Electricity Feed-in (Large-scale Renewable Energy Generation) Act 2011 (ACT)

This Act creates tradable feed‑in tariff (FiT) entitlements for large renewable electricity generators (>200 kW) and fixes total FiT capacity at 900 MW. The Minister controls when capacity is released and may grant entitlements with conditions; the ACT electricity distributor must pay FiT support payments (and may recover reasonable costs from retailers), while generators receive top‑up payments calculated against spot prices. It matters because the Act places payment obligations on the distributor/retailers and gives the Minister discretion over allocation, timing and compliance.

The Electricity Feed-in (Large-scale Renewable Energy Generation) Act 2011 establishes a statutory framework by which the Australian Capital Territory (ACT) makes available FiT entitlements (feed‑in tariff entitlements) for large renewable electricity generators, sets a hard cap on capacity eligible for those entitlements, prescribes how support payments are calculated and paid, and allocates payment and administrative obligations across the ACT electricity distributor and electricity retailers. The Act’s objects are stated at section 5: to promote large‑scale renewable generation in the Australian capital region and elsewhere, to promote the renewable generation industry consistent with the national electricity market, to reduce the ACT’s greenhouse gas emissions and to minimise cost to electricity consumers (s 5).

Mechanically, the Act:

Defines eligible projects as “large renewable energy generators” (capacity >200 kW, s 6) using prescribed renewable energy sources (s 6(1)-(3)).
Fixes FiT capacity at 900 MW (s 9) and gives the Minister power to release parts of that capacity for grant as FiT entitlements (s 10).
Enables the Minister to allocate capacity either by competitive process or by direct grant, and to set terms and conditions for entitlements including term (up to 20 years), required renewable source and location constraints (s 10(2), s 11(6)).
Creates the FiT entitlement as a right to receive FiT support payments for eligible electricity (s 8), and describes eligible electricity in detail (s 17).
Prescribes the FiT support payment formula (s 17A(4)): (FiT − SP) × quantity of electricity, where SP is the spot price value (s 17A(4); definition of spot price value in the dictionary).
Entrusts payment of positive FiT support payments to the ACT electricity distributor, payable in arrears within 30 days once required information is supplied (s 18); permits offset or recovery where payments are negative (s 19).
Allows the ACT electricity distributor to pass on “reasonable costs” of payments and administration to electricity retailers, subject to an annual determination process by the Minister (ss 20A-20D).
Requires quarterly reporting by the ACT electricity distributor, audit powers for the Minister, and a review right to the ACT Civil and Administrative Tribunal (ACAT) of the Minister’s reasonable costs determinations (ss 21, 21A; pt 5A, ss 21B-21D).
Provides for conditions, cancellation, surrender and transfer of FiT entitlements (ss 12-16), and authorises regulations and fees (ss 23, 25).

The Act therefore creates an entitlement stream linked to generation and market spot prices, limits aggregate exposure by a statutory capacity cap and by Ministerial design of releases, allocates immediate payment responsibility to the network owner (ACT electricity distributor) and offers a mechanism for cost recovery from retailers subject to Ministerial oversight and ACAT review (ss 9, 10, 17A, 18, 20A-20C). The Act contains criminal penalties tied to non‑payment and audit non‑compliance (ss 20, 21A). Penalty unit values at the republication date are stated in the republished law: $160 for an individual and $810 for a corporation (Legislation Act 2001, s 133, prefatory note).

This Act builds on a few core legal and economic concepts, each defined in the statute and the dictionary. The central legal object is the FiT entitlement, defined as “a right for the holder of a FiT entitlement to receive FiT support payments under part 4 for the holder’s eligible electricity” (s 8). Eligible electricity is specified by reference both to how it is generated and its relationship to the Commonwealth large‑scale generation certificate regime: it must be electricity generated by a connected large renewable energy generator and either registered as LGC‑eligible under the Renewable Energy (Electricity) Act 2000 (Cwlth) or meet transitional or accreditation requirements if that Commonwealth scheme is amended or repealed (s 17(1)(a)-(b)).

Capacity is central. The Act defines “large renewable energy generator” as a renewable generating system with capacity over 200 kW (s 6). The statutory FiT capacity , the aggregate capacity in relation to which FiT entitlements may be held , is 900 MW (s 9). The Minister controls releases of that capacity (a FiT capacity release) and determines whether releases are allocated by competitive process or direct grant, the term of entitlements (up to 20 years), required renewable source and location requirements (s 10(1)-(3), s 11(6)).

