sec.53 Relationship with the City of Brisbane Act 2010 or the Local Government Act 2009

The declaration of an area as a priority development area does not affect— the operation of the City of Brisbane Act 2010 or the Local Government Act 2009 in relation to the area; or the area of the relevant local government; or the jurisdiction, under the Act s, of the relevant local government. However, the performance of the relevant local government’s functions or the exercise of its powers under the Act s is subject to MEDQ’s functions or powers under this Act. A reference in subsection (1) to the declaration of an area as a priority development area includes a reference to the inclusion, under a boundary change regulation, of an additional area in a priority development area. Subsection (1) is subject to sections 51AW and 54 . s 53 amd 2019 No. 11 ss 41 , 77 (sec.53-ssec.1) The declaration of an area as a priority development area does not affect— the operation of the City of Brisbane Act 2010 or the Local Government Act 2009 in relation to the area; or the area of the relevant local government; or the jurisdiction, under the Act s, of the relevant local government. (sec.53-ssec.2) However, the performance of the relevant local government’s functions or the exercise of its powers under the Act s is subject to MEDQ’s functions or powers under this Act. (sec.53-ssec.3) A reference in subsection (1) to the declaration of an area as a priority development area includes a reference to the inclusion, under a boundary change regulation, of an additional area in a priority development area. (sec.53-ssec.4) Subsection (1) is subject to sections 51AW and 54 .

• (a) the operation of the City of Brisbane Act 2010 or the Local Government Act 2009 in relation to the area; or
• (b) the area of the relevant local government; or
• (c) the jurisdiction, under the Act s, of the relevant local government.
