Electricity entities are also given procedural obligations, for example to provide councils with at least 30 days written notice of planned clearance programs (reg 11(1)) unless a vegetation clearance scheme applies (reg 11(2)).

Councils: Councils that have a duty to keep vegetation clear of powerlines may carry out clearance under the same principles, but are explicitly permitted to avoid clearing more vegetation than reasonably necessary to satisfy the stricter standard (reg 4(7)). Councils may enter into clearance schemes with electricity entities governing how the duty will be carried out in their area; those schemes must be written, may be enforced as contracts, and must not derogate from the prescribed principles (reg 8(2), (4)-(6)). Councils receive 30 days' notice of proposed clearance programs affecting their area (reg 11).

Occupiers and owners of private land: Occupiers have duties concerning private powerlines. An occupier must keep non-naturally occurring vegetation clear of private overhead powerlines so that vegetation does not intrude into the clearance zone in still air and is not likely to bend into it in reasonably expected winds (reg 5(2)). Occupiers are not required to clear beyond buffer zones (reg 5(3)). Occupiers may enter into written agreements with electricity entities whereby the occupier performs inspections and clearance or where additional inspection frequency is specified (reg 9). Occupiers may apply for exemptions where vegetation is planted or nurtured for commercial purposes (reg 7(1)(a)), and they may lodge objections to notices to enter under Part 5 that freeze intended clearance until the Technical Regulator determines the objection (reg 10).

Technical Regulator: The Technical Regulator is the central decision-maker for discretionary matters. The regulator publishes the bushfire risk area maps that determine which technical provisions apply (reg 3). The regulator may grant exemptions to occupiers from reg 5 or from Schedule 2 (reg 7), may approve electricity entities to manage low risk powerlines under the alternative principles in reg 4(2)(b) (reg 4(4)), may require guidelines, and may on application alter clearance-zone dimensions for particular powerlines provided minimum clearances are maintained (Schedule 1 cl 6). The regulator also adjudicates objections (reg 10).

Planting, farming and commercial growers: The regulations explicitly provide an exemption pathway for occupiers who plant or nurture vegetation for commercial purposes (reg 7(1)(a)). Schedule 2 places constraints on what vegetation may be planted or nurtured within specified distances of public powerlines and refers to a regulator-published list of approved and permitted species (Schedule 2 cl 1 and cl 4 Table 1). Those who grow small crops or ground covers will typically fall under the exempt vegetation classification in Schedule 2 cl 1.

Training organisations and qualified personnel: The regulations prescribe a minimum qualification for persons exercising an electricity entity’s vegetation clearance power , a diploma in arboriculture obtained from a training organisation registered under the South Australian Skills Act 2008 or an equivalent law elsewhere (reg 12). That affects workforce compliance and procurement decisions for electricity entities using contractors.

Other stakeholders and municipal amenity interests: Landholders, residents and interest groups are affected through the consultation and objection mechanisms. Councils and electricity entities must consider amenity, historical or biological significance, and the long-term effect on vegetation health when formulating schemes (reg 8(3)(b)-(d)). Those interests appear as factors to be weighed in schemes, and may be the subject of objections under reg 10.

Minister and fee structure: The Minister fixes application fees for exemptions and Technical Regulator determinations (reg 7(2)(c); Schedule 1 cl 6(3)(c)). The regulations therefore expose applicants to a fee regime set by the Minister, with the potential for cost-recovery conditions attached to exemptions (reg 7(4)(b)).

Who bears costs: The immediate operational costs of inspection and clearance fall on electricity entities and councils when they have statutory duties. However, the regulations allow costs to be imposed on exemption applicants by condition (reg 7(4)(b)), and agreements under reg 9 may set payments between entities and occupiers for additional work. The contractual enforcement of schemes and agreements (regs 8(6), 9(2)(d)) means parties can allocate costs by private contract, subject to the non-derogation requirement in reg 8(4).

In sum, electricity entities and councils perform most of the active duties and bear direct operational costs; occupiers bear obligations with respect to private powerlines and may face offence exposure where they breach conditions of an exemption (reg 7(5)). The Technical Regulator is the gatekeeper for exceptions, determinations and objections.

