sec.40H Consultation about proposed PDA instrument change and making of PDA instrument change

Before preparing the proposed instrument for the PDA instrument change, MEDQ must— consult, in the way it considers appropriate, with the relevant local government; and make reasonable endeavours to consult, in the way it considers appropriate, with any government entity, GOC or other entity MEDQ considers will be likely to be affected by the proposed PDA instrument change. After complying with subsection (1) , MEDQ must decide— to make the instrument for the PDA instrument change; or not to make the instrument for the PDA instrument change. In making the decision under subsection (2) , MEDQ must consider the main purpose of this Act. s 40H ins 2019 No. 11 s 28 (sec.40H-ssec.1) Before preparing the proposed instrument for the PDA instrument change, MEDQ must— consult, in the way it considers appropriate, with the relevant local government; and make reasonable endeavours to consult, in the way it considers appropriate, with any government entity, GOC or other entity MEDQ considers will be likely to be affected by the proposed PDA instrument change. (sec.40H-ssec.2) After complying with subsection (1) , MEDQ must decide— to make the instrument for the PDA instrument change; or not to make the instrument for the PDA instrument change. (sec.40H-ssec.3) In making the decision under subsection (2) , MEDQ must consider the main purpose of this Act.

• (a) consult, in the way it considers appropriate, with the relevant local government; and
• (b) make reasonable endeavours to consult, in the way it considers appropriate, with any government entity, GOC or other entity MEDQ considers will be likely to be affected by the proposed PDA instrument change.
• (a) to make the instrument for the PDA instrument change; or
• (b) not to make the instrument for the PDA instrument change.
