Electricity Feed-in (Renewable Energy Premium) Act 2008

The Act builds on a small set of defined legal concepts that determine eligibility, payment mechanics and administrative oversight. Key concepts and their legal roles are:

• Renewable energy generator and renewable energy source, (s 5B). A renewable energy generator is an energy generator that generates electricity from a renewable energy source, and the definition explicitly includes micro and medium renewable energy generators while excluding energy storage devices that store energy not generated from a compliant generator (s 5B). Renewable energy source is defined to include solar and wind, and also permits the Minister to add other sources by determination (s 5B(1)(b)-(c)). Determinations are disallowable instruments (s 5B(2)).

• Capacity, (s 5C). For solar photovoltaic generators, capacity is the rated power output of the panels (s 5C(1)(a)). The Minister may determine alternative methods of measuring capacity, and such determinations are disallowable instruments (s 5C(2)-(3)). The Act separates generators into micro and medium categories by capacity thresholds (s 5D).

• Micro and medium renewable energy generators, (s 5D). A micro renewable energy generator is one with total capacity not more than 30kW. A medium renewable energy generator has total capacity greater than 30kW and not more than 200kW. These thresholds drive payment proportions and eligibility constraints (see s 8 and s 5E).

• Compliant renewable energy generator, (s 5E). The Act sets out a multi-part compliance test. A generator is compliant only if it is installed on premises in the ACT (s 5E(1)(a)), complies with the service and installation rules on connection (s 5E(1)(b)), has total capacity not more than 200kW or a Minister-determined capacity (s 5E(1)(c)), and if micro or medium, was connected before aggregate region-wide capacity caps are reached (s 5E(1)(d)). For micro and medium generators, the Act includes historic application cutoffs (29 July 2011 for micros, 13 July 2011 for mediums) and a final installation/connect-by date of 31 December 2016 (s 5E(1)(e)-(g)). The Minister may determine different capacities or aggregate caps, and those determinations are disallowable instruments (s 5E(2)-(4)).

• Eligible entity, (s 5F). The person entitled to apply for connection and payment is defined with specificity. It includes incorporated associations and co-operatives that own premises, persons who own commercial or retail premises, lessees who lease premises for the purpose of installing or operating a compliant generator, and, otherwise, the occupier of the premises to which electricity is supplied (s 5F(1)(a)). The Act expressly excludes territory agencies, territory-owned corporations, the Commonwealth or Commonwealth authorities, and entities the Minister may determine (s 5F(1)(b)). Determinations under s 5F(2) are disallowable instruments.

• Premium rate and its temporal guarantee, (ss 10-11). The premium rate is the dollar rate the Minister determines that an eligible entity receives for a qualifying period, and it is fixed for twenty years for the generator that is connected in the financial year in which the relevant application is made (s 11(1)). The Minister must seek advice from the Independent Competition and Regulatory Commission before making the premium rate determination and prioritise equitable cost impacts, encouragement of renewable generation, greenhouse gas emission reductions, reasonable payback periods for eligible entities, and other relevant matters set out in s 10(3)(b)-(c).

• Normal cost of electricity, (s 6A). The Minister may determine an amount that is the normal cost of electricity for a period; that normal cost is used to calculate the distributor’s reimbursement to the NERL retailer (s 6A(1)). The instrument type for that determination is a notifiable instrument (s 6A(2)). The Minister may also make guidelines for such a determination and these guidelines are disallowable instruments (s 6A(3)-(4)).

• Cost recovery and administrative cost pass-through. The Act creates ordered cost flows. The NERL retailer pays the eligible entity the premium rate percentage set out in s 8, with the distributor required to reimburse the retailer for the premium component beyond the normal cost (s 6(2)(b); s 8). Retailers may recover such costs from consumers in proportion to use (s 8A(1)-(2)). Distributors may pass on reasonable administration costs to eligible entities, but only up to a Minister-determined maximum and subject to application and time constraints (ss 11D-11F).

• Reporting and audits. The Minister must publish an annual report within six months of the financial year end covering the number and total capacity of compliant generators and costs under the Act (s 11A). Distributors and retailers are reporting entities obliged to supply the Minister with required information and to respond to Ministerial requests within 10 working days (s 11B). False or omitted information attracts penalties up to 30 penalty units (s 11B(5)-(6)). The Minister may require an audit of a reporting entity’s information in specified circumstances; the audit must be completed in three months, be paid for by the reporting entity, and be undertaken under Ministerial requirements (s 11C).

• Administrative instrument types and controls. The Act distinguishes the forms of Ministerial instruments. Several Ministerial powers produce disallowable instruments; at least one produces a notifiable instrument (s 6A(2)). The Act prescribes the Minister must seek ICRC advice and present it to the Legislative Assembly when determining the premium rate (s 10(3)-(4)).

These concepts structure eligibility, timing, cost allocation and accountability. The definitions are prescriptive and bind the substantive operation of the feed-in premium regime; critical thresholds and dates embedded in the definitions materially limit who can claim the premium and under what circumstances.

The Act allocates duties and financial exposures across a narrow set of actors. The primary affected parties are:

• Eligible entities (s 5F). Eligible entities are the natural or legal persons who may apply for connection and for payment. The category includes incorporated associations and co-operatives that own the premises on which a compliant generator is installed, persons who own commercial or retail premises with compliant generators, the lessee who leases premises to install or operate a compliant generator, and, otherwise, the occupier of the premises to which electricity is supplied (s 5F(1)(a)). The Act explicitly excludes territory agencies, territory-owned corporations, the Commonwealth and Commonwealth authorities, and other entities the Minister may determine (s 5F(1)(b)). Practically, residential occupiers and private businesses that met the compliance test are the main potential recipients of feed-in payments.