The regulations translate safety standards into discrete duties and procedural rights. Below are the principal duties for each actor and the corresponding rights that shape how those duties may be exercised, constrained, or contested.

Duties of electricity entities and councils (reg 4)

• Inspect overhead powerlines and clear vegetation at intervals of no longer than three years (reg 4(2)).
• For powerlines other than low risk powerlines, clear vegetation such that: no vegetation remains in the clearance zone in still air at the time of clearance; regrowth is unlikely to intrude into the clearance zone within three years (or shorter interval if scheduled); and vegetation is not likely to bend into the clearance zone in wind within that same interval (reg 4(2)(a)(i)-(iii)).
• For low risk powerlines, clear vegetation either in accordance with the paragraph above, or so that no vegetation is likely to contact the powerline or otherwise create leakage, tracking, bridging or cause damage resulting in fire, shock or supply loss , but the alternative applies only if the Technical Regulator has approved its use (reg 4(2)(b), reg 4(4)).
• Do not clear more vegetation than reasonably necessary and not beyond a buffer zone except in limited exceptions (reg 4(5)(a)(i)-(ii)). Exceptions include reasonableness for vegetation health or appearance, removal of plants wholly grown in the previous five years of species known to grow into the clearance zone, or at the occupier’s request provided legality (reg 4(5)(a)(iii)-(v)).
• For low risk powerlines supported on structures that also carry non-low voltage conductors, apply the stricter principles to non-low voltage conductors and the lower risk principles to low voltage conductors (reg 4(3)).
• May be required by the Technical Regulator to prepare internal guidelines for clearance where specified (reg 4(6)).
• Must give the relevant council at least 30 days written notice before commencing a clearance program unless a vegetation clearance scheme applies (reg 11(1)-(2)).

Duties of occupiers on private land (reg 5)

• Keep vegetation (other than naturally occurring vegetation) clear of private overhead powerlines so that no part intrudes into the clearance zone in still air and none is likely to bend into the zone in reasonably expected winds (reg 5(2)).
• Not required to clear beyond the buffer zone (reg 5(3)).
• Must not clear vegetation which the occupier may not lawfully clear apart from these regulations more than reasonably necessary for the clearance and for enhancing appearance, stability, or health of remaining vegetation, and must not clear beyond the buffer zone (reg 5(4)(a)-(b)).

Rights and procedural protections (reg 7, reg 10)

• Occupiers planting or nurturing vegetation commercially (excluding timber) may apply for an exemption from reg 5 (reg 7(1)(a)). Other persons may apply to be exempted from Schedule 2 provisions in relation to specified vegetation (reg 7(1)(b)). Applications must use Technical Regulator-approved forms, include specified information and be accompanied by a Minister-fixed fee (reg 7(2)).
• Before determining exemption applications, the Technical Regulator must give the electricity entity or council a reasonable opportunity to make submissions and be heard (reg 7(3)). Exemptions must be in writing, may be conditional, and may require the applicant to pay costs incurred by the electricity entity or council in keeping vegetation clear (reg 7(4)). A breach of an exemption condition is an offence with a specified maximum penalty and expiation fee (reg 7(5)).
• Owners or occupiers may lodge objections to notices of intention to enter land under Part 5; objections must be in writing and lodged within 21 days unless extended (reg 10(1)-(2)). The Technical Regulator must notify the entity or council of any objection and, upon notification, the entity or council is prohibited from carrying out the clearance until the objection is determined (reg 10(3)-(4)). The regulator may dismiss objections on specified grounds, direct action or reflect an agreement that resolves the objection (reg 10(5)-(6)).

Contractual arrangements (regs 8-9)

• Electricity entities and councils may agree a vegetation clearance scheme for public land outside prescribed areas; schemes must be written, may be varied, and are enforceable as contracts but cannot derogate from the prescribed principles (reg 8(2)-(6)). The scheme-making process requires consideration of factors including vegetation nature, amenity impact, significance, long-term effects, planting controls, need to prevent damage to powerlines, and the costs and resources of council and entity (reg 8(3)).
• Electricity entities may enter written agreements with occupiers of private land for more frequent inspection or to have the occupier undertake work on behalf of the entity; such agreements must specify areas, intervals and payments if applicable, may be varied, and are enforceable as contracts (reg 9(1)-(2)).