Payment mechanics are formulaic. The FiT support payment is the amount derived from the payment formula set out in s 17A(4): (FiT − SP) × quantity of electricity. FiT is the contract tariff stated in a FiT entitlement grant; SP is the spot price value that would have been paid on the spot market (dictionary and s 17A(4)). The Act allows the Minister to approve an alternative assessment method provided it meets statutory constraints , the Minister must be satisfied an assessment method minimises cost to consumers and does not disadvantage existing entitlement holders (s 17A(2)). That approval instrument is disallowable (s 17A(3)).

Payer and cost recovery: the ACT electricity distributor must make payments to entitlement holders when amounts are positive, and may recover reasonable costs from electricity retailers up to ministerially determined limits (ss 18; 20A-20C). The Act prescribes an annual application and decision process for determining those reasonable costs, including disclosure requirements and timelines (ss 20B-20C). The Minister may determine a methodology for cost estimation after consultation with the distributor (s 20D).

Administrative and enforcement concepts include Ministerial discretion over grant, conditions and cancellation (ss 11-13), reporting and audit obligations for the ACT electricity distributor (ss 21-21A), reviewability of reasonable costs determinations by ACAT (pt 5A, ss 21B-21D) and a small set of criminal offences related to non‑payment and failure to commission audits (ss 20, 21A(5)).

The Act creates obligations and rights that fall on a small set of actors in the electricity sector, with distributional implications.

Holders of FiT entitlements (project proponents and their assignees): entitlement holders acquire a right to FiT support payments for eligible electricity (s 8). They are subject to substantive and ancillary conditions in the grant (s 12), including construction deadlines, generation minimums, transfer conditions and requirements to transfer large‑scale generation certificates to the Territory where the grant requires it (s 11(6)(g); s 12(1)-(2)). Holders may surrender, transfer or have entitlements cancelled under the Act; transfers and cancellations require Ministerial notices and triggers for public notice (ss 13-16). Holders who are required to make payments under s 19 (negative FiT support payment) risk a criminal penalty if they fail to pay (s 20(2)).
ACT electricity distributor: defined in the dictionary as the network service provider operating the ACT electricity distribution system, which is the distribution component of the interconnected national electricity system in the ACT. The distributor is the immediate payer of positive FiT support payments to entitlement holders (s 18). It must make quarterly reports to the Minister with specified contents (s 21), may be required to commission Minister‑appointed or independent audits of its reporting (s 21A), and may pass through reasonable costs to electricity retailers subject to a ministerial determination (ss 20A-20C). The distributor risks criminal and civil exposure for failure to pay FiT support payments (s 20(1) , 50 penalty units) and faces a significant penalty (400 penalty units) if it fails to commission a required audit (s 21A(5)).
Electricity retailers (NERL retailers and NERL exempt sellers): retailers are the class of parties to whom the distributor may pass on reasonable costs incurred in making FiT support payments and administering the scheme (s 20A(1) and (3)). The distributor’s pass‑through to retailers is capped by the Minister’s reasonable costs determination for each financial year (s 20A(2); s 20C(1)).
The Minister and ACT Government: the Minister decides whether and how FiT capacity is released (s 10), can grant entitlements, impose conditions and require agreements (ss 10-12), determine and approve assessment methods (s 17A), determine methodologies and reasonable cost amounts (ss 20C-20D), require audits (s 21A), and must review the Act and capacity releases at statutory intervals (s 22). Ministerial instruments include disallowable instruments and notifiable instruments referenced throughout (e.g. s 10(5); s 11(7); s 12(3); s 17A(3)).

The Act sets out specific statutory duties and reciprocal rights. Below is a mapping of principal duties and rights with the statutory source.

Rights

Right to FiT support payments: Holder of a FiT entitlement has the right to receive FiT support payments for eligible electricity produced in accordance with the entitlement (s 8; s 17A).
Transfer and surrender rights: Holders may apply to transfer an entitlement (s 15) or surrender it (s 14); transfers are effected by a transfer notice and may attract additional conditions (s 15(2)-(4)).