• Electricity distributors (s 6(1)-(2); s 11D-11F). Licensed distributors are required by licence conditions to connect compliant generators on application (s 6(2)(a)), reimburse the NERL retailer the premium component (s 6(2)(b)), and pass on additional metering costs to eligible entities (s 6(2)(c)). Distributors are reporting entities obliged to provide the Minister with the required information for the annual report (s 11B(3)(a)). Distributors may apply to the Minister for a determination of the maximum administration costs they may pass on to eligible entities (s 11E), and the Act prescribes application timing and required information (s 11E(1)-(3)). If the Minister does not determine the maximum within the statutory period, the distributor’s estimate becomes the default maximum (s 11F(5)).

• NERL retailers (s 6(1), s 6(3), s 8). Retailers authorised under the National Energy Retail Law (ACT) are obliged to pay eligible entities for the total electricity generated by the renewable energy generator on or after the day the eligible entity applies (s 6(3)). The payment rates and timing are set out (s 8). Retailers are also reporting entities required to give the Minister the required information (s 11B(3)(b)). Retailers may recover the costs of the renewable energy premium from electricity consumers proportionally to their usage (s 8A(1)-(2)).

• Electricity consumers (s 8A). Consumers ultimately face the financial incidence of the premium: the Act provides that if a NERL retailer imposes a recovery of costs on customers to recover the premium, that recovery must be made proportionally to the consumer’s electricity usage (s 8A(2)). The Minister’s premium rate determination must prioritise equitable impact on electricity users (s 10(3)(b)(i)).

• The Minister and Executive agencies. The Minister holds multiple rulemaking and reporting powers, including the power to determine the premium rate (s 10), definitions and capacity measures (s 5B, s 5C, s 5E, s 5F), the normal cost of electricity (s 6A), required reporting information (s 11B(1)), audit requirements (s 11C(3)), and the maximum administration cost that distributors may pass on (s 11F). Determinations are generally disallowable instruments, so they are subject to Legislative Assembly oversight (see s 5B(2), s 10(2), s 5E(4), s 5C(3), s 5F(2), s 9(2)).

• Third parties involved in installation, metering and compliance. The Act requires installations to comply with the service and installation rules that are part of technical codes made under the Utilities (Technical Regulation) Act 2014 (s 5E(5)). Additional metering costs not the distributor’s responsibility may be passed to eligible entities by the distributor (s 6(2)(c)). Auditors engaged under Ministerial audit requirements are appointed either by the Minister or must be independent of the reporting entity (s 11C(2)(c)).

• The Legislative Assembly and the Independent Competition and Regulatory Commission (ICRC). The Minister must consult the ICRC when determining the premium rate and present the advice to the Assembly; the Assembly therefore has a formal oversight pathway built into the rate-setting process (s 10(3)-(4)).

Excluded or limited actors. The Act expressly excludes certain public sector entities from being eligible entities (s 5F(1)(b)). The compliance definition also places time-based restrictions and aggregate capacity caps that impose eligibility limitations, especially for micro and medium generators (s 5E(1)(d)-(g)). The Minister retains power to broaden or narrow some thresholds by determination, which is itself a disallowable instrument (s 5E(2)-(4)).

Who ultimately pays. The statutory architecture places initial payment obligations on NERL retailers to the eligible entity (s 6(3)), with distributors required to reimburse retailers for the premium component beyond the normal cost of electricity (s 6(2)(b)). Retailers may recover the costs from electricity consumers, in proportion to usage (s 8A). Distributors may pass administration costs to eligible entities, subject to maximums (ss 11D-11F). In sum, the legal incidence is split between retailers, distributors, eligible entities, and end-use consumers through permitted cost-shifting mechanisms established in the Act.

The Act creates specific duties and rights for eligible entities, electricity distributors, NERL retailers, and the Minister. These are set out below with the operative provisions cited.

Duties placed on electricity distributors

• Licence condition to connect and reimburse: It is a condition of an electricity distributor’s licence that, on application by an eligible entity, the distributor must connect a renewable energy generator to the distributor’s network (s 6(2)(a)), reimburse the NERL retailer that supplies electricity to the eligible entity the difference between (i) the amount payable to the eligible entity and (ii) the normal cost of that electricity (s 6(2)(b)), and pass on to the eligible entity additional metering costs related to the generator (s 6(2)(c)). The action required under s 6(2) is a utility service for the Utilities Act 2000 (s 7).

• Reporting and information duties: Distributors are reporting entities required to give the Minister the information the Minister determines is required for the annual report (s 11B(1)-(3)). If the Minister requests other information in writing, the distributor must provide it within 10 working days (s 11B(4)). Failure to comply attracts an offence and a penalty up to 30 penalty units (s 11B(5)). If the Minister requires an audit under s 11C, the distributor must ensure the audit is completed in accordance with s 11C(2); failure to undertake the audit as required attracts a maximum penalty of 400 penalty units (s 11C(4)).

• Administration cost recovery: Distributors may pass on reasonable administration costs to eligible entities up to a maximum amount determined by the Minister (s 11D). Distributors must apply to the Minister no later than six months before the relevant financial year for the determination and include the previous year’s incurred and recovered administration costs and an estimate for the relevant year (s 11E).

Duties placed on NERL retailers

• Payment obligation: On application by an eligible entity, the NERL retailer must pay the eligible entity, in accordance with s 8, for the total amount of electricity generated by the renewable energy generator on or after the day the application is made (s 6(3)). Payments are quarterly in arrears (s 8(2)).

• Reporting duties: NERL retailers are reporting entities under s 11B and must provide required information and any requested additional information within 10 working days (s 11B(3)-(4)). The offence provisions and penalties for false or missing information apply (s 11B(5)-(6)).

• Recovery from consumers: If the retailer imposes a recovery of costs on electricity consumers to recover the premium under the Act, that recovery must be in proportion to the amount of electricity used by the consumer (s 8A(1)-(2)).