Technical Regulator powers (reg 4(4), Schedule 1 cl 6)

• The Technical Regulator may approve electricity entities to apply the low risk powerline principles at reg 4(2)(b)(ii) (reg 4(4)).
• The regulator can determine alternative numeric values or methods for V, H, B or S in relation to a specified portion of a powerline on application by an entity, provided minimum clearances are still met (Schedule 1 cl 6(1)-(2)). Applications must use approved forms, contain specified information and be accompanied by a Minister-fixed fee; determinations must be in writing and the regulator may vary or revoke them (Schedule 1 cl 6(3)-(5)).

Qualification requirement (reg 12)

• For the purposes of section 55AA(2) of the Act, the prescribed qualification for persons exercising vegetation clearance power on behalf of an electricity entity is a diploma in arboriculture from a registered training organisation under the South Australian Skills Act 2008 or equivalent jurisdictional law (reg 12).

Other procedural duties

• When giving a notice of intention to enter private land under Part 5, the entity or council must include a statement of the owner's or occupier's rights to lodge an objection with the Technical Regulator (reg 10(8)).

These duties create overlapping legal and contractual obligations. Electricity entities and councils must meet technical clearance standards and follow notice, consultation and possible freeze procedures where objections are raised, while occupiers must manage vegetation on private powerlines within buffer limits and may seek exemptions or contract arrangements where commercial planting is undertaken.

The regulations contain limited explicit penalties within the text provided. They also create procedural and contractual enforcement mechanisms and vest discretionary enforcement powers in the Technical Regulator. The operative elements for enforcement and penalties follow.

Express statutory offence and expiation (reg 7(5))

• The only explicit criminal sanction contained in these regulations is for contravention of, or failure to comply with, a condition of an exemption granted under regulation 7. That contravention is declared an offence with a maximum penalty of $5,000 and an expiation fee of $315 (reg 7(5)). The regulations do not, within the text provided, set other monetary penalties for breach of the clearance principles; the contravention of exemption conditions is the sole penal provision expressly included here.

Contractual enforcement (regs 8(6), 9(2)(d))

• Several mechanisms turn agreements and schemes into private law remedies. Vegetation clearance schemes agreed between an electricity entity and a council have effect and may be enforced as a contract between the parties (reg 8(6)). Similarly, agreements between electricity entities and occupiers have contractual effect and may be enforced as contracts (reg 9(2)(d)). Those contractual remedies operate in addition to any statutory rights the Act may confer (the Act itself is referenced as the source of Part 5 powers), and they permit allocation of financial responsibilities and performance obligations by private agreement.

Technical Regulator determination and procedural stays (reg 10)

• The objection process gives the Technical Regulator an active enforcement-related role. When an objection is lodged to a notice of intention to enter land for clearance, the regulator must notify the electricity entity or council (reg 10(3)). The regulations prohibit the electricity entity or council from carrying out the clearance to which the objection relates until the objection has been determined by the Technical Regulator (reg 10(4)). The regulator may dismiss the objection (including on grounds of repetition, frivolousness, or lack of prior attempt to resolve) or direct the entity or council to act or not act in specified ways (reg 10(5)-(6)). The regulator must notify the parties of its determination as soon as practicable (reg 10(7)). The power to stay works pending determination is a potent administrative control that operates independently of any criminal or civil penalty.

Exemptions and conditions with cost recovery (reg 7(4))

• Exemptions granted by the Technical Regulator must be in writing and may be subject to conditions, including a condition that the applicant pay any costs that the electricity entity or council incur in keeping vegetation clear in accordance with the regulations (reg 7(4)(b)). Non-compliance with such conditions is the offence flagged above (reg 7(5)). Thus a financial enforcement lever , direct liability for cost recovery conditioned on the exemption , is available to the regulator.

Administrative powers to vary determinations (Schedule 1 cl 6(5))

• The Technical Regulator’s written determinations on clearance-zone values for particular powerlines may be varied or revoked by notice in writing to the electricity entity (Schedule 1 cl 6(5)). The prospect of revocation forms an administrative compliance mechanism: a determination that makes operations easier for an entity can be withdrawn if compliance or safety thresholds are not being maintained.

