sec.212 Existing proceedings for declaration

This section applies in relation to a proceeding for a declaration started under the repealed ULDA Act , section 92 that has not been decided at the commencement. The Planning and Environment Court— may make a declaration about either or both of the following— the matter mentioned in the repealed ULDA Act , section 92 (1) for which the declaration was sought; a matter mentioned in section 114(1) of this Act that corresponds to the matter mentioned in the repealed ULDA Act , section 92 (1) for which the declaration was sought; and may make an order about the declaration made under paragraph (a). If the court makes a declaration under subsection (2)(a), the declaration is taken to be a declaration made under section 114(1). If the court makes an order under subsection (2)(b), the order is taken to be an order made under section 114(2). (sec.212-ssec.1) This section applies in relation to a proceeding for a declaration started under the repealed ULDA Act , section 92 that has not been decided at the commencement. (sec.212-ssec.4) If the court makes an order under subsection (2)(b), the order is taken to be an order made under section 114(2).

• (a) may make a declaration about either or both of the following— (i) the matter mentioned in the repealed ULDA Act , section 92 (1) for which the declaration was sought; (ii) a matter mentioned in section 114(1) of this Act that corresponds to the matter mentioned in the repealed ULDA Act , section 92 (1) for which the declaration was sought; and
• (i) the matter mentioned in the repealed ULDA Act , section 92 (1) for which the declaration was sought;
• (ii) a matter mentioned in section 114(1) of this Act that corresponds to the matter mentioned in the repealed ULDA Act , section 92 (1) for which the declaration was sought; and
• (b) may make an order about the declaration made under paragraph (a).
• (i) the matter mentioned in the repealed ULDA Act , section 92 (1) for which the declaration was sought;
• (ii) a matter mentioned in section 114(1) of this Act that corresponds to the matter mentioned in the repealed ULDA Act , section 92 (1) for which the declaration was sought; and