Duties and rights of eligible entities

• Application for connection and payment: An eligible entity has the right to apply for connection and, on making an application, the right to payment from the NERL retailer (s 6(2)(a); s 6(3)). Eligibility requires compliance with the Act’s compliance test (s 5E).

• Receipt of premium: Eligible entities receive the premium as a percentage of the premium rate, determined by generator size (micro or medium) and by whether a contract for installation was entered into before specified dates (s 8(1)). The percentages are subject to Ministerial determination under s 9.

• Additional metering costs: The distributor must pass on to the eligible entity any additional metering costs accrued because of the generator (s 6(2)(c)).

Ministerial duties and procedural constraints

• Premium rate determination duty: The Minister must determine the premium rate for amounts payable under s 6 for compliant generators (s 10(1)). In making that determination the Minister must seek advice from the ICRC and must give priority to specified policy considerations including equitable cost impact, encouragement of renewable generation, emission reductions and reasonable payback periods (s 10(3)(a)-(b)). The Minister must present any ICRC advice to the Legislative Assembly within 3 sitting days and provide a copy to each member at least 14 days before making the determination but within 30 days of receiving the advice (s 10(4)).

• Reporting duty: The Minister must publish an annual report within six months after the financial year end covering number and total capacity of compliant generators and costs under the Act (s 11A).

• Determination powers are subject to parliamentary oversight: Many Ministerial determinations are disallowable instruments (see, e.g., s 5B(2), s 5C(3), s 5E(4), s 5F(2), s 9(2), s 10(2)). The normal-cost determination under s 6A is a notifiable instrument and guidelines for that determination are disallowable (s 6A(2)-(4)).

Penalties and offences relevant to duties

• False or incomplete reporting: Reporting entities that fail to give required information or provide false or misleading information in a material particular commit offences carrying a maximum penalty of 30 penalty units (s 11B(5)-(6)).

• Failure to comply with audit order: Failing to undertake an audit as required under s 11C attracts a maximum penalty of 400 penalty units (s 11C(4)).

• Regulations may create offences with penalties up to 30 penalty units (s 12(3)).

Rights created by the Act

• For eligible entities, the right to be paid the premium by the retailer for electricity generated from a compliant generator once the eligible entity has applied (s 6(3); s 8).

• For distributors and retailers, procedural rights to ministerial determinations, including the ability to apply for a maximum cap on administration cost pass-through and to have the Minister consider their submissions in making that determination (s 11E-11F).

• For the Legislative Assembly, the right to be provided with ICRC advice in connection with the premium rate and to exercise disallowance powers over Ministerial determinations that are disallowable instruments (s 10(4); instrument types throughout Act).

Together, these duties and rights produce a structured flow of connection obligations, payments and information. The Act places the immediate payment obligation on retailers, a reimbursement duty on distributors, specific reporting and audit obligations on distributors and retailers, and hands the Minister the key rate-setting and instrument-making powers subject to statutory procedural constraints.

The Act establishes a limited set of offences with specified maximum penalties, ties enforcement of the feed-in obligations into licence conditions and administrative instruments, and gives the Minister powers to require audits and to impose associated compliance consequences.

Penalties enumerated in the Act

• Reporting and false information offences: A reporting entity (an electricity distributor or a NERL retailer, s 11B(3)) that is required to give the Minister information and fails to do so commits an offence with a maximum penalty of 30 penalty units (s 11B(5)). If a reporting entity gives the Minister information that is false or misleading in a material particular, and the entity knows it is false or is reckless as to its truth, the maximum penalty is 30 penalty units (s 11B(6)). The Act’s republication page records the penalty unit values as $160 for an individual and $810 for a corporation at the republication date, under Legislation Act 2001, s 133; that figure is set out in the front matter of the republished Act.

• Failure to undertake required audit: If the Minister requires a reporting entity to have an audit under s 11C and the entity fails to undertake the audit in accordance with s 11C, the entity commits an offence with a maximum penalty of 400 penalty units (s 11C(4)). The 400 penalty units figure, converted at the republication penalty unit rates noted at the front of the republished law, indicates a materially higher sanction for audit failure than for false or missing reporting.

• Regulation-created offences: The Executive may make regulations for the Act and the regulations may create offences with maximum penalties of not more than 30 penalty units (s 12(2)-(3)).

Enforcement architecture and mechanisms

• Licence condition enforcement: The distributor’s obligations to connect compliant generators and to reimburse the NERL retailer are imposed as conditions of the distributor’s licence (s 6(2)). Consequently, enforcement of those duties may be pursued through the utilities licensing and regulatory framework under the Utilities Act 2000 and by the Independent Competition and Regulatory Commission, subject to the mechanisms available under the Utilities Act and the relevant licence. Section 7 explicitly declares that the action required by a distributor under s 6(2) is a utility service for the Utilities Act 2000.

• Ministerial audit powers: The Minister may require an audit of information provided by a reporting entity when the Minister believes on reasonable grounds that the information is false, misleading or incomplete or there is a risk of falsity or incompleteness (s 11C(1)). The audit must be completed within three months, is to be paid for by the reporting entity, and must be undertaken by an auditor appointed by the Minister or, if the Minister decides not to appoint an auditor, an auditor independent of the reporting entity (s 11C(2)(a)-(c)). The Minister may determine the audit requirements, and those determinations are disallowable instruments (s 11C(3)).

• Administrative oversight through instrument types: Many of the Minister’s powers are to be exercised by determinations that are disallowable instruments (for example s 5B(2), s 5C(3), s 5E(4), s 5F(2), s 9(2), s 10(2), s 11F(6)). That instrument type subjects the Minister’s determinations to parliamentary disallowance procedures, thus creating an institutional check on the exercise of discretion in significant respects.

