page 1 Western Australia LEGISLATIVE ASSEMBLY Electricity Industry Amendment (Capital Charges) Bill (No. 2) 2026 A Bill for An Act to amend the Electricity Industry Act 2004. The Parliament of Western Australia enacts as follows:

- Short title1 This is the Electricity Industry Amendment (Capital Charges)2 Act (No. 2) 2026.3
- Commencement4 This Act comes into operation as follows —5 (a) sections 1 and 2 — on the day on which this Act6 receives the Royal Assent;7 (b) the rest of the Act — when the Electricity Industry8 Amendment (Capital Charges) Act 2026 section 4 comes9 into operation.10
- Act amended11 This Act amends the Electricity Industry Act 2004.12
- Section 129ZE inserted13 After section 129ZD insert:14 15 129ZE. Imposition of tax16 To the extent that a capital charge payable under this17 Part includes an amount that is a tax, the tax is18 imposed.19 20