Ministerial rights and discretions

Release and grant of FiT capacity: The Minister may determine release of parts of the 900 MW FiT capacity and may grant FiT entitlements under a release (ss 9-11). Determinations must specify allocation method (competitive vs direct grant), term (≤20 years), required renewable source and location constraints (s 10(2)).
Imposition and amendment of conditions: The Minister may impose conditions on entitlements, require written agreements with the Territory and amend entitlements where necessary to protect Territory interests or meet objects of the Act (ss 12(1)-(3)).
Cancellation: The Minister may cancel an entitlement on reasonable grounds where conditions are breached, but must give intended cancellation notice and take into account any written response within 28 days (s 13).
Cost and methodology determinations: The Minister makes reasonable costs determinations and may determine a methodology for estimating FiT support payment costs after consulting the ACT electricity distributor (ss 20C, 20D).

Duties on ACT electricity distributor

Payment duty: If a connected large renewable energy generator has a FiT entitlement and the FiT support payment for a period is positive, the distributor must pay the holder in arrears within 30 days after the holder supplies required information (s 18(1)-(2)). Payment method may be prescribed by regulation (s 18(2)(c)).
Reporting duty: The distributor must provide a quarterly report to the Minister with specified information on connection costs, maintenance, eligible electricity quantities and FiT payments (s 21(2)-(4)). The Minister must publish reports within 3 months (s 21(5)).
Audit duty: The distributor must commission audits as required by Minister (s 21A(1)-(2)); failure to commission an audit where required is an offence carrying a maximum penalty of 400 penalty units (s 21A(5)).

The Act includes targeted criminal penalties and administrative enforcement mechanisms tied to the payment and reporting functions it establishes.

Specified criminal penalties

Non‑payment by ACT electricity distributor: If the distributor is required under s 18 to pay a FiT support payment and fails to do so, the distributor commits an offence, maximum penalty 50 penalty units (s 20(1)). At the republication date the penalty unit value is $160 for an individual and $810 for a corporation (prefatory note citing Legislation Act 2001, s 133); the Act itself sets the penalty in units.
Non‑payment by FiT entitlement holder: If a holder is required to pay an amount under s 19 (a negative FiT support payment) and fails to make the payment when required, the holder commits an offence, maximum 50 penalty units (s 20(2)).
Failure to commission required audit: If the Minister requires an audit of information given under s 21 and the distributor engages in conduct that results in failure to commission the audit, the distributor commits an offence with a maximum penalty of 400 penalty units (s 21A(5)).

Enforcement mechanisms and remedies

Civil recovery: The Act notes that amounts owing may be recovered as a debt in a court or in ACAT (s 18(2) note and s 19 note; and Legislation Act, s 177 , referenced in notes).
Ministerial cancellation: The Minister may cancel a FiT entitlement where a condition has been breached, but procedural safeguards apply: an intended cancellation notice and a 28‑day response period, and cancellation only on consideration of any response (s 13(1)-(4)).
Transfer, surrender and public notice: Transfers, surrenders and cancellations trigger public notices that are notifiable instruments, enabling transparency and public record (s 16).
ACAT review: The reasonable costs determination is expressly reviewable by ACAT (pt 5A, ss 21B-21D). The Minister must provide a reviewable decision notice (s 21C) and the distributor may apply for review (s 21D).

Administrative controls and instrument types

Disallowable and notifiable instruments: The Act requires or contemplates Ministerial determinations, approvals and methodologies that are either disallowable or notifiable instruments (e.g. s 10(5), s 11(7), s 17A(3), s 20C(5), s 20D(3)). Those instrument classes create parliamentary oversight (disallowance) and public notification (notifiable instruments), and thus institutional checks on Ministerial decisions.

The Act is designed to sit alongside the national electricity regulatory frameworks and the Commonwealth renewable certificate scheme. It cross‑references and depends upon several external instruments and regimes.

