36 Safety duty of person conducting recognised external certification scheme (1) The duty specified in subsection (2) applies to a person who conducts a business or undertaking that: (a) conducts an external certification scheme prescribed by regulation; and (b) certifies consumer electrical equipment under the scheme. (2) The person must ensure that the consumer electrical equipment to which the certification relates is safe from electrical risk.