Notice and opportunity to be heard (reg 7(3))

• Before deciding an exemption application, the Technical Regulator must permit the electricity entity or council with the duty to keep vegetation clear a reasonable opportunity to make submissions and be heard (reg 7(3)). That procedural protection gives the entity or council a say before conditions are imposed that could shift costs onto them or limit their ability to meet safety obligations.

Gaps and relationship with the Act

• These regulations are drafted to sit under Part 5 of the Electricity Act 1996 and expressly prescribe principles for that Part (regs 4(1), 5(1)). The enforcement architecture for failure to comply with Part 5 may be supplemented by offences and enforcement powers in the principal Act. The regulations themselves do not reproduce any Part 5 entry or penalty provisions; they provide the Technical Regulator with adjudicative and conditioning powers and embed contractual enforcement as a default for schemes and agreements. Where the regulations are silent about criminal sanctions for failing to meet clearance principles, enforcement may therefore rely on the Part 5 machinery of the Act, contractual remedies, and the regulator’s conditional exemptions and determinations.

Application fees and Ministerial role

• Applicants for exemptions (reg 7(2)(c)) and for Technical Regulator determinations under Schedule 1 cl 6(3)(c) must pay application fees fixed by the Minister. The regulations do not set the fee levels, but the requirement to pay a Minister-fixed fee is an administrative barrier that can influence the number and type of applications made.

Operational consequences of procedural provisions

• The objector’s right to lodge an objection with a statutory stay on clearance work (reg 10(4)) is a strong procedural protection that can prevent immediate clearance and force a regulator-mediated resolution. For entities this creates litigation risk in the administrative sense: work schedules can be interrupted pending regulator decisions. For occupiers it creates an accessible statutory right to pause works that affect their land.

In short, the regulations create a mixed enforcement landscape: a narrow criminal sanction tied to exemption condition breaches, contractual enforcement of schemes and agreements, administrative controls (objection-triggered stays, regulator determinations and revocations), and delegated cost-allocation tools. The Technical Regulator acts as the central adjudicator and conditioning authority.

These regulations are subordinate legislation under the Electricity Act 1996 and explicitly designed to operate in the context of Part 5 of that Act (regs 4(1) and 5(1)). The text also links to and depends upon other statutory instruments, regulatory publications, and external laws in a number of concrete ways.

Primary enabling statute: Electricity Act 1996

• The regulations are made under the Electricity Act and prescribe principles for Part 5 of that Act (reg 4(1), reg 5(1)). They do not reproduce Part 5; rather they operationalise the duty to keep vegetation clear. Where the regulations refer to powers "under Part 5 of the Act" (for example, notice to enter and the right to object), the Act supplies the underlying statutory authority for entry, notice and other enforcement mechanisms. The text provided does not include the Act’s provisions themselves, so the practical enforcement and remedial consequences of failing to meet these regulations may be augmented by the Act.

Cross-reference to South Australian Skills Act 2008

• Regulation 12 prescribes a specific qualification for persons exercising vegetation clearance power on behalf of an electricity entity: a diploma in arboriculture obtained from a training organisation registered under the South Australian Skills Act 2008 or an equivalent training law (reg 12). This links workforce credential requirements under these regulations to the vocational education registration regime.

Ministerial role and fees

• The Minister is required to fix application fees for exemptions (reg 7(2)(c)) and for Technical Regulator determinations under Schedule 1 cl 6(3)(c). Fees fixed by the Minister thus interact administratively with the fee schedules or ministerial instruments set under other legislation governing public fees, though those instruments are not reproduced here.

Regulator publications and external content

• Several operational definitions and restrictions require external materials published on a Technical Regulator-determined website. The bushfire risk area is defined as parts of the State shown in maps published on a website determined by the Technical Regulator (reg 3 definition of bushfire risk area). Schedule 2’s lists of approved and permitted vegetation species are to be published on a Technical Regulator website (Schedule 2 cl 1). These cross-references create a legal regime where the technical scope of the regulations depends on external, regulator-published materials. The legal effect of the schedules therefore depends on the content of those publications.