Interaction with Commonwealth Renewable Energy (Electricity) Act 2000 (Cwlth)

Eligible electricity depends on large‑scale generation certificates (LGCs): Section 17(1)(b) requires eligible electricity to be electricity for which LGCs are registered under the Renewable Energy (Electricity) Act 2000 (Cwlth), or, if that Commonwealth Act is repealed or amended to end LGC registration, electricity that was formerly registered or meets accreditation or exemption criteria (s 17(1)(b)(i)-(ii)). Section 7A explicitly provides that references to the Renewable Energy (Electricity) Act 2000 include regulations under that Act, embedding the Commonwealth scheme as the accreditation baseline (s 7A).
The Act allows regulations to prescribe electricity accreditation requirements for the transitional or replacement tests (s 17(2)-(3)), but includes a non‑disadvantage constraint: a regulation must not impose requirements that would, compared with the LGC regime as in force on commencement, disadvantage a large generator (s 17(3)).

Interaction with national electricity law and rules

Connection, definitions and market references: The Act uses definitions from the National Electricity (ACT) Law and the national electricity rules for terms such as distribution system, generating system, generating unit, market participant, trading interval and AEMO (dictionary, s 3 notes, and scattered cross‑references throughout the Act). Capacity is defined in relation to the point of connection to the interconnected national electricity system (s 7(1)).
Payments reference market spot price: The SP term in the FiT support payment formula is the spot price value that would have been paid for the electricity by AEMO had it been sold on the spot market (s 17A(4), dictionary). The Act therefore links support payments directly to national market outcomes.

Interaction with other ACT utilities and regulatory legislation

Retailer definitions and Utilities Act: “Electricity retailer” for pass‑through purposes is defined by reference to NERL retailer and NERL exempt seller under the Utilities Act 2000 (s 20A(3) , referencing Utilities Act sections).
Instrumentation and parliamentary oversight: The Act generates disallowable and notifiable instruments that operate within the Legislation Act 2001 framework. The ministerial determinations and approvals (e.g. methods of measuring capacity, assessment methods, reasonable costs determinations and methodologies) are subject to disallowance or notification as required by the Act (ss 7(3)-(5); 17A(3); 20C(5); 20D(3)).

The republished Act and its endnotes do not record judicial decisions or tribunal determinations interpreting the Act. The statute itself creates a specific administrative review pathway but does not catalogue case law.

Statutory review and dispute pathways established by the Act

ACAT review: The Act expressly makes a reasonable costs determination a reviewable decision under part 5A (s 21B) and provides that the ACT electricity distributor may apply to the ACAT for review of such a decision (ss 21C-21D). This is the explicit statutory forum for review of the Minister’s determinations on reasonable costs.
Debt recovery and civil enforcement: The Act notes that amounts owing under its provisions may be recovered as a debt in a court of competent jurisdiction or ACAT (s 18 note; s 19 note; Legislation Act, s 177). That indicates litigation over payment disputes can proceed in civil courts or the ACAT.

Absence of named cases in the Act

The republished Act includes no case law citations and endnotes do not record any litigation history or reported judicial consideration. Practitioners seeking precedents on how the Minister’s discretions, the FiT payment formula, or reasonable costs determinations have been judicially reviewed must search case law databases and ACAT decisions; nothing in the republished Act provides that material.

Anticipated litigation touchpoints (derived from statutory structure)

Challenge to reasonable costs determinations: the Act anticipates ACAT review (pt 5A). Expect disputes over whether the Minister properly applied statutory considerations in s 20C (e.g. balancing distributor and consumer disadvantage, evaluation of historical differences, and application of any methodology).
Contractual and payment disputes: disputes might arise between entitlement holders and the ACT electricity distributor over calculation of eligible electricity, spot price values, assessment methods approved by the Minister (s 17A(2)-(3)), or the distributor’s compliance with s 18 payment timelines.
Enforcement and procedural fairness: cancellation decisions under s 13 could be contested on procedural fairness grounds (intended cancellation notice, 28‑day response period), particularly where complex compliance histories and substantial commercial stakes exist.

For authoritative litigation history, practitioners must consult ACAT decisions and case law databases; the statute itself contains only the review architecture and no reported decisions.

The Act’s mechanics include several features that can generate practical and legal risk if misread or operationally mishandled. The items below point to concrete statutory mechanisms that commonly produce surprise in practice.

Capacity cap and Ministerial discretion

Hard cap at 900 MW (s 9): FiT entitlements can only be granted up to the statutory FiT capacity. The Minister’s release choices therefore determine whether a prospective project can access FiT; a project not included in a FiT capacity release cannot obtain entitlement. The Minister may allocate releases by direct grant rather than competitive tender (s 10(2)(a)), a point that materially affects project strategy and expectation of open auction processes. In deciding to direct grant, the Minister must consider advantages and disadvantages to the Territory and objects of the Act (s 10(4)), but that still leaves wide policy discretion.

