43 Reckless conduct – category 1 (1) A person commits a category 1 offence if: (a) the person has an electrical safety duty; and (c) that conduct results in a risk to an individual of death, serious injury or serious illness caused directly by electricity or originating from electricity; and conducting a business or undertaking – 2 000 penalty units or imprisonment for 5 years or both; or or undertaking – 4 000 penalty units or imprisonment for 5 years or both; or (c) for a body corporate – 20 000 penalty units. (2) Strict liability applies to subsection (1)(a).