Interaction with "other law" constraints on clearing vegetation

• The regulations recognise that occupiers may be constrained from clearing certain vegetation by other laws. For example, reg 4(5)(a)(v) allows an electricity entity to undertake clearance at an occupier’s request only if the proposed clearance would not be contrary to any other law if carried out by the occupier. Similarly reg 5(4) prohibits occupiers from clearing vegetation which they may not lawfully clear apart from the regulations. These cross-references acknowledge overlaying statutory or regulatory regimes that may restrict clearance for heritage protection, conservation, native vegetation, or planning controls , although those other laws are not specified in the text provided.

Interaction with Part 5 notices and objection mechanics

• The objector rights in reg 10 are directly linked to Part 5 notices of intention to enter land; the regulations establish the process for lodging an objection to such notices and give the Technical Regulator the power to determine objections. That creates a procedural interface between Part 5 entry powers and the regulator’s administrative processes.

Contract law and enforceability

• The rules that convert clearance schemes and agreements into enforceable contracts between parties (reg 8(6) and reg 9(2)(d)) mean that common law and statutory contract principles will operate in parallel. Parties entering schemes must therefore consider general contract law, municipal law, and any relevant public law limitations when drafting enforcement provisions.

Administrative law and regulator decision-making

• The Technical Regulator’s functions under reg 7 and Schedule 1 cl 6 (granting exemptions, determining alternate clearance metrics, hearing objections, varying determinations) are administrative acts. Although not detailed here, those acts will plausibly engage principles of administrative law (procedural fairness, reasoned decision-making, reviewability) in practice. The regulations themselves require the regulator to give the electricity entity or council a reasonable opportunity to make submissions before determining an application for exemption (reg 7(3)), which is a procedural fairness step.

Revocation of prior subordinate legislation

• Schedule 3 revokes the Electricity (Principles of Vegetation Clearance) Regulations 2010, creating a clear line of legislative substitution. Any transitional or savings provisions would need to be sought in the enabling instruments or explanatory materials, but revocation is explicit.

In short, the regulations are tightly coupled to the Electricity Act 1996 and to the Technical Regulator’s web-published artefacts. They require coordination with training/qualification law, ministerial fee instruments, administrative law norms, contract law for schemes, and other statutory regimes that might constrain vegetation clearing. Where they defer to external publications or other laws, those external instruments will determine operational effect.

The regulations are new instruments that came into force on 1 September 2021 (reg 2). The legislative history attached to the instrument records the principal regulations entry: Year 2021, No 114, Gazette 12.8.2021 p3018, with commencement on 1.9.2021 (Legislative history). Schedule 3 expressly revokes the Electricity (Principles of Vegetation Clearance) Regulations 2010 (Schedule 3).

Key mechanical points in the instrument’s legislative history and amendment posture are these:

• The regulations replace the earlier 2010 subordinate legislation by revocation in Schedule 3. There is no separate transitional provision printed in the text provided; the revocation is simply contained as part of Schedule 3.

• The instrument is cited as the Electricity (Principles of Vegetation Clearance) Regulations 2021 (r 1).

• The regulations come into operation per the commencement clause on a single date: 1 September 2021 (r 2) , the legislative history gives the Gazette reference.

• The regulations incorporate external dynamic content (maps and species lists) published on a website determined by the Technical Regulator (reg 3(bushfire risk area) and Schedule 2 cl 1 approved and permitted vegetation lists). Because the content of those external publications can be amended administratively by the Technical Regulator, the practical effect of the regulations may change over time without amendment to the regulations themselves, depending on the content and updates to those web materials.

• The Minister is empowered to fix the application fees for exemptions and Technical Regulator determinations (reg 7(2)(c); Schedule 1 cl 6(3)(c)). The regulations therefore anticipate minor instrument variation (fees) by ministerial decision rather than by formal amendment to the regulations.

• The Technical Regulator has discretion to make and vary written determinations about clearance zone values for particular powerlines and to revoke those determinations (Schedule 1 cl 6(1)-(5)). Such determinations are administrative variations to the application of the Schedule 1 tables and have legal effect in relation to specified portions of lines.

No subsequent amending instruments are printed in the materials provided. If an entity needs to track changes in practice or legal effect, two streams are relevant: amendments to the regulations themselves as published in the Gazette, and changes to the Technical Regulator-published materials (maps and species lists), and the Ministerial fee instruments.