Practical enforcement consequences

• Financial exposure: The Act creates monetary liabilities and potential recovery flows that shift the premium cost through retailers and distributors to consumers or eligible entities. Enforcement of payment obligations is therefore primarily about ensuring statutory payments are made, reimbursements are passed, and cost-recovery rules are respected. The Act does not create a suite of criminal sanctions for failure to make premium payments; rather, it frames duties as licence conditions or administrative obligations with reporting and audit sanctions for non-compliance.

• Information compliance enforcement: The Act places concrete criminal penalties on reporting failures and false information, and provides for substantial penalties for failure to comply with an audit order. These provisions assign sanctions to the accuracy, completeness and auditability of the information upon which Ministerial reporting and rate-setting rely.

• Regulatory enforcement: Because the distributor’s duty is a licence condition and the action required by the distributor is a utility service under the Utilities Act 2000 (s 7), regulatory authorities exercising functions under the Utilities Act have enforcement levers to ensure compliance, including licence compliance processes and industry code enforcement mechanisms.

Limitations and scope of enforcement

• No private right of action in the Act text: The Act does not itself articulate private rights of action or civil remedies for eligible entities or consumers against non-payment beyond the regulatory and administrative architecture. Enforcement is primarily through reporting, audit, licence condition enforcement and the criminal penalties for specified information offences.

• Delegation to other regulatory schemes: Enforcement of the distributor’s licence condition and the retailer’s regulatory obligations will be mediated through the broader utilities and national energy retail law frameworks, as the Act cross-references those regimes (s 7; Dictionary entries for NERL retailer and electricity distributor). Practitioners should therefore examine the Utilities Act 2000 and the National Energy Retail Law (ACT) for enforcement processes and sanctioning powers that operate alongside this Act.

In summary, the Act’s enforcement levers are concentrated on administrative information integrity, auditability and the licensing framework. The most significant criminal penalties attach to failures in reporting and audit compliance rather than to non-payment of premiums per se, and the Act relies on the broader utilities regulatory architecture to enforce the distributor and retailer obligations.

The Act is tightly interwoven with territorial and national electricity and regulatory regimes, and it references multiple external laws and instruments that shape its operation and enforcement. The interactions are legislative and administrative, and they determine scope, technical standards, payment obligations, instrument types, and oversight.

Primary statutory interactions

• Utilities Act 2000. The Act makes the distributor’s actions under s 6(2) a utility service for the purposes of the Utilities Act 2000 (s 7). This cross-reference integrates the feed-in obligations into the utilities licensing and regulatory framework, which will determine how licence conditions are enforced, how industry codes apply, and how distributors are regulated more broadly. The Act therefore does not create an isolated regulatory silo; rather, it nests feed-in duties within the utilities regulatory machinery.

• National Energy Retail Law (ACT). The Act uses the term NERL retailer and places primary payment obligations on such retailers (s 6(1), s 6(3)). The functions and obligations of NERL retailers are governed by the National Energy Retail Law (ACT), and the Act’s payment and recovery mechanisms must be read alongside the retailer’s statutory obligations and permitted practices under that national law.

• Utilities (Technical Regulation) Act 2014 and technical codes. The Act requires compliant generators, when connected to the distributor’s network, to comply with the service and installation rules, which are part of technical codes made under the Utilities (Technical Regulation) Act 2014 (s 5E(5)). Those rules are the technical standardisation mechanism. Compliance with these technical codes is therefore a condition precedent to being a compliant generator eligible for the premium.

• Leases (Commercial and Retail) Act 2001, Associations Incorporation Act 1991, Co-operatives National Law (ACT), Education Acts, Civil Law (Sale of Residential Property) Act 2003, Dangerous Substances Act 2004, Building Act 2004. These statutes are referenced in the definition of eligible entity and in the exceptions and special transfer rules. For example, definitions for commercial premises and retail premises are taken from the Leases Act (s 5F definitions). The Act also contains special transfer rules for generators installed on premises affected by loose-fill asbestos remediation under the Dangerous Substances Act 2004 and related legislation (s 11(3)-(4), Dictionary entries). Those references embed sectoral and property law considerations into the feed-in scheme.

Instrument types and parliamentary oversight

• Disallowable and notifiable instruments. The Act specifies the legal form of a number of Ministerial determinations. Many determinations are disallowable instruments, meaning they are subject to parliamentary disallowance procedures under the Legislation Act, and thus to legislative oversight (see s 5B(2), s 5C(3), s 5E(4), s 5F(2), s 9(2), s 10(2), s 11F(6), s 11C(3)). The normal cost of electricity determination under s 6A is a notifiable instrument (s 6A(2)), and the guidelines for that determination are disallowable (s 6A(3)-(4)). Different instrument classes carry different procedural requirements and notice obligations under the Legislation Act.

• Interaction with the Independent Competition and Regulatory Commission. The Minister is statutorily required to seek the advice of the ICRC before making the premium rate determination and to present ICRC advice to the Legislative Assembly (s 10(3)-(4)). That requirement institutionalises an economic and regulatory advisory role for the ICRC in premium rate setting.

Cost recovery and retail regulation

• National energy retail and distribution regulation. The Act establishes a payment flow where the NERL retailer pays the eligible entity and the distributor reimburses the retailer for the premium component beyond the normal cost (s 6(2)(b), s 6(3)). Retailers may then recover the cost from consumers proportionally (s 8A). Those mechanics must be implemented in a manner consistent with the National Energy Retail Law (ACT) and any applicable retail pricing rules and consumer protection provisions.

Administrative and reporting interlocks

• Reporting and audit requirements under the Act create obligations for reporting entities to supply specified information to the Minister (s 11B), and these obligations operate alongside other statutory reporting requirements under energy laws. The Minister’s power to audit and require an audit to be paid for by the reporting entity (s 11C(2)(b)) links to the broader regulatory audit capacity under the utilities and retail regimes.

