45 Failure to comply with electrical safety duty – category 3 (1) A person commits a category 3 offence if: (a) the person has an electrical duty; and (b) the person fails to comply with that duty. conducting a business or undertaking – 320 penalty units; or or undertaking – 650 penalty units; or (c) for a body corporate – 3 200 penalty units. (3) The maximum penalty of 650 penalty units under subsection (1) for an officer only applies in relation to a duty imposed under sections 23 to 34.