The printed text of the regulations does not include any decisions, reported litigation history, or references to cases. The instrument is a statutory regulation and the materials supplied do not record any judicial interpretations, appeals, or litigation that has engaged these specific regulations.

What the regulations do embed that could lead to litigation (or administrative review) includes:

• Disputes about the Technical Regulator’s exercise of discretion in granting exemptions and in determining alternate clearance values under Schedule 1 cl 6 (both of which require applications in approved form and permit conditions and fees) (reg 7; Schedule 1 cl 6).
• Challenges to determinations by the Technical Regulator under the objection process in reg 10 , for example disputes about whether an objection was rightly dismissed or whether a stay on works was properly applied or lifted.
• Contractual disputes under vegetation clearance schemes between electricity entities and councils (reg 8(6)) or under agreements between electricity entities and occupiers (reg 9(2)(d)), particularly where parties disagree about whether clearing work complied with the prescribed principles or about cost-sharing.
• Administrative law review applications concerning procedural fairness tied to reg 7(3) (the requirement to give the electricity entity or council reasonable opportunity to make submissions) or to the regulator’s variation/revocation of written determinations under Schedule 1 cl 6(5).

Absent any reported cases in the text, no judicially settled points of construction for these regulations are available within the materials provided. Practitioners should therefore expect that interpretation questions might be novel and that administrative decision-making by the Technical Regulator will be central to how ambiguities are resolved in practice.

Several practical pitfalls and operational traps are embedded in the drafting. These are items that can create compliance risk, shifting costs or operational surprises if not anticipated.

Reliance on regulator-published maps and lists

• Critical definitions depend on materials published on a Technical Regulator website. The bushfire risk area is defined by the regulator’s maps (reg 3). Schedule 2’s lists of approved and permitted vegetation are also on the regulator’s website (Schedule 2 cl 1). The legal standard therefore moves with what the regulator publishes. Parties cannot rely solely on the fixed text of the regulations to determine whether a locality is in a bushfire risk area or whether a species is approved; they must check the current regulator publications.

Objection freezes clearance work

• If an occupier or owner objects to a notice of intention to enter land, the electricity entity or council is prohibited from carrying out the clearance to which the objection relates until the Technical Regulator has determined the objection (reg 10(4)). That statutory stay can halt urgent works and create scheduling and safety consequences. Entities must therefore anticipate that work may be delayed and design procedures (consultation, early notice, pre-emptive agreements) to mitigate the risk (reg 10(8) requires inclusion of a statement of rights in notices).

Exemption condition breach is an offence

• While exemptions can be tailored and may include cost recovery conditions (reg 7(4)(b)), contravening a condition is an offence with a $5,000 maximum penalty and a $315 expiation fee (reg 7(5)). Applicants who rely on exemptions need to manage and document compliance with conditions carefully.

Buffer zone interplay and clearing limits

• Occupiers are not required to clear beyond the buffer zone (reg 5(3)), and electricity entities must not clear beyond the buffer zone except in narrow exceptions (reg 4(5)(a)(ii)-(iii)). However, electricity entities can agree to clear at the occupier’s request provided the action would not be unlawful if carried out by the occupier (reg 4(5)(a)(v)). This interplay creates a potential ambiguity where private or public obligations, planning restrictions, heritage laws or conservation regulations limit what can be cleared. The regulations explicitly recognise that other laws can constrain clearance (reg 4(5)(a)(v); reg 5(4)).

Dynamic technical parameters and regulator determinations

• Schedule 1 contains tables for V, H, B, S and P values, but the Technical Regulator can determine alternative values for a specific powerline on application (Schedule 1 cl 6). The regulator will do this only if minimum clearances are maintained (Schedule 1 cl 6(2)). Entities wanting to reduce clearing burdens must make an application and pay a Minister-fixed fee (Schedule 1 cl 6(3)). That application process can be time-consuming and risky if the regulator refuses or imposes conditions.