Temporal and transitional interactions

• The Act contains time-limited eligibility and application dates for micro and medium generators (s 5E(1)(e)-(f)) and a final installation connect-by date of 31 December 2016 (s 5E(1)(g)). These dates interact with amendment and transitional provisions recorded in the Act’s endnotes, and with later legislation that amended the Act, for example the Electricity Feed-in (Renewable Energy Premium) Amendment Acts and other amending acts listed in the legislation history and amendment history in the endnotes.

Practical consequence of these interactions

• The Act must be administered by practitioners cognisant of both the Act’s specific provisions and the operational rules, licences and codes made under the Utilities Act and the National Energy Retail Law. Compliance, enforcement and cost recovery will be shaped by how licence conditions are enforced by regulators and by how retailers implement recovery mechanisms consistent with national retail law consumer protections. Ministerial determinations and guidelines will operate within the parliamentary oversight structures established by the Legislation Act for disallowable and notifiable instruments.

In short, the Act is not standalone. It depends on definitions, licence enforcement, technical codes, and national retail law instruments to implement connection, payment, safety and cost allocation. Practitioners should review the Utilities Act 2000, National Energy Retail Law (ACT), the Utilities (Technical Regulation) Act 2014 and any relevant industry codes or determinations when advising clients covered by this Act.

The Act has been amended multiple times since its 2008 enactment. The republished law includes a detailed legislative and amendment history in the endnotes which identify the amending Acts and the provisions they inserted, amended or omitted. Below are the principal amendments and the operative changes as reflected in the endnotes.

Chronology of primary amendments

• Electricity Feed-in (Renewable Energy Premium) Act 2008 A2008-21, notified LR 9 July 2008, initial commencement dates for sections as recorded in the legislation history.

• Electricity Feed-in (Renewable Energy Premium) Amendment Act 2009 A2009-8, notified LR 2 March 2009. The amendment history records multiple renumberings and amendments to s 6 and related provisions (see amendment history entries for s 6 and s 10).

• Electricity Feed-in (Renewable Energy Premium) Amendment Act 2011 A2011-6 and Electricity Feed-in (Renewable Energy Premium) Amendment Act 2011 (No 2) A2011-25, notified LR 24 February 2011 and LR 11 July 2011 respectively. The 2011 amendments introduced substantive definitional provisions and the Part 1A objects and important concepts (s 5A inserted by A2009-8 s 5), and other re-enumerations and substitutions across the Act (see amendment history notes indicating insertion of pt 1A, ss 5A, 5B, 5C, 5D, 5E, 5F, and the addition of reporting provisions in A2011-25).

• National Energy Retail Law (Consequential Amendments) Act 2012 A2012-32, notified LR 14 June 2012, made consequential amendments to align terminology with the National Energy Retail Law framework and inserted references to NERL retailer definitions (amendment history entries show s 6 renumberings and s 11 amendments).

• A sequence of later amendments addressing technical and consequential matters were made by acts including the Training and Tertiary Education Amendment Act 2014 A2014-48, Dangerous Substances and Loose-fill Asbestos related amendment Acts in 2015 and 2020 (A2015-6, A2015-42, A2020-20), the Electricity Feed-in Tariff Schemes Legislation Amendment Act 2015 A2015-20, and Planning, Building and Environment Legislation Amendment Act 2016 A2016-2. These amendments adjusted definitions and added special transfer and continuity rules for generators affected by asbestos remediation projects (see s 11(3) and associated definitions amended by A2015-42 and A2020-20).

• Co-operatives National Law (ACT) Act 2017 A2017-8 and subsequent planning, building and environment amendments in 2017 amended definitions and eligibility constructs (see amendment history entries for s 5F and associated dictionary amendments).

• Electricity Feed-in (Renewable Energy Premium) Amendment Act 2020 A2020-37, notified LR 5 August 2020, inserted Part 3B addressing the passing on of reasonable administration costs by distributors (ss 11D-11F), and also amended reporting and audit provisions (see amendment history entries: pt 3B hdg ins A2020-37 s 8; ss 11D, 11E, 11F ins A2020-37 s 8).

• Statute Law Amendment Act 2025 A2025-29, notified LR 6 November 2025 and commenced sch 4 pt 4.66 on 16 December 2025, contains further amendments to definitions and to sections including s 6A, s 9 and s 10 as indicated in the amendment history (see amendment history entries noting multiple "A2025-29 amdt 4.66").

Nature of the amendments

• Definitions and eligibility. Several amendments altered definitions, capacity measures, and the compliant generator test. Key definitional insertions and substitutions occurred across 2009 and 2011 amendments and were adjusted later in 2015, 2017 and 2025. The amendment history shows insertion and substitution of definitions such as renewable energy generator, renewable energy source, capacity, compliant and eligible entity across those amending acts.

• Reporting and audit. The reporting Part 3A was added by A2011-25 and later modified by A2015-20 and A2020-37. The 2015 amendments (A2015-20) strengthened reporting architecture, and the 2020 amendment added the audit mechanism and Part 3B cost recovery provisions.

• Cost recovery and administration costs. The 2020 amendment A2020-37 introduced Part 3B so distributors can pass reasonable administration costs to eligible entities subject to a Minister-determined maximum amount and application and determination procedures (ss 11D-11F). The amendment history records insertion of s 11D, s 11E and s 11F by A2020-37 s 8.

• Technical and property exceptions. The asbestos remediation-related amendments in 2015 and 2020 and building/planning amendments in 2015, 2016 and 2017 introduced special continuity provisions allowing certain micro generators to retain premium entitlements when premises are demolished and replaced under asbestos remediation programs (s 11(3)). Those amendments link feed-in premium continuity to other territory remediation and building schemes.

