sec.71 Development instruments prevail over particular instruments
If there is a conflict between a development instrument and any of the following instruments, the development instrument prevails to the extent of the inconsistency— a planning instrument; assessment benchmarks prescribed by regulation under the Planning Act ; assessment benchmarks made under another Act for the Planning Act . In this section— development instrument means— a draft provisional land use plan; or a provisional land use plan; or an interim land use plan; or a development scheme. s 71 amd 2016 No. 27 s 181 ; 2019 No. 11 s 53 (sec.71-ssec.1) If there is a conflict between a development instrument and any of the following instruments, the development instrument prevails to the extent of the inconsistency— a planning instrument; assessment benchmarks prescribed by regulation under the Planning Act ; assessment benchmarks made under another Act for the Planning Act . (sec.71-ssec.2) In this section— development instrument means— a draft provisional land use plan; or a provisional land use plan; or an interim land use plan; or a development scheme.

- (b) assessment benchmarks prescribed by regulation under the Planning Act ;
- (c) assessment benchmarks made under another Act for the Planning Act .
