sec.171L Effect of declarations under Planning Act 2016 , s 275O

This section applies if— a declaration is made under the Planning Act 2016 , section 275O in relation to a use or class of uses; and any of the following has the effect of limiting the hours of operation of the use or a use of the class or restricting the movement of goods in relation to the use or a use of the class— a provision of this Act; a PDA development condition of a PDA development approval. For the period the declaration is in effect, the provision or condition does not apply in relation to the carrying out of the use, or a use of the class, on premises in the area to which the declaration applies. s 171L ins 2020 No. 11 s 11 (sec.171L-ssec.1) This section applies if— a declaration is made under the Planning Act 2016 , section 275O in relation to a use or class of uses; and any of the following has the effect of limiting the hours of operation of the use or a use of the class or restricting the movement of goods in relation to the use or a use of the class— a provision of this Act; a PDA development condition of a PDA development approval. (sec.171L-ssec.2) For the period the declaration is in effect, the provision or condition does not apply in relation to the carrying out of the use, or a use of the class, on premises in the area to which the declaration applies.