Procedural and legislative instrument changes

• Instrument classification. Over the amendments the Act consistently treats Ministerial determinations as disallowable instruments for key powers, preserving parliamentary scrutiny of significant rule-making. The 2009, 2011 and 2015 amendments inserted and clarified the instrument types for specific Ministerial powers as recorded in the amendment history.

• Cross-references. The Act’s amendments consistently added cross-references to other territorial laws and national instruments, notably to the National Energy Retail Law (ACT) and the Utilities (Technical Regulation) Act 2014 and to the Legislation Act 2001 provisions on instrument types.

Practitioner implications

• The amendment history shows that the Act has been adapted to respond to regulatory transitions (for example, the introduction of NERL), technical regulation updates, cost-recovery policy changes, and property remediation programs. Advisers must consult the endnotes and amendment history to track the specific enactments that changed eligibility, reporting and cost allocation. The republished law’s amendment history entries identify which sections each Act altered, and those entries constitute the primary documentary record for tracing how particular obligations and definitions evolved.

The endnotes in the republished Act set out the detailed legislative history and amendment history entries that underpin the summary above. Practitioners should consult those endnotes for clause-level tracing when preparing advice on discrete points of eligibility, instrument types, or the effect of a particular amending Act.

The republished Act and its endnotes, as provided, do not record judicial decisions or refer to any cases interpreting or applying the Electricity Feed-in (Renewable Energy Premium) Act 2008. The legislation’s text and endnotes focus on legislative content, amendments and the Acts that made them. There is no internal list of litigation or citations to judicial authorities within the republished material.

Consequently:

• The text contains no judicial interpretation or case law summary that would alter the plain meaning of the statutory provisions set out in the Act. The Act’s operative provisions and the endnotes governing amendments provide the legal baseline for obligations, definitions and instrument types.

• Any practical disputes concerning the Act’s application, such as disagreements over eligibility, calculation of the normal cost of electricity, reimbursement mechanics between distributors and retailers, the Minister’s determinations, or the adequacy or accuracy of reporting, would be litigable issues in the ACT courts or in administrative review contexts, but the republished law does not include any reporting of such cases.

For practitioners preparing litigation-focused advice or representing a party involved in a dispute under the Act, the following steps are necessary, because the republished Act itself does not provide a litigation record:

• Conduct a targeted search of ACT tribunal and court databases, the Australian Legal Information Institute (AustLII), and other legal databases for cases referencing the Electricity Feed-in (Renewable Energy Premium) Act 2008 or for disputes involving the ICRC, electricity distributors, NERL retailers, or ministerial determinations made under this Act.

• Examine decisions under the Utilities Act 2000, the National Energy Retail Law (ACT) and related regulatory instruments, because enforcement and dispute resolution for distributor licence conditions and retailer obligations may occur in those forums and might involve interpretation of the Act’s obligations as they intersect with licensing and industry codes.

• Consider administrative law review options where a ministerial determination is challenged on procedural grounds. Several of the Minister’s powers under this Act produce disallowable instruments (see s 10(2) and other sections). Procedural fairness, statutory consultation requirements (for example the requirement to seek ICRC advice under s 10(3)(a)), and compliance with the Legislation Act 2001 when making disallowable instruments could be grounds for administrative review.

• For disputes over reporting accuracy and audits, note that the Act gives the Minister express power to compel audits and to set audit requirements (s 11C). Court review may be available if the audit power is exercised unlawfully, or if penalties are sought to be imposed for non-compliance in ways inconsistent with the Act.

In the absence of cases in the republished law, practitioners should treat the Act’s language as the working rulebook and undertake jurisdiction-specific research for case law that may have arisen after the republication date or that is not summarised in the legislation text. The statutes to check in conjunction with this Act include the Utilities Act 2000, the National Energy Retail Law (ACT), the Legislation Act 2001 and any determinations or industry codes published by the ICRC or the relevant utility regulators.

The Act contains several provisions and structural features that can produce unexpected outcomes unless carefully monitored. These are concrete mechanics and procedural traps that practitioners and stakeholders should note, with section references.

Eligibility cutoffs and historic application dates

• Time-limited application dates for micro and medium generators. The compliance test for a compliant renewable energy generator includes historic dates for receipt of connection applications: for micro renewable energy generators, the distributor must have received the application by 29 July 2011, and for medium renewable energy generators the distributor must have received the application by 13 July 2011 (s 5E(1)(e)-(f)). Those dates are historic. If an installation’s application post-dated those cutoffs, the generator will not meet the compliance criteria in s 5E and will thus not be eligible for the premium. Practitioners should verify application timestamps and supporting records; a missing or late application can eliminate entitlement.

• Final installation/connection deadline. The generator must be installed on premises and connected to the distributor’s network before 31 December 2016 to be compliant (s 5E(1)(g)). This hard deadline means that many installations completed after that date are excluded from the premium scheme. The effect is that the statutory entitlement is time-constrained.

Aggregate capacity caps and Ministerial variability

• Aggregate cap on micro and medium generators. If a micro or medium generator is connected after an aggregate cap is reached on the distributor’s network, eligibility may be lost. The Act fixes an initial aggregate cap of 30MW for connection of micro and medium renewable energy generators to the distributor’s network, but the Minister may determine another capacity (s 5E(1)(d) and (3)). That Ministerial power means the aggregate cap is not immutable; the Minister could lower or raise it by determination, subject to the instrument type. Check whether any determinations under s 5E(3) have been made.