3-year inspection cycle is a maximum, not a minimum

• Regulation 4(2) sets that overhead powerlines must be inspected and vegetation cleared at intervals of no longer than three years. This is a maximum interval; entities or councils may schedule more frequent inspections. Agreements with occupiers can specify more frequent inspections (reg 9(1)(a)). Operationally, entities that try to rely on a three-year cycle regardless of local growth rates may risk non-compliance with the "no growth likely to intrude within 3 years" standard that must take account of reasonably ascertainable vegetation characteristics (reg 4(2)(a)(ii)).

Low risk powerline approvals required

• Low risk powerlines have the potential for alternative clearance treatment (reg 4(2)(b)(ii)), but only if the Technical Regulator has approved the electricity entity to use those principles (reg 4(4)). Entities cannot unilaterally adopt the lower standard simply by classifying a line as low risk; approval is required.

Interactions with other laws and municipal controls

• Clearing work that would otherwise be lawful under these regulations could nonetheless be unlawful under other statutes or planning controls. The regulations explicitly preserve those other legal limits (reg 4(5)(a)(v) and reg 5(4)). Entities and occupiers should check heritage, native vegetation, planning overlays and conservation laws before acting.

Contractual schemes cannot derogate from prescribed principles

• Vegetation clearance schemes agreed between entities and councils must not derogate from the prescribed principles (reg 8(4)). Parties drafting schemes should not assume that a written agreement can relax clearance requirements; schemes can govern process and factor weighting but cannot contradict the core technical standards.

Qualification requirement applies to entity powers

• The prescribed qualification for exercising vegetation clearance power on behalf of an electricity entity is a diploma in arboriculture from a registered training organisation (reg 12). Entities using contractors must ensure contractors meet that qualification requirement or an equivalent recognised under the Skills Act, or risk a technical compliance issue.

Financial and administrative friction from fees and conditions

• Exemption and determination applications require Minister-fixed fees (reg 7(2)(c); Schedule 1 cl 6(3)(c)). Exemptions may be conditioned on cost recovery (reg 7(4)(b)). Those costs can be material for commercial growers, councils or occupiers and may affect whether an applicant seeks an exemption or a scheme.

Ambiguities on "naturally occurring vegetation"

• Reg 5(2) exempts "naturally occurring vegetation" from the occupier’s duty, but the term is not defined within the provided text. That lack of definition could create disputes about what counts as naturally occurring versus planted, particularly on semi-rural properties.

In practice, these gotchas mean that electricity entities, councils and occupiers must integrate legal checks, local growth assessments, regulator publications, and contract terms into clearance planning; failure to do so risks delays, administrative penalties, or contractual disputes.

Compliance under these regulations requires combining technical measurement, procedural discipline and administrative interaction with the Technical Regulator and relevant local authorities. Below is a practical compliance checklist mapped to the regulatory text.

1. Identify jurisdictional designations

• Determine whether the land is in a bushfire risk area using the Technical Regulator-published maps (reg 3 definition of bushfire risk area). Confirm whether the locality is within a prescribed area for the low risk powerline definition (reg 3(3)).

2. Classify the powerline

• Confirm whether the powerline is public or private. For the purposes of private powerline definitions under section 4(1) of the Act the prescribed voltage is 19 kV (reg 3(2)). Identify the operating voltage (240 V-11 kV, 19 kV, 33/66 kV, 132-275 kV) and measure span lengths for application of Schedule 1 tables (Schedule 1 cl 5 and Tables 1-4).

3. Apply Schedule 1 tables and diagrams

• Use Schedule 1 diagrams and tables to determine the clearance zone, buffer zone and the numeric values V, H, B, S and P for each span. For high-voltage lines (132 kV and 275 kV), apply the "stepout" S and check the alternative S* option and the 3.5 m minimum where applicable (Schedule 1 cl 5 and Table 4).

4. Establish inspection program

• For overhead powerlines, schedule inspections and clearance at intervals no longer than three years and document inspection intervals and the basis for any shorter interval (reg 4(2)). Inspections should explicitly assess whether remaining vegetation will intrude or bend into the clearance zone within the chosen interval (reg 4(2)(a)(ii)-(iii)).

5. Distinguish low risk treatment

• If the line meets low risk criteria (prescribed area, spans ≤50 m, low voltage conductors) and the entity wishes to manage it under the alternative low risk principles, apply to the Technical Regulator for approval; do not self-declare (reg 3 definition; reg 4(2)(b); reg 4(4)).