FiT formula, spot price, and negative payments

Formula links to spot price (s 17A(4)): Support payments are (FiT − SP) × quantity. Where SP exceeds FiT, the payment is negative and the generator could be required to pay the distributor (s 19(2)). That negative payment risk is unusual relative to simple top‑up subsidy schemes and creates counterparty exposure for generators and cash‑flow volatility. The distributor may offset negatives against future payments or demand payment within 30 days (s 19(2)).

Assessment methods and advantage/disadvantage test

Minister approval of assessment methods must both minimise cost for electricity consumers and not disadvantage existing holders (s 17A(2)). Approval is a disallowable instrument (s 17A(3)). The legal test is therefore dual: consumer cost minimisation and protection of incumbents. Any approved method may be the subject of political and legal challenge, and is bound by disallowance risk.

Payment and information timing

Distributor must pay within 30 days after the holder gives the distributor any information reasonably required to work out the payment (s 18(2)(b)). The risk is practical: entitlement holders must supply timely and verified data; disputes over what information is “reasonably required” can delay payment and create penalty exposure for distributors.

Cost pass‑through subject to ministerial cap

Distributor can pass on reasonable costs to retailers but only up to the Minister’s reasonable costs determination for the financial year (s 20A(2); s 20C(1)). The annual application timeline (application no later than 6 months after the start of current financial year, s 20B(2)) and the Minister’s 2‑month decision window (s 20C(1)) create calendar risks: uncertainty in interim months about recoverable amounts can affect cash flow for the distributor and retailers.

Compliance with the Act requires attention across project design, contract drafting, reporting and administrative processes. The key practical steps follow from the statutory duties and rights.

For prospective project proponents and holders of FiT entitlements

Verify eligibility and capacity definitions: confirm the generating system qualifies as a “large renewable energy generator” (>200 kW, s 6) and that the project’s capacity will be measured in the manner specified by s 7 or any Ministerial determination under s 7(3)-(4).
Track FiT capacity releases: design proposals consistent with the Minister’s specified release terms (s 10(2)),term length (≤20 years), required renewable source and location constraints (s 10(2)(b)(i)-(iii)). If the release is by direct grant, ensure eligibility criteria for direct grants are met (s 10(2)(c)).
Contractual clarity on LGCs and accreditation: if the grant requires transfer of large‑scale generation certificates to the Territory, include express contractual provisions and operational arrangements to ensure compliance (s 11(6)(g); s 12(1)(b)(i)). If Commonwealth LGC rules change, be aware of transitional tests in s 17(1)(b).
Prepare for conditions and deadlines: FiT entitlements may include conditions about construction schedules, connection deadlines and financing arrangements (s 12(2)(a)-(c)). Include covenant structures, milestones, security and warranties to ensure procedural compliance and to document cure periods.
Manage negative payment exposure: understand the FiT support payment formula (s 17A(4)). Model scenarios where SP > FiT and cash‑flow implications of s 19 where negative amounts may be offset or required to be paid within 30 days.

For the ACT electricity distributor

Payment processing and documentation: implement processes to accept and verify “any information reasonably required” to calculate FiT payments, to pay within 30 days of receipt (s 18(2)(b)), and to properly offset negative amounts under s 19 or demand payment where applicable.
Quarterly reporting and audit readiness: compile the quarterly reports required by s 21(2)-(4) and publish them in the three‑month window (s 21(5)). Be ready to commission audits under s 21A, including budgeting for the audit cost and developing audit‑quality information systems; failure to commission an audit where required can attract a 400 penalty unit fine (s 21A(5)).
Reasonable costs applications: submit the annual application for a reasonable costs determination timely (s 20B(1)-(3)). The application must include historical payment amounts and administrative costs, estimated future FiT payments and administrative costs for the upcoming financial year and four following years, and demonstrate use of any ministerially determined methodology or explain the distributor’s methodology (s 20B(3)(a)-(d)). Anticipate that if the Minister fails to make a determination within the two‑month statutory window, the distributor’s stated amounts will be taken as reasonable costs (s 20C(4)).