Ministerial determination scope and instrument types

• Wide Ministerial discretion with parliamentary oversight. The Minister has multiple powers to make determinations that affect eligibility, capacity measurement, premium rates, percentages and more (see ss 5B(2), 5C(2), 5E(2)-(3), 5F(2), 6A(1), 9(1), 10(1)). Many of these are disallowable instruments. The disallowable instrument classification subjects determinations to parliamentary scrutiny but does not prevent abrupt policy changes during the operation of a generator if the instrument is validly made and not disallowed. Check the register of disallowable instruments for current determinations.

• Notifiable instrument for normal cost. The normal cost of electricity determination under s 6A is a notifiable instrument and the Minister may make guidelines that are disallowable instruments (s 6A(1)-(4)). The normal cost figure determines the distributor’s reimbursement to the retailer under s 6(2)(b), so any change to the normal cost can materially affect the distributor’s financial exposure.

Payment percentage rules and their triggers

• Payment percentages dependent on contract dates and generator class. Section 8 prescribes a tiered payment structure. For micro generators, if an eligible entity entered into a contract for installation before 1 June 2011, payment is 100% of the premium rate (subject to s 9 determinations); if the contract was entered into on or after 1 June 2011, payment is 66% of the premium rate (subject to s 9). For medium generators, similar cutoffs apply with different percentages (75% for pre-relevant date contracts, 66% for on or after relevant date). The "relevant date" for mediums is defined as the date the Electricity Feed-in (Renewable Energy Premium) Amendment Act 2011 (No 2) commenced (s 8(3)). Practitioners should check contract dates and whether the Minister has determined lower percentages under s 9.

Cost-shifting mechanics

• Multiple pathways for cost recovery. The statutory architecture permits retailers to recover premium costs from consumers in proportion to usage (s 8A), and allows distributors to pass reasonable administration costs to eligible entities up to a Minister-determined maximum (ss 11D-11F). This layered cost-shifting can produce complex and overlapping recovery claims and can leave distributors or retailers exposed while awaiting determinations or transfers. For instance, if a distributor submits an application for a maximum administration cost determination but the Minister does not decide within the statutory period, the distributor’s estimate becomes the default maximum (s 11F(5)). Timing mismatches can leave distributors with unrecovered costs in the short term.

Reporting and audit liabilities

• Material penalties for reporting failures and audit non-compliance. Reporting entities face penalties of 30 penalty units for failure to provide required information or for submitting false or misleading information (s 11B(5)-(6)). Failure to undertake a Minister-required audit attracts a maximum penalty of 400 penalty units (s 11C(4)). The audit obligation is paid for by the reporting entity and must be complete within three months (s 11C(2)(a)-(b)). The large penalty attached to audit non-compliance is a significant practical risk for reporting entities that do not maintain robust record-keeping and audit-ready data.

Interaction with other regulatory obligations and standards

• Technical compliance linked to other legislation. A generator must comply with the service and installation rules for connection when connected to the distributor’s network to be compliant (s 5E(1)(b)). Those rules are made under the Utilities (Technical Regulation) Act 2014. Failure to meet technical code requirements may defeat eligibility even where other conditions are met.

• Licence condition enforcement channels. The distributor’s duties are licence conditions under the Utilities Act 2000 (s 7). Enforcement questions about distributor non-performance will be managed through the utilities regulatory framework, which can involve separate industry codes, regulatory proceedings, and different remedies from those found in this Act.

Continuity and transfer pitfalls

• 20-year premium guarantee with narrow transfer rules. Section 11 fixes the premium rate for 20 years for the year in which a generator is connected, but a generator is taken to remain connected in limited situations such as temporary interruptions or transfer with the premises to another eligible entity (s 11(2)(a)-(b)). The Act includes a narrow continuity provision for micro generators in asbestos remediation demolition/relocation contexts, with multiple strict conditions applying (s 11(3)). Transfers outside these narrow scenarios can end entitlement to the original premium terms.

Administrative timing and process risk

• Ministerial and regulatory timetables. The Act imposes timeframes on Ministerial obligations, for example the requirement to present ICRC advice to the Legislative Assembly within three sitting days and to provide copies to members at least 14 days before making a premium rate determination (s 10(4)). Delays in Ministerial action or determinations can leave distributors and retailers in a position of financial uncertainty, particularly around the maximum administration cost cap application and normal cost determinations.

In short, the main "gotchas" arise from the Act’s reliance on precise historical dates, aggregate capacity caps, Ministerial determination powers, layered cost recovery mechanisms, strict reporting and audit penalties, and close dependence on other regulatory instruments and standards. Practitioners advising clients should check each generator’s factual record against s 5E eligibility requirements, verify dates and contracts that trigger percentage changes under s 8, and monitor the register for any Ministerial determinations or disallowable instruments that alter thresholds or operational rules.

This section translates the Act’s obligations into actionable compliance steps for the principal stakeholders: eligible entities (installers, owners and occupiers), electricity distributors, NERL retailers, and the Minister (administration). Each step references the operative provisions.

For eligible entities (prospective or existing generators)

1. Confirm eligibility under s 5F and the compliant test in s 5E:

   • Ensure the generator is installed on premises in the ACT (s 5E(1)(a)).
   • Ensure the installation complies with service and installation rules applicable upon connection to the distributor’s network (s 5E(1)(b)); consult the technical codes made under the Utilities (Technical Regulation) Act 2014, and keep certificates or evidence of compliance.
   • Check the capacity thresholds: ensure total capacity does not exceed 200kW or any Minister-determined capacity (s 5E(1)(c)); if solar, ensure rated power output is correctly documented as capacity (s 5C(1)(a)).
   • For micro and medium generators, confirm whether the distributor received the connection application by the historical cutoffs and that the generator was installed and connected prior to 31 December 2016 (s 5E(1)(d)-(g)). If these are not satisfied, prepare for ineligibility.