6. Manage occupier duties and agreements

• For private powerlines, occupiers must keep vegetation out of the clearance zone and prevent wind-bending intrusions (reg 5(2)). Occupiers are not required to clear beyond a buffer zone (reg 5(3)). Where an occupier and an electricity entity prefer a different arrangement, use a written agreement that specifies area, intervals, and payments, and execute it (reg 9(1)-(2)). Keep records of agreements and any payments.

7. Use written clearance schemes with councils

• For public land in a non-bushfire risk area outside prescribed areas, consider agreeing a written vegetation clearance scheme with the council (reg 8). Ensure schemes are careful to address the factors listed in reg 8(3) and that they do not derogate from the basic principles (reg 8(4)). Execute and retain schemes as contracts (reg 8(5)-(6)).

8. Publish and distribute notices, and prepare to handle objections

• When the entity intends to enter private land under Part 5, include in notices the statement of the owner/occupier rights to lodge an objection (reg 10(8)). Provide councils with at least 30 days’ written notice before commencing a clearance program on their area, unless part of a scheme (reg 11(1)-(2)). Prepare internal procedures for responding to objections promptly because the objection prohibits carrying out the clearance until determination (reg 10(4)).

9. Apply for exemptions and make applications correctly

• Occupiers planting for commercial purposes may apply for exemptions from reg 5 or from Schedule 2 controls (reg 7(1); Schedule 2 cl 3 for some specific exemptions). Use Technical Regulator-approved forms, supply specified information, and pay the Minister-fixed fee (reg 7(2)). Note the requirement to give the electricity entity or council a reasonable opportunity to be heard before the regulator decides (reg 7(3)). Prepare to accept conditions, including cost-recovery, and ensure compliance to avoid the $5,000 penalty and $315 expiation (reg 7(4)-(5)).

10. Manage workforce qualifications

• Ensure personnel or contractors performing vegetation clearance under an electricity entity’s authority hold the prescribed qualification (a diploma in arboriculture from a registered training organisation under the South Australian Skills Act 2008 or equivalent) or verify the applicability of equivalent credentials (reg 12). Keep records of qualifications and credentials for audits.

11. Prepare for regulator determinations about clearance values

• If alternative clearance values would materially reduce clearing burdens, an electricity entity can apply to the Technical Regulator under Schedule 1 cl 6. Applications must be in approved form, include required information and pay a Minister-fixed fee; the regulator will only grant an alternative if minimum clearances are maintained (Schedule 1 cl 6(1)-(3) and (2)). Prepare engineering and safety evidence to demonstrate that minimum margins remain.

12. Follow Schedule 2 planting rules

• For public powerlines, follow Schedule 2 distances and species lists. Only plant or nurture species that are permitted under the Schedule’s Table 1 within the distances specified, and check the regulator-published lists of approved and permitted vegetation (Schedule 2 cl 1-4 and Table 1). For replacement planting along roads, Schedule 2 cl 3 provides a narrow exemption if replacement species are identical to the original stand.

13. Documentation and record retention

• Keep inspection reports, clearance logs, council notices, technical assessments of sag and swing, agreements, exemption application materials, regulator determinations, and training certificates on file for administrative, contractual and possible regulatory review. Given the role of the Technical Regulator and the possibility of objections and determinations, a clear paper trail is essential.

14. Pre-clearance legal audit for complex sites

• Where buffer zones abut areas with heritage overlays, native vegetation protections, or other statutory restrictions, obtain legal advice and check relevant legislation before clearance work. The regs explicitly preserve other laws that may limit clearance (reg 4(5)(a)(v); reg 5(4)).

15. Budget for fees and potential cost conditions

• Factor Minister-fixed application fees and possible cost-recovery conditions into project budgets when seeking exemptions or determinations (reg 7(2)(c); Schedule 1 cl 6(3)(c); reg 7(4)(b)). Include contractual provisions when negotiating schemes or agreements to allocate future costs for additional clearance or for compliance with regulator-imposed conditions.

Following these steps should position electricity entities, councils and occupiers to meet the regulations’ technical standards, manage procedural interactions with the Technical Regulator, and limit the risk of interruptions, contractual disputes or regulatory penalties.