2. Document contractual and installation dates:

   • Retain dated contracts for installation. Payment percentages under s 8 depend on whether the eligible entity entered into a contract before specified dates (for micro generators, before 1 June 2011; for medium generators, before the "relevant date" noted in s 8(3)). Maintain original contracts and evidence of execution to support payment percentage claims.

3. Apply to the NERL retailer for payment:

   • Make an application to the NERL retailer in accordance with s 6(3). The retailer must pay for total electricity generated on or after the day the application is made. Keep records of the application date and copies of correspondence.

4. Keep metering and generation records:

   • Maintain generation logs, meter readings, and metering certificates to support quarterly payment claims (payments are made quarterly in arrears, s 8(2)). Keep evidence of any additional metering costs passed on by the distributor under s 6(2)(c).

For electricity distributors

1. Treat the connection duty as a licence obligation:

   • Ensure that distributor processes are in place to connect compliant generators on application, as s 6(2)(a) makes connection a condition of the distributor’s licence. Integrate the feed-in connection processes into licence compliance systems (s 7 notes the action is a utility service under the Utilities Act 2000).

2. Reimbursement process:

   • Implement an internal mechanism to reimburse NERL retailers the difference between the amount payable to eligible entities and the normal cost of electricity as determined under s 6A (s 6(2)(b)). Track normal cost determinations and guidelines published under s 6A because they affect reimbursement amounts.

3. Metering cost accounting:

   • Identify and record additional metering costs attributable to generator connections and pass those costs to eligible entities as required by s 6(2)(c). Keep documentation supporting the metering costs.

4. Apply for administration cost maximum, if needed:

   • If intending to pass on administration costs to eligible entities, apply to the Minister under s 11E no later than six months before the relevant financial year. The application must include last year’s incurred administration costs and amounts recovered under s 11E(3)(a), and estimated administration costs for the relevant year under s 11E(3)(b).

5. Reporting and audit readiness:

   • Provide the Minister with required information as determined under s 11B(1). Establish record-keeping and data validation procedures because failure to provide required information or to correct false information can attract a penalty of 30 penalty units (s 11B(5)-(6)). If the Minister requires an audit under s 11C, note that the audit must be completed in three months, be paid for by the distributor, and be undertaken by an auditor appointed by the Minister or an independent auditor (s 11C(2)). Non-compliance can lead to penalties up to 400 penalty units (s 11C(4)).

For NERL retailers

1. Implement payment procedures:

   • On application by an eligible entity, pay the total amount of electricity generated in accordance with s 8 and do so quarterly in arrears (s 6(3); s 8(2)). Ensure billing and accounting systems can process feed-in payments and reflect the applicable premium rate percentage.

2. Cost recovery compliance:

   • If the retailer imposes a recovery of costs on consumers to recover premiums, apply recoveries in proportion to electricity usage as mandated by s 8A(2). Confirm consistency with National Energy Retail Law consumer protections and pricing rules.

3. Reporting obligations:

   • Supply the Minister with required information under s 11B(3)(b). If the Minister requests additional information in writing, provide it within 10 working days (s 11B(4)). Avoid providing false or misleading information as this is an offence with a maximum penalty of 30 penalty units (s 11B(6)).

For the Minister and Executive

1. Premium rate determination process:

   • Before determining the premium rate under s 10(1), seek the advice of the Independent Competition and Regulatory Commission to assist the Minister to determine the premium rate (s 10(3)(a)). Prioritise the criteria listed in s 10(3)(b), and have regard to the matters in s 10(3)(c). Present any ICRC advice to the Legislative Assembly within three sitting days of receiving it and give each Assembly member a copy at least 14 days before the determination but within 30 days after receiving the advice (s 10(4)). Make the premium-rate determination as a disallowable instrument (s 10(2)).

2. Normal cost determination and guidelines:

   • If making a normal-cost determination under s 6A, note that the determination is a notifiable instrument (s 6A(2)). If guidelines are issued for the determination, they are disallowable instruments (s 6A(3)-(4)). Use transparent methodology and document it because normal cost affects distributor reimbursements.

3. Reporting and information mandates:

   • Determine the required information for the annual report under s 11B(1) and publish the annual report within six months after the end of each financial year, covering the number of compliant generators, total capacity, and costs under the Act (s 11A). Exercise audit powers under s 11C where there are reasonable grounds to suspect false, misleading or incomplete information; set audit requirements and appoint auditors as appropriate.

4. Administration cost determinations:

   • When a distributor applies for a maximum administration cost determination under s 11E, consider the information provided and ensure the determination protects distributors, eligible entities and ACT electricity consumers from being unreasonably financially disadvantaged (s 11F(3)). Determine the maximum amount within two months of receiving the application, and if the determination is not made in time, the applicant’s estimate becomes the default maximum (s 11F(5)).

Cross-cutting compliance tips

• Maintain contemporaneous documentary evidence. Because eligibility, payment percentages and compliance depend on dates, contractual terms and installation records, keep original contracts, connection applications, engineering compliance certificates, and meter records.

• Monitor Ministerial instruments and the Legislation Register. The Minister can alter or clarify definitions, capacities, percentages and normal-cost measures by determinations that will appear as disallowable or notifiable instruments. Regularly check the ACT Legislation Register and the underlying instrument registers for current determinations.

• Coordinate with the utilities regulatory framework. Distributors and retailers must operate within the Utilities Act 2000 and the National Energy Retail Law (ACT). Align internal compliance and billing systems with those regimes and consult regulators as necessary.

• Prepare for audits. Reporting entities should maintain audit-ready records and consider independent pre-audit reviews to reduce the risk of Ministerial audit orders and the substantial penalties attached to audit non-compliance.

Adopting these compliance steps and aligning internal processes with the Act’s statutory cadence will reduce legal and regulatory risk for all parties required to operate under the Electricity Feed-in (Renewable Energy Premium) Act 2008.
